Sarah Boone's legal team is fighting for a new trial after a jury convicted her of second-degree murder in the death of her boyfriend, Jorge Torres Jr. Boone's attorney, James Owens, filed a motion arguing that Boone's constitutional rights were violated and accusing the prosecution of misconduct. Torres' tragic death occurred in February 2020. Authorities discovered him zipped up in a suitcase at the couple's apartment following a night of drinking. During her trial, Boone testified that she acted in self-defense and suffered from battered spouse syndrome. The prosecution, however, countered with evidence showing Boone not only left Torres to suffocate but also beat the suitcase with a baseball bat. The case took four years to reach trial, partly due to Boone's changing defense team. A total of eight different attorneys represented her before Judge Michael Kraynick ultimately decided that Boone had forfeited her right to an attorney because of her behavior, forcing her to represent herself. Owens' motion claims this ruling violated Boone's Sixth Amendment right to legal representation. “Judge Kraynick failed to warn Ms. Boone that repeated ‘misbehavior' would lead to her losing her right to an attorney,” Owens wrote. He also emphasized that Boone's actions did not meet the standard for misconduct that justifies stripping someone of their right to counsel. Owens pointed to another key issue: the judge's refusal to grant a continuance. Owens had entered his notice of appearance only 45 days before the trial began, which he argued left insufficient time to prepare. “Despite his best attempts to prepare for trial, it was impossible to adequately prepare for unforeseen issues,” Owens stated, mentioning that crucial evidence, such as texts from Boone's phone and prior interactions with law enforcement, could not be fully reviewed. Despite Owens' attempts to delay proceedings, Judge Kraynick held firm, stating that Boone had only “herself to blame” for the defense team's difficulties and that Owens knew the deadlines before taking the case. Owens further alleged that the prosecution committed misconduct, accusing the State of failing to disclose a change in their rebuttal expert's opinion. He also criticized prosecutor William Jay for delivering what he called a “second closing argument” instead of a proper rebuttal. Additionally, Owens contended that Judge Kraynick should have declared a mistrial when Torres' family had an emotional outburst during closing arguments. The judge denied the mistrial request, and Owens argued that the jury should have received a curative instruction to disregard the incident. Boone now faces a minimum sentence of 22.5 years in prison, with her sentencing hearing set for Dec. 2. A July ruling in New York marked a victory for the public and transparency. Federal judge Victor Marrero held that the public has a First Amendment right to know what authorities have done with allegations of prosecutorial misconduct. The court issued its July 22 decision in the case CRC v. Cushman, finding that the Second Department and Grievance Committees can no longer conceal from public view the decisions they have made, or will make, regarding 21 ethics complaints filed against current and former Queens prosecutors. In total, from 2021 to 2023, law professors and attorneys filed 50 ethics complaints alleging prosecutorial misconduct by New York prosecutors and published them online at AccountabilityNY.org. The ethics complaints include very serious misconduct allegations, such as providing secret benefits to a witness, allowing a witness to lie to the jury, concealing evidence of innocence, unlawfully discriminating against Black jurors, and misleading the jury about the evidence in the case. Everyday Injustice spoke with Peter Santina, the Managing Attorney of the Prosecutorial Accountability Project at Civil Rights Corps who talked about the problem of prosecutorial misconduct and the difficulty of exposing it to the public.

Today, Hunter spoke with Civil Rights Corps' Attorney Peter Santina to discuss their efforts in uncovering and challenging prosecutorial misconduct. From Alleghany County to San Francisco County, Peter and his team are those leading the charge in revealing the negligence, maleficence, and misconduct of prosecutors around the country. This episode, however, does offer a reminder that all of their actions are enabled by judges, politicians, and legal ethics bodies that sit by and do nothing to hold prosecutors accountable for their actions. Guests: Peter Santina, Managing Attorney of the Prosecutorial Accountability Project, Civil Rights Corps Resources: To do something about this, and raise awareness of this continuing racial discrimination, CRC worked with our AccountabilityNY professor partners to prepare and file 10 complaints against prosecutors alleging court findings of racial or religious discrimination. CRC also publicized the fact that an attorney for the NYPD union had once been a prosecutor who used a handwritten guide of racist and sexist tropes to select juries, leading to three reversals. Journalists at the Gothamist, The City, Queens Daily Eagle, and Davis Vanguard each wrote original stories about the discrimination complaints. CRC attorney Bina Ahmad appeared on WBAI radio and WNYC radio with Dexter Murray, a man personally victimized by this form of discrimination. Mr. Murray's powerful op-ed ran in the NY Daily News. In San Francisco, nearly 1,000 people are past their last day for speedy trial, over 100 of whom are incarcerated, awaiting an unknown trial date. In a particular pending case, the San Francisco Public Defender's Office asked the California Supreme Court to intervene and restore people's speedy trial rights. In support of this petition, CRC filed an amicus brief to explain to the justices how the denial of speedy trial rights turns an already-flawed system of plea bargaining into a system of plea begging and unfairly extends the already-oppressive conditions of pretrial detention. CRC await the California Supreme Court's decision. The prosecutor's choice to pursue or dismiss charges is one of their greatest powers and is ripe for abuse. As over 90 percent of criminal cases resolve by plea bargain, recent reports have exposed the troubling lack of transparency and oversight in this plea bargain system (2020 Vera Institute Report) and that innocent people plead guilty to crimes they did not commit (2023 American Bar Association Task Force Report). In March 2023, the longtime Allegheny County District Attorney, Stephen Zappala, was in a contentious primary battle for reelection against the Chief Public Defender, who was also running for District Attorney. It was reported that after Zappala did not secure the Democratic Committee's nomination, a supervisor in his office gave line prosecutors instructions that referenced the election. In the following days, two prosecutors were reported to refused to dismiss weak charges, and each prosecutor cited the election—and Zappala's endorsement loss—in their explanation. CRC worked with two legendary professors, David Rudovsky (Penn Carey School of Law) and Jules Lobel (University of Pittsburgh School of Law), to prepare and file an ethics complaint with the Disciplinary Board of the Supreme Court of Pennsylvania against Zappala. We included a 2021 incident where Zappala ordered his prosecutors to not offer any plea bargain to clients of a Black defense attorney who had criticized his office. Who in the World is Geoff Shepard?This show is an attempt to introduce you to him and get to know exactly who he is. We have discussed him at various times in our 1973 episodes but this as an in-depth look at who he is and why he is a man of unquestioned stature. I also wanted to put this show together because of my own experience with coming to learn about this man and his work , a chance to address the usually skillful way the other side undermines everyone with a different viewpoint in the eyes of the public. It's also a way to keep a skillful eye on current events too.The first time I had ever heard of Geoff Shepard I was arguing with a former anchor at my local television station over drinks. Since the advent of social media I have developed a reputation as a rabid Nixon defender. My friend, who was on WPDE - TV 15 in Myrtle Beach, was not a Nixon fan. Over the course of our argument he said something along the lines of me believing looney conspiracy theories, and threw out Geoff Shepard's name. I had never heard of him but was aware that a little cottage industry of hairbrained conspiracy theories had cropped up over Watergate and various other historic events from the Lincoln Assassination to the assassination of John F. Kennedy, to the Bermuda Triangle for that matter. But for me after the back and forth with the anchorman, I mostly forgot about it. A while later I got to talking with a friend of mine who was the Assistant City Attorney for the City of Myrtle Beach. He was the young man who had broken up the fist fight years before between our Mayor Mark McBride and a City Councilman Wayne Gray in executive session. That fight had made national news at the time. The Assistant City Attorney had since moved on before I was elected, but we became friendly acquaintances. He had seen some of my posts on Facebook about President Nixon and had told me about his own legal work with Geoff Shepard and how Shepard had told him all about his time working with Richard Nixon. Then he sent me an article that had been in The Atlantic Magazine. It was a fascinating look at what had really happened in Watergate. That is when I realized that there may be more to this man than what the anchorman had portrayed to me earlier. When Geoff Shepard's second book came out "The Real Watergate Scandal (Collusion , Conspiracy and the plot that brought down Nixon) " I went out and bought a copy. It was a stunning, shocking, mesmerizing book that I almost highlighted from cover to cover. It was one of the best books on Richard Nixon and Watergate I had ever read. So I did some research on the author. What I discovered was he is a very serious man, and more importantly, a very credible one with a long resume of experience both as part of the Nixon Administration an after. So with this episode I want to establish with you, our audience, that Geoff Shepard is not a conspiracy theorist, not a person pedaling a story of a vast intricate plot of espionage designed to destroy a President, but a serious man who has uncovered a rather simple case of Prosecutorial Misconduct that has sadly occurred in far less dramatic fashion in courtrooms and legal cases all over America. Our Season 7 story opens with a look at the conventional wisdom most of America, and the world holds on Watergate. It is the story of the heroic Special Prosecutors who investigated the heinous crimes of Watergate. The story of a Washington Press Corp determined not to let the sly , crooked , Richard Nixon get away with running his, as Dan Rather called it, "crime syndicate" from the White House. It is the story of the heroic Democrats in Congress who continued to push for more and more information in order to protect the country from a President determined to undermine our constitutional democracy and trample over the American Criminal Justice System. It is the story of those brave, unselfish, upstanding, righteous Republicans who finally said enough. It was nothing less than saving our democracy itself and stopping fascism from reigning over our mighty and free land. I don't know about you, but I ain't never bought that line of happy Horse manure!!But I also never had anything but a feeling that "something was not right in Denmark". I had studied the career of Richard Nixon most of my life. What I had found was if you really looked at it almost none of the accusations, other than those of Watergate, ever stood up. He had in fact exposed a real communist spy in Alger Hiss. He had defeated Helen Cahagan Douglas for the U.S. Senate in a nasty race where most of the nastiness had been provoked by her not him. He had had a special fund to help with legitimate expenses related to his political career but he had been able to account for every dime spent from the fund, something the 1952 Democratic Nominee for President, Adlai Stevenson, who also had a similar fund could not do for himself. The 1960 election for President had been arguably stolen from Richard Nixon and Nixon had had his taxes audited by the IRS and his airplane and phone lines bugged by the FBI during the subsequent Kennedy and Johnson years. It just seemed that every time you really looked at it, except for Watergate, Richard Nixon was actually not at all what he was constantly being presented to the public as having been. So you just always had this feeling that maybe Richard Nixon's claim that he would one day be vindicated, yet again, would prove true. But like most Americans, while sympathetic, I guess I kind of doubted that it could actually be possible. Until I read three riveting books by a lawyer, former Nixon staffer, and a man whose own credibility is unquestioned. That man's name was Geoff Shepard, and starting with this episode we are going to do a deep dive into documents he has unearthed over the past nearly two decades. They discuss how the desire to close the Rikers Island jail facilities and limiting the number of people being held pretrial was the impetus for bail reform. They then close the conversation by talking about the Commission on Prosecutorial Misconduct, which oversees District Attorneys and their offices work to ensure ni impropriety is taking place. Anyway, I went over news of the day, and then got into this article about a Second Amendment supporter who is gay, and works for the NRA, and he gets far more support from the NRA, than the gay community, because conservatives are simply more inclusive. We don't care what you are, just who you are as a person. But the big story today is our reporter Michael Volpe, and our very special guest Jeffrey Deskovic, wrongly convicted of rape and murder of a 15 year old girl when he was 16, everything that could have gone wrong with the arrest, prosecution and conviction, did, on purpose, as he was judged guilty immediately, and all the evidence made to fit that pre-determined conclusion. It was only the intervention of correct DNA evidence that finally freed an innocent man, but now a forever changed man. Police/prosecutor/judge misconduct, a public defender that did no defending, and a badly informed jury all contributed. Robin Konrad, Director of Research and Special Projects, interviews Isaiah McCoy, the nation's 157th death-row exoneree, and his lawyers, Michael Wiseman and Herbert Mondros. McCoy was wrongly convicted and sentenced to death in Delaware in 2012. After winning a new trial in 2015, he was acquitted of all charges in January 2017. McCoy's case featured several systemic problems that plague the death penalty system: a lack of physical evidence, eyewitnesses who received deals from the prosecutor and told multiple versions of the story about the crime, a non-unanimous jury recommendation for a death sentence, and a prosecutor whose misconduct in the case was so outrageous that he was suspended from practicing law. McCoy and his lawyers explain how these factors contributed to his wrongful conviction, discuss his efforts to be exonerated, and describe McCoy's life since exoneration.
