Abby Rogers, who first investigated legal nursing as a career three years ago has made a commitment with impressive results. She began as a subcontractor, which she feels gave her the grounding to reach out for an independent career. Her first independent client didn't know what he wanted, which gave her a unique opportunity to guide him. Abby currently divides her work life between bedside nursing and LNC work. A special aspect of her promotional efforts involves LinkedIn, which she has studied in detail. While she feels that individuals find their own “sweet spots” in terms of types and amounts of posts, she shares what has worked and what has not worked for her. Currently, she posts about three times a week. She also makes a point of responding to others' posts. She analyzes her successes and failures in terms of responses and considers LinkedIn to be a major marketing tool for her. She says that a lot of her best post ideas come when she's walking her dog or doing other non-writing-related tasks. She urges those who want to post regularly to make a record of their ideas. Some may not be immediately relevant, but they can be used later. When questioned about whether she uses artificial intelligence, she says only as a last step, for polishing language. She finds that if she makes it more part of the formative stage of writing, it ends up not sounding like her. Abby is an enterprising and talented LNC businesswoman. One of the biggest challenges when we live in a world dominated by processed food is to eat in a healthy manner. Because of stresses in our lives, we are conditioned to handle them by eating sugary or fat-laden food. When we're tired and don't feel like cooking, we reach for a frozen dinner. Kris Mew, a legal nurse consultant, shares today her own journey to a healthy pattern of food consumption. As a nurse, she was aware of the connection between disease and diet. She began by investigating the ingredients in what she ate in terms of healthy eating and realized that she needed to change her habits. She details the role of sugar in weight gain and points out that many people aren't aware of the hidden sources of sugar, such as sugar in their coffee creamers. This is only one area where sugar hides and causes damage. To discover how food affects them, many people now wear glucose monitors, even when they aren't diabetics. The monitor readings teach them how much sugar is in what they've just eaten. She also emphasizes that we need to find healthy alternatives to burying emotions with food. Taking a walk, talking with a friend, or addressing what we're feeling go far to solve the problem. Kris emphasizes that it's important to be patient with yourself. Lifetime habits don't disappear in a day, but you will come to feel the benefits of improved eating with increased energy and calm. As an LNC, you will probably work with cases where the credentials and privileging for doctors are in question. To be able to assess this, you need to understand the complex processes involved. Dr. Vipul Kella, an emergency medicine and highly experienced physician in a number of areas, unravels this complicated web. During the late twentieth century, doctors whose reputations were tainted by malpractice suits and other violations could move from state to state and set up practices and get credentialed and receive medical and surgical privileges. Now a National Practitioner Data Bank exists to flag wayward practitioners, making it more difficult for them to elude detection. Like all systems, it has flaws. Because practitioners may be credentialed in multiple facilities, those who give credentials have much more data to handle. The weight of data involved can penalize blameless practitioners in terms of the time involved to receive credentialing and medical and surgical privileges. Privileges are particularly sensitive. It makes a difference what kind of medicine or surgery is being practiced. Privileges are less likely to be granted for new or experimental surgery, for example. On the other hand, a variant of the “old boy” network may activate. Credentialers will face the challenges of being objective when a colleague, a good friend, wants to be re-credentialed and yet has a series of problems or poor outcomes. There may be a lot of pressure on the hospital to keep them on staff. Professionals have been discussing the concept of nurse burnout and how it affects the profession for at least 50 years. Dr. Lorre Laws, whose Ph.D. is in nursing, realized from her own experiences and from interviewing and speaking to other nurses that the issue has been insufficiently addressed. She decided to rectify this. The result was her book, Nursing Our Healers: A Recovery Guide for Nurse Trauma and Burnout. Check out this podcast episode on Healing Nurse Trauma: Burnout, Self-Care, and Systemic Challenges. Lorre has a deep understanding of the connection between burnout and trauma and believes that, while some sources of burnout are inevitable, many require solving systemic changes. Lack of equipment, for example, forced her to catch a falling patient at the cost of three herniated discs. She also points out that when nurses report abuse by patients, they are often gaslighted, asked how they could have prevented the incident. This literally adds insult to injury. This issue is relevant to LNCs for a number of reasons. Career transition can also be traumatic. The LNC may be somewhat removed from the immediacy of a plaintiff's traumas, but they must address them, often in a pain and suffering report. They may be subject to the frustrations of an attorney having problems. In addition, they may be exposed to a burned-out, traumatized nurse who made a mistake as a result. In conclusion, Lorre offers two 30-second practices that she recommends doing whenever possible to reduce stress and burnout levels. You can do them anywhere, and she hopes you will. When you think about falls, your first thought may be of nursing home or hospital falls. However, a large percentage of falls and other injuries occur on the job. Slippery or buckled floors, wet spots, hidden holes, and other structural issues can cause serious injuries. These injuries are complicated further by supervisors who may shuffle the injured worker to a clinic rather than to needed care in an emergency department of a hospital. The company that insures the business that employs the worker may deny needed care. A supervisor may want to avoid the usual method of reporting an injury because he wants a clean safety record. A reportable incident usually goes to OSHA (Occupational Safety Health Administration), which has the option to investigate the company and possibly fine them for violations. These fines can be for major amounts of money. Sometimes the workers, due to substance abuse, may be investigated. Some may be undocumented workers. Still others fail to show up for physical therapy or other medical appointments. Add to this the unusual number of documentation that this kind of investigation seems to spawn, and you can end up with a data nightmare. Laura's thoughtful explanation of the various issues involved will prove invaluable to you if you end up with a workplace fall case. This podcast, Transitioning from Clinician to Legal Consultant, provides a more uncommon perspective on the world of medical malpractice. Jeff Willis, MD, served as a board-certified emergency department practitioner. In time, he shifted his professional focus to working with attorneys. In his new career, he has seen the best and worst of medical care. This career has grown rapidly. He works as a consulting physician, and he has gotten most of his clientele by writing about medical cases on LinkedIn. He doesn't actively seek contacts, although when he concludes a successful case, he will ask the attorney for referrals—and he gets them. He's acquired a lot of experience in a brief time, and from his altered perspective, he's observed that most medical malpractice suits stem from systemic errors. For example, there will be insufficient safeguards to prevent someone getting the wrong medication or blood. Due to the lack of communication in hospitals, even those part of the same system, Hospital B, which is in the same system as Hospital A, will make the same error. Lawsuits also occur when the hospital doesn't proactively explain to the affected parties why the error occurred. Most plaintiffs want to make sure that the tragedy that impacted their lives doesn't reoccur. Sometimes it takes the Center for Medicare and Medicaid Service to initiate effective change. Today's podcast, The Role of Legal Nurses in Placenta Accreta Cases, discusses a serious condition called placenta accreta. When this occurs, the placenta attaches to the uterus, causing major difficulties in the delivery of the infant. Nurse specialist Katie Roberts goes into depth about this medical condition. While the condition is rare, it's on the rise. Katie explains that cesarian sections and placenta previa are some of the risks for placenta accreta. Another risk factor is a pregnancy in which there have been no ultrasounds and sometimes no medical supervision at all. This prevents the obstetrician from preparing safely for the delivery. A carefully planned delivery, often by cesarian section, involves a complete team of medical practitioners. A primary goal is to prevent excessive blood loss, and when deemed appropriate, to schedule the delivery in advance of the anticipated due date. An LNC experienced in obstetrics can make a major contribution to the evaluation of a case involving placenta accreta. He or she can assess the medical personnel's consideration of the risk factors and preparedness to prevent crises, as well as determining whether the optimal procedures were used. Katie points out that, due in part to women becoming pregnant at increasingly older ages, the risk of placenta accreta correspondingly increases. That alone makes this a valuable podcast for you. In this podcast, Enhancing Surgical Outcomes: The Vital Work of RNFAs, we investigate an area of nursing that you may not know about: the registered nurse first assistant, or RNFA. You will find this practitioner in the operating room assisting the surgeon. Anna Gray, who serves in this role, is here to explain what it involves. This is a position that requires years of training and passing a difficult examination. It's an expanded set of nursing skills that involves both knowledge of the dynamics of an OR and a deep understanding of surgical processes. And that's not all. Communication skills assume paramount importance in this position. The RNFA must coordinate the flow of work and appropriately delegate tasks so that surgeons have everything they need to successfully perform the operation. It might be considered a high-level version of directing traffic in order to keep traffic flowing smoothly. Having RNFAs working in an OR is frankly more cost-effective than having another surgeon as first assist, and both surgeons and hospitals have embraced having these highly-qualified nurses in the OR. For LNCs, though, the RNFA's role is problematic, since it's not required to be documented. This will prove frustrating to LNCs, as they often need to figure out, when an operation goes wrong, why it happened. OR notes may not even record that the RNFA was present. Anna says she relies on the operating room nurse to record her presence, but LNCs may also want to dig down to discover if an RFNA was working in the OR. This is my second solo podcast on the topic of difficult clients. In this podcast, Client Disputes and Departures – LNC Nightmares, I describe some of the diverse issues associated with fee collection. As always, I share some of the mistakes I've made—so that you won't make them. The first issue for you to consider if clients aren't paying is the quality of your work product. Attorneys require well-written, accurate, and error-free reports. The best ones will tell you when your report doesn't meet their standards. Sometimes attorneys fail to accurately represent what they need in a report. I describe a case where that happened to me. It's of primary importance for you to spell out every detail of the contract you have the attorney sign. That includes payment schedules, the disallowance of contingency payments, the point at which you will involve a collection agency, and other issues. You also need to decide when you will grant clients some slack. This should always be based on their value to your business. When clients disappear, it's always a good idea to find out way. Some reasons have nothing to do with the quality of your work, and that's a good thing to know. It's equally valuable to know if the client has an issue with your work product. In this session, Handling Tough Clients: Business Insights for LNCs, you'll discover valuable lessons I've learned from working with attorneys. Listening to or reading this podcast can save you thousands of dollars and untold misery. I take up three major difficult client situations. The first is the importance of boundaries. You need to make it clear when you are and are not available to clients. Set those boundaries and safeguard them. You will prevent a lot of stress in your life. Money issues can be huge for legal nurse consultants. As a novice LNC, I didn't increase my rates as regularly as I should have. I've learned to see this in the context of cost-of-living increases. Like everyone, I have increased expenses. If I want to stay in business, I need to pass them on to the client. Rest assured that they are doing the same and learn to state your increases in a matter-of-fact way. I give some specific suggestions. It took me a while to catch on to the idea of rush fees. ALWAYS charge rush fees when needed. If you are dealing with a new client, ask for a retainer upfront. The third important element is client fit. Some clients are very difficult to work with, and I'll share with you some strategies for managing the client fit problem. Today's podcast, The Role of Legal Nurses in Placenta Accreta Cases, discusses a serious condition called placenta accreta. When this occurs, the placenta attaches to the uterus, causing major difficulties in the delivery of the infant. Nurse specialist Katie Roberts goes into depth about this medical condition. While the condition is rare, it's on the rise. Katie explains that cesarian sections and placenta previa are some of the risks for placenta accreta. Another risk factor is a pregnancy in which there have been no ultrasounds and sometimes no medical supervision at all. This prevents the obstetrician from preparing safely for the delivery. A carefully planned delivery, often by cesarian section, involves a complete team of medical practitioners. A primary goal is to prevent excessive blood loss, and when deemed appropriate, to schedule the delivery in advance of the anticipated due date. An LNC experienced in obstetrics can make a major contribution to the evaluation of a case involving placenta accreta. He or she can assess the medical personnel's consideration of the risk factors and preparedness to prevent crises, as well as determining whether the optimal procedures were used. Katie points out that, due in part to women becoming pregnant at increasingly older ages, the risk of placenta accreta correspondingly increases. That alone makes this a valuable podcast for you. We discuss one of the most disturbing and problematic areas of health care and forensic medicine: child abuse, which may be physical, sexual, emotional, or due to neglect. Katie Holmes, a pediatric nurse practitioner with over 17 years of experience, assists attorneys with child abuse and other child-related cases. She's here to share her wealth of information in this critical area. She emphasizes the importance of teaching children about inappropriate touching and their right to say “no.” This should be part of a child's early education. Evaluation of physical injuries has to be done carefully, and the kind of injury must be correlated to the age of a child. An eight-month-old baby may roll out of a bed, but it is highly unlikely that a three-week-old baby will. It's also essential to have a pediatric ophthalmologist examine for retinal damage. The kinds of skull injuries sustained are also significant. While it's always wise to be alert for abuse, Katie points out that some injuries are caused by genetic conditions. Some children may sustain fractures from a blood pressure test. Others have bruised-looking skin from hereditary conditions. In this podcast episode, we explore Crafting Effective Chronologies for Legal Nurses. Creating chronologies that have multi-purpose functions in a range of cases is one of the services attorneys are most likely to request. Today we have an expert in this area, Mary Beth Kerstein, who will share with you what she's learned about this important service. Attorneys lack both the time and medical expertise to prepare a chronology, and it's not a job that can be handed off to a paralegal. This is where LNCs can prove their value. Mary Beth addresses a number of practical issues. Since all records don't arrive at the same time, you need to find a way to indicate new information for the attorney's benefit. She details how to do this. The biggest issue is deciding what information is pertinent for a chronology. As this will also determine the length and number of billing hours required, she recommends that you ask the attorney what he or she wants. You can also provide samples of chronologies you've done. She emphasizes that the chronology should be opinion-free. Expert witnesses, opposing attorneys, and other parties may see this. If the attorney wants it, you can provide your opinion about the case in a separate email. You can also offer to provide additional services, like a list of providers or a medical glossary. As a legal nurse consultant, you will be evaluating both the physicians who may be defendants in lawsuits and in the selection of physician expert witnesses. He breaks down the stages of the very long path of a would-be doctor's journey. One issue he demystifies is whether going to a non-U.S. medical school is a handicap in terms of professional reputation. As long as a student passes the USMLE (U.S. Medical Licensing Examination), they are qualified. He also explains about board certification in a specialty. Roughly 60% of doctors are not board-certified. Board certification gives an extra layer of credibility. Dr. Patel says that board-certified doctors are less likely to be involved in malpractice suits. They are seen as having greater credentials than doctors without that extra credential. Given the challenge of selecting expert witnesses, this distinction will help LNCs make the choice that can often influence juries. One of the greatest difficulties for novice entrepreneurs is dealing with difficult clients. This can be especially difficult for a nurse. In a clinical setting you get a regular paycheck. Usually, expectations of what you will do are clear. Pat Iyer and Barbara Leven share tips on how to handle difficult attorney clients. In communications, though, with attorneys, until you get to know them, that kind of clarity doesn't always manifest. Some attorneys don't make their needs clear; others may not want to discuss issues they have with your work. Pat Iyer and Barbara Levin, experienced LNCs share their expertise in these areas. They emphasize that you will often need to take the lead in discerning issues. Ask questions. Persist in making contact. Listen carefully. In practical terms, have a contractual agreement signed before you work. If a termination of the relationship occurs, return unused portions of the retainer. Richard emphasizes that malpractice suits may often contain elements of fraud. This provides as huge opportunity for LNCs. They can catch the discrepancies in billing that may point to fraud. They can detect diagnosis discrepancies. In countless ways, they can provide the attorney with information that can greatly strengthen a case. In cases where a potential client says he can't afford your fees, consider each case on its own merits. This may be a negotiating ploy. You may have to resist your nurse-ingrained impulse to help you. Remember, you have bills to pay. The same determination applies when your client refuses to pay your invoices. Find out if there were work-related issues. Do your best to get paid without resorting to a collection agency but go that route if you must.
