For this Overdrive Radio edition, a bit of a special preview of a special report dropping this coming Monday, July 10. It's called “Trucking's State of Surveillance” and follows Overdrive's surveying of our owner-operator, small fleet and company driver readers about remote monitoring- and/or tracking-capable technologies used in the business. We asked readers assess the techs they use -- from smartphones and ELDs to truck and trailer telematics and various permutations of monitoring video cameras -- and rate what's being given up in costs and/or being gained in benefits. Reporting around those results yielded plenty in the way of how working owner-ops and other truckers view how techs are changing the trucking business and culture, as monitoring goes well beyond just fleets today and sits squarely in other business-to-business relationships with brokers and others. But all of that reporting also followed attorney and academic Karen Levy's book "Data Driven: Truckers, technology, and the new workplace surveillance," in which Levy tells the story of trucking during a time of transition, before and after federally mandated electronic logging devices came into play in late 2017. The book leans heavily on in-depth interviews with working drivers, and boatloads of other research besides, including leaning in part on Overdrive's own chronicling of the ELD transition over the last decade and more. Marhoefer and Levy, in this episode, take us back to the initial inspiration for the book with FMCSA's first feints toward an e-log mandate more than a decade ago. All of the time put in. For all the rancor that the ELD mandate engenders, and all the technological intrusiveness it's in some ways enabled, ELDs can play a role in that just-compensation fix. But as Levy has it, they're certainly no panacea, much less any kind of magic safety tool.

This edition of Overdrive Radio picks up where Overdrive News Editor Matt Cole left on in his reporting from mid-late October around truck-involved crash statistics in the four years prior to, and the four years after, implementation of the FMCSA's electronic logging device mandate, which began in earnest right at the end of 2017: https://www.overdriveonline.com/csas-data-trail/article/15301876/crashes-injuries-and-fatalities-up-posteld-mandate As many listeners and Overdrive readers have likely seen, Cole's reporting illustrated clearly the generally higher rates of crashes post-mandate, even considering the 2020 year when statistics were way down with the big decline in motorist highway traffic amid the fear and uncertainty of the early COVID pandemic. So there's a definite correlation between regulatory change in the ELD mandate and those negative safety impacts, but can we really determine there's a cause there? Hard to say, given so many factors go into the cause of any crash, not least among those causal factors the “unprofessional” driving behavior of our four-wheeled friends. Just refer back to the 2020 year noted just earlier for evidence of that. The question of cause and effect around the ELD mandate, though, is certainly a conversation starter for Overdrive's owner-operator audience. Attendant to Cole's reporting, we surveyed owner-operators, and the overwhelming majority feel the mandate has at least contributed to safety-negative effects. In this podcast, hear a variety of viewpoints on the cause-and-effect question, both from contributing reporting from video editor Lawson Rudisll surveying owners about the ELD mandate and any safety connection, or lack thereof, and Matt Cole's own interviews for the broader picture. We can't count Michigan-headquartered small fleet owner Bud Davenport among the majority who see some safety impact from the mandate, exactly. Yet Cole's talk with Davenport is instructive when it comes to the state of play for driver training that other owners feel has been exacerbated by the mandate. In March 2020, you awoke to find that the government deemed you essential or nonessential. Over-the-road (OTR) haulers, or truck drivers, were deemed essential. But as the arrival of healthcare workers was celebrated with fire engine parades, truck drivers were spared recognition and told to shift into overdrive and deal with peeled back restrictions, including letting drivers with learner's permits drive without their Commercial Drivers License (CDL) and changing hours of service guidelines so truckers could drive longer than they would be allowed to otherwise. In other words, truckers were directed to stretch themselves, and not just absent parades, but in a landscape of closed waysides, truck stops, restaurants -- while being told to stay in their cabs when picking up or delivering their cargo. Being a trucker before the pandemic meant choosing a profession under-appreciated by the public. During the pandemic, finite truckers were unfathomably treated as expendable. IN THIS EPISODE. Doc interviews former trucker Jonathan Burger to discuss the state of OTR haulers before the pandemic, at the onset of the pandemic, and now in 2022. Jonathan will talk about OTR haulers access to toilet facilities, restaurants, and places to park when they sleep. In addition, Jonathan will bring awareness to lesser known aspects of trucking including new Electronic Logging Device (ELD) mandates, negative behaviors within the trucker workforce, hazard pay (lack of), and lumpers. Doc and Jonathan consider how government and society might better demonstrate appreciation from truckers - the seemingly forgotten essential workers. ABOUT JONATHAN BURGER. Jonathan Burger has a YouTube channel focused on Second Amendment activism/advocacy. His channel is called Guns N BBQ as he periodically tosses in content about his hobby of barbecuing. He is a former armed security officer and corrections officer turned truck driver. Jonathan drove truck for just over 5 years before going blind. Shortly after losing his vision he decided to start a YouTube channel. Jonathan remains well-connected to the OTR hauler community and understands the lesser-understood nodes along the OTR hauler network. PRE-2020 STATE OF TRUCKING. Jonathan reminds us that the trucking industry had challenges prior to the pandemic. Overnight parking was particularly difficult to find and even booking ahead didn't necessarily secure a spot for the rig. Fewer businesses were allowing truckers to park in their lots due to the poor behavior of some in the industry who would leave behind trash. IMPACT OF 2017 ELD MANDATE. On January 23, 2022, Grace Dean of Business Insider wrote an article titled: Truckers say an electronic device that measures the hours they drive each day sometimes leaves them stranded just 30 minutes from home. While truckers had maintained paper logging records for decades, electronic logging devices went into effect in 2017 for most rigs. The logs track when truckers drive and take breaks, but the system is inflexible. Jonathan offered an example of a trucker taking a break in the parking lot near a warehouse. A few minutes into the mandated break, someone asks the driver to move his truck to the end of the lot, perhaps a hundred feet away. When the truck begins to move, the ELD resets the break. Ultimately, the purpose of ELDs was to prevent fatigued drivers from being on the roads - so ELDs make sense, but in their current incarnation, they seem to be too restrictive. PANDEMIC RELAXED TRUCKING RULES WITHOUT SUPPORT TO TRUCKERS - LUMPERS CASH IN AS DRIVERS TOLD NOT TO UNLOAD THEIR FREIGHT. On March 13, 2020, the US government made an emergency relief declaration that allowed OTR drivers with expiring licenses to continue working, eliminated the 30-minute break requirement during 11 hours driving, and relaxed the 60/70-hour rule. However, neither federal or state governments took action to support truckers. Arizona opened two shuttered waysides with limited hours - so that was at least something. But, no hazard pay for truckers, no National Guard deployed to keep open waysides and supply food, showers, and basic care to truckers. County fairgrounds could have been temporarily opened for truckers, right? There were no hero parades for truckers - even as wait times increased for truckers to unload and they were told to stay in their rigs, cubed away from the world. BROWN BAG BOOST CAMPAIGN. The title of this Overdrive Radio podcast sounds a little like the set-up for an inside-baseball joke of sorts, but for owner-operator Mike Landis and Ezlogz head and former owner-op C.J. Karman, that day was a serious one indeed. Directly and indirectly in a variety of ways, its culimination of the three-week Mayday-begun protest vigil outside the White House has had material effects in terms of getting the conversation going around enforcement and potential enhancement of the 49 CFR 371.3 transparency requirement for brokers when other parties in a freight transaction request it. Here, Landis and Karman nonetheless narrate the story of how the two came to be on the same page in talks over the issue with the White House chief of staff in May 2020. FMCSA recently extended the comment period on three petitions and the transparency regulation in general through November 18. This edition of Overdrive Radio features Overdrive Senior Editor James Jaillet's conversation with Northeastern University academic Alex Scott, who with colleagues at Michigan State and the University of Arkansas completed a recent study around potential safety-sensitive impacts of the electronic-logging-device mandate. The upshot, which you know if you saw the headlines, is that a comparative analysis of various carrier size groups, average weekly crash volumes, and hours of service violations, among others, showed that, while hours violations were down quite a lot for small carriers, there was little change in crash volumes before and after the mandate was being fully enforced in any size grouping. If anything, average weekly crash volume ticked up a bit for those most directly affected by the mandate – the smallest of fleets. It all seemed to lend at least a little further credence to the notion that the mandate, ultimately, might not be about safety at all, also the widely held contention that the hours of service rule could use some work to reintroduce flexibility for professional truckers in how they utilize available hours, within limits. The effects of ELD mandate on Trucker Health & Safety 4-5-18 Thursday 6PM et 347-826-9170 The ELD mandate is causing an uproar among the truck driving community, ELD's are designed to enforce the FMCSA Hours-of-Service rule by synchronizing a vehicle engine to automatically record a truckers' driving time.The purpose is to increase highway safety by ensuring drivers do not drive more than their 11 hour limit or work more than their 14 hours allowed. Although the use of the ELD theoretically sounds like a great way to reduce driver fatigue, prevent employers from pushing their drivers to drive over their hours, prevent drivers from "cheating" on their log books ( to get more miles), and increase overall safety, there are MANY who disagree and believe the ELD mandate works in reverse and is actually detrimental to overall highway safety.  Tonight we'll address opposition to the ELD mandate and discuss why truckers are feeling rushed to beat the 14 hour clock and how it affecting their health and livelihood. Commentary has reflected fairly strong opposition to the mandate by and large, with as much as 85 percent of readers -- in a poll still ongoing at OverdriveOnline.com -- noting they'd do what they could to avoid running with an electronic log of any kind. Half said they'd rather retire or look for another line of work if they couldn't avoid it with the short-haul exception under the hours of service rules or a pre-2000 truck.
