What happens when ancient philosophical questions about "the good life" collide with modern healthcare regulations?  In this compelling episode of TCNtalks, host Chris Comeaux welcomes hospice leaders Annette Kiser, Chief Compliance Officer with Teleios, and Judi Lund Person, Principal, Lund Person & Associates LLC,  for a deep dive into the regulatory crossroads facing hospice providers. In this episode,  we discuss the FY 2026 Proposed Rule, which focused on implementing the HOPE initiative, and two RFIs (Requests for Information) that were part of it.  Also, discuss how important it is for us in the hospice field to give CMS feedback via these RFIs.  These will impact the Future Quality Measure Concepts for the Hospice Quality Reporting Program, and CMS is asking for input on three concepts for the  HQRP Hospice Quality Reporting Program:- The Challenges of Interoperability,- The Evolving Quality Measures related to Patient Well-Being - Nutrition, including Safe Eating Habits, Exercise, Nutrition, and Activity  appropriate for end-of-life careLast, they discuss a separate RFI related to the Advanced Digital Quality Measurement (dQM) in the HQRP (Hospice Quality Reporting Program) and the data standards of Health Level Seven® (HL7®) and Fast Healthcare Interoperability Resources® (FHIR®).Annette and Judi have a wealth of experience and knowledge.  This is a great listen for staff, leaders, and Boards of hospice and palliative care organizations to become more educated about the tracks being laid with the proposed 2026 Wage Index.  This show is timely and relevant, so join us.Guest:Annette Kiser, Chief Compliance Officer with Teleios Judi Lund Person, Principal, Lund Person & Associates LLC Host:Chris Comeaux, President / CEO of TELEIOShttps://www.teleioscn.org/tcntalkspodcast/navigating-the-future-hope-wage-index-and-cms-quality-measuresTeleios Collaborative Network / https://www.teleioscn.org/tcntalkspodcast

The FTC released two Notices of Proposed Rulemaking (NPR) and an Advance Notice of Proposed Rulemaking (ANPR) that would establish a new Earnings Claims Rule and expand the existing Business Opportunity Rule – changes that according to the FTC's release “would strengthen the agency's tools to curb deceptive earnings claims in industries where they are pervasive: multi-level marketing (MLM) programs and money-making opportunities.” Notably, the proposed Earnings Claims Rule is limited to MLM programs (with different definitions proposed for consideration) and would not cover the gig economy, notwithstanding that the Commission's recent enforcement actions related to earnings claims have not involved direct selling companies. https://www.kelleydrye.com/viewpoints/blogs/ad-law-access/ftc-puts-pedal-to-the-metal-to-release-proposed-rule-on-mlm-earnings-claims-changes-to-business-opportunity-rule-but-republican-commissioners-pump-the-brakes-in-potential-foreshadowing John Villafranco jvillafranco@kelleydrye.com (202) 342-8423 www.kelleydrye.com/people/john-e-villafranco Donnelly McDowell dmcdowell@kelleydrye.com (202) 342-8645 www.kelleydrye.com/people/donnelly-l-mcdowell Robert Ward rward@kelleydrye.com (973) 503 5978 https://www.kelleydrye.com/people/robert-n-ward Ioana Gorecki igorecki@kelleydrye.com (202) 342-8417 https://www.kelleydrye.com/people/ioana-gorecki Subscribe to the Ad Law Access blog - www.kelleydrye.com/subscribe Subscribe to the Ad Law News Newsletter - www.kelleydrye.com/subscribe View the Advertising and Privacy Law Resource Center - www.kelleydrye.com/advertising-and-privacy-law Find all of our links here linktr.ee/KelleyDryeAdLaw Hosted by Simone Roach

In this episode of the Simply Trade podcast, hosts Annik and Andy dive deep into the complexities of global trade, exploring the nuances and challenges faced by businesses navigating the ever-changing international landscape. From China's dairy industry surplus to new regulations on 3D printing technologies, this episode provides valuable insights and actionable takeaways for importers, exporters, and anyone invested in the success of their global operations. Stay informed, stay compliant, and stay ahead of the curve with the Simply Trade podcast. Main Points/Takeaways: 1. China's Dairy Industry Surplus: Declining birth rates and a sluggish economy have led to a surplus of milk products in China, resulting in financial losses for dairy farming companies. This surplus has also impacted imports and led to restrictions on European dairy products, highlighting the interconnected nature of global trade. 2. Proposed Rule on Car Imports from China: The US government is considering a new rule that could impact car imports from China, targeting software and hardware components of Chinese origin. This move raises national security concerns and could significantly affect major automakers like GM and Ford. 3. Regulations on 3D Printing Technology: The US Department of Commerce has introduced robust export controls on advanced 3D printing technologies, particularly focusing on metal additive manufacturing. These regulations extend beyond manufacturing, encompassing technologies like quantum computing and semiconductor equipment, requiring companies to recalibrate their compliance strategies. The saying goes, “Be ready so you don't have to get ready.” The Government of Denmark just advised its people to get ready and prepare for a potential war with Russia. What is the advice that they are being given and how does that jive with reality? Two court rulings have come down in the last week highlighting the criminal overreach by Joe Biden's “AFT”.  First the prohibition against the pistol brace was thrown out by a judge in Texas. Then the US Supreme Court ruled that the AFT overstepped its authority by classifying bump-stocks as “machine guns”. We have a Tech Talk from EOTech for you. Judge Reed O'Connor has issued a ruling in Mock v. Garland vacating the ATF's byzantine rule that effectively bans pistol braces. You know…the same pistol braces the ATF had previously said were perfectly fine and an acceptable firearm accessory. That, of course, was back before the Biden administration waged a war on gun owners, their rights, and companies that make legal products those people want to buy. This comes the same week the decrepit but still rabidly anti-gun president was trundled out of the White House and propped up behind a podium at Everytown's “Gun Sense University” meeting of anti-gun flying monkeys. There the president once again rotely spouted all the same bogus hoplophobic talking points he's been using since first finding himself in the Oval Office in 2021. Judge O'Connor granted the plaintiffs' motion for summary judgement  . . . For the reasons set out above, the Court GRANTS Plaintiffs' Motion for Summary Judgment on the grounds that the Final Rule violated the APA's procedural requirements because it was arbitrary and capricious and was not a logical outgrowth of the Proposed Rule; DENIES Defendants' Cross Motion for Summary Judgment; DENIES Plaintiffs' request for a permanent injunction; and VACATES the Final Rule. More than 130 people are dead after a terrorist attack Friday night at a concert in Moscow. An offshoot of the Islamic State known as ISIS-K claimed responsibility, and U.S. officials said there's evidence to support that claim. Four suspects from Tajikistan were arrested. But Russian President Vladimir Putin instead pushed the idea that Ukraine was involved in the attack, despite the fact that there's no evidence to support it.The Texas Medical Board on Friday released its proposed definition for what would constitute an “emergency medical exception” to the state's strict anti-abortion law. The board left the rule purposefully vague, however. Molly Duane, a senior staff attorney for the Center for Reproductive Rights, explains how the proposed definition could make things even worse for Texas patients and doctors. And in headlines: Monday is the deadline for former President Donald Trump to cough up the $454 million fine he owes in his New York civil fraud case, the Princess of Wales said she's undergoing chemotherapy to treat an undisclosed form of cancer, and indicted former Rep. George Santos said he's dropping the Republican Party to run as an independent for another seat in Congress. Show Notes:Vox: “The battle for blame over a deadly terror attack in Moscow” – https://tinyurl.com/2aup665mTexas Medical Board's Proposed Rule for Medical Exceptions To The State's Anti-Abortion Law: https://tinyurl.com/2ceh2hxaPublicly Comment On The Board's Proposed Rule – https://tinyurl.com/2dpt9zqgWhat A Day – YouTube – https://www.youtube.com/@whatadaypodcastFollow us on Instagram – https://www.instagram.com/crookedmedia/For a transcript of this episode, please visit crooked.com/whataday

Our special guest is Richard (“Rick”) Hackett, former Assistant CFPB Director responsible for auto finance regulation and presently a member of the Board of F&I Sentinel, which supports lender compliance in the auto finance and insurance industry. In December 2023, the FTC announced its final Combatting Auto Retail Scams Rule, otherwise known as the “CARS Rule,” which sets new requirements on the sale, financing, and leasing of new and used vehicles by motor vehicle dealers. This two-part podcast episode repurposes a recent webinar. In Part II, we begin with a discussion of how the Rule impacts the sale of add-on products. We then discuss the Rule's impact beyond motor vehicle dealers covered by the Rule and the Rule's intersection with other laws and regulations, including state law and the FTC's Used Car Rule and Proposed Rule on Unfair or Deceptive Fees. We conclude with a discussion of best practices for auto sales finance companies to help navigate the Rule's new requirements. Alan Kaplinsky, Senior Counsel in Ballard Spahr's Consumer Financial Services Group, moderates the discussion, joined by John Culhane and Michael Guerrero, Partners in the Group, and Brian Turetsky, Of Counsel in the Group.
