Is there anything a person can do that makes them unworthy of our empathy, curiosity, or compassion?   What if they've done something truly heinous?   This episode features my conversation with Robin Steinberg, who spent 35 years as a public defender in New York representing people in court who couldn't afford a lawyer, many of whom had undeniably committed horrific crimes.    In her book, “The Courage of Compassion: A Journey from Judgment to Connection,” and in this conversation, Robin makes the case that even in instances where a person has committed a crime, they are still worthy of being treated with dignity. While she acknowledges that even for her, practicing compassion for people who have committed crimes doesn't always come instinctively, getting there is made easier by asking a question that creates a perspective shift — Would you want your entire worth as a person judged by the worst mistake you ever made?   Robin is on a mission to help people maintain their humanity throughout their experience in the United States legal system, which Robin says crushes people before they are ever convicted of a crime, even in instances where the accused is innocent.   I encourage you to listen closely to what Robin is advocating for. Robin Steinberg is an American lawyer and social justice advocate, with over 30 years of experience as a public defender. Robin also is the founder and CEO of the bailout project, the first-of-its-kind nonprofit revolving bail fund. On any given day, about half a million people are locked in jail, but not yet convicted of any crime. The most common reason by far is an inability to pay cash bail. Bail is the main driver of mass incarceration, but what is cash bail? How should it work in theory? And how does it work in practice? Are reforms needed? Engagement and Representation There are a multitude of ways to become an engaged citizen. Often people think of civic engagement as an overwhelming and high-level concept. In reality, civic engagement can be performed on any level, from lowering the speed limit on your street and participating in a protest, to joining a local advisory council or parent-teacher organization. Since the 2016 election, it has become increasingly imperative that we participate in our democracy as citizens. The price of freedom Cash bail was initially conceived as a way to incentivize the accused to come to court at their appointed court dates. As the criminal legal system expanded during the tough-on-crime years, cash bail was set at amounts that low income people could not afford. Even though they had yet to be convicted of a crime, they were forced to go to jail because they could not afford bail. One way to get out is to plead guilty to a small offense so that they can go home, but that adds significant complications down the road. The cost to our society Our society pays a steep price from allowing the current cash bail system to continue as it is. American taxpayers spend 14 billion dollars each year to hold people in jail cells who have not been convicted of a crime. The collateral consequences are estimated to be as high as 140 billion dollars per year. Most disturbing is that only 2 percent of the Bail Project’s clients actually receive a jail sentence. In fact, when people are fighting their cases from a position of freedom, judges and prosecutors are willing to engage in alternatives to incarceration as sentences. A new system A new system to ensure people appear at appointed court times must come from a perspective of humanity and respect. Over a decade’s worth of data in the Bronx shows that effective court reminders do work. Further, the needs of the accused have to be addressed, such as transportation fare or emergency child care, especially for low income people. Most importantly, any new system must involve a presumption of innocence, and can no longer be a two-tier system that favors those who can afford to pay for the price of their freedom. For most people, a traffic violation simply means a fine. But for poorer people in the US, it could mean being imprisoned. Since the global financial crisis, local and state governments have tried to make up for shortfalls in tax revenue by issuing more, and larger, fines. Recorded in October 2017 - Robin Steinberg ’82 is a leader and a pioneer in the field of indigent defense. She is the CEO of The Bail Project, a national organization modeled after The Bronx Freedom Fund, which she co-founded with David Feige in 2007. Steinberg is the founder and former executive director of The Bronx Defenders, a community-based public defender office serving low-income New Yorkers in the Bronx since 1997. She helped develop The Bronx Defenders’ model of holistic defense, a client-centered model of public defense that uses interdisciplinary teams of advocates to address both the underlying causes and collateral consequences of criminal justice involvement. She is also the director of Still She Rises, Tulsa, the first public defender office in the nation dedicated exclusively to the representation of mothers in the criminal justice system. Steinberg received her BA from UC Berkeley and JD from New York University School of Law. She is currently a senior fellow of the Criminal Justice Program at UCLA School of Law, where she works with faculty and students on bail reform initiatives and research.
