Navigating the Complex World of Trusts and EstatesThis conversation delves into the complexities of trusts and estates, focusing on key concepts such as testamentary intent, the plain meaning rule, ambiguity in wills, mandatory statutory protections for families, elective shares, distribution mechanics in intestacy, and the challenges posed by blended families and non-marital partners. It emphasizes the importance of understanding these principles for effective estate planning and the evolving nature of succession law.In the intricate realm of Trusts and Estates, understanding the balance between honoring a decedent's intent and adhering to statutory requirements is crucial. This blog post delves into the key concepts and challenges faced in this field, providing insights for both law students and practitioners. The Plain Meaning Rule and Its ExceptionsA foundational principle in testamentary documents is the Plain Meaning Rule, which dictates that if the language of a will is clear, extrinsic evidence is generally inadmissible. However, this rule is not absolute and has exceptions, particularly when dealing with inter vivos trusts, where courts are more lenient in considering external evidence to determine intent.Ambiguity in Wills: Latent vs. PatentAmbiguity in wills can be classified as latent or patent, with significant implications for the admissibility of evidence. Latent ambiguities arise when clear language becomes ambiguous due to external facts, allowing for extrinsic evidence. In contrast, patent ambiguities are apparent contradictions within the document itself, traditionally precluding external evidence.Mandatory Statutory ProtectionsThe law imposes mandatory protections to safeguard the immediate family, such as family allowances and elective shares. These provisions ensure that a surviving spouse and minor children receive support, often prioritizing their claims over the decedent's explicit wishes.Blended Families and Estate PlanningBlended families present unique challenges in estate planning, requiring sophisticated tools like QTIP trusts to balance the needs of a surviving spouse with the inheritance rights of children from previous marriages. These trusts provide income to the spouse while preserving the principal for the decedent's children. The Role of Non-Probate TransfersNon-probate transfers, such as life insurance and IRAs, can override a will's provisions, highlighting the importance of keeping beneficiary designations up to date. This aspect is critical in avoiding unintended disinheritance and ensuring that assets are distributed according to the decedent's wishes.Trusts and Estates law is a dynamic field that requires a deep understanding of both legal principles and practical considerations. By mastering these concepts, practitioners can effectively navigate the complexities of estate planning and ensure that their clients' intentions are honored.Subscribe now to stay updated on the latest insights in Trusts and Estates law.TakeawaysSuccession Law balances honoring the deceased's wishes with statutory protections. The Plain Meaning Rule restricts the use of extrinsic evidence in wills.Latent ambiguity allows for external evidence, while patent ambiguity does not.Mandatory protections prioritize the surviving spouse and minor children. The elective share ensures a minimum inheritance for spouses.Distribution methods in intestacy reflect the decedent's presumed intent.Blended families complicate estate planning due to conflicting interests.Non-probate transfers can override a will's provisions.Incorporation by reference allows external documents to be part of a will. The UPC's exclusion of non-marital partners raises questions about modern family dynamicsTrusts, Estates, Testamentary Intent, Plain Meaning Rule, Ambiguity, Statutory Protections, Elective Share, Distribution Mechanics, Blended Families, Non-Marital Partners

Jenn is prepping for his last couple of episodes of season 7 so we're putting a recent episode of Super Awesome Mix on the feed this week.  The focus is on gratitude and in particular, songs that feature the words 'Thank You'.  We kick off with Sly's Thank You and the relief of being yourself again, then trace how Dido's gentle melody got flipped into Eminem's Stan without erasing its original warmth. Andrew Gold's Thank You for Being a Friend sparks a riff on friendship rituals, party etiquette, and why the Golden Girls hook lives rent-free in our heads. DJ Khaled and Big Sean bring gratitude to ambition, reminding us that success without appreciation rings hollow. Boyz II Men drop us into a 90s harmony cocoon, proving that a simple refrain can feel like community.  The mix widens with Logic's Thank You, closing on real fan voicemails from around the globe—a living map of music's connective tissue. Alanis Morissette's Thank U honors letting go and landing; Snoop Dogg and Dr. Dre rework Sly's groove into a modern head-nod; Nathaniel Rateliff and the Night Sweats turn repetition into affirmation. Diana Ross glows with a love that adds to an already good life, pushing back on the myth that gratitude only comes from struggle. And we sign off with Moana's You're Welcome, a playful reminder to accept appreciation with grace.  https://music.apple.com/us/playlist/sam-thank-you-mix/pl.u-02P6s4oxbV1. Tracklist : Paradigme — La FemmeNuage Gris — Marlon Magnee Big Daddy — Tems Day in The Sun (Gettin' wit U) — De La Soul, Q-Tip & Yummy Bingham Work It — Missy Elliott Murder On The Dancefloor — Sophie Ellis-Bextor Ask the Angels — Patti Smith GroupDo Me — P-Square Inner City — Big Fun (12'' Mix)Energy — Drake Sidi Mimoune Gnawi (feat. Beastie Boys' Anthology: Sounds of Science, Michael Diamond (Mike D) says: “We had all been influenced by Lee Perry's productions. We were into how on reggae recordings there would often be a ‘dub version' on the b-side of a single, a practice that got co-opted by a few punk and early hip-hop singles as well.” Who knew? When their debut “License To Ill” was released in 1986, almost 40 years ago - it was fresh and had a great sense of humour, playfullness that on the surface could be disregarded as white-boy rap, but if you took a close listen you'll notice the attention to detail in the music - the use of sampling, 808 Drum Machine, experimentation, mixing and overall production - this was groundbreaking. The lads and Rick Ruben had crafted something unique that had not been done before. In 1985, it was Run-DMC, Schoolly D, and LL Cool J, but by 1986, hip-hop had begun to transform, and part of that was due to this release. They'd pulled together all the elements of their musical inspirations, Run-DMC, WWF Wrestling (Rick Ruben is a known superfan of the sport), The Clash, Dub, Punk, along with a frat-boy, teenage FU attitude. They'd taken hip-hop to a level while still paying homage to those they'd learned from, borrowed from, sampled from and absorbed. Within the following year, you'd have more groundbreaking releases from Boogie Down Productions, Marley Marl & The Mighty Public Enemy. On their 1998 album Hello Nasty, Lee Perry is on “Dr Lee, PhD. Perry's fingerprints are evident: spring reverb, echo throws, and that cosmic feel only he could bring. They also collaborated with Mad Professor (the recording in question is the unreleased dub instrumental album that Mad Professor and the Beastie Boys made, presumably at some point between the releases of Ill Communication and Hello Nasty) from Beastiemania.com. Dub has woven its magic thread throughout so many styles of music, not to mention launching entirely new genres via direct inspiration and use of dub techniques and sampling, that we shouldn't be surprised to see that same link with the Beastie Boys. Playliste: Janet Jackson feat. Q-Tip & Joni Mitchell - Got 'til it's gone Janet Jackson - Together again Spice Girls - Spice up your life Backstreet Boys - Everybody (Backstreet's back) Aqua - Didn't I M-People - Just for you Clemens - Psykopat på fri fod Michael Learns To Rock - Something you should know Oasis - Stand by me Shola Ama - You might need somebody Nana - Lonely Dominus - The path Goon - Panic

This week we are breaking down Ill Communication as part of our miniseries entitled 3 Bad Brothers A Beastie Boys Breakdown. DBRP hosts Nate LeBlanc, David Ma and Demone Carter are joined by one of the very best producers in hip-hop, Kenny Segal, who knows a thing or two about blending disparate elements into a cohesive whole, as the Beasties did on one of their most successful records. In the popular imagination, the Beasties' anthemic rock song Sabotage and its iconic video are probably the highlights from this record, but for us rap nerds, it also contains some of their very best alternative hip-hop songs. We get into some specifics about Sure Shot, Flute Loop and of course Get It Together, the mostly-freestyled jam they recorded with Q-Tip from A Tribe Called Quest. At the end of the episode we rank the album on our 5-point rubric, talking about the best beats, rhymes and magic moments, as well as the album's lasting cultural impact and replay-ability. We'd love to hear from all of you, what do you think of this album? Leave a comment with any thoughts. Please make sure to listen to the very end to hear a snippet of Kenny's one and only Beasties remix, which may in an alternative timeline have been released on Grand Royal and changed the course of his life. 3 Bad Brothers A Beastie Boys Breakdown is a production of Dad Bod Rap Pod Hosted By Demone Carter, David Ma, and Nate LeBlanc Executive Produced by Nate LeBlanc Produced by Demone Carter and Paolo “Cutso” Bello  Edited by Demone Carter and Nate LeBlanc  Engineering and Post-Production by Paolo “Cutso” Bello Artwork by Rory Simms Photography by Stephanie Barajas  Youtube version produced by Paolo “Cutso” Bello Theme song written and recorded by Defcee and Produced by Cutso Dad Bod Rap Pod is distributed by Open Mike Eagle's Stony Island Audio

It's DILLA TIME This month's special is about Jay Dee aka J Dilla, a Detroit hip-hop producer's whose work is so prolific and influential his MPC sampler is in the Smithsonian. Dilla worked with hip-hop and R&B greats - Q-Tip, A Tribe Called Quest, Busta Rhymes, The Roots, The Pharcyde, D'Angelo, Common, Madlib and made his own signature rhythm that others copied - he used a sampler like no one had before. Through his unique methods of playing with layered timing, rhythmic expectation, polyrhythm, samples stretching and feel and his ability to bend time-signatures to his will, Dilla changed how music moves, and made Dilla Time (a term coined in the 2022 book of the same name by Dan Charnas). We explore his production work, solo music and the legacy of his final album from 2006, released three days before he died - Donuts - a sample psychedelic beat tape of melancholic beauty and a magic trick of sampling that serves as a towering and influential creative statement.
