Financial troubles may be one of the earliest signs of a dementia causing disease making this conversation extraordinarily important. From being estranged, overnight, Lianne was thrust into the role of her father's primary caregiver, managing his financial matters with constant threats from her mother, who continued to exploit him. In playing this role, Leanne had a firsthand account of what is sadly a common occurrence – financial elder abuse by family members. Lianne now seeks to change elder abuse laws based on her experience. Through her trials and tribulations, one can identify with some of the key changes that are needed. Most critical amongst them are early diagnosis of cognitive impairments such as dementia and the strengthening of societal attitudes towards the elderly. Warning signs that caregivers should be mindful of include confusion, forgetfulness, inability to manage finances, frequent acts of generosity, and persistent requests from family members for money. Regular checking of bank statements can go a long way in preventing financial abuse of the elderly. Early diagnosis of dementia and other such cognitive impairments is critical to safeguarding the interests of the elderly. Elder Financial Abuse is the fastest growing category of elder abuse, and the numbers are going up every year.  Typically a caregiver or family member works to gain the trust of an elderly person and gains access to financial accounts. In this episode we discuss Red Flags to may point to suspicious activity. We talk about things a person can do if they suspect financial abuse. We also talked about other scams, such as phone scams and online scams. Part of the reason older people are more vulnerable to financial exploitation is because it is more likely that they are isolated and lonely. Frances Simon, my guest and founder of the PSGroup, suggests that even if your loved one lives out of state, that you develop relationships with neighbors and elder support services where they live. A ruling in February 2021, found the two grandsons and JP Morgan liable for abusing their fiduciary duty and making fraudulent misrepresentations. They also found the bank and Evan Schottenstein liable for elder abuse. Newly retired Deputy District Attorney Paul Greenwood was a lawyer in England for 13 years. After relocating to San Diego in 1991 he passed the California Bar and joined the DA’s office in 1993. For twenty two years Paul headed up the Elder Abuse Prosecution Unit at the San Diego DA’s Office. In 1999 California Lawyer magazine named Paul as one of their top 20 lawyers of the year in recognition of his pioneering efforts to pursue justice on behalf of senior citizens.He has prosecuted over 750 felony cases of both physical, sexual, emotional and financial elder abuse. He has also prosecuted ten murder cases, including one death penalty case.In March 2018 Paul retired from the San Diego DA’s office to concentrate on sharing lessons learned from his elder abuse prosecutions with a wider audience. In October 2018 he was given a lifetime achievement award by his former office.Paul now spends much of his post retirement time consulting on elder abuse cases and providing trainings to law enforcement and Adult Protective Services agencies across the country and internationally. Listen to our newest episode as Dr. Peter explains what financial exploitation is for seniors.Meet Dr. Peter LichtenbergPeter A. Lichtenberg, Ph.D., ABPP is the Director of The Institute of Gerontology and the Merrill Palmer Skillman Institute. He is also a Professor of Psychology at Wayne State University. He received his bachelor’s degree from Washington University in St. Louis, and his master’s and doctorate in Clinical Psychology from Purdue University. After his internship he completed a post-doctoral fellowship in geriatric neuropsychology at the University of Virginia Medical School where he also became a faculty member. A clinician and researcher throughout his career Dr. Lichtenberg, one of the first board certified Clinical Geropsychologists in the nation, has made contributions to the practice of psychology across a variety of areas including in Alzheimer’s disease, medical rehabilitation and with those suffering from late life depression. He is particularly interested in the area of intersection between financial capacity and financial exploitation; finding ways to balance autonomy and protection for older adults. His work in this area led him to be a contributor to the 2008 Assessment of Diminished Capacity of Older Adults: A Handbook for Psychologists published jointly by the American Bar and American Psychological Associations. In 2013 he published the first nationally representative study on predictors of older adult scam victims. In 2015 he published the Lichtenberg Financial Decision Making Rating Scale, and the Lichtenberg Financial Decision Screening Scale, and has contributed several empirical studies on the scales since then. These tools can be used to assess major financial decisions and/or transactions of older adults. The exploitation of their Aunt Huguette by her professional advisors and caregivers horrified the Clark family. By the time she passed away in 2011 at age 104, Huguette's attorney, accountant and medical caretakers had manipulated her out of nearly $40 million. The 2013 book, Empty Mansions, told some of the story. Determined to bring good from a terrible situation, the Clark family resolved to protect vulnerable elders across the country. In 2018, multiple generations of the Clark family—descendants of Huguette's father, Senator William A. Clark—established the Huguette Clark Foundation to protect vulnerable seniors and hold accountable those who abuse them. Ian Clark Devine is a long-time leader in nonprofit and foundation management. He is a great-grand-nephew of the late Huguette Clark, whose financial exploitation sparked his interest in the protection of elders. Elder abuse affects millions of people across all socioeconomic levels. Isolation, mental illness and dementia exacerbate the problem by making elders even more susceptible to those who would exploit them. With some 10,000 Americans reaching age 65 every day and life expectancies lengthening, elder abuse is a societal concern that could be on the rise for decades. The phone rings, and we recognize the number on the Caller ID. The caller id shows that it is a local business, a neighbor down the street, or even the consumer’s own name and number. Because the number is known or familiar, the consumer answers the phone.“Unfortunately, technology has evolved, and we can no longer fully trust that the number displayed is the number that is actually calling us,” said Attorney General Hood. “Our advice has always been to answer only those calls from known numbers, but that won’t work when the caller identification has been spoofed, or is displaying incorrect information.”Mississippi joined other states in 2010 to enact the Caller ID Anti-Spoofing Act (2010 Miss. H.B. 872) to regulate and prohibit caller ID spoofing. However, the Fifth Circuit Court of Appeals found that the scammers had a first amendment right to spoof phone numbers and upheld the legality of “non-harmful spoofing” in 2012 when it overturned the state law.The Attorney General’s Office offers the following information and tips to follow on these types of scams:DO NOT answer the phone for a call that shows it is from your own number. That is a sure sign of a scam.REMEMBER THAT THE CALLER ID CAN BE MANIPULATED. Don’t completely rely on what appears on the screen. Scammers use technology that lets them display any number or organization’s name on your screen.HANG UP as soon as you realize the call is a scam. Even answering simple questions in the affirmative or negative could be used to try to scam you.BE SUSPICIOUS of anyone who is vague in identifying themselves on the phone.NEVER WIRE OR SEND MONEY in any form to persons or organizations you do not know.DON’T CALL THEM BACK. If you receive a voice mail message, do not call the scammer back.GUARD YOUR PERSONAL INFORMATION. Do not provide bank account, credit card or Social Security numbers to anyone calling you over the phone. Giving out personal information out could cause you to become a victim of identity theft.DON’T BE INTIMIDATED BY THREATS OF ARREST. Scammers may try to intimidate you by threatening to bring in local police or other law-enforcement groups to have you arrested. Don’t believe them. Elder Financial Abuse.  It is a dirty, disgusting term that makes most normal folks cringe at the thought of such a thing.  The sad fact is, it is out there...in your community...maybe in your own family...in so many forms and in so many paces, many consider it an epidemic.  Go figure that. This week, I am privileged to have Barbara-Anne Foley, Executive Director of the Harwich Council on Aging, as my special guest to help address this subject.  In addition to her many duties in this important role, she has been able to leverage her experience with thousands of seniors and the stories they have told about financial abuse, by working with in partnership with the Harwich Police Department, trying to warn seniors about these frauds and scams. For those of you who do not know her, Barbara-Anne began her career in mental health and career counseling in Braintree, MA.  She also worked in an adult day care center and a nursing center on Cape Cod before landing her dream job with the Harwich Council on Aging in 1999.  She can be reached there at (508) 430-7550. She has developed a primary focus on Alzheimer's disease and hoarding, both population of which are growing in leaps and bounds. In 2006, when her own father lost his 10 year battle to Alzheimer's disease, she and her family started the "Remembery Walk ---Dave Birtwell Memorial", raising over $150,000 to date for Alzheimer's patients and their families.
