This Day in Legal History: 13th Amendment PassedOn January 31, 1865, the U.S. Congress passed the 13th Amendment, formally abolishing slavery in the United States. The amendment declared that "neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction." While President Abraham Lincoln's Emancipation Proclamation had freed enslaved people in Confederate-held territories two years earlier, it lacked the permanence of a constitutional amendment. The House of Representatives passed the measure by a vote of 119 to 56, narrowly reaching the required two-thirds majority after intense political maneuvering. The Senate had already approved it in April 1864. Ratification by the states followed, culminating in its adoption on December 6, 1865. The amendment marked a legal end to slavery, but systemic racial discrimination persisted through Black Codes, Jim Crow laws, and other restrictive measures. Despite this, the 13th Amendment laid the foundation for future civil rights advancements. Its passage was a key victory for abolitionists and a defining moment of the Civil War's aftermath. The amendment's "punishment for crime" clause later became a subject of controversy, as it allowed convict leasing and forced labor in prisons, disproportionately affecting Black Americans. In Berkeley Talks episode 200, Gigi Sohn, one of the nation's leading public advocates for equal access to the internet, delivers the keynote address at the UC Berkeley School of Information's 2024 commencement ceremony. “I'd like to share with you some of the twists and turns of my professional journey as a public advocate in the world of communications and technology policy,” Sohn began at the May 18 event. … “I'm hoping that by sharing my story, you'll be inspired to keep choosing the path that you know is right for you and for society, even if it sometimes comes at a cost.”Sohn began her story in the late 1980s, when she started a career in communications law. It was through this work, she said, that she learned the importance of media to a healthy democracy. “Those with access to the [communications] networks influenced the debates that shaped public policy and decided elections,” Sohn said. “Those without were simply perilous. Gigi Sohn is an attorney and public advocate. She's served on the FCC in the past, and when she was nominated by Joe Biden many of us were thrilled. She's been a leader, especially when it comes to issues like Net Neutrality, for many years. A right-wing smear campaign followed her nomination, and after three hearings, each more absurd than the last, she had to withdraw. It's tragic she's not currently at the FCC, the good news though, she has a new project that dare I say is pretty exciting. Tech policy wonks, rejoice!

Alfred Ng over at Politico reports that the police can obtain Ring camera footage without your permission. All they need is a warrant. But don't worry – they will be nice. They will call you instead of knocking on your door. If you don't give them the footage, Ring will also contact you. If you still don't give them the footage, well, I don't know about you but I wouldn't want to find out what happens after that! And getting a warrant is the least intrusive way to gain access. San Francisco recently passed an ordinance allowing police access to live Ring camera footage. – Should the U.S. ban TikTok in the U.S.? The younger you are, the more likely you are to say, “No.” But lawmakers across the aisle want the app banned, citing security and propaganda concerns about the fact that its parent company, ByteDance, is based in China, and China has way more control over its corporations than the U.S. But in yet another deadlock in Washington, the Biden administration hasn't acted, the Commerce Department hasn't acted, and neither has Congress. The Committee on Foreign Investment in the U.S. (CFIUS) has engaged nine agencies in an investigation, but it has taken years to get that completed. Federal Communications Commission board nominee Gigi Sohn appeared at a Senate committee hearing for the third time on Feb. 14. She was met with strong opposition from Senate Republicans. A poll from the American Principles Project shows the culture war is going to be a critical battleground in 2024. It shows Republican voters in the presidential primary are most likely to support candidates tackling things related to critical race theory and gender ideology. The Federal Communications Commission (FCC) is currently short a commissioner, and the Biden Administration and Senate Democrats just can't seem to get that seat filled despite having nominated an amazingly qualified person. Her name is Gigi Sohn. The inability to get Gigi confirmed at the FCC has left the commission deadlocked with two Democrats and two Republicans. That means the commission in charge of regulating all telecom in the United States, including how you get your internet service, is unable to get much done. The Biden administration can't accomplish some of its biggest policy priorities like rural broadband and restoring net neutrality. President Biden first nominated Gigi Sohn to the FCC over a year ago, but the full Senate vote to confirm her just hasn't happened.
