It is a genuine component of inheritance planning, not something to skip. But on its own, it only moves money to the next generation. A will can say who gets what. Inheritance planning is about what happens next, after the money arrives and the next generation is left to steward, use, and grow it. The Four Things Every Inheritance Plan Should Protect: A Family Wealth Protection Framework It is easy to have a narrow view here without realizing it. A strong plan protects four things, not just one. Protect the Assets This is the part people already think about: businesses, investments, property, real estate, life insurance policies. Protecting the assets means more than securing them. It includes ownership structure, beneficiary designations, liquidity, insurance, and tax strategy, all coordinated across a genuine 360-degree view of your financial life so that your advisors are not quietly working against each other.  When advice is properly coordinated, you plug the leaks, minimize unnecessary tax, and keep every recommendation pointed at the same goal instead of pulling in different directions. The result is advice that amplifies cash flow, cash value, liquidity, and long-term generational wealth, rather than one advisor's strategy quietly undoing another's. Protect the Family This is the piece families tend to overlook. Protecting the family means protecting the relationships within it, preventing confusion, resentment, entitlement, perceived favoritism, and unmet expectations. When heirs are surprised by what they receive, or by how it is divided, that surprise becomes conflict, often years after the fact and long after it could have been prevented with a simple conversation.  Removing the element of surprise through clear communication puts a family light-years ahead, because the family is no longer left to make it up as they go or insert their own assumptions about what was intended. Protect the Heirs Where protecting the family looks at the unit as a whole, protecting the heirs looks at the individuals in it. They are not just recipients of assets. They are recipients of something with history, story, and sacrifice behind it, and they need preparation, education, and clear expectations to step into responsible stewardship rather than being handed something they were never equipped to manage. Protect the Mission Few people think of their family as having a mission, the way every successful business has one, with clear values and a team structure behind it. Yet those same principles apply to long-term family continuity. Worth asking: what is your family together for, beyond consuming? What do you want your family's shared purpose to be across the coming generations, not just the current one?  For some families, that means building generational wealth further; for others, it means expanding their capabilities, or simply serving and blessing more people than any one generation could alone. Why Liquidity Matters More Than You Realize A family can be worth tens or even hundreds of millions of dollars on paper and still be completely unprepared for the cash demands of death, taxes, business transition, debts, and estate settlement. That gap between net worth and accessible capital catches families more often than you would expect. Illiquid assets force a hard choice: sell something you wanted to keep, at exactly the wrong time, or find cash from somewhere else. Consider two children: one wants to keep the family business, and the other does not.  Without liquid capital to equalize the estate between them, the business may have to be sold just to make the numbers work, regardless of what anyone actually wanted, or what years of running that business were worth to the child who stayed. Life insurance plays a liquidity role here, twice over. The death benefit pays into the next generation, ideally into a trust with guidelines rather than directly to an individual. And the cash value on remaining policies stays accessible during your lifetime, available for taxes or settlement needs without forcing a sale. Your Plan Is a System, Not a Stack of Documents Inheritance planning usually fails not because any single document was wrong, but because the pieces were never aligned with each other.  Beneficiary designations override what a will says, regardless of what the will was written to accomplish.  A business operating agreement controls what happens to ownership, regardless of what you communicated verbally to your family or wrote elsewhere.  A trust that was signed but never actually funded, meaning the underlying assets were never retitled into it, protects nothing at all. It sits as a document with no substance behind it. The fix is coordination. Every document, account, designation, agreement, and insurance policy needs to be aligned and speak the same language, so the whole plan works together rather than quietly contradicting itself.  This is also where family wealth planning becomes concrete rather than aspirational: it is the discipline of making sure your intentions and your paperwork actually match, account by account. Too often, parents, guardians and carers discover their rights only when a crisis has already arrived. That is precisely the gap that The Ability Bridges was designed to help close. Launched in late 2025 as a six-month pro bono initiative, The Ability Bridges is a collaborative campaign dedicated to bringing accessible, practical legal knowledge to individuals with disabilities and their families across Hong Kong. The campaign is run in partnership with three community organisations at the heart of the special needs sector — the Love21 Foundation, The Nesbitt Centre, and Sensational Foundation — and reflects the firm's deep commitment to ensuring that access to justice is a right, not a privilege. The campaign has already made a tangible difference. In March 2026, Hugill & Ip hosted an intimate evening at its offices, gathering families, carers, and NGO workers for a focused session on estate planning for families with special needs. Led by Alfred Ip, the discussion tackled the questions that keep parents and carers awake at night — from structuring discretionary trusts to understanding guardianship. Today, the campaign has taken a broader step with a free, community-facing seminar at Café 8 in Hong Kong. Three of the firm's leading practitioners — Adam Hugill, Raphael Wong, and Polly Chu — addressed a distinct area of law that directly affects families living with disability: anti-discrimination protections, divorce and child arrangements, and long-term housing and estate planning.

They're not. Here's the simple distinction: Estate taxes are settled by the estate. The money comes out of the estate before everything is fully distributed. Inheritance taxes are settled by the beneficiaries. The tax bill is tied to what they receive. There's also the state-level reality: not every state has inheritance tax, and state estate taxes can be entirely different from federal rules. That's why one of the first questions we encourage families to answer is: “Which taxes apply in my state, and which apply federally?” When you get the definitions right, you avoid planning in the wrong direction. Federal Estate Tax Exemption 2026 and Why the Rules Don't Stay Put When we recorded this episode, we were in December 2025, and Congress had just changed a tax bill that was expected to sunset at the start of 2026. That shift is a perfect example of why families can't build a legacy plan on the assumption that today's rules will remain tomorrow's rules. Here's what matters more than any single number: tax law can change quickly, and thresholds can move. That's why planning is less about guessing the future and more about building a structure that is resilient no matter what Congress does next. Estate Tax Exemption 2025 vs 2026: Timing Matters A detail that surprises many families is that timing can change what exemption applies. If someone passes away in one year, that year's rules apply. If they pass away the next year, the next year's exemption applies. We don't control the timing of life. But we can control the readiness of our plan. Estate Tax Rate 40 Percent: The “One-Time Loss” That Creates Long-Term Damage A federal estate tax hit can be significant. In our conversation, we referenced how quickly the dollars add up when large estates exceed the exemption threshold. But the bigger point we want you to see is this: It's not just the dollars paid in tax once. It's the generational opportunity cost of losing that capital. When your family loses money to unnecessary taxes, your family also loses what that money could have produced across decades: businesses that could have been started real estate acquisitions that could have created cash flow education and training that could have expanded a child's capacity family philanthropy that could have multiplied impact economic stability that could have protected future generations Bruce tells clients: when the money is gone, you can't make money on that money anymore. That's not just a financial statement. It's a legacy statement. Why Do Estate Tax Planning Strategies Matter Even If You're Under the Exemption Today? This is where most families get lulled to sleep. They see a high exemption and think, “We don't need to worry about estate taxes.” Two realities can make that assumption dangerous: Exemptions can change Your plan changes when one spouse dies Estate Planning for Married Couples vs Surviving Spouse: The Quiet Shift Even if you don't consider yourself “ultra-wealthy,” your planning needs to account for the fact that most couples will not pass away at the same time. A couple may look comfortably under a combined exemption threshold—then one spouse dies and the surviving spouse's position changes. Planning that felt safe becomes exposed. We see this across many areas of tax planning, not just estate taxes. The financial world often treats “married” and “single” very differently. That's why it's so important to build your plan while you still have options, flexibility, and time. How to Avoid Estate Tax Legally With Annual Gifting One of the simplest tools families can use is consistent, intentional gifting. In our episode, we talked about an annual gifting amount of $19,000 per person, per recipient, per year. The specific number can change over time, so always confirm the current annual exclusion with your CPA. But the concept is what matters. Here's why annual gifting is so powerful: It reduces the size of your estate over time It can move assets into the next generation in a planned way It can be used to build capability, not entitlement—if you pair it with purpose and guidance Do I Have to Report Gifts Under 19,000? In many situations, gifts under the annual exclusion amount don't require filing a gift tax return. That's why families like it: it's simple and consistent. Where it gets complicated is when you go above the annual threshold. When Do You Have to File Form 709 Gift Tax Return? If you exceed the annual exclusion amount, you may need to file a gift tax return (often IRS Form 709). Filing doesn't necessarily mean you owe tax immediately. It can mean the gift is tracked against lifetime gifting limits. Your CPA is the right person to guide you on the reporting mechanics for your situation. The takeaway: gifting can be one of the cleanest ways to reduce your estate—especially when you do it proactively and consistently. Lifetime Gift Tax Exemption 2026: Larger Gifts and Long-Term Tracking Beyond annual gifting, there is typically a lifetime gifting framework that tracks larger transfers. This is where families often say, “I'm confused,” and they're not alone. The important part isn't memorizing every detail—it's understanding the two-tier structure: annual gifting can be simple and repeatable larger gifts may require reporting and coordination with lifetime limits Again, this is why we encourage families to coordinate with their CPA and estate planning attorney.
