For the last episode of the year, we are returning to the Aurora Municipal Office to unpack the ongoing effort by the Aurora City Council to disband the Public Defender Office. This time, Hunter is joined by the new Chief Public Defender, Elizabeth Cadiz. Over a long career in the office, Elizabeth has seen the incredible corruption and Constitutional violations. Over the last year, she helped to orchestrate an amazing challenge to the city attorney's office pattern and practice of discovery violations. The NS Mass Casualty Commission issued an update this week on their progress, as we approach the March 31st (extended) deadline for their report. I review the update, and a talk with St. F.X. students I will be giving this week. Small Claims Court Adjudicator, Tuma Young K.C. issued a decision this week in the Mi'kmaw language. In doing so, he referenced the Mi'kmaw Language Act which was passed last year, and which enshrined Mi'kmaw as Nova Scotia's 'first' language. The devolved Scottish Parliament in Edinburg is attempting to pass gender recognition legislation that is generating major controversy and push-back in the UK. Canada has been cited as an example by the governing SNP of how such legislation might operate. British Columbia is starting a three-year pilot project, with the approval of the federal government, to legalize the possession of up to 2.5 grams of hard drugs, in an effort to treat the issue as one best primarily dealt with as a public health matter. I discuss how this is expected to work, and why it does not directly address the main cause of the thousands of deaths this policy is designed to prevent. Finally, I review two cases released by the Supreme Court of Canada last week dealing with Charter challenges to the validity of mandatory minimum sentences in cases involving gun violence. The defendants claimed that reasonable hypothetical situations showed that the mandatory minimum sentences amounted to cruel and unusual punishment. The Court agreed in one case but not in the other. I explain why, and why some may prefer Justice Cote's dissenting opinion in the one where the Court struck down the law.

This week in Canadian law, the Emergencies Act Inquiry looked at the protests that were taking place at the Ambassador Bridge in Windsor, ON, as well as those at Coutts, Alta. In both cases, evidence presented seems to show that both protests were disruptive, but that the Emergencies Act was not necessary to deal with them. Also during the Inquiry, one of the lawyers collapsed in the middle of questioning a witness. I discuss how a lawyer needs to be physically ready for court in order to be mentally sharp when it matters. This week the Supreme Court of Canada upheld a mandatory minimum sentence for a woman convicted of importing nearly 2kg of cocaine through the Toronto Pearson Airport. This broke something of a trend of courts striking down Harper-era legislation on sentencing. The SCC said that it was up to Parliament to make changes to this legislation, as it did not offend the Charter as it was applied here, despite the accused being an Ojibwe woman and the issue of overincarceration of indigenous offenders. Next, I review C-11 and C-18, both of which deal with online content regulation in Canada. C-11 would allow the CRTC to regulate user-generated content, and C-18 would restrict how news articles are shared on social media. Combined, these Bills would restrict freedom of expression online, and are not an appropriate response to revenue issues in the traditional media landscape. Finally, I review a criminal case out of the NS Court of Appeal, where the Court reviewed how apologetic text messages sent after an alleged sexual assault may be used in a trial. It is not correct to have "repetition enhance credibility" but okay where the content amounts to an "admission".
Today, Hunter sat down once again with Doug Wilson, Chief Public Defender in the Aurora Municipal Public Defender Office, to discuss what has unfolded in Aurora, Colorado over the past year. Often, people will ask the question, “Why do you think we don't fund Public Defender Offices the way we should?” While there are many potential answers to that question, this episode highlights one of the most important ones: Policy makers have an exponentially more tough time incarcerating people when there is a zealous advocate both in and out of the court room for the rights of the accused. Starting back to last year, the Aurora Public Defender Office has been instrumental in highlighting the misconduct and illegal activity of the prosecution and police of the city. At the same time, the city council marched on towards its mission to incarcerate as many people as possible in a misguided effort to make their community safer. At every step of the way, Doug and his office have been pushing back against the city's goals. Now it seems, the city is tired of the pushback. A lot of the debate on criminal justice reform focuses on mandatory minimums. What are they and why do people — including us — think they’re unfair? Simply put, anyone convicted of a crime under a “mandatory minimum” gets at least that sentence. The goal of these laws when they were developed was to promote uniformity; it doesn’t matter how strict or lenient your judge is, as the law and the law alone determines the sentence you receive. Regrettably, the adoption of mandatory minimums has not led to a fairer system. In fact, it's had the opposite effect. The federal government’s new Bill 22 repeals some of the offences that currently carry mandatory minimums, but it leaves quite a number still in place. Meghan McDermott says that any imposition of sentencing requirements on judges leads to problems with systemic racism within the justice system. The reason why this matters is the cancellation of valid issued certificates is contrary to the purpose of Order in Council, and makes compliance more difficult. Hundreds of Canadians receiving these notices decided to exercise their legal right to a hearing to have the issue referred to the Provincial Court. The issue in part is that notices claim that the certificates are nullified, but there is no such thing as nullification according to the law. At the hearings, the government is taking the position that as the certificates were nullified (a term made up by the Registrar), the applicants are not even entitled to a hearing. Some applicants were successful in overcoming this hurdle, others were not. A group of unsuccessful S74 applicants are now looking to fund an appeal to the Superior Court of Ontario challenging the dismissal of their applications. The appeal will concern whether the Provincial Courts used a fair and legally valid process to deny the applicants a full fair hearing on the merits. While this type of hearing process has received a lot of heated discussion within the gun community, the fundamental purpose of this type of hearing is to hold the government decision makers accountable and prevent them from making up their own rules and running roughshod over peoples rights in a clear disregard for the principle of Procedural Fairness. If the Registrar and the Canadians Firearms Program are able to avoid scrutiny of this most recent action simply by ignoring the actual regulations and using wordplay, the implications for all Canadian firearms owners is dire, leading potentially to jeopardizing any future ability to challenge government overreach. The immediate need is to appeal to the Superior Court of Ontario for two recent dismissals. We need to hit our fundraising target ideally by Feb 10, 2021 so that appeal notices can be filed with the court during the appeal window. In this type of action, able counsel is required. Ed Burlew, one of Canada’s most notable and experienced attorney’s in the area of firearms has agreed to handle the appeals and is confident they will be successful. We recognize this is not the main fight - The most important battle is the one going on in Federal Court to strike the Order in Council. However, this is still an important challenge to make and will help protect Canadian firearms owners from even more erosion of our already tenuous rights. It’s also a complimentary action to the Federal Challenges as any evidence, testimony or findings against the government are being shared with several attorneys involved at that level and may prove useful in the grander scheme. You can read the different sections of the First Step Act to see why Jeff Sessions is not given unprecedented or unaccountable power. Recently, the Brennan Center for Justice, a former opponent has indicated that they are likely to support the new compromise legislation. Distance matters and this article is a good summary of the evidence for why visitation and distance are critical to better prisoner outcomes. The Mandatory Minimums quote came from this great article by Erik Luna. The Sentencing Reform and Corrections Act included new mandatory minimums. The Department of Justice Letter opposing the First Step Act was almost as shocking as Senator Grassley's response. My friend Jason Pye and his co-worker Sarah Anderson at FreedomWorks wrote a very detailed response to the DOJ letter. Here is a great summary of the problems with electronic monitoring. I do not think that John Pfaff has written an article about privatization but I have had many conversations about this issue on Twitter.

A company asked me to review their documentary (Incarcerating US) but it was basically half baked propaganda about prisons, mandatory minimums, and the evil that is justice in the US. So I decided to tear the doc a new one. “How come you don't attack conservative propaganda, Runge?” Because that wouldn’t balance the world we live in: Anything remotely critical of African Americans: racist; must be in KKK Anything anti-abortion or anti-birth control: sexist; must hate women Anything pro-gun: you must sleep with a rifle and adore mass shootings. Anything that even hints at taxing the rich less: Ok district 1, tell us if you ever come to reality. This is the emotionally incompetent PC culture we live in i.e. 90% of what we find on Reddit, Imgur, twitter, and the news. If the pendulum ever swings back (which it might) and I have 1dimensional conservative/right wing arguments shoved down my throat day in and day out, I’ll crucify that simplistic moronicism, but that’s not the world we live in.
