Estate Planning Essentials: Why a Will Might Not Be Enough

When people think about estate planning, a will is often the first thing that comes to mind. But relying solely on a will might leave significant gaps in your financial plan, potentially putting your loved ones and your hard-earned assets at risk. Join Jeff as he breaks down the critical features of a will and why a will alone might not be enough to protect your assets and your family's future.    WHAT YOU NEED TO KNOW (00:00) Episode introduction. (03:20) While a will directs the distribution of assets in your name alone, it does not control assets with joint owners or designated beneficiaries, like insurance policies or jointly held bank accounts.  (07:46) Most financial institutions won't allow a testamentary trust (a trust established within a will) to be named as a beneficiary. This limits your ability to protect those assets after your death.  (09:26) Assets passed outright through a will can be exposed to risks like Medicaid repayment, creditor claims, financial mismanagement, and future spouses via death or divorce.   (11:11) Probate can be costly, with legal fees often ranging from 4-6% of the estate. While you can handle probate without a lawyer, the executor still bears significant personal liability to ensure everything is handled correctly.  (18:12) Relying on beneficiary designations to avoid probate can leave assets unprotected, potentially exposing them to creditors, lawsuits, and financial missteps.  (21:45) Unlike a will, a properly structured trust can help you avoid probate, reduce fees, and provide ongoing asset protection for your heirs.  (24:12) The absence of a will triggers the intestate succession process. When it comes to estate planning, there are a lot of half-truths, outdated advice, and persistent myths that can leave your family vulnerable. Join Jeff as he clarifies common misconceptions about wills, probate, powers of attorney, and trusts. Estate planning is far from a one-size-fits-all exercise. Multiple tools are available, and to be most effective, they should be strategically customized to each family's needs.    WHAT YOU NEED TO KNOW   (00:00) Episode introduction. (03:02) Myth #1 – A last will and testament is good enough. Truth – A will outlines what will happen to our assets that are in our name alone. This leaves a lot of issues unresolved.  (04:42) Myth #2 – Avoid probate using joint ownership and beneficiaries. Truth – When money is distributed outright to the joint owner(s) at the time of death, it creates a situation where (1) the money can be spent before creditors and tax collectors get their share, and (2) assets become susceptible to unintended claimants.  (10:44) Myth #3 – Revocable trusts should not be used. Truth – They ensure flexibility during life, give the grantor complete control, offer options for disability planning, and provide after-death asset protection.  (19:45) Myth #4 – A revocable living trust is all you need. Truth – In some instances, an irrevocable pure grantor trust is a better option. It can offer more robust tax handling, leaves the grantor in control, and provides a step up in basis for the beneficiary.   (22:52) Myth #5 – Trusts are one-size-fits-all. Truth – There are many tools available to estate planners; it's important to mix and match to develop a custom plan that is appropriate for each family.  (24:25) Myth #6 – A power of attorney (PoA) is good forever and any PoA is good enough. Truth – Most banks want these documents updated at least every two years. A Perspective on Change: How to Avoid Anxiety When Faced with Uncertainty

Things seem to be happening fast, and many people are worried about potential changes to tax laws and funding for programs on which they rely. Over time, Jeff has learned that talk of change does not always result in change. Because speculation can drive anxiety and poor decisions, often the best approach is to wait. If laws and programs do change, then meet with your professional advisor(s) and make decisions based on the most current and accurate information.   WHAT YOU NEED TO KNOW (00:00) Episode introduction. (03:48) We anticipate changes in 2026 to the federal estate tax limit for people who have at least $13.99 million as a single person or $27.98 million as a married couple. Be prepared to speak with your tax attorney in the last quarter of 2025. (05:45) If you have less than $13.99 million or $27.98 million, hold off on making changes for tax purposes until we know more. (07:40) Tax planning with an irrevocable trust means giving up control. Understand your options.  (12:00) Jeff is skeptical that they will make cuts to Medicaid.  (16:18) Schedule an appointment with your attorney if changes are made to same sex marriage laws. (17:50) There is no harm in filing for The Corporate Transparency Act. If you wait, keep track of the filing deadline.  (19:21) If you have a grantor trust and have been filing separate trust tax returns, ask your tax professional if you should continue to do that. Pennsylvania now follows the federal rules.  (21:26) Changes to The Secure Act are possible. Wait to make adjustments until we know whether changes occur. (23:28) One smart way to prepare for an unknown future is to make sure that everyone over the age of 18 has a financial power of attorney, a health care power of attorney with a living will, and a last will and testament.   ABOUT BELLOMO & ASSOCIATES Jeffrey R. Asset Protection After Death: How to Avoid Probate the Smart Way

You may have been told by family, friends, or even your financial planner that you should avoid the probate process by adding a joint owner to your financial accounts and/or by designating a beneficiary for your assets. But be aware. While you save upfront costs, you lose control of your assets and open your family to unintended consequences, which can be much more costly in the long run.   There is a better way to avoid probate. We encourage you to share this discussion with the people in your life so that everyone understands the smart alternatives to avoiding the probate process.   WHAT YOU NEED TO KNOW (00:00) Episode introduction. (02:47) Probate is the legal process by which we carry out a person's wishes at the time of their death when they own assets in their name only with no designated beneficiary.   (05:50) Some people want to avoid probate to avoid the associated fees. This can be a good strategy if done correctly. (07:39) Avoiding probate does not avoid taxes.  (10:45) Joint ownership of assets or passing assets directly to a beneficiary can unintentionally undermine the wishes of the deceased. (11:48) After the death of a spouse, joint ownership of assets during a second marriage can jeopardize the inheritance of the children from the first marriage. (13:45) A Will does not go through probate if the assets named in the Will are jointly owned.  (16:06) Probate can be avoided when assets are transferred to a trust at the time of a person's death. The assets are protected immediately, and they are not subject to the five-year lookback period for Medicaid eligibility.    (20:40) Trusts are a great way to protect your assets for your family's use, avoid unintended consequences, and ensure that your wishes are honored.   ABOUT BELLOMO & ASSOCIATES Jeffrey R. (05:39) Our Special Needs Workshop looks at special needs trusts (also known as first-party trusts or payback trusts or d4A trusts), supplemental needs trusts (i.e., third-party special needs trusts), pooled trusts, ABLE accounts, and more.  (09:00) A third-party special needs trust is created and funded by someone for a person with a disability. A first-party special needs trust is created and funded by the person with the disability. (10:47) The terms “special needs trusts” and “supplemental needs trusts” are essentially interchangeable.   (16:51) “First-party special needs trust” and “third-party special needs trust” are clearer terms and the rules for each are different. A first-party special needs trust provides for the state to get repaid up to the amount of care provided. James Kabrhel, Ph.D., and Jeff Bellomo were college roommates more than 20 years ago and have remained good friends ever since. Today, Jim is an associate professor of chemistry at the University of Wisconsin–Green Bay. Jim and Jeff reflect on the importance of mentors, relationships, hard work, finding the right environment, and playing to your strengths.    Check out Jim's science podcast: Baloney Detection with Dr. K.     WHAT YOU NEED TO KNOW (00:00) Episode introduction. (02:35) Raised in East Stroudsburg, Jim found a home away from home at Juniata College. In choosing a college, he recognized that a smaller school would be a better fit for him.   (06:05) Jim's high school science teacher inspired his interest in chemistry. At Juniata, his chemistry professor deepened Jim's desire to pursue chemistry as a career.  (07:51) Jim earned his Ph.D. in organic chemistry from the University of Minnesota, Twin Cities. The environment and his advisor had a tremendous influence on Jim's ability to thrive.  (13:19) At Juniata, Jeff's three roommates all studied the hard sciences, which led to some funny moments for him. Looking back, Jeff and Jim recognize that everyone has their own special set of strengths, but there is no substitute for hard work.   (16:35) Jim and his wife, Amy, first bonded over Harry Potter. Today they share a home in Wisconsin right on Lake Michigan.  (22:03) Higher education is going through an interesting time of change.   (23:37) Amy is also an associate professor. In addition to traditional chemistry classes, she and Jim teach sustainability chemistry, scientific literacy, and an intense organic chemistry boot camp. Putting your house in a trust has many benefits—from financial savings to peace of mind. You can continue to live in the home and control the property. You can avoid the capital gains tax, the 2% transfer tax, and the inheritance tax while still qualifying for the homestead exemption and the Clean and Green tax benefit. And, of course, a trust protects your assets to pass the wealth to your loved ones.    In this discussion, Jeff Bellomo—an experienced estate planning and elder law attorney with a master's degree in taxation—explains planning techniques for estates with a net worth in the $300,000 to $5 million range.     WHAT YOU NEED TO KNOW   (00:00) Episode introduction. (02:40) A trust is a legal contract between three parties. The grantor creates the trust, the trustee controls it, and the beneficiary receives it.   (06:56) A grantor can also serve as the trustee and live in the home, much like a beneficiary. The grantor is taxed at individual income tax rates.   (08:01) As a trustee, a grantor can sell the home, buy another home, and avoid the capital gains tax if they live in the home two out of five years as their primary residence.   (08:53) If the trust provides only for lineal descendants or siblings, there will be no transfer tax. Use an experienced estate planner to still qualify for the homestead exemption.  (12:44) A grantor trust will not jeopardize the Clean and Green tax benefit.  (13:00) If there is a current mortgage on the primary residence, it can be added to the trust. Be sure to continue to pay on time.   (16:17) It's wise to create the trust when a person or a couple is younger so that the Medicaid five-year lookback period does not pose a problem. (20:04) A trust allows the family to protect accumulated equity, access funds to enhance the grantor's life, and keep the grantor in the home.   (21:35) Ultimately, a trust provides flexibility and peace of mind. (02:43) In 2025, the annual gift tax exclusion amount will be $19,000. The exemption amount will be $13.99 million for an individual or $27.98 million for a couple.   (08:15) To qualify for Medicaid, you must spend down your assets to either $2,400 or $8,000 depending on your income. If your monthly income is greater than $2,901, you can have $2,400 in assets. If your income is less than $2,901, you can have $8,000 in assets.  (09:38) The monthly personal needs allowance will be $60.00.   (10:03) For a married couple, the community spouse can keep 50% of the couple's total assets—but no less than $31,584 and no more than $157,920.   (11:21) The community spouse will be allowed a minimum monthly income of $2,555. If the community spouse's income is less than this amount, they may keep a portion of their spouse's income to reach the minimum. The maximum allowable monthly amount will be $3,948.   (11:57) Gifting money during the Medicaid five-year lookback period can cause a delay in Medicaid eligibility. The 2025 penalty divisor will be 399.80.   (13:37) The minimum home equity exemption will be $730,000. The maximum will be $1,000,097. (14:10) The home maintenance deduction will be $989.10. The heating standard will be $750 or $401 for non-heating. The excess monthly allowance will be $767. The Medicare Part B premium will be $185.  (15:15) Some current tax rules are expected to sunset at the end of 2025.   (19:28) Beware of recent trends in estate planning. Divorce can significantly impact your estate plans, so knowing how to update your documents and beneficiary designations is essential. Jeff discusses the key steps to take after a divorce. He guides us through important topics like updating your full inventory of estate planning documents, protecting assets for children from previous marriages, ensuring the financial future of blended families, and preparing for long-term care as you age. This practical advice will help you safeguard your medical and financial plans as life circumstances change after divorce.     WHAT YOU NEED TO KNOW (00:00) Episode introduction. (02:33) Immediately after a divorce, update your estate planning documents and change all beneficiary designations. This includes medical and financial powers of attorney (PoA), trusts, last will and testament, life insurance, retirement accounts, annuities, etc.   (04:55) If you want to make changes to your documents before the divorce is final, talk to your attorney to ensure that you're not violating any laws or agreements.   (06:29) Before getting remarried, talk with your attorney about pre-nuptial agreements and elective share rights.   (09:40) Regarding elder law and long-term care, remarrying later in life could put your assets and/or Medicaid qualification at risk. Talk with your estate planning attorney.   (15:27) Before re-drafting your documents, consider each document separately. Relationships and responsibilities of new spouses and children from earlier marriage(s) can affect decision-making.  (18:32) In blended family situations, trusts are often used after death to determine distribution of assets. And sometimes, it makes sense to name a neutral, professional third-party as trustee. (23:36) In all planning documents, make your wishes as detailed and clear as possible. In response to listener requests, Jeff explains financial planning options for individuals with special needs. In addition to common estate planning tools, you'll learn about third-party and first-party special needs trusts, pooled trusts, and ABLE accounts. These strategies can help safeguard governmental benefits and create long-term financial stability for your disabled loved one.   WHAT YOU NEED TO KNOW (00:00) Episode introduction.   (02:35) A common estate plan can include a financial power of attorney (PoA), a medical PoA, a living will, and a last will and testament.    (03:42) A trust is a legal contract between three parties, the grantor (the person who creates it), the trustee (the person who controls it), and the beneficiary (the person who receives it).     (04:14) It's smart to set up a financial PoA and a medical PoA when a child, who has capacity to make decisions for himself or herself, turns 18. A child who does not have capacity to make decisions will likely require a guardianship hearing.     (08:08) To provide for a family member with a disability who is receiving public benefits, you can create a third-party special needs trust. The money is not left outright to the person with the disability because that can put their public benefits at risk.     (14:55) Most public benefit programs have a $2000 limit. The person with the disability is allowed to have no more than $2000 in their name. When that amount is exceeded, the person can create a first-party special needs trust, also known as a payback trust.   (18:31) A pooled trust is a type of special needs trust run by a charitable organization. It combines the funds of multiple beneficiaries into a single trust.    (20:22) An ABLE account is less expensive to set up but still provides access to money. Planning Pitfalls: These Lesser-Known Factors Could Affect Your Medicaid Eligibility

Since 2016, Christine has used her nursing experience and Medicaid knowledge to help clients better understand the Medicaid system and make the best choices for themselves and their families. As part of this work, she sits down with Jeff to discuss some of the lesser-known factors that can affect your asset protection strategy and Medicaid eligibility.   WHAT YOU NEED TO KNOW   (00:00) Episode introduction.   (03:15) A “529 account” helps people save for educational expenses. However, a 529 account could affect your eligibility for Medicaid.      (06:22) Funds in a “uniform transfer to minors account” are exempt from Medicaid eligibility even within the five-year lookback period.    (07:23) When filing a Medicaid application, estranged spouses must prove that they are living separate lives with separate finances. A hearing may be necessary.   (10:48) Divorcing and giving the “community” spouse 100% of assets to gain Medicaid eligibility is a red flag for possible fraud. Additionally, this scenario limits protection of the community spouse's assets.     (14:20) When people get married and enter into a prenup to keep finances separate, the state can still make a claim on the resources of the community spouse. The same applies to postnuptial agreements.    (16:47) Some blended families have wills designed to keep inheritable resources separate for the “original” children. This does not protect the assets of the community spouse.     (19:05) Continuing care retirement communities (CCRCs) often have a “benevolent fund” available to pay for care if a person—who is not yet in skilled care—runs out of money. There are many factors to consider under this scenario.   (24:26) Having your assets in a trust would not necessarily disqualify you from entering a CCRC. But, at the least, you likely would need to have sufficient funds in your name alone to buy in. Estate planning options are available to manage this scenario.     (27:57) Typically, a benevolent fund contract will restrict the amount and type of gifting that is allowed while the contract is in force.     ABOUT BELLOMO & ASSOCIATES   Jeffrey R. In addition to elder law and estate planning, she is experienced in family law, custody conciliation, Social Security disability, and other areas that make her the perfect person to sit down with Jeff and answer your questions about the legal guardianship process.     WHAT YOU NEED TO KNOW (00:00) Episode introduction. (02:40) In Pennsylvania, pursuing guardianship requires a court proceeding where a judge must determine whether a person is incapacitated and whether to name someone to be that person's guardian. (03:17) Often, a guardianship proceeding occurs when people have an adult child with special needs—they've never had and never will have the capacity to decide if they need a power of attorney.   (04:32) A guardianship proceeding can also occur if someone has lost the capacity to name a power of attorney because of dementia, a traumatic brain injury, etc. (05:45) Competency is a medical term; capacity is a legal term. A doctor's testimony is necessary for a judge to determine capacity. (06:30) For competency, a doctor must complete a lengthy form outlining a person's abilities or appear before the court as a witness.  (08:52) Each county in PA has different local rules. Use an attorney familiar with your county's requirements. (12:17) A guardianship hearing is a last resort. Preferably, the person in question has a power of attorney that is current and drawn up by a qualified attorney. (16:36) Guardians are subject to more oversight than a person with power of attorney. A guardian is responsible for filing an annual accounting of finances. Some expenses must be approved by the court.   (21:01) The alleged incapacitated individual and immediate family members must be served notice at least 10 days before the hearing.   (22:37) A third-party can be assigned to serve as guardian if there are no family members or no appropriate family members available. Fran Gibbons is the senior director of development for the Greater Pennsylvania Chapter of the Alzheimer's Association. The organization serves western, central, and northeastern Pennsylvania, helping people with Alzheimer's disease and all other dementias. Fran's fundraising efforts provide support groups and educational resources while advancing crucial research and public policy initiatives. Today, many seniors live longer—often farther away from family—and want to avoid continuing care retirement communities (CCRC). They'd rather age at home in familiar surroundings. But, aging at home usually requires some degree of assistance, which can be difficult to find. You can reach Melissa directly at (717) 584-1224.  WHAT YOU NEED TO KNOW (00:00) Podcast introduction.  (02:04) Dependent largely on volunteers, Lancaster Downtowners is a village model nonprofit—one of over 300 across the country—that makes it possible for people to age at home in their community.   (02:58) Many members live in an apartment or condo, but others live a little farther out and some even have a bit of land.  (03:43) Instead of providing the range of services you'd get in CCRC, a village provides social connections and support with everyday tasks.   (03:56) Lancaster Downtowners offers three types of help. Social connections: events, support groups, walking groups, etc. “Just One Call” program: transportation, technology assistance, etc. Home and life maintenance: yardwork, snow shoveling, medical notetaking, etc.   (07:18) There are about eight villages in Pennsylvania. The newest one serves York County. (07:51) Membership fees are tiered based on income. Dues range from $0 to $15 per month.   (08:17) Call or fill out an application on the website to see if membership makes sense for you. For some needs, the team will connect you with other service providers (e.g., Meals on Wheels) to help you thrive at home.   (10:58) The service provider directory includes only those recommended by other members.   (12:04) Some members have given up their vehicles. Common Questions: Clearing Up Confusion in Estate Planning, Elder Law, and Asset Protection

Generally, if a couple of people ask the same question, then we know that other people are thinking it, too. And, since we're dedicated to education here at Bellomo & Associates, we like to jump in right away and clear up any confusion that might be out there. We want everyone to understand the tactics we recommend—and why we recommend them—for estate planning, elder law, and asset protection.     What You Need to Know  (00:00) Podcast introduction.  (02:37) Bellomo & Associates says the firm offers free workshops, but I'm skeptical because “nothing is free.” So, what's the catch?  (04:04) I don't have children. Numbers and More for 2024: IRS Rulings, Tax Info, and Medicaid Updates

It's that time of year when Jeff provides the newest and most applicable IRS and Medicaid numbers for tax and estate planning purposes. Many of these numbers are discussed in our free, educational workshops. Jeff also likes to review them here along with related questions we get from our clients.   WHAT YOU NEED TO KNOW   (00:00) Episode introduction. (05:50) The federal estate tax limit is now $13.61 million per person or $27.22 MM for a married couple.  (09:14) The annual exclusion gift is set at $18,000 per person per recipient per year. Ask your tax preparer if you should file a gift tax return.  (10:40) For Medicaid purposes in Pennsylvania in 2024, the income limit is $2,829 per month. If your income is greater than the limit, you're allowed $2,400 in resources. If less than the limit, you can have $8,000 in resources.   (11:20) To be eligible for waiver services in the home, your income must be less than $2,829 + $500 per month. Talk to your financial professional.   (12:17) For a community spouse's protected share amounts, the maximum is 50% of the assets, but no more than $154,140 and no less than $30,828.  (12:59) To calculate penalty for gifting during look back period and days until Medicaid eligibility for nursing home or waiver, use the amount gifted divided by $379.65 per day or $11,547 per month.  (14:04) The Minimum Monthly Maintenance Needs Allowance (MMMNA) refers to income limits for the community spouse. The maximum is $3,853.50 and the minimum is $2,465.   (14:20) The excess home minimum is $713,000 and the maximum is $1,071,000. The home maintenance deduction is $965.10 per month. The heating standard is $750 per month and the non-heating standard is $401. The personal needs allowance is $45 per month.  (15:30) A new IRS ruling headline suggests that children are losing step up in basis with irrevocable trusts. This does not apply to the type of trusts used at Bellomo. (19:13) The grantor trust rules in Pennsylvania now mimic the federal grantor trust rules. Nothing will change for most Bellomo clients. (21:30) The IRS announced a potential gift tax for trust beneficiaries. This should not affect you if Bellomo created your trust.   ABOUT BELLOMO & ASSOCIATES Jeffrey R. This is the 2nd part of our examination of celebrity estate plans. Using the real-life stories of some of entertainment's most famous figures, Jeff teaches us valuable lessons that can be applied to our own situations.    What You Need to Know  (00:00) Episode introduction. (02:56) Singer Whitney Houston created a will in 1993. She died 19 years later with the same will in place. The lesson: Keep your will up to date. Be careful about passing large sums of unprotected money to young people. (07:39) Attorney Robert Kardashian—part of OJ Simpson's defense team and the father of Kourtney, Kim, Khloe, and Rob—had a handwritten will. Upon his death, the language in the will was unclear and subsequently disputed. The lesson: Detailed language matters.   (11:44) Actor Heath Ledger died in 2008 with an outdated will that left everything to his parents and sister. So, at the time of his death, Ledger's young daughter was not provided for. His family gifted the inheritance to his daughter. The lesson: Don't rely on others to do the right thing.   (16:20) Musician Prince died in 2016 with $200 million in assets—and no will or trust. Forty-five people claimed to be heirs. By 2018, $6 million had been spent on unnecessary legal fees. The lesson: Formalize your plan. Be detailed and intentional. (19:20) Actress Brittany Murphy named her mother as heir in a handwritten will. When Ms. Murphy got married, she updated her estate plan and used very specific language, again leaving her entire estate to her mother. The lesson: Keep your plan updated and use detailed language. (22:51) Singer Aretha Franklin died without a will or trust. Two contradictory handwritten wills were found in her house. The lesson: Use a professional to create an estate plan. Have only one document stored in a safe, known place.   (26:23) DJ Casey Kasem suffered from dementia in his later years. In 2007 and 2011, he created conflicting documents that put his daughter and his wife at odds over his fortune. The courts were forced to intervene. It might not seem like it, but celebrities are people, too. Their estate plans prove that, just like us, some are forward-thinking and prepared while others fail to protect their assets. Jeff uses the stories of some of the wealthiest and most fascinating figures in entertainment and sports to teach us valuable lessons in estate planning because our legacies matter, too!     What You Need to Know  (00) Episode introduction.  (07:04) Elvis Presley established a trust for his daughter, Lisa Marie. The trust dissolved when she turned 25 and that made the assets vulnerable. The lesson: Use non-dissolving trusts and carefully consider the age and maturity of the beneficiary. (13:10) Actor Philip Seymour Hoffman did not provide for after-born children. The lesson: Add a clause, “and any after-born children” and don't rely on governmental statutes that might not be in place when needed.   (15:50) Jim Morrison of The Doors died with an overly simplistic will. Plans should be able to accommodate the many “what if” scenarios that could be playing out at the time of death. The lesson: Provide for various contingencies and backup the backup. (19:32) Track star Florence Griffith Joyner kept the location of her will a secret. As a result, it took four years to close her estate and members of her family disagreed on what they thought were her wishes. The lesson: Make your document(s) location known and keep the papers in a professional's safe, secure facility. 22:50) Michael Jackson, the King of Pop, created a trust, but he never funded it. Jackson's family spent a lot of time in probate court. With trusts, you avoid probate and keep your business private. The lesson: Fund your trust.  (24:30) Actor Marlon Brando supposedly made oral promises to his long-time housekeeper. His estate plan excluded those promises, and his housekeeper brought a lawsuit. In the end, she won just a fraction of what she allegedly had been promised. The lesson: Document the details.    (26:57) James Gandolfini of The Sopranos had an estate worth $70 million when he died suddenly. He hadn't finalized his plan before leaving on vacation and 55% of the wealth was lost to taxes. Jeff “inherited” probate paralegal Cathy Montague two years ago when Bellomo acquired a small elder law firm from a retiring attorney. It didn't take long for Jeff and the team to recognize Cathy's experience and value. And it didn't take long for Cathy to embrace her new environment and colleagues. Cathy sits down with Jeff to reflect on her long and impressive career. They discuss how sole ownership and probate can be a good financial planning strategy. Then Cathy shares what she has learned about dealing with families experiencing heightened stress and emotion in the wake of loss. She started doing a bit of everything—wills, powers of attorney, deeds, and the like—but eventually became a specialist in probate administration.  (06:35) Cathy finds great fulfillment in helping others. In addition to providing professional guidance and answering questions, she is determined to make this difficult time as easy as possible for folks.  (07:27) The probate process can take up to a year because the estate must be advertised with two different agencies per Pennsylvania law. Creditors have one year to submit a bill from the advertisement date.  (09:25) Sometimes people underestimate the stress that can come with losing a loved one and finalizing the estate. Other times, people are hesitant to complete the probate process because it can feel like letting go of their loved one. (11:33) Cathy describes herself as someone who helps family members after their loved one has passed. She walks them through the process to ensure that they fulfill the activities and deadlines stipulated by Pennsylvania law.  (12:15) Probate administration is needed when the deceased owns assets in his/her name alone. As an experienced, licensed social worker, Meg provides personalized support for elderly individuals dealing with various challenges related to aging, health, and living arrangements. Meg and Jeff share stories of commitment, personal connections, and the critical role of advocacy in health care. It's an eye-opening look at just one aspect of service that differentiates this law firm.   What You Need to Know  (02:42) At 16, Meg decided to pursue social work when she cared for an elderly relative. She graduated Western Maryland College and earned her graduate degree from the University of Kansas. (04:13) A life care planning coordinator's duties vary depending on the needs of the individual and family. Some clients are healthy and well; they live at home and want to stay there so Meg acts as a support or advocate when needed. Sometimes, though, an elderly person's situation is not good. Meg can intervene to determine the services that are needed and assess whether the home is safe. (07:21) A health care advocate is a valuable ally. It's important to have someone who can track, follow up, and understand medical decisions and activity.  (09:58) Jeff hired Meg because he needed someone who could answer questions such as:  How can we make Mom's home safer? Does she need memory care? Does she need skilled care? How should we be advocating for her? (18:39) Meg's willingness to help and advocate for those in need has even extended to non-clients, such as the woman she encountered who was not feeling emotionally safe at home. Meg, her daughter Jennah (Bellomo's chief operating officer), and Jeff all got involved in moving the woman into assisted living. Today, the woman is flourishing, and Meg continues to be involved. (23:34) In a previous episode, Jeff discussed how individuals can use advocates as power of attorney when they don't have family or a support system in place. Jeff is joined today by Craig Milsten. Craig has worked as an assistant District Attorney and the head of litigation at a large general practice law firm. What You Need to Know  (04:12) Personal injury law is based on the concept of negligence and a reasonableness standard.  (04:41) Injuries due to negligence can have financial, medical, and emotional consequences.   (07:00) Before joining KBG Injury Law, Craig considered KBG to be the gold standard. There is no better way to learn the rules of evidence, the rules of procedure, and how the courtroom works.  (09:55) Only a small number of civil cases go to trial. When they do, they can be years in the making and require a tremendous amount of work. (12:20) The goal with every civil claim is to try to resolve it outside of court. A claim only becomes a lawsuit when the plaintiff's idea of a fair resolution doesn't match the defendant's idea.   (12:39) There are risks in going to trial. It can take a long time to get to the courtroom. A trial is typically more expensive. There is also the risk of unexpected outcomes. (15:05) Craig's younger son is a terrific singer and actor, heavily involved in musical theatre. Craig's older son, Andy, is 19 and on the autism spectrum. Currently, he is finishing his first semester as a piano performance major at West Chester University. Know the Risks of Gifting Money, Unwrap Peace of Mind Instead

With the holidays upon us, you might be tempted to gift large sums of money to your children. But Jeff warns against this seemingly generous practice because gifting money and/or assets carries real and potential risks, including loss of control, severe tax implications, and inability to pay for long-term care.  Jeff recommends a more thoughtful and lasting gesture—give peace of mind. Do the things that will serve your children best in the long run. Make sure that your affairs are in order. Have your powers of attorney in place. Pre-plan your funeral. Set up a trust to ensure your money and assets are protected and preserved so that your children can enjoy the peace of mind that you wish for them. What You Need to Know  (02:12)  It's important to understand all the rules before you start gifting money or other assets.   (04:51) Why not gift money? (1) You lose control while you're still alive. (2) You could create a heavy capital gains tax burden for your children. (3) If you need long-term care (LTC), the money might not be available when you need it.  (09:40) If you want to gift money every month, you may gift up to $500 in total—not $500 each to multiple people, but rather, $500 combined per month. (11:57) Nursing homes have a right to sue under the filial responsibility statute, meaning that the children are responsible for their parent's nursing home stay. (13:59) So, what should you give your children? Peace of mind is a great gift. Pre-plan your funeral. Make all of the arrangements. Estate Planning Essentials: Act Early to Safeguard Your Future

Estate planning is not only for older, established homeowners. Jeff explains how to know when it's the right time to set up powers of attorney and wills. He outlines state laws that will determine how medical decisions and finances will be handled if a person dies or becomes incapacitated without legal documents in place. Then, he ties it all together with a discussion of trusts for asset protection and tax management. This is a vital discussion for every adult to understand the importance of timing and the different options available for smart, proactive estate planning.   WHAT YOU NEED TO KNOW   (01:01) Everyone age 18+ is deemed an adult in Pennsylvania (PA) and should have a financial power of attorney (POA) in place.     (02:09) If no health care POA is in place, state law determines who can make medical decisions for you.    (02:29) The state can determine who your assets will go to if you die without a will.   (05:19) Do not assume that all your assets will go to your spouse if you die without a will.     (05:35) Do not assume that you're “too young” to need a power of attorney.     (06:22) Increasingly, 18-year-olds are getting POAs before they go off to college so that their parents can get involved on their behalf if the student suffers a serious illness or injury or needs help with, say, a banking issue or a problem at the school.     (07:37) If no POA is in place at 18, the next best time is when you start making some money. In fact, a financial POA is probably more valuable than a will at this point.     (08:12) Having a POA in place avoids legal guardianship hearings should a loved one become incapacitated.   (11:36) In general, there are two major types of trusts: testamentary trusts (created under a will) and living trusts (including revocable and irrevocable trusts). There are different types of irrevocable trusts (e.g., tax trusts, asset protection trusts). (15:06) Revocable trusts are taking the place of testamentary trusts. These provide asset protection but need to satisfy the five-year look-back period.   (17:41) If a young person needs long-term care, it is much better to do crisis planning with a financial POA already in place.   (19:36) Get an irrevocable tax trust only if you have more than the federal estate tax amount, which is currently about $26 million for a couple.   (21:19) Do you have a house or about $150,000 in investable assets that you do not rely on for everyday expenses? The Setting Every Community Up for Retirement Enhancement (SECURE) Act 2.0 was passed in December 2022. Some sections are already in effect and others begin January 1, 2024. The law focuses mainly on retirement and tax-related issues, but has significant implications for estate planning, also. People who have estate plans that list trusts as beneficiaries of retirement accounts are advised to have them reviewed and updated to ensure that their plans continue to meet their financial and estate planning goals.     WHAT YOU NEED TO KNOW   (01:56) The original SECURE Act was passed on Christmas Eve in 2019. The SECURE Act 2.0 was passed in December 2022. The law includes consequential changes.   (02:54) Before the SECURE Act, estate planners would often create an accumulation trust as the beneficiary of a retirement account. Benefits could accumulate, providing long-term asset protection and the ability to stretch out tax payments over the lifetime of the heir(s).     (4:00) Now, spouses can still stretch out taxes over their life expectancy, but children have 10 years to pay.     (07:01) The SECURE Act also means loss of asset protection. Jeff reflects on his many years as an attorney and shares the advice he would give himself as a young lawyer. As it turns out, his advice consists of universal truths: think differently; keep learning and growing; be clear, consistent, and honest in your communications; accept that people need to make their own decisions in their own time; nurture and value your relationships; and, most of all, cherish your loved ones and tell them how you feel.   What You Need to Know  (02:22) Traditional client management and billing practices leave a lot to be desired. Education, transparency, competence, and fairness are integral to a better approach.  (04:01) One-on-one consultations with attorneys can be overwhelming for clients. Create a learning environment that allows them to breathe and think without feeling pressured.   (09:33) Don't impose what you believe on other people. Listen to what people are telling you. (11:04) It's okay when people say “no.” You are not failing your client if you have communicated clearly, consistently, and honestly. Let people know the pros, the cons, the good, the bad, and the ugly. From there, the decision is out of your hands.  (13:53) The work you're putting in to educate people is worth it. Keep fighting the good fight.  (15:12) Be transparent about pricing, and not just front-end pricing. Explain what the process looks like from start to finish. (15:29) The Red Wagon Club is not only about the maintenance features it offers. People love the relationships that develop from it. It's okay that it's not a revenue generator.   (16:19) Spend the money on legal software that will keep you—and your clients—current. Case law, Social Security plans, Medicaid regulations, tax law, and other crucial elements of your work are constantly changing. Clients' documents should be up-to-date and effective whether they are needed today, tomorrow, or decades from now. You can't put a price tag on a client's peace of mind.  (21:05) There is no crystal ball. Do everything you can to make sure that your clients are prepared.
