Patricia De Fonte is an estate planning attorney and the founder of De Fonte Law PC, a boutique estate planning firm that works with clients over Zoom all over California. She started the firm to offer what she thinks of as estate planning with heart. She wanted to create a better experience for her clients to preserve family harmony, empower their heirs, and thoughtfully reflect their values. I'm excited to introduce this week's guest, Doug Noll. Doug was born with multiple disabilities: he had both audio and visual disabilities as well as two club feet. After struggling with sports in school, he turned to Scouts and the outdoors and started to thrive. Doug is a whitewater guide, Level III PSIA ski instructor, sailor, and fly fisher. He has also been a rock climber, mountaineer, competitive swimmer, and Class IV kayaker. His various outdoor adventures have taught him discipline, persistence, patience, mental endurance, and fortitude, which he applies in his career as a peacemaker and mediator. In this episode, we discuss Doug's adventures, how he overcame his disabilities to thrive in the outdoors, and what he's learned over the years.   About Doug Noll Douglas E. Joel's award-winning film, Sonic Sea tackles the inordinate amount of noise under the water in our oceans that are literally killing marine life, like whales. Joel and Mark also discuss Joel's philosophy and practice in going the distance for huge environmental battles like defending Bristol Bay from the proposed Pebble Mine.NRDC's principal institutional representative in the West, Joel Reynolds joined the organization as a senior attorney in 1990, after a decade with the Center for Law in the Public Interest and the Western Center on Law and Poverty, both in Los Angeles. Since 1980, he has specialized in complex law-reform litigation, arguing cases on behalf of environmental and community groups at all levels of the federal courts, including the U.S. Supreme Court. He has also led several of NRDC's largest campaigns: to preserve the birthing lagoon of gray whales in Baja California; to protect the California State Park at San Onofre; to reduce underwater noise pollution that threatens ocean wildlife; and, most recently, to halt the construction of the environmentally destructive Pebble Mine in Alaska's Bristol Bay. He has twice been selected California Attorney of the Year in the environmental category. From 1986 to 1990, Reynolds was an adjunct professor at the University of Southern California Law Center. Since 2012, he has served as chair of the Tejon Ranch Conservancy, one of California's largest land trusts. His articles and editorials appear frequently in the Los Angeles Times, the Washington Post, the Christian Science Monitor, the Huffington Post, and other major media outlets. When putting together this episode of the podcast, I reflected on what my late husband and I had said we wanted for our children when they became adults. We wanted them to be happy, healthy, and able to afford the toys they would want to buy. If no debts, notes or mortgages were acquired by the nonexistent trust, then it is basic black letter law that if no money or property (tangible or intangible) has been entrusted to the trustee, there can be no valid entity calling itself a trust that exists as a legal person. Patricia Rodriguez will discuss why lawyers, servicers, trusts, and other parties have been unable to demonstrate they have consulted with the investors.   Even in modification situations, Neil Garfield states, that in all his years of practicing foreclosure defense, he has seen no evidence that there was any contact with the owner of the debt when a homeowner is told that the investors turned down the offer to modify. Rodriguez will provide her analysis of modification fraud- which tracks wrongful foreclosure but raises the fraud to an entirely new level, and what changes she sees occurring in foreclosure defense.
