The Presidential Pardon Power, from Biden and Trump to Ancient Kings

Stanford Legal

Presidential pardons are in the headlines again after President Joe Biden's pardon of his son Hunter. But the vast majority of presidents have used this awesome power, which was enshrined in the Constitution at the founding of the country and dates back to 7th Century English monarchs. What are the issues at play with modern presidential pardons? What does history tell us about this practice? Our guest this week is Stanford Law Professor Bernie Meyler, a scholar of British and American constitutional law and of law and the humanities and author of the book Theaters of Pardoning. She joins Pam and Rich for a discussion of high-profile pardons like Hunter Biden and Donald Trump's allies to broader issues of mercy, justice reform, the implications of pardons in polarized politics, their historical roots, and ideas for reform. Connect:Episode Transcripts >>> Stanford Legal Podcast WebsiteStanford Legal Podcast >>> LinkedIn PageRich Ford >>>  Twitter/XPam Karlan >>> Stanford Law School PageStanford Law School >>> Twitter/XStanford Lawyer Magazine >>> Twitter/XLinks:Bernadette Meyler >>> Stanford Law page(00:00:00) Chapter 1: The Origins and Evolution of the Pardoning PowerHosts Pam Karlan and Rich Ford welcome guest Bernie Meyler. The discussion opens with a look at the historical roots of the pardoning power, tracing its lineage from the divine rights of kings in England to its adaptation in American democracy. Key examples include early English judicial pardons, debates at the U.S. Constitutional Convention, and George Washington's use during the Whiskey Rebellion. The chapter closes with insights into President Trump's controversial approach to pardons, likened to monarchical practices of wielding power above the law.(00:05:04) Chapter 2: Legal Boundaries and Contemporary Issues in PardoningThis chapter examines the legal limits of the president's pardoning power, such as the inability to pardon state crimes, and the various forms pardons can take. The conversation pivots to notable recent pardons, including Hunter Biden's, sparking a discussion about blanket pardons versus specific ones and their implications on guilt and historical accountability.(00:14:24) Chapter 3: Pardons, Polarization, and Public Perception The discussion shifts to the broader context of pardons, their declining use, and the influence of public opinion. The hosts analyze the risks of granting pardons and compare historical uses of the power, such as Washington's Whiskey Rebellion pardons, to modern examples like January 6th.(00:21:02) Chapter 4: Reforming the Pardon Process in a Divided Society The group explores potential reforms to the pardon process, suggesting ways to make it more democratic and transparent. Meyler discusses citizen panels and their role in ensuring fairness, while reflecting on the challenges of polarized politics.

On this edition of Parallax Views, Creamhound's Walker and Z. Behl joins the show to discuss their TrueAnon-approved, controversy-stirring, and darkly humorous board game Storm the Capitol. Described cheekily as "Insurrection in a Box!", Storm the Capitol allows you to relive the madness of the January 6th Capitol attack as either a MAGA "patriot" that needs to help Donald Trump "Stop the Steal" or a member of the Capitol police trying to stop them. Needless to say, some have been offended by the game, even assuming that it's a pro-MAGA board game. A look at the game, however, reveals that it's a satirical poke-in-the-eye to our politics-as-pro-wrestling media circus spectacle with its darkly, even gallows-esque, sense of humor rather than an endorsement of MAGA or the January 6th insurrection. We'll discuss the game, its mechanics, how it came to be during the days of the pandemic, the reactions to and controversy stirred up by the game, the lameness of moral tut-tutting about the game, the influence of punk rock on the game, and some of the game's jokes about QAnon, MAGA's alleged obsession with Alexandria Ocasio Cortez's feet, indie rockers (cough... Ariel Pink... cough) who participate in the January 6th Capitol attack, the QAnon shaman, and more. Yes, a lot of horrible things happened on January 6th. But it was also a day where a guy dressed in face paint carrying a spear and animal headdress stormed the capitol building. It was like something out of a David Lynch movie. A completely surreal, absurd moment in American history. And there's something darkly comical about that absurdity. Which is what made it perfect fodder for a satirical board game. We'll discuss all that and much more on this edition of the show.

The Doctrine of Discovery conference epitomizes scholarship's potency in initiating societal reflection and change, a revelation deeply felt by attendees like Jason. The connections forged among participants of various backgrounds underscore the role of academia in facilitating a collective confrontation with our intricate historical legacies. These moments serve as catalysts for personal growth and cultural respect, sparking an appreciation for the diverse tapestry that is our shared human experience. Finally, we navigate the profound relationship between land, heritage, and identity, acknowledging the stark repercussions of European conquest on indigenous communities. When we ignore our collective losses and tragedies, we only compound the pain they generate. And when we feel like our pain is ignored or we cannot share it, remembering can become complicated. And how we lead can become toxic. No matter your age, you have moments in your life that are embedded in your nervous system–the time, the place, who you were with–when something significant happened in your world that shook you to your core.  When we experience significant collective losses, who we were with and how we connected impacts how we metabolize shock, grief, or horror, as we grapple to make sense of the experience in the moment. And the sense of community, or lack thereof, we feel during those moments also impacts our remembering. When we remember together, we comfort each other. And we also come together to ask the hard questions that support change that sustains.Over the last 2 years, the January 6th Committee has gathered an incredible amount of data, eyewitness accounts, and transcripts of many conversations that led to the Insurrection. Formal criminal recommendations have just been sent to the Department of Justice as the committee prepares to close down. And for this year's anniversary, I am replaying my conversation with Julie Tagen, Chief of Staff to Congressman Jamie Raskin, who served on the January 6th committee.Julie Tagen is the Chief of Staff to Congressman Jamie Raskin, (MD-08). She is a veteran leader in DC politics and campaigns. She is committed to leaving a legacy to the next generation of leaders who will continue the work she has cared so much about for over two decades.Listen to the full episode to hear:Julie's first-hand account of what she experienced on January 6 and what she learned about herself that day and in the aftermathHow Julie has kept cynicism at bay and how she defines success after 25+ years in politicsWhy Julie believes it is critical for politicians to address the cultural issues in their communities to win votersHow Julie's experience as a gay, Jewish woman in politics have evolved since her first job and coming out in the 90sWhy we should be paying closer attention the Congressional investigation into the events of January 6Learn more about Rebecca:rebeccaching.comWork With RebeccaSign up for the weekly Unburdened Leader EmailResources:Vicarious Traumatization: An Empirical Study of the Effects of Trauma Work on Trauma Therapists, Laurie Anne Pearlman and Paula S. The last US soldier to leave Afghanistan returned home this August, but private security personnel long outnumbered US troops in that war, and the for-profit business of training guns-for-hire is booming -- literally -- in the backyards of many rural Americans. In this special episode, The Laura Flanders Show travels to the tiny town of Hoffman in Richmond County, NC, where residents live next to a loud private training ground. They have real concerns about who is receiving training there and why, especially after the January 6th Insurrection at the Capitol. Laura interviews Hoffman's Mayors and one of the County Commissioners who approved the permit for Oak Grove Technologies' tactical training site. They regret that approval now. And we travel to nearby Hoke County, where a diverse coalition of local stakeholders — and an all-POC County Commission — were able to stop the expansion of Reservoir International, another training outfit seeking to expand its footprint near the county seat of Raeford. “The latter is an example of the power of community organizing,” says Serena Sebring of Blueprint NC. Blueprint is partnering with a statewide network of veteran ant-racist, anti-militia organizers to pool information and lift up local strategies for making communities safer.  “I don't think it's worthwhile for the county period. And it's really not good for the town of Hoffman. [We need to tell these private paramilitary training groups that]. We don't need you anymore…  Go back to the military, go back to camp McCall, go back to Fort Bragg... Don't let the civilians takeover military. We don't need it. “ Don Bryant GuestsDonald Bryant, Richmond County CommissionerTommy Hart, Mayor Hoffman, NCDaniel Kelly, Mayor Pro Tempore, Hoffman, NCDanielle Purifoy, Assistant Professor, Dept of Geography, UNC Chapel HillHarry Southerland, Chairman, Hoke County Board of CommissionersChristina Davis McCoy, Former Executive Director, North Carolinians Against Racist and Religious ViolenceJim Davis, Former Sheriff, Hoke County, NCSerena Sebring, Executive Director, BluePrint NC NOTE:  This podcast originally aired Fall of 2021.  Listen to our most recent episode as a follow up:  'The Forgotten Coup, January 6th & the Small Town Americans on the Frontlines of Democracy'

Many individual police officers acted heroically on January 6th. But the successful attack on the Capitol by a pro-Trump mob, seeking to disrupt the certification of the electoral votes, remains one of the biggest policing failures in American history. Not only did the Capitol police fail to prepare for the attack, but many members of the mob were themselves police officers from around the country. To talk through the many reasons behind this failure, Alan Z. Rozenshtein sat down with Vida Johnson, an associate professor of law at Georgetown Law School and the author of a recent Brooklyn Law Review article and companion Lawfare post, exploring the tactical and structural policing failures that contributed to January 6th.Alan spoke with her about what the police should have done differently, and the role that race and politics play in how police react to domestic extremism.
