Episode 89: Calloway County personal injury attorney Jeff Roberts discusses accidents involving self-driving cars. For the purposes of this episode, the term “self-driving” will refer to both autonomous driving vehicles and those requiring a driver to be in the front seat, but not necessarily guiding the vehicle the entire time. New Kentucky Legislation There are two laws regarding self-driving cars became effective in July of 2024. Autonomous vehicles refer to those not needing the assistance of driver to operate on the roads. Automated driving systems enable to the vehicle to travel on the roads, but require someone to be in the driver's seat to takeover, should that be required for safety reasons. It is legal to have an autonomous car on the road in Kentucky. Over time, this will also include large, tractor trailers. Autonomous trucks weighing 6,200 pounds or more will be legal on Kentucky beginning July 31, 2026. Safe-Driving Technology Jeff comments on how many cars are already equipped with lane departure, automatic breaking and other safety features. Fortunately, the technology being used by self-driving vehicles are even more advanced. He admits there will be a learning curve for the manufacturers of autonomous vehicles. This creates a scary situation for other drivers on the road with self-driving cars in the area. Hopefully, the technology will avoid having the vehicles camp out in the left lane; but that's a topic for another episode! What Do Other Clients Think About Jeff? Commercial self-driving passenger and freight services has the potential to revolutionise public transport and passenger travel with many benefits that include reduced road traffic accidents due to human error, to improved connectivity to remote areas for goods and healthcare services. Yet building public trust and acceptance in autonomous systems and overcoming the perception of risk will be challenging. In this episode, in discussion with Dr Sam Blaxland, Siraj Shaikh, Professor in Systems Security in the Faculty of Science and Engineering, talks about the evolution and future of self-driving technology; the risks and benefits, and how pushing industry standards can help build public trust in complex autonomous technologies. Siraj Shaikh is a Professor in Systems Security at Swansea University (UK). His research interests lie at the intersection of cybersecurity, systems engineering and computer science addressing cyber-physical systems security for automotive and transport systems. Professor Shaikh is also Co-Founder and Chief Scientist at CyberOwl, which is dedicated to cyber-physical systems security monitoring for the maritime sector. The U.S. Department of Transportation is applying a surprisingly light hand to the regulation of driverless vehicles. Not that DOT intends to cede its authority to oversee the new technology. On the contrary. But a new proposed policy, replacing one from three years ago, allows automakers and designers some wiggle room in how they meet the agency's strict safety standards. For example, DOT has laid out a 15-point safety assessment that's entirely voluntary in nature as long as the end result satisfies the agency's requirements. On this episode, we speak with Katie Thomson, partner in the law firm of Morrison Foerster. She is a former senior counsel at both DOT and the Federal Aviation Administration, with extensive experience in parsing the legal and regulatory ramifications of driverless vehicles. Thomson also weighs in on certain key questions yet to be resolved, such as the proper balance of regulatory authority between states and the federal government, and legal liability for accidents involving driverless cars.
