This was a hybrid panel event co-hosted by UNSW's Centre for Criminology, Law & Justice, and the Kaldor Centre for International Refugee Law, in conversation with Dr Anthea Vogl, Dr Tina Dixson, Associate Professor Maria Giannacopoulos and Professor Daniel Ghezelbash. In 'Judging Refugees', Anthea Vogl investigates the black box of the refugee oral hearing and the politics of narrative within individualised processes for refugee status determination (RSD). Drawing on a rich archive of administrative oral hearings in Australia and Canada, Vogl sets global trends of diminished and fast-tracked RSD against the critical role played by the discretionary spaces of refugee decision-making, and the gate-keeping functions of credibility assessment. About the author: Anthea Vogl is an Associate Professor of Law at the University of Technology Sydney (UTS). She teaches and researches in the fields of refugee and migration law, focusing on the social and legal categories of the refugee and non-citizen, executive decision-making, and the criminology of border control. Guest speakers: Dr Tina Dixson (she/her) is an early career academic, advocate, and social policy professional with experience in advancing LGBTIQA+ equality, refugee protection, and responses to gender-based violence. Tina has her own experience of queer displacement, having been forced to leave Ukraine with her partner Dr Renee Dixson due to their LGBTIQA+ activism. Dr Maria Giannacopoulos (she/her) is Associate Professor and Director of the Centre for Criminology Law and Justice at UNSW Sydney. The suffering of vulnerable people has not always received much attention from the environmental community.  Instead, there's a disturbing history of people being displaced in creating parks and protected areas. As we seek a future in which people and nature coexist harmoniously, today we'll delve into the refugee crisis and the systems we have in place to resettle refugees from someone who has experienced these firsthand.  A key theme in today's conversation—this season's last episode—is community. Understanding the community in the refugee system will help us welcome refugees warmly and without backlash. It also offers insights into how we might build a community to effect the system change necessary to combat the climate and ecological crisis. Some immigrants are applying for refugee status because they've tested positive for HIV in New Zealand and are worried the government will kick them out. Immigration rules mean people with HIV applying for visas will be assessed on a case by case basis, with all visa applicants requiring a medical check. This rule was introduced in October 2021 but before that there was a blanket ban because people with HIV were seen as being likely to impose significant costs or demands on health services. Immigration lawyer Alastair McClymont says moves to deport Ahamed Samsudeen could well have given him new grounds to claim refugee status. McClymont said if he was to be sent back to Sri Lanka, the authorities there would be told and that would open up the possibility for arrest and interrogation. Samsudeen was behind an attack at Countdown New Lynn on Friday, where he took a knife from the shelf and started stabbing people nearby. Seven people were injured and Samsudeen was fatally shot by police. McClymont said even if the terrorist's refugee status had been revoked due to fraudulent claims, it would not have brought an end to his presence here.

Over the course of two weeks in August, 95 Afghan nationals reached out to the Moscow-based charity Civic Assistance Committee for help. They had all come to Russia before the Taliban seized power in Afghanistan; most came to study or to work. Now, they're seeking asylum, but this is no easy feat. Indeed, as of January 1, 2020, only 455 people in Russia were in possession of refugee status. For years and sometimes decades, tens of thousands of people have tried to seek asylum in Russia - usually in vain. Just last month, authorities in the Leningrad region expelled an Afghan girl and her family from the country; they had fled to Russia after the Taliban tried to force the 12-year-old child to marry. To find out more about the challenges Afghan asylum seekers face in Russia, Meduza spoke to "refugees sur place," an Afghan woman who fled to Moscow in 1997, and students who are now afraid to return to their homeland. Eid was shadowing one of our fitness sessions from the neighbouring public lane a while back. While at first I though how cheeky of him he then came and apologised. Didn't I feel dreadful as he explained he was a Syrian Refugee living on £5 per day at the local YMCA and swimming was his escape from the stress of his former war torn life and the chaos of being smuggled to the UK. Recognising his talent, I did not believe he had only recently learned to swim we were keen to take him on. Letters to the IOC, sponsors, training camps to Club La Santa, the United Nations a new world was opening to us both.

In this episode, we will pick up where we left off with Tankut Atuk and discuss sexualized and racialized deservingness of LGBTI refugees in Turkey.  In the second episode, we discussed different ways in which Global North oriented categorizations of vulnerability have migrated to Turkey. We saw that they migrated in the form of project-based funding, and they are enacted through local NGOs. We also explained how these categories violently make space for their existence within local realities by transforming subjectivities of LGBTI refugees.Now we will shift our focus to the concept of deservingness, and it is relations to vulnerability. Drawing upon my fieldwork, I will argue that being deserving of refugee status and rights is proved or performed via a continuous parody of vulnerability. I am calling it a parody, because, vulnerability here does not reflect the complexity of social and political exclusion LGBTI refugees face. Instead, vulnerability reflects only one or two essentialized feature of these exclusions -- i.e. the ones that speak to the sensibilities of UNHCR or countries in the Global North. Thus, this approach to vulnerability creates hierarchies within certain forms of social and political exclusions while ignoring others. In this episode, I am hosting Tankut Atuk again. We will talk about one of the worst kept secrets of non-governmental organizations working with refugees; the fact that project-based funding of NGOs reduces refugees to mere numbers and categories while ignoring their subjectivity and agency. There were many instances in my own research in Turkey when I observed that the priority of NGOs was to report higher number of refugees to the funding organizations instead of focusing on the quality of services and protection for refugees. One of the most striking examples was the practice of collecting identification numbers of families as a whole. That is to say, even though only one member of the family was visiting NGOs, they were asked to provide ID numbers of other family members. This way, NGOs were seemingly serving more refugees than they actually did.Tankut will further complicate this fact by talking about a project for LGBTI and women refugees at the NGO he worked for as a project manager. Sharing his experiences, Tankut will reveal how refugees are subjected to the violence of categories, or as Judith Butler would call it, normative violence. We will also discuss the material effects of those violent categories. Normative violence, here, refers to the Global North oriented liminal categorisations of refugees in Turkey that disarticulate citizenship rights and rearticulates them in very small bundles. Turkey differentially distributes these small bundles to the refugees according to different categories of “vulnerability” assigned to them. In other words, the language of the projects funded by organisations such as UNHCR or the EU violently reproduces itself in the localities and it produces new subjectivities of deserving and undeserving refugees. We will also problematize the concept of vulnerability that is established in the projects. These projects are funded by transnational organizations such as UNHCR, UNFPA, the EU or international bodies of states such as the USA, the UK or Germany. As countries in the Global North, the projects they fund create hierarchies of vulnerability for refugees which determine who deserve what form of services and rights. Vulnerability thus becomes a tool of managing refugee populations as opposed to granting equal protection to every refugee.Tankut is a Ph.D. Student in Gender, Women and Sexuality Studies at the University of Minnesota. His current work is on the conservative politics of HIV in Turkey, but his first MA thesis was on the gay men who served in the army.I have conducted a multi-sited ethnography in four cities of Turkey; Ankara, Istanbul, Eskişehir, and Yalova. Ankara and Istanbul can be seen as capitals of NGOs as their headquarters are in these cities. On the other hand, Eskişehir and Yalova are heavily populated by refugees in general, LGBTI refugees in particular. I conducted participant observations and oral history style interviews with ninety-four informants. There are many calls for reforming the way the world protects, or fails to protect, refugees. Some have suggested that the UN Refugee Convention is out-dated, others that the right to seek asylum should be abolished or that asylum claims should be processed off-shore. At the same time, the UNHCR has been drafting a Global Compact on Refugees, promising to increase global cooperation on refugee protection. James Hathaway, James E. and Sarah A. Degan Professor of Law at the University of Michigan, is the founding director of the University of Michigan’s Program in Refugee Asylum Law and author of two leading treatises: The Law of Refugee Status and of The Rights of Refugees under International Law. James Hathaway has put forward a model for a global solution to refugee protection, based on a five year project involving over 100 participants, including six governments.
