Former President Donald Trump and several of his co-defendants are requesting permission to appeal Judge Scott McAfee's recent ruling, which failed to dismiss the Georgia election interference case against President Trump outright or to remove disgraced Fulton County District Attorney Fani Willis from prosecuting the former President. The Georgia racketeering case against Donald Trump can proceed with Fulton County District Attorney Fani Willis in charge. However, on Friday, Fulton County Superior Court Judge Scott McAfee ruled that if Willis stayed on, her lead prosecutor, Nathan Wade, would have to leave the case. He stepped down later that day. One of Trump's co-defendants accused Willis of misconduct for having a romantic relationship with Wade, but Judge McAfee said it did not constitute the kind of conflict of interest that would require her removal from the case. Friday morning in Fulton County, Georgia, Judge Scott McAfee issued an opinion in the matter of the disqualification of District Attorney Fani Willis. It was not a complete victory for anybody. The defense didn't get Fani Willis booted from the case, but they did get Nathan Wade booted from the case. And Fani Willis has to contend with the loss of her special prosecutor, as well as some scorching criticism from the judge. America's Mayor Rudy Giuliani says Judge McAfee is trying to play both sides against the middle. In allowing Fani Willis to stay on the case, he left several issues unresolved. Willis admitted she took money from her campaign and Giuliani says that's a crime in the state of Georgia. We're going to trial against the former President of the United States with a DA who has an unresolved, serious felony. She also committed perjury approximately five times in her testimony which would have put most people in prison. Giuliani wants to know how we ended up with the three worst prosecutors in America? And every one of them is a Democrat, not even a single Independent. Judge McAfee knows this is an important case of international importance. Having once worked for Willis, he and his wife also donated to her campaign. You should recuse yourself if you're an honest judge. Fulton Co. Georgia is like New York, Chicago and Philadelphia, all run by the crooked Democrat machine. Giuliani became puzzled and disappointed in Bill Barr when he had Hunter Biden's laptop and didn't realize the imperative to examine it fully. Rarely does a prosecutor get a piece of evidence like this. It was the main focal point of the bag man, explaining why and what he's been doing for the corrupt family business. It was self incriminating and Giuliani has never seen a more damaging piece of evidence in his career as a lawyer. You have to realize it implicates a possible future President of the United States of America. Barr could have investigated before Joe was even nominated. Instead, he watched Joe lie on television calling it Russian disinformation. You have to come forward if you're the Attorney General. It wasn't just lying, it involved our national security. These bribes were coming from our biggest enemy, China. Giuliani says there was no explanation for Barr other than something corrupt was going on. They had something on him because he changed. Judge Scott McAfee, who's presiding over the Georgia state RICO prosecution, granted a defense motion to dismiss six of the charges in the indictment, including three of the charges against Donald Trump. Judge McAfee ruled there wasn't enough specificity in the indictment regarding the precise nature of the crimes being charged. However, the judge told prosecutors - they can cure the technical defect in the indictment by re-indicting the charges with greater specificity. Since a grand jury in Fulton County, Georgia, handed up an indictment in August of former President Donald Trump and 18 other defendants for their efforts to overturn the results of the 2020 election in Georgia, all eyes had been on the defendants' behavior and their legal fate. That was until an explosive filing by one of the defendants, Mike Roman, alleged that Fulton County District Attorney Fani Willis had engaged in a kickback scheme through a romantic relationship she had with an outside prosecutor Willis had hired to participate in the case, Nathan Wade. Roman asked the presiding judge, Scott McAfee, to disqualify Willis and her office from the election case. Willis and Wade have since acknowledged their relationship but claim that Willis did not financially benefit from it.Last week, Judge McAfee held a two-day evidentiary hearing to determine whether Willis and Wade's relationship presented a conflict of interest, requiring the removal of Willis and her office from the case. Trump co-defendant Michael Roman last month first accused Willis and special prosecutor Nathan Wade of having romantic ties, claiming it rendered the far-reaching Georgia election interference indictment ‘fatally defective.'” Earlier this week, Willis insisted that she would not step down from the 34-count election crimes case, against Donald Trump despite the obvious conflict of interest and ethics violations. Willis' office has paid Wade an estimated $650,000. She is also alleged to have gone on numerous, extravagant vacations with Wade. Cunningham—a law professor at Georgia State University—explains the legal consequences for the improper relationship between lead prosecutor in the Donald Trump Georgia election interference criminal case, Nathan Wade, and Fulton County District Attorney Fani Willis. Cunningham writes: “Mr. Wade was very involved in both the special grand jury investigation and the current criminal case, despite an absence of obvious qualifications. Although Ms. Willis has defended her decision to hire Mr. Wade, his previous experience as a prosecutor appears to have been largely limited to misdemeanors. The amount paid to Mr. Wade so far is substantial yet Mr. Wade's billing invoices obtained by Mr. Roman's lawyer are not well documented and don't always offer, for example, itemized time worked in increments of less than one day. If Ms. Willis and Mr. Wade are dismissed by Judge McAfee, it will be up to a state agency, the Prosecuting Attorneys' Council of Georgia, to appoint a prosecutor to take over from Ms. Willis. And that's where things could really go off the rails. Take one precedent: On July 25, 2022, Ms. Willis was disqualified from prosecuting Burt Jones, who was then a state senator, after she hosted a fund-raiser for Mr. Jones's eventual opponent in the race for lieutenant governor. Eighteen months later, the PACGA still hasn't appointed a special prosecutor, and Mr. Jones, now lieutenant governor, has not even been indicted. Delay is not even the worst possible outcome for the case if Ms. Willis is disqualified. The Rich Zeoli Show- Full Episode (01/25/2024): 3:05pm- On Tuesday, New Hampshire held its Republican presidential primary with Donald Trump ultimately defeating Nikki Haley 54% to 43%. Meanwhile, despite not being sanctioned by the Democratic National Committee and consequently awarding no delegates, President Joe Biden defeated Rep. Dean Phillips 64% to 20%. Biden did not appear on the ballot—citing New Hampshire's prevention of South Carolina from becoming the party's first primary state—though his supporters did organize an extensive write-in campaign. According to CNN exit polling, 70% of the New Hampshire voters that cast their primary ballots for Haley in Tuesday's Republican presidential primary were not registered as Republicans—instead they were “undeclared” registrants. As the primary moves towards more conservative states, like South Carolina, will her support with independent-minded and moderate voters be enough to keep her campaign competitive? 3:10pm- Peter Navarro, former Director of the Office of Trade and Manufacturing Policy, has been sentenced to 4 months in jail for defying a Congressional subpoena. Could Hunter Biden face a similar fate if he doesn't cooperate with his own Congressional subpoena? 3:15pm- Earlier this week, in a 5 to 4 decision, the U.S. Supreme Court determined that the Biden Administration has the authority to remove concertina wire erected by Texas officials along the U.S. Southern border—designed to prevent the unlawful border crossings that continue to plague the state. According to reports, Gov. Greg Abbott (R-TX) has continued to place “razor wire” along the border—arguing that the Supreme Court may have authorized the federal government to remove the wiring, but he remains legally permitted to use the wire when he deems it necessary. 3:20pm- On Wednesday night, United Auto Workers (UAW) President Shawn Fain announced that the union would be endorsing President Joe Biden for reelection during a conference in Washington D.C. During his speech, Fain referred to presumed Republican presidential nominee Donald Trump as a “scab” explaining: “If Donald Trump ever worked in an auto plant, he wouldn't be a UAW member. He'd be a company man trying to squeeze the American worker. Donald Trump stands against everything we stand for as a union, as a society.” 3:40pm- In a New York Times editorial, Clark D. Cunningham—a law professor at Georgia State University—explains the legal consequences for the alleged improper relationship between lead prosecutor in the Donald Trump Georgia election interference criminal case, Nathan Wade, and Fulton County District Attorney Fani Willis. Cunningham writes: “Mr. Wade was very involved in both the special grand jury investigation and the current criminal case, despite an absence of obvious qualifications. Although Ms. Willis has defended her decision to hire Mr. Wade, his previous experience as a prosecutor appears to have been largely limited to misdemeanors. The amount paid to Mr. Wade so far is substantial yet Mr. Wade's billing invoices obtained by Mr. Roman's lawyer are not well documented and don't always offer, for example, itemized time worked in increments of less than one day. If Ms. Willis and Mr. Wade are dismissed by Judge McAfee, it will be up to a state agency, the Prosecuting Attorneys' Council of Georgia, to appoint a prosecutor to take over from Ms. Willis. And that's where things could really go off the rails. Take one precedent: On July 25, 2022, Ms. Willis was disqualified from prosecuting Burt Jones, who was then a state senator, after she hosted a fund-raiser for Mr. Jones's eventual opponent in the race for lieutenant governor.
