A radio station that stole a song he wrote & turned it into an ad for Samsung without his permission, at the time I was attending law school & he asked me for help. I didn't know anything about IP but in 1996 nobody in Russia had any idea about IP because Russia had just changed from Soviet law into free market law, so I gave it a shot & as part of that journey I became passionate about helping people who created something to protect it from others who want to steal it from them. Trademarking is mostly the same around the world, there are small differences here & there & you need to understand them to be successful in those countries. But, this isn't something I think entrepreneurs should care about, that's why providers exists who can navigate them through this. What you should know are the basics, it's not as complex as you might think: What is trademarking? What are you protecting? What do you need to show to the government to prove it's a brand & not a cute name or image? The biggest misconceptions I see with trademarks is that you don't own the word or the image you own the mental association between that work, phrase or image & specific products & services that you sell. Why trademark? If you plan to be in business for several/many years, the brand will become the most valuable asset of your business. It makes it easier t=for you to attract better talent, attract better leads at a lower cost to advertise at lesser cost. Even if you file your trademark a day before someone else does, you're good. The problem is you don't know when someone else will file for a trademark, so you should do it early or else someone else will do it and you won't be protected, even if you came up with the name first. Copyrights, patents, industrial right expire, if you renew your trademark every 10 years you can own it forever.' Your business name is your intellectual property and you need to protect your ideas. To do so you need to build a protectable brand. So what does that look like? Your brand needs to be unique. Your name needs to be innovative and what you offer needs to be different than (or a better process than) everyone else. Your brand needs to be memorable among your target market. Getting a trademark for a brand that makes no impact is useless, right? Your brand needs to be well-protected. This is where trademark law comes into play. A small business doesn’t have the money to dispute a trademark issue. It’s far better to spend the money on the front end, then lose thousands of dollars in legal fees—or your business. Don’t DIY your trademark research: Hire a trademark attorney Look, there are ways that you can research a brand name and find out if you can claim it. You can find a domain name and snag it. Great. You can do a trademark search or pay a 3rd party website to help you through the process. Inevitably, they will let you down. You can search the United States Patent and Trademark Office (USPTO) but the results tend to be pretty overwhelming. The bottom line is—it is not wise to do the legwork yourself. Even if you deem that the brand name is available, the back and forth process of getting your trademark registered is exhausting. So what does Andrei recommend? Hire a trademark attorney—or consider working with his company, The Trademark Factory®. Don’t wait for a sign from above—start the process now People often ask Andrei when to start the trademark process. His answer? Immediately. You can’t build a business and choose an arbitrary number and say “When the business is making (insert dollar amount here) then I will invest in the trademark”. There will be no good external validation. Uber filed a trademark application 2 months before launching the business. Now it’s worth over 50 billion. Jeff Bezos registered ‘Amazon’ and ‘Amazon books’ at the very beginning—he built an empire. Andrei said Coca-Cola started as a “lemonade stand with a dream”. Now it’s a soft-drink know world-wide. All of these brands started small but understood the importance of protecting what they knew they could build. A trademark is your insurance policy—you hope to never have to use it, but it’s there when you need it. Is it going to cost me an arm and a leg to hire a trademark attorney? If you’re doing the work yourself, it can cost a few hundred dollars (for specific numbers, check out USPTO.gov) but it will cost you a lot of time. It's impossible to overstate the importance of being a great leader when you're working to build a team or an organization into something that will change the world and make things better for people. Today's guest Andrei Mincov founded Trademark Factory in 2013 to help entrepreneurs secure the legacy of their brands and preserve their hard work. Teams As you grow your team, as you grow your business, as you grow your dream, as you grow your vision, there comes a time when the leader can't come up with all the ideas. In order for the organization to grow, leaders need team members who help generate ideas and who provide initiative to improve things. You'll likely have some team members who simply have marching orders or tasks. Others will be responsible to help you move the organization forward. Those team members will have to have vision. They'll operate from your inspiration. Hiring Finding those visionary team members is different than hiring task-based team members. Andrei uses small, unique tasks to help make hiring decisions simpler. He might, for example, offer a jpeg with a typo or error in it and ask prospective employees to find the error. The intention would be to measure the candidate's attention to detail. He might also ask the candidate to build a video or a graphics project. This process helps him narrow the field because not every candidate is willing to jump through the required hoops to get the job. It also helps him determine who actually has the necessary skill set to accomplish the work. Without poring over countless resumes and applications he can narrow the field to the best candidates. If candidates aren't excited enough, in the beginning, to show you what they can do for you, how excited will they be after they are hired? [Tweet "It's hard to hire from a bunch of unknowns, but it's much easier to select employees from a smaller number of candidates you've already seen in action. #HiringLeaders"] Growth Leaders must have a compelling vision in order to grow a company. They should also likely have a track record of successfully accomplishing goals. Conveying thoughts and messages won't be enough to lead well. Leadership demands action and results. People will follow leaders who have vision and a successful track record. The better your business and the better your track record, the more likely you are to attract great people to surround you. Andrei shared that animals in the zoo don't care about ticket sales. They care about food and comfort and safety. Your team members are similar in that they care about basic things like provision and comfort. While you probably want them to have full ownership in your business, they likely never will. Your role is to provide enough vision for them to recognize that aligning themselves with your goal will benefit them personally. Building Smaller companies often fail to see that they are capable of building something that matters. They may have a really cool team or a really cool business and they assume it's a fluke. They don't take themselves seriously enough to worry about protecting their businesses. What steps would you take to protect yourself and your business if you knew that you would definitely succeed? This issue boils down to leadership, because if you don't have a vision of growing your company into something substantial, you'll miss an opportunity. Great leaders like Steve Jobs and Jeff Bezos know that they are building something that can change the world. They are building something that will help a bunch of people do a bunch of great stuff. After almost being shot in a high-speed chase, he found his salvation in programming and entrepreneurship. Dan Martell is best known as the founder of Clarity.Fm and Flowtown, and now through his massive efforts to help thousands upon thousands of aspiring entrepreneurs in the SAAS space. With me today is Louis Stack, the founder and president of Fitter International. He has been, as he calls it, "Leading the World to Better Balance" since 1985. Louis, a business owner, a national athlete and a father, has dedicated over 30 years to changing the way we approach office environment.
