We get really, really personal on this one. Michael Johnson is the CEO of Metrc, the most trusted and experienced provider of cannabis regulatory tech in the United States. The company's solution combines advanced software, radio-frequency identification (RFID), a dedicated customer-support team, and a secure database to track cannabis from growth, harvest, and processing to testing, transport, and sale. Metrc is engaged in 23 government contracts and serves more than 300,000 users, including growers, testing facilities, dispensaries, state regulators, and law enforcement officials. Johnson's experience managing highly effective teams, integrating business units, and building out enterprise-wide processes has consistently led to the harmonization of customer experience and profitability. During his time as Metrc's president and CFO, he transformed its organizational infrastructure, hired top leadership across all phases, and led year-over-year growth of nearly 50%. Prior to joining Metrc, Johnson spent his career scaling hyper-growth tech businesses, working with investors and overseeing financial operations. Most recently, he served as the CFO of InformedDNA, the largest provider of genetics services, where he led the company to consecutive years of high growth, eventually selling the company to private equity investors. Over his 20+ year career, Bryan has held a number of executive and operational roles with some of the largest cultivators, manufacturers, and retailers in the cannabis industry. Some of Bryan's prior roles include Head of Cultivation at Vapor Room, one of the industry's first legal and fully-vertical cannabis businesses in San Francisco. Although the political landscape has largely leaned towards more positive sentiment towards cannabis, it is still very expensive and risky to do business in the industry largely because of compliance burdens like tracking the entire operation from seed-to-sale. Cannabis companies often spend 1/3rd of their time on compliance-related issues. There are licenses required to do different parts of the process like growing, manufacturing, selling. What’s worse is, they cannot participate in the financial markets because banks will ultimately get fined for doing business with them. Regulation 280E and Significant Growth ConstraintThe cannabis industry has been set up to fail. Although it’s getting more mainstream, there are still significant choke points that prevent businesses from thriving like Regulation 280E, a piece of legislation that punishes banks for doing business with any company that deals with a schedule I or II drug (Cannabis is still a Schedule I drug federally). Some large cannabis companies receive their transactions in cash only and have a difficult time getting capital to scale businesses. Furthermore, individual states have different regulations and amounts of license, which makes it much more difficult to participate. Capital comes to CannabisAs the industry grows and becomes legal in more states, there is a new interest in investment. In 2018, there was a $13Bn investment into the legal marijuana industry up from $3.4Bn in 2017. When capital starts flowing into the industry, the entrepreneurs start finding ways to solve more problems! We talked to Stacey Hronowski, an entrepreneur that is trying to get rid of the compliance burden by creating an Enterprise Resource Planning (ERP) tool called Canix to handle just that. Since everything from growing the product to selling it needs to be tracked, Canix has found a way to make it easier for businesses to collect their data, use their data, and strive with it. As I was pointing towards the gold mine of data in the podcast, Stacey kept emphasizing the importance of understanding what the customers needs are with the data that they collect.Canix doesn't only become an ERP for compliance purposes but also a place to figure out how to become successful in the industry. The current suite has all sorts of functionality like live inventory tracking, METRC integration (The regulation stuff), Chart of Accounts management (the accounting stuff), RFID harvesting, and clone data. This week’s regulatory compliance updates are from April 1 to April 8 and contain information for California, Colorado, Michigan, and Washington dispensaries, as well as federal and international news. California is being sued by 24 cities over a rule that allows marijuana deliveries in places that have banned cannabis retail stores. A Los Angeles Times article noted “Those that stand to benefit from the state rules allowing home deliveries include 311 state-licensed delivery firms.” The Colorado Sunset Bill “Proposes Changes for Pot Industry Rules and Regulations”, including (but not limited to) selling hemp and CBD in recreational dispensaries with testing, medical marijuana equivalency limits for patients, and merging medical and retail marijuana codes. In Michigan, Metrc released information within a recent bulletin on a new software update that will allow Provisioning Centers the ability to record sales deliveries to a qualifying patient. As of April 5, 2019, the Metrc Admin for each Provisioning Center will see a new selectable “Deliveries” option beneath the “Sales” tab. Michigan regulators also released an updated “Home Deliveries Procedures Checklist” for medical cannabis deliveries. This extensive 3-page checklist will help ensure all home deliveries are compliant with the regulations. In Washington state, the WSLCB shared that they will soon seek input from cannabis testing labs, as well as retailers, on upcoming Quality Assurance Testing and Product Requirements. Also, Leaf Data Systems’ newest version will include numeric standardization that will standardize decimal values pertaining to weights and the replacement of drop-down menus with “type-ahead” search fields for batches, inventories and inventory types. Soon after, Qlik reports are scheduled to be available. In federal and international news... On April 2nd, the FDA Commissioner Scott Gottlieb issued a press release on hemp and hemp-derived cannabidiol (also referred to as “Hemp CBD”). The FDA is creating a “working group” to “explore potential pathways for dietary supplements and/or conventional foods containing CBD to be lawfully marketed.” Guam became the first U.S. jurisdiction to legalize marijuana in 2019 with the signature of Gov. Lou Leon Guerrero (D) on April 4th. When it goes into effect, the U.S. territory’s new law will permit adults 21 and older to possess and grow cannabis, and it will create a system of licensed and regulated businesses to produce and sell marijuana. Scott Denholm spent the first part of his life on the west coast, then he moved east, and now he resides down south in Tennessee. This variety of experience has helped him develop an acute talent for understanding different people, which helps him greatly with his line of work developing track and trace programs for cannabis cultivators. He says it’s all about listening to what someone wants, to be able to figure out what they really need. After a stint in the Navy and time at ADT Security, Scott wouldn’t have ever imagined he would have found his way to the cannabis industry, but a consultant gig with the Marijuana Enforcement Division in Colorado set him on such a path, and now he’s implementing Franwell’s Metrc program in states all over the country to ensure their cannabis programs are efficiently and effectively regulated.
