Two local filmmakers set out to tell stories about Harrisburg that transcend boundaries of race, class, gender and geography. The result is the film River City Stories, which is screening this week at the West Shore Theater in New Cumberland. WITF's Rachel McDevitt spoke with the film's creators Paul Hood and Wallace McKelvey. According to McKelvey, he loved the City of Harrisburg, and wanted to portray that in a film. “I just feel like there's so much more to the city that people think is there. And with River City Stories, we're trying to show the world that there's more to Harrisburg than just a downtown core, said McKelvey. Hood echoed McKelvey’s sentiments on his love for the area. “There's so much vibrancy here that we don't always appreciate, whether you're a local or whether you're an outsider, you don't fully comprehend the complexity of our culture, the way that it can at once be segregated, but also mix together and overlap. And it's reflected in the way the film is structured, where you have a really diverse group of characters who kind of ebb and flow through these stories where one character will be the protagonist of one and then show up later in the story that has a different perspective, different lead character, because we all interact. We all share this space together. And I don't think we always appreciate that, “said Hood. The idea for River City Stories was born in the middle of the COVID pandemic, where folks were socially distanced and isolated. “We just talked, we just talked, and all these ideas came, and we had a really cool like system. So, we would sit and just have a conversation and then we'd pick out the things that were interesting in those conversations and we'd task each other with going off and working on a script. So, we would do that, we did that for like almost a year and by the next time we met like a year later, “said Hood. The film is screening Friday, March 7 and Sunday, March 9th at the West Shore Theater in New Cumberland. It will also be shown at Zootropolis in Lancaster on May 16th and 18th. Qualified terminable interest property (QTIP) trusts were created so that spouses could receive the benefit of the marital deduction while also setting aside resources for a surviving spouse and retaining control over what happens to the funds when the surviving spouse passes away. In this episode of the PFP Section podcast, Bob Keebler, CPA/PFS, and Paul Hood, JD, LLM, discuss the nuances of QTIPs, including: The confusion is caused by the separate Internal Revenue Code provisions on the estate and gift side. On the estate side, the rules are lax. And, on the gift side, they are rigid. How can a buy/sell agreement interfere with the efficacy of a QTIP trust and what to watch out for to make sure this doesn't happen. What do QTIP limits like fiduciary income to the surviving spouse mean from a family harmony, efficient trust and estate administration, and a fiduciary income accounting perspective. What's the bottom line as CPAs prepare gift tax returns that involve QTIPs in 2024. Business Owner's May Think They Know the Value of Their Company, But Statistics Say Differently! Over the years, I have heard the expression, “business owner knows their business better than anyone”. That might be true in some respects, however, when it comes to knowing the accurate value of their company, statistics would disagree. In many cases, owners use “a rule of thumb”, valuation method, advocated by industries, associations, or organizations. “Rules of thumb”, are not necessarily accurate as each business has its own set of metrics, method of management, statistics, and other value drivers that come into play when a company is appraised. Statistically, 90% of the buy and sell agreements have flaws, along with a flawed valuation, causing business owners to sell their businesses for less than the maximum potential business value. In this podcast we have two of the best with a long history of specializing in the area of valuations and buy and sell agreements. With us is Paul Hood and Ed Pratesi two of the best in the industry share their vast experience in working with companies both on the valuation side of the business and the construction of a solid Buy and Sell Agreement, avoiding disagreements and litigation. He is going to talk about trust, estates, and wills. He is also going to talk about business valuations for those owners. Episode Highlights · 04.31: Paul is a Louisiana guy, despite being in Ohio right now he grew up in Alexandria, LA. He talks about the early days and his experience of growing up in Alexandria, right in the middle of the state. · 05.33: The thing that Paul noticed as a kid listening to the rainy day show on KALB, the mighty 580AM every morning was that they developed this growing up and antipathy toward New Orleans. · 07.41: Paul is in the process of endowing $1000 a year student writing award at his alma mater high school, Holy Savior Menard Central High School in Alexandria and the scholarship will be awarded on Friday, April 28th at a school assembly and he will give a speech to the students. · 09.29: Paul doesn't view what he has literally done since Hurricane Katrina as work. He has written nine books, published hundreds of articles. He has done 96-90-minute webinars on estate and tax and charitable planning. He doesn't view all this as work which is why he doesn't ever see himself stopping. · 12.05: Paul shares how things changed for him when Katrina made its third and final landfall on August 29th, 2005. · 14.04: Paul discusses the things that are important for a buy-sell agreement. · 18.25: It's not a triggering event that causes the problem. It's the procedure that is drafted and one of those common errors Paul sees is the appraiser has to produce an appraisal in 30 days. · 20.14: The appraiser can't appraise in 30 days and no appraiser can, says Paul. · 22.40: One thing that the TV show Shark Tank has taught Bill is that a business owner at least a lot of business owners come up with this idea of valuation in their head that in the most cases seems to be based on not a lot and it could be very inflated. · 24.36: One of Paul's strongest bits of advice for people in business is your business should be ready for sale 24/7, 365. · 25.06: What happens to a lot of people is they skimp on their accounting and then they sign up a non-disclosure agreement and they enter due diligence and people who can't figure out, their financials, they are not audited, they are not reviewed, they're not consistent, they are not complete. · 28.02: Paul's earliest LSU memory was probably a trip to Tiger Stadium in 1973 when the Tigers weren't very good. Three Key Points 1. Paul talks about his mindset and how he felt when he turned 50. 2. Paul talks about two of his books, both are based on planning your future series, the last will and testament for your business, "Buy- Sell Agreements" and then “It's Yours," Mine and Ours" which Pete loves because it's on the blended family. 3. Paul talks about his earliest LSU memory. In this episode of Money Tales, our guest is Paul Hood. Paul is a “recovering tax lawyer”. Among many things, he is also a prolific writer. Paul recently published his ninth book, Yours, Mine & Ours: Estate Planning for People in Blended or Stepfamilies. In this Money Tales conversation, Paul talks about his personal journey navigating his own blended family. Paul has two sons from his first marriage and later married again. As he shares, there have been periods where he felt like he wasn't doing enough for his current spouse, while also feeling like he was never fully caught up with his kids. Paul viewed this as a “damned if you do and damned if you don't” situation. A native of Louisiana (and a double LSU Tiger), Paul obtained his undergraduate and law degrees from Louisiana State University and an LL.M. in taxation from Georgetown University Law Center before settling down to practice tax and estate planning law in the New Orleans area. Paul has taught at the University of New Orleans, Northeastern University, The University of Toledo College of Law and Ohio Northern University Pettit College of Law. Paul has authored or co-authored nine books and over 500 professional articles on estate, charitable and tax planning and business valuation. Paul's ninth book, Yours, Mine & Ours: Estate Planning for People in Blended or StepFamilies, is now out. His website is www.paulhoodservices.com. A frequent contributor to Leimberg Information Services since its inception, Paul is a highly sought-after speaker and consultant because of his innate ability to see through the complexity and explain difficult and even boring subjects in understandable and entertaining language with his insightful and biting sense of humor, and he minces no words in doing so. Along the way, Paul's been a father, husband, uncle, Godfather, lawyer, trustee, member, director, president, partner, trust protector, director of planned giving, expert witness, agent, professor, judge, juror, respondent, and a defendant, and he uses his experience in these myriad roles to guide others. A passionate history buff who teaches the history of tax and estate planning in his school and continuing education classes, Paul is a self-described amateur papal historian (boasting a personal library of papal history books that exceeds 100), and he has given numerous speeches about the history of the papacy and the popes as well as the history of the governors of Louisiana. In the fall of 2022, Paul is beginning to teach a three-semester course on the history of the popes and the papacy in the Adult Lifelong Learning Program at Lourdes University, and he's also teaching another course in the fall of 2022 on the fascinating and litigious histories of Rock ‘n Roll Hall of Fame groups the Platters and the Drifters. Paul is an author, speaker and consultant on tax, estate and charitable planning. He also is a Vice-President with Thompson & Associates, a charitable estate planning firm. See all episodes >

Today, I interview Paul Hood who describes his childhood household as "quiet, non-controversial, and easy". Maintaining privacy and avoiding conflict were the M.O. His father was a CPA and introduced him to a colleague who was both a CPA and a lawyer, and at age ten Paul decided that this was the combination he would strive for. He graduated with a master's in tax law and was mentored in estate planning, in which he landed a successful job at a great firm. At age 38, he was nationally nominated for an ACTEC fellowship-- something unheard of for someone so young-- and became a reputable speaker. Then, he stood his ground in a disagreement within a social organization for which he was treasurer. He lost the battle and was blacklisted in the community. Not long after, his wife of ten years decided she wanted a divorce. Paul loved his work, but he was experiencing burnout. He would later be diagnosed as bipolar. Then, after some deception by his clients regarding an estate matter, the tables turned and Paul's handling of the case was regarded as unethical, and he eventually received a suspension from the bar. His friends and colleagues abandoned him, he was struggling with his custody battle, and after much anxiety, he'd become addicted to Xanax. And finally, after a heartbreaking misunderstanding with his family, an altercation went terribly wrong. His world was crumbling and he attempted suicide. He realized that "suicide is a permanent solution to a temporary problem." He was determined to climb out of the empty hole his life had become. He has completed rehabilitation and worked to be reinstated. He encourages others never to stop believing in themselves, and that when we don't have anyone in our corner, we have to be our own strength. He believes his inner voice carried him through. __________________ A native of Louisiana (and a double LSU Tiger), Paul Hood obtained his undergraduate and law degrees from Louisiana State University and an LL.M. in taxation from Georgetown University Law Center before settling down to practice tax and estate planning law in the New Orleans area. Making choices about just how much conflict to address can lead to better outcomes than stopping before you start or setting up for a sense of failure. We can feel overwhelmed -- and fearful -- about estate planning, as my guest last time, Paul Hood, discussed. An internal conflict. It helps to recognize that it will take time and that changes can be made down the road. And almost any decision is better than none. Doing nothing invites conflict in your surviving family. Trying to make a difficult relationship perfect is unrealistic – instead, try to make it better. When a family has multiple concerns to address, it's best to handle critical ones first. Outside of a crisis, try for a “win” where the family can experience success. Attempting to solve everything at once is a lot to ask. Do you have comments or suggestions about a topic or guest? There are documents that Founders and Investors need to make sure a company has in place to protect the business when critical disrupters occur. Paul Hood joins Karen Rands to talk about the events business owners and investors should anticipate and the agreements that act as insurance policies to protect the interest of the organization's stakeholders. Paul takes the conversation a level deeper with real life examples of problems avoided and problems solved when you understand the kinds of precautions and assurance of sustainability certain agreements bring. GREAT NEW BOOK BY YOURS, Mine & OursBy: Paul Hood, JR. JD. LLM. CFRE, FCED A great honor to have on my podcast, Paul Hood, an extraordinary person. A wonderful technical author with over nine books, and many articles published. His new book is a must read for professional planners, blended families, or anyone interested in arranging their estate properly. The book is focused on the blended family, which is one of the only a few resources I have seen on this topic. Paul has been writing about blended families for over 25 years. Paul's passion is all about helping people determine the best estate plan that suits their needs and building that plan with a solid legal foundation. As far as Paul feels, this is the best way to help people achieve their dreams while preserving relationships, peace, and prosperity through major life transitions. “When it comes to estate planning, people often think about wills, trusts, foundations, and family entities, in other words, the “bricks” of estate planning. The “bricks” are important, but even more important is the emotional infrastructure supporting those” bricks,” which really is the “mortar” of the estate plan. I've included a graphic description of the bricks and mortar of estate planning on this page to illustrate my point.” This is a wonderful book, and as far as I am concerned this is the “operational manual” to making sure you set up the right kind of estate planning. My conversation today with Paul Hood, which in many ways is a continuation of the “listening” conversation that we had earlier this week, begs the question of whether fundraisers support the notion of grateful patient programs and the like, or do they merely tolerate them, and given the opportunity, would prefer that their work be more exploratory. When I think of fundraisers like Paul who insist that their practices align with the highest ethical standards, I believe they would be far more fulfilled without some the data and, instead, to simply rely on their communication and relationship-building skills. Both of which our guests consistently demonstrate that fundraisers have in remarkable and immeasurable ways. The question becomes whether their employers give them the opportunity to use them. Our conversation today aligns with some of the thoughts that I have previously expressed about the naïveté that is inherent in some of our thinking. I believe we are in the cusp of several decades of extraordinary fundraising; however, I am highly skeptical of whether the potential accurately aligns with the practices that we increasingly rely on to inform our work. For example, without having in-depth conversations with perhaps several people at the table, we can't fully understand the vested interest of those who are ultimately influencing a gift decision. It's one thing to know that that Mrs. Smith is perfectly capable of giving the hospital millions of dollars; it's another to understand that the larger and more complex these gifts get, the more likely her children, trusted friends and loved ones, and professional advisors are going to want to have a say in how such a gift happens. As always, we are grateful to our friends at CueBack for sponsoring The Fundraising Talent Podcast. And, if you're interested in hosting the Responsive Fundraising Roadshow, reach out and let's talk.

Is Your Buy Sell Agreement Any Good? During this episode we will be focused on the following topics: Horror stories of buy sell agreements that failed the family and the business. Why using valuation formulas is a fool's errand. 4 of the most significant issues with buy sell agreements, which ones are in yours? The critical steps you must follow before signing a buy sell agreement. Why fundamental fairness is so important in a buy sell agreement? This week's guests: Don Parkhill, JD** Bluestone Wealth Partners After graduating from law school in 1983, Don started working and advising business owners when he worked for the “Big Eight” accounting firm, Price Waterhouse. He later joined a law firm in Columbus, Ohio that specialized in working with closely held business owners. Don was instrumental in helping clients protect and plan for their families, the future of their business interests and the transition of the business and the family wealth. Much of the success of the planning was a result of collaborating with clients' other advisors, often the financial planner and CPA. This included developing and implementing transition strategies and working with the IRS to obtain private letter rulings. Don inherited his father's entrepreneurial spirit and left the practice of law to acquire his own business. He purchased several insurance agencies and later merged those with a larger firm, while continuing to do comprehensive financial planning for business owners. He joined Lincoln Financial Advisors in 2000 and continues to help successful business owners plan for their future, their family and their legacy. With 35 years of experience and an excellent team, he helps his clients create a financial roadmap distinctive to their vision, by listening and learning what is important to them and who they care about. Don has been active in numerous civic, philanthropic and professional organizations over his professional career. He has attended many national conferences, including The Institute for Preparing Heirs and the Notre Dame Tax and Estate Planning Institute, all of which discuss ideas to help the successful business owner protect, grow and transition family wealth. Don and his wife, Sheila, live in Westerville. They have a daughter, Annie, and a son, David. When not working, you may find Don traveling with his family or driving the back roads of Ohio with Sheila. A 1980 graduate of The Ohio State University, Don received his Bachelor of Science degree in Business Administration. Don Parkhill is a registered representative of Lincoln Financial Advisors.
