An arbitration panel has ruled in favor of Alex Rodriguez and Marc Lore, allowing them to proceed with their acquisition of the Minnesota Timberwolves and Lynx. This decision concludes a legal dispute with the current owner Glen Taylor, who had attempted to halt the sale by alleging missed payment deadlines. The duo dives into the realm of college athletics with a significant movement underway... over 250 current and former athletes have opted out of the proposed House v. NCAA settlement. These athletes are voicing concerns over issues such as gender equity, antitrust implications, and roster limitations. The NIL hour duo also discusses the potential appointment of a College Sports CEO—a role envisioned to navigate the complex terrain of modern collegiate athletics. In this episode, we delve into the implications of these developments, analyzing how the arbitration ruling could set new precedents in ownership, the potential ripple effects of athletes' mass exodus from the NCAA settlement, and the envisioned role of a College Sports CEO in steering the future of collegiate athletics. What are your thoughts?***Have a topic you want to write about? Show Notes:  https://wetflyswing.com/626 Presented By: Yellowstone Teton Territory  Bruce Staples, author of multiple books on fishing in the Yellowstone area, is back to take us to the East Idaho Fly Tying Expo. You'll find out what you can expect for the next one in 2025. You'll also get some of the best flies for fishing in Yellowstone Country and a little insight into Sheridan Lake and other lakes around the country. You'll also hear about some of Bruce's favorite books and the people you should follow this season. Episode Chapters with Bruce Staples on the East Idaho Fly Tying Expo Planning a large fishing event is no easy task. I've planned smaller trips and schools that have required considerable effort, and it's hard to imagine what planning a fly fishing tying expo would be like. Bruce Staples did just that and has brought back and created one of the biggest fishing expos of its kind. 2024 East Idaho Fly Tying Expo  03:18 - Bruce says that the 2024 East Idaho Fly Tying Expo was a huge success with a massive crowd and fly tyers from all over, even Florida and Ohio. They had around 40 commercial vendors and kept the same layout from 2023. 05:09 - For 2025, they plan to start prepping in September. They've signed a three-year contract with the Mountain America Center that will end in 2025. Bruce said they will likely renew because the center is a great venue. It is used for many community events, including hockey games by the Spud Kings, concerts, and basketball tournaments. Books by Bruce Staples  08:39 - Bruce first started writing in the 1990s. His first three books were done for Frank Amato Publications: Snake River Country: Flies and Waters (1991) Yellowstone Park (1996) Trout Country Flies: From Greater Yellowstone Area Masters (2002) Later Works: Flies for the Greater Yellowstone Area Fly Fishing the Greater Yellowstone Backcountry Fly Fishing West Yellowstone: A History and Guide 12:30 - Bruce shared how "Fly Fishing West Yellowstone: A History and Guide" came together. He teamed up with Bob Jacklyn, who provided valuable historical insights and photos. Craig Mathews also contributed his expertise. Check out our episode with Bob here and with Craig here! 21:05 - Bruce shared some hidden fishing spots from his "Fly Fishing the Greater Yellowstone Backcountry" book. 28:32 - Bruce discussed fishing at Eagle Ridge Ranch. The owner, Frank VanderSloot, is a prominent figure in Idaho known for founding Melaleuca, a wellness company. 34:15  Sheridan Lake is a moderate-sized lake offering good fishing. Fishing techniques include using midges, snails, leech patterns, and streamers, which are especially effective in the fall. More About The East Idaho Fly Tying Expo 38:20 - There are also workshops and demos by expert flytyers like Steven Fernandez and iconic figures like Mike Lawson. There are tying workshops, commercial vendors, and an annual banquet with a live auction. 48:31 - Bruce talks about the exciting plans for the 2025 event. The website will soon have info on vendors and activities starting in February. Many participants from 2024 will return because it was a success. Show Notes:  https://wetflyswing.com/626

Edgar and Barry Award finalist Mike Lawson resumes his beloved Joe DeMarco series with a pulse-pounding thriller starring the Washington DC “troubleshooter” as he tries to pin down a Boston billionaire soaring at the top of the world in KINGPIN (Atlantic Monthly Press). As evidenced by his ever growing Boston empire, Carson Newman doesn't usually get his hands dirty. Joe DeMarco, on the other hand, is paid to do that, and by the former Speaker of the House, John Mahoney. Brian Lewis, an intense workaholic interning for Mahoney, has been found dead in his apartment, purportedly from a drug overdose. But Brian never showed signs of drug use prior to his death, and he coincidentally seemed to be on the cusp of releasing a report identifying a group of politicians who had taken bribes to help dismantle a recent bill. Brian's mother is convinced that her son was murdered because of what he'd learned. While DeMarco reaches a similar conclusion, all evidence only points to the sheer impossibility of a murder ever having happened: a locked door to a thirdfloor apartment with locked windows and no fire escape ladder, and no defensive wounds on Brian's body. In a city full of shadowy agreements and duplicitous deals, DeMarco will soon learn that to get to the bottom of Brian's death, he'll have to look at people perched at the very top of the world. MIKE LAWSON is a former senior civilian executive for the US Navy. He is the Edgar Award nominated author of more than fifteen novels starring Joe DeMarco and three novels with his protagonist Kay Hamilton. For more info on the book click HERE

You probably know Beardbrand and its founder, Eric Bandholz. Beardbrand rose to prominence in the ecommerce landscape as they built a YouTube channel with over a million subscribers, thereby powering their customer acquisition with basically zero investment in paid marketing channels. But as the impact of their organic efforts began to fade in 2022 and into 2023, Bandholz and his team decided that they needed to crack the code on Meta Ads. The problem? This channel had never been successful for them before. So when Bandholz reached out to me to see if I could be any help as they handed the keys to a talented but green (as far as paid social is concerned) team member, Mike Lawson, I suggested he come on the podcast and build a plan from the ground-up, complete with screenshares of their actual Meta Ads account. In this episode, you'll learn exactly how I'd build an ad account almost from the ground-up centering on a consolidated, broad-targeted, Bid Cap strategy, and you'll even get a follow-up a month after our initial recording to see how their efforts were going. Does the NCAA actually want to change their model?? Welcome back to the intersection of sports and the law! On this episode of Conduct Detrimental: THE Sports Law Podcast, Dan Lust (@SportsLawLust) is joined by Mike Lawson (@MikeSonofLaw) is and Tarun Sharma (@tksharmalaw) to discuss the latest surrounding the NCAA. FSU gets snubbed from the College Football Playoffs. (2:00) FSU had an undefeated season and was ranked 4th going into the conference championship season. However, they ultimately fell to 5th place and Alabama took over the 4th place following their upset over Georgia. Florida Senator Rick Scott sent a demand letter to the committee for texts, emails, notes, etc. regarding their decision to snub FSU. Governor Ron DeSantis also stated that the state budget would put aside $1M for a possible lawsuit for FSU being left out of the playoffs. We break down the potential lawsuits that may emerge and analyze the CFP selection committee's decision to drop FSU. During halftime of the Texas v. Oklahoma State football game, two participants competed in a halftime game in which they had to throw footballs into a target. (4:21) After video replay evidence, and a viral tweet by Dan Lust, Dr. Pepper has agreed to award both halftime participants with tuition scholarships due to an incorrect determination of the winner. The NCAA is proposing a new subdivision conference where the "haves" can make up their own rules, and the "have nots" will sit on the sidelines. (34:59) NCAA President Charlie Baker released a proposal in which a new subdivision of college athletics which school can opt-in to. The schools that opt-in would be based upon the financial status of the schools, and the schools within the subdivision would be able to create their own new rules regarding scholarships, recruiting, NIL, and more. The biggest thing would be that these universities would be able to enter into NIL deals with their own student athletes. This may show that the NCAA is willing to adapt to the times, but there is still a long way to go. *** Have a topic you want to write about? Happy Wine Wednesday, Pitches! Sheena joins me this week to discuss a beloved show that was cancelled far too soon - Pitch.  We unpack the pilot episode of the show and work through some of our salty feelings about this fantastic series only getting one season. We kick off by discussing our introduction to Ginny Baker - portrayed by the amazing Kylie Bunbury - and the use of sports commentary to help us get acquainted with the glass ceiling smashing pitcher and the world in which she is making her debut as the first woman to be called up to a Major League Baseball team.  Next, we get into memorable character introductions outside of Ginny.  We talk about the influence and abuse of her father Bill Baker (Michael Beach).  We discuss Amelia (Ali Larter) as Ginny's no nonsense agent and we swoon over Blip Sanders (Mo McRae). We share our thoughts on what worked well in the pilot and whether there was anything we would have done differently.  And as always, you know we got into our thirsty thoughts inspired by this very hot cast.  Friendly reminder: we drink, we know things, we use adult language, and we have a great time. Thanks so much for listening! Dan Lust, Justin Mader, and Mike Lawson break down this jam-packed week of sports law storylines as some of the most prominent athletes, movies, and networks made significant motions. Welcome to THE Sports Law Podcast! We keep you informed on everything at the intersection of sports and the law. Michael Oher, Super Bowl Champion and inspiration for the critically-acclaimed movie, The Blindside, filed a legal petition against his “adoptive parents” this Monday in Tennessee (3:14). Dan (@SportsLawLust) and Justin (@MaderLaw) dive into the specifics of the accusations and share the history of how we got here from the beginning.  “Our baseball guy” Mike Lawson (@MikesonofLaw) gives us the latest on Tampa Bay Rays' young superstar, Wander Franco's recent allegations. (17:00). Mike tells us why Franco may have played the last game of his MLB career at just 22 years old. Dan then gives an update on the Pac-12 exodus and the four teams that still seek refuge in another conference (23:23). Dan and Justin share their thoughts on why the ACC said no to some of these schools and where they will end up.  As we discussed last week from a Barstool perspective, Penn Entertainment has dropped Barstool Sports and picked up ESPN for their next sportsbook, ESPNBet (35:33). Justin and Dan dive into what this means for the sports betting market and ESPN, as a whole.  Finally, the two wrap up the episode with a discussion of the seemingly never-ending drama from James Harden (49:30). He may be on his way out of Philadelphia already and Dan discusses the legal possibilities behind this.  *** Have a topic you want to write about? Rutgers finished the season with a modest 19-15 record and ended up losing to Hofstra in the first round of the NIT tournament. Ja Morant was issued an 8-game suspension by the NBA. (7:25) Morant had been taking some time away from the Grizzlies to receive counseling following the incident where he flashed a gun on his Instagram while he was in a club. We discuss the comparable suspensions related to other conduct detrimental. Most notable was the Gilbert Arenas suspension for bringing a gun into the Wizards locker room that resulted in a 50-game suspension. We also compare this situation to the 8-game suspension that Kyrie received. Some updates in the James Dolan and MSG v. New York State Liquor Authority. (20:40) The State Liquor Authority ("SLA") hired a private investigator to look into the actions being taken by MSG (using facial recognition technology to restrict access to any venue if they are associated with a law firm with active litigation against MSG) violates the liquor laws, thus possibly resulting in a loss in their liquor licenses for those venues. These would include Madison Square Garden, Radio City Music Hall, and Beacon Theater. The SLA investigator claims that he was being followed for more than 100 miles and outside of his house taking photos. When the NYPD pulled over the vehicle later, it was reportedly a private investigator hired by MSG. MSG acknowledged they hired the PI and that it was "common and legal practice" to do so. Dolan and MSG filed an Article 78 claim in Manhattan claiming several actions against the NYS Liquor Authority seeking a preliminary injunction from any violations. Rumors surfaced of Aaron Rodgers being traded to the New York Jets. (33:50) Not so fast, it is apparent that the Packers are demanding a higher price and it is not a done deal yet. Rogers took to the Pat McAfee Show and Barstool to discuss his plans for the future and has made it known that he will be playing for the Jets in 2023. Rogers further went on to state that he has a very tight circle and NFL reporters do not know any information related to his camp. Joe Mixon's sister and her boyfriend are being charged in connection with the teenager who was shot outside of Mixon's residence. (40:25) The prosecution held a press conference stating that Lamonte Brewer is facing four charges including felony assault for shooting Mixon's neighbor. Video evidence shows Shalanda Mixon picking up the shell casings and leaving in a vehicle with Brewer. Shalanda is also being charged with obstruction of justice and tampering with evidence. The video also shows that Joe Mixon had a weapon on him but did not draw or fire that weapon. The prosecution stated that they will not be filing any charges against Mixon because he was lawfully in possession of his own weapon. Mixon claims to have had a recent influx of death threats on social media. Dan Snyder is moving closer to a record sale of the Commanders. (46:51) However, Goodell appears to be receiving an extension on his contract that is set to expire in 2024. Could the final push of Goodell getting Snyder to sell seal the deal for the owners to vote on an extension for Goodell? *** Have a topic you want to write about? The Dans are back in action joined by Mike Lawson to bring you the latest at the intersection of sports and the law. Robert Sarver has stated his intent to begin the process to sell the Phoenix Suns and Mercury. (2:18) Minority owner Jahm Najafi called for the sale of the Suns. NBA players have expressed their desire for the NBA owners to put it to a vote to remove Sarver as owner. However, Sarver took it upon himself to start the process of selling the team, which is estimated to be worth $1.8 billion. Aaron Judge is standing on the steps of history. (19:50) Judge is one homerun away from tying the American League single-season homerun total of 61 homeruns, which was set in 1961 by Roger Maris. We took to the case law textbooks of Baseball and the Law (@BaseballandLaw) on page 891 which is Popov v. Hayashi. This case was the aftermath of the MLB homerun single season record of 73 homeruns set by Barry Bonds in 2001. Popov initially caught the 73rd homerun ball and it was knocked out of his hands and Hayashi ultimately ended up with the ball. A California judge ruled that they each shared an undivided share in the possession of the ball and were to sell the ball and split the proceeds. As Judge approaches history, keep a keen eye out for who ends up with possession of number 62. Oakland Raiders relocation lawsuit has come to a halt. (36:48) California Judge rejects Oakland's appeal in the relocation lawsuit. The California court of appeals rejected the theory that the city of Oakland could be a third-party beneficiary to the NFL's relocation policy. Although this may seem like an end to city causes of actions under the relocation policy, the ruling would be a state-by-state decision. California has more stringent laws relating to third-party beneficiary contract laws. Friend of the show Jim Quinn, representing the City of Oakland, can now take the next step of appealing to the California Supreme Court. *** Have a topic you want to write about? Welcome to the intersection of Sports and the Law. Dan Lust is joined this week by Mike Lawson to give you the latest in Sports Law. Robert Sarver has been suspended for one year and fined $10 million. (2:53) The law firm of Wachtell, Lipton, Rosen & Katz started investigating last November the allegations of racism and misogyny within the Phoenix Suns organization. The report found that Sarver engaged in conduct that clearly violated common workplace standards, as reflected in team and League rules and policies. Sarver is prohibited from all basketball activities and operations for both the Suns and Mercury teams. MLB through a statement of Commissioner Manfred will voluntarily recognize MiLB as a union. (13:30) MiLB has begun the card process required by NLRB to form a union where they were assessing the interest of Minor League Players to unionize. With the MLB statement, the union will not need to go to a vote and can be recognized immediately. The language of such voluntary recognition is still to be drafted. MiLB has reported that they will allow the MLBPA to negotiate on their behalf. The next CBA to be negotiated will be the 2023 season. Scott Frost has been terminated as head coach of Nebraska. (18:45) Frost's buyout clause provides him with $15 million. Frost's clause was set to renew on October 1, 2022, which would have only given him $7.5 million for a buyout. Why couldn't Nebraska wait a few more weeks? Josh Gerben (@JoshGerben) joins to discuss Luka Dončić's trademark battle against his mother. (24:09) Luka's mother trademarked a dozen trademarks in Luka's name in Europe and the US. Luka filed for his own trademark, and it was denied because of his mother's trademarks. However, Luka's mother will not transfer the rights to Luka and his company. Luka has now filed for a petition of cancellation of his mother's trademarks. One of the claims in the cancellation petition is that his mother is not actually using the goods. Luka also revoked the consent he originally provided his mother to file the trademarks with his name in them. *** Have a topic you want to write about? Welcome back to Conduct Detrimental. Dan Lust is joined by Mike Lawson and John Nucci (@JNucci23) to break down this week's sports law news. Lindsey Hill accused Trevor Bauer of sexual assault last year which resulted in Bauer being suspended for 2 years. (2:04) Hill was not granted a restraining order in LA Superior Court and the Judge even stated that her request was "materially misleading" in part. The LA District Attorney's office also declined to bring criminal charges. Bauer filed a defamation lawsuit against Hill claiming the accusations were all lies to destroy his reputation. Ms. Hill has now counterclaimed claiming sexual battery and battery. This counterclaim also adds more allegations that were not brought to light in the restraining order hearing. Patrick Reed has brought a defamation lawsuit against Brandel Chamblee and Golf Channel for $750M. (14:55) Reed claims that there was a pattern of defamatory comments made by Chamblee and the Golf Channel that ultimately led to his "constructive termination" from the PGA Tour. Reed is now a part of the LIV Tour. Ben Simmons has settled his grievance with the 76ers. (29:10) Simmons was seeking lost wages in the amount of $20M. The 76ers were claiming that he breached his contract and refused to play in any games, which was why they fined him. Simmons claimed that he could not participate because of a mental illness. Dan Lust is joined by Mike Lawson and our resident DA, Matt Tympanick (@TympanickLaw) to break down the latest in the Sports Law world. Deshaun Watson's punishment has finally been decided (for now). (2:15) Judge Sue Robinson issued her ruling Monday August 1 at 830am and found the NFL met their burden that Watson violated the personal conduct policy. The punishment for Watson is 6 games. The NFL has until Thursday August 4 to file an appeal, as the NFLPA has issued a statement that they will not be filing an appeal. If the NFL appeals, it would be reviewed by Commissioner Roger Goodell to make a decision on increasing the punishment. At that point, the NFLPA could appeal to Federal Court. Watson has also settled three more civil cases, which leaves one remaining civil case. Stephen Ross and the Dolphins were found to have violated the NFL anti-tampering policy with their impermissible communcations with Tom Brady and Sean Payton. (32:34) Stephen Ross and Bruce Beal (co-owner of Dolphins) participated in impermissible contact twice with Tom Brady, the first when he was with the Patriots in 2019-2020 and the second violation when he was with the Buccaneers in 2021, and impermissible contact once with Sean Payton in 2022 before he retired from the Saints. Ross is suspended for 6 weeks and suspended $1.5 million. Dan Snyder testified before the Congressional House Oversight Committee virtually for 11 hours. I'm Stacey Simms and these are the top diabetes stories and headlines of the past seven days. XX In the news is brought to you by T1D Exchange! T1D Exchange is a nonprofit organization dedicated to improving outcomes for the entire T1D population. https://t1dexchange.org/stacey/ XX Two Senators have unveiled legislation aimed at lowering the cost of insulin, but not for the uninsured. This is a bipartisan bill that would lower patietn's cost to 35-dollars a month, for those with commercial insurance and on Medicare. It would eliminate the rebates drug companies pay to negotiators known as pharmacy benefit managers if the drug company kept the overall price of insulin below a certain level. Democrats are also in the midst of talks on a party-line package on President Biden's economic agenda that would likely include reductions in insulin costs as well as broader measures aimed at lowering drug prices, which could complicate any push for a stand-alone insulin measure. This change has enormous support among Americans, but can't seem to get any real traction in Washington despite who's in power. We'll see what happens.. https://thehill.com/policy/healthcare/3531954-bipartisan-pair-of-senators-unveils-bill-to-lower-insulin-costs/ XX Nasal insulin doesn't look like it works too well on diabetes, but a new study shows it may help to slow age related mental decline. This study found that after 12 months of once daily intranasal insulin, people with diabetes in the study performed better on cognitive tests than those diabetics in the placebo group. The non-diabetic group receiving the intranasal insulin also displayed improvements on decision making and verbal memory tests compared to non-diabetics in the placebo group. The biggest improvements in the non-diabetic group were seen in those subjects who started the trial in a prediabetic state. This suggests the treatment may be most effective at slowing cognitive decline in either diabetics or those with prediabetes. https://newatlas.com/health-wellbeing/insulin-nasal-spray-cognitive-decline-dementia-clinical-trial/ XX Go to sleep, and don't breathe too much. Researchers in the U.K. will test hypoxia to treat type 2 diabetes. Hypoxia is a state where the body does not receive sufficient amounts of oxygen. Multiple studies have shown that hypoxia improves blood sugar levels and aids in weight loss. Although scientists do not fully understand how this works, it is suggested that hypoxia burns more calories in the body, resulting in lower appetites in individuals. These researchers want to recruit volunteers so they can figure out why. Each volunteer will be provided with a sleeping tent in which they have to sleep – at home - for 10-day periods on two separate occasions. For one of they nights, they oxygen levels will be set to 15 percent. That sounds ridiculous, but, the air we breathe right now is only about 21% oxygen. 15-percent is pretty typical for find at high altitudes or inside an airplane. https://interestingengineering.com/lose-weight-while-asleep XX Another look at sleeping and type 2.. an exposure to light may increase the risk. Big sleep study at Northwestern University found that exposure to any amount of light during the sleep period was correlated with the higher prevalence of diabetes, obesity and hypertension in both older men and women. A study published earlier this year by the same team found for healthy adults in their 20s. Sleeping for only one night with a dim light, such as a TV set with the sound off, raised the blood sugar and heart rate. An elevated heart rate at night has been shown in prior studies to be a risk factor for future heart disease and early death, while higher blood sugar levels are a sign of insulin resistance, which can ultimately lead to type 2 diabetes. Instead of pulling people into a sleep lab, the new study used a real-world setting. Researchers gave 552 men and women between the ages of 63 and 84 an actigraph, a small device worn like a wristwatch that measures sleep cycles, average movement and light exposure. Fewer than half of the adults in the study got five hours of darkness at night. those who had higher amounts of light at night were also the most likely to have diabetes, obesity or hypertension." Strategies for reducing light levels at night include positioning your bed away from windows or using light-blocking window shades. Don't charge laptops and cellphones in your bedroom where melatonin-altering blue light can disrupt your sleep. If low levels of light persist, try a sleep mask to shelter your eyes. In that case, consider using nightlights positioned very low to the ground, and choose lights with an amber or red color. That spectrum of light has a longer wavelength, and is less intrusive and disruptive to our circadian rhythm, or body clock, than shorter wavelengths such as blue light. https://www.cnn.com/2022/06/22/health/light-exposure-sleep-study-wellness/index.html XX https://medicalxpress.com/news/2022-06-reveals-key-diabetes-drug-nature.htmlXX XX Nice story out of Kansas City where Chiefs offensive tackle Orlando Brown Jr. publicly enrolled himself in a TrialNet study. His brother lives with type 1 and his father died of DKA without knowing he had diabetes. Brown said he hopes participating in the trial will help others while helping himself and his family. https://www.kshb.com/sports/chiefs-orlando-brown-jr-enrolls-in-trialnet-study-for-type-1-diabetes XX Right back to the news in a moment but first As I mentioned, The T1D Exchange Registry is an online research study, designed to harness the power of individuals with type 1 diabetes. It's a research study conducted online over time, designed to foster innovation and improve the lives of people with T1D. Personal information remains confidential and participation is fully voluntary. Once enrolled, participants will complete annual surveys and have the opportunity to sign up for other studies on specific topics related to T1D. By sharing opinions, experiences and data, patients can help advance meaningful T1D treatment, care and policy Sign up at T1DExchange.org slash Stacey (that's S-T-A-C-E-Y). XX Congrats to the great team of Ginger Vieira and Mike Lawson on their newest book. Ain't Gonna Hide My T1D. Sherry the Sheep loves to draw and play basketball, but she's worried about what her friends will think if they see her insulin & CGM. Ginger and Mike are long time advocates who both live with type 1. This is their 3rd children's book together and I think they do a great job of balancing fun and education. https://smile.amazon.com/Aint-Gonna-Hide-My-T1D/dp/B0B455DL45/ref=sr_1_4?qid=1655748198&refinements=p_27:GingerVieira&s=books&sr=1-4&text=GingerVieira XX And finally, The Human Trial premieres this weekend. This is a documentary all about stem cell transplantation as a functional cure for type 1. I first spoke to the people behind this film back in 2016 when they were well underway. The movie follows the first two patients in the Viacyte trials. You can host your own screening.. I'll link up more information – as I do with all of these stories - in the show notes. XX And.. The Human Trial will be subject of next week's long format show. My interview with Lisa Hepner is a follow up to the one six years ago when we first discussed this project. We go into the details of stem cell research, what changed and what she's seen behind the scenes. The current long-format episode out now is all about Skirt My Pump, an ingenious idea from a women who's lived with type 1 for 40 years and got fed up with figuring out where to put her pump. Listen wherever you get your podcasts That's In the News for this week.. if you like it, please share it! Thanks for joining me! See you back here soon.
