Do you know what I get on every week? And I record these and I just say the numbers. But 250 episodes. Wow. That is loads. That is so many, that is so much content. It's crazy. It blows me away how these numbers just creep up and if I was smart I would work out how many years that has been but I'm not sure I want to because that's a lot a lot a lot. Anyway This week I have an interview for you which is really really cool. So I have the lovely Nakia Gray on and we're talking all things legal. Now I know if you're anything like me that stuff scares me Like I'm not even kidding you. I do not find that stuff like enjoyable or easy or fun. The same with the finance stuff, these two areas for me are like oh I really have to focus and really have to remind myself to do these things. But The way she talks about it and some of the stuff she says is so so helpful. And it's really really important as small business owners that we have some kind of cover in some way or other. And one thing that was great to talk about is the fact of like the template thing. And I know you know I've heard people say you know you're not allowed to use or not allowed or you shouldn't use templates. You shouldn't just Google a privacy policy and use that. But you know what not everyone can afford to bring a lawyer in. So I talked to her about it and I said "You know, is that Okay? What do you think?" So yeah that's really helpful We talked around that. We talked about things around intellectual property. Also we talked about where you should never say you've got lifetime value of something which is really interesting cause that's definitely a mistake I've made in the past, years ago but I've definitely said you've got lifetime access to something and she talked about why you shouldn't say that. Um because basically it's not true is it because whose lifetime are you talking about yours or mine or what is a lifetime? Does that mean that I need you to still be serving me. I saw someone do lifetime access for a membership the other day which I think is fascinating because courses I can understand why people would say that like even ones. So I had a course of Jasmine Star, That was a really old course. And she actually said I'm checking this course down but you've got so long to download all the stuff. So technically yeah I have had access to that course for you know as long as I need it for a lifetime if you like. So courses I get but memberships I don't like what if that person decided

Do you understand the importance of branding and trademark protection?  A friend of mine asked me if I had Trademarked my Net Worth It brand and I was like, "Say whaaaa???"  She then told me a story of when one of her Facebook groups had to be changed because someone infringed their Trademark rights on her because the names were similar.  So I immediately went to the USPTO office and applied for my own Trademark.  It totally would have been helpful to know someone like today's guest while I was applying to save me the headache of potentially making a mistake on the application. Intellectual Property Lawyer Derek Hawkins helps people with branding and trademarks to protect your brand.  The biggest key in trademark is exclusivity, where you are the first one to use the brand.  If you operate on your own brand that has a name, symbol and identity this episode is for you. I have a trademark for Net Worth It™ but not for my nutrition business because I am a 1099 of the company I partner with and operate that under my personal taxes at this point until it is put into a LLC or S-Corp. Being a 1099 partner is one reason I love that business, it is so much less work as a busines owner than my Net Worth It brand. The Biologics Price Competition and Innovation Act of 2010 (42 U.S.C. § 262) created an abbreviated pathway for FDA approval of biological products determined to be “biosimilar” to a reference product. The Act outlines a patent resolution and information exchange scheme, with litigation safe harbors during this “patent dance.” -- Subsection (l)(2)(A) provides that not later than 20 days after the application is accepted for review, “…the subsection (k) applicant – shall provide to the reference product sponsor a copy of the application…and other information that describes the processes used to manufacture the biological product…” Subsection (l)(8)(A) provides “[t]he subsection (k) applicant shall provide notice to the reference product sponsor not later than 180 days before the date of the first commercial marketing of the biological product licensed under subsection (k).” -- In 2015, Sandoz filed a subsection (k) application based on Amgen’s filgrastim (Neupogen®), but refused to provide its (l)(2)(A) disclosure and claimed that pre-FDA approval notice satisfied (l)(8)(A). Amgen sued in federal court on state law claims of unfair competition and conversion, and patent infringement, and requested a preliminary injunction. The district court granted Sandoz’ motion for partial summary judgment, holding that (l)(2)(A) disclosure was optional and that Sandoz did not have to wait for FDA approval before providing (l)(8)(A) notice. -- In a fractured opinion, the Federal Circuit affirmed on the (l)(2)(A) issue, holding that subsection (l)(9)(C) provided a remedy for the reference product sponsor to bring an immediate declaratory judgment action if the subsection (k) applicant failed to provide its (l)(2)(A) information, showing that disclosure was optional. The court reversed on the (l)(8)(A) issue, holding that notice before the FDA approved the subsection (k) application was ineffective under the statute. Welcome to another episode of Making It with Chris G where we have Conversations with people in the world of entertainment who are making it, from behind the scenes to the spotlight. Sharing their stories and insight to help you get one step closer to Making It. Matt Cottingham is an entertainment attorney based out of Nashville, TN. He joined the firm Ritholz Levy in 2014 as an associate in the firm’s Entertainment Group in Nashville, specializing in entertainment, intellectual property and business law. Matt represents individuals and companies in the entertainment industry and provides experienced guidance to songwriters, recording artists, record producers, independent music publishers, new media companies and independent record labels. Before joining Ritholz Levy, Matt practiced with Chip Petree at Petree Law after starting his career practicing at a boutique corporate firm in Franklin, TN. Matt serves on the Board of Directors for the non-profit organization, Young Entertainment Professionals (YEP), a networking group whose members cover all facets of the entertainment industry. Matt received a B.S. in Recording Industry Management from Middle Tennessee State University and received his law degree from the University of Memphis. He is a member of the Tennessee and Nashville Bar Associations and volunteers with Volunteer Lawyers & Professionals for the Arts (VLPA). I met Matt through a mutual friend in Nashville, and from day one, he has been one of the kindest and most helpful people I’ve met in my career in the music business so far. Helene Godin traded in the life of business suits and a career as an Intellectual Property Attorney to be an entrepreneur and start By The Way Bakery, a gluten-free and dairy-free bakery in New York. She loved being an attorney but after 22 years, she called her husband early one morning while standing in front of the company fax machine and said, "I think I'm done."
