Content/Trigger warning: police brutality, addressing racism, brief mention of sexual assailants Today we are going to discuss something a little bit different but highly relevant. We aim to wake everyone we can up to police brutality. What has happened to the people we talk about is a crime and a senseless one at that. We want to drive the point home that even after the outrage that occurred during the murder of George Floyd in 2020, even to this day black men and women are being murdered for no reason by law enforcement. We do not believe all of law enforcement to be bad people, but it's unfortunate that many of them do indeed seem to target people of color. It has to stop. For the last few years, former Dallas Police officer Amber Guyger has hoped to appeal her conviction and sentencing for killing an unarmed man in his apartment in 2018. But now that the state's highest criminal court upheld her murder conviction and 10-year prison sentence Wednesday, Guyger may be running out of options.     Meanwhile, the family of the man she shot and killed says they haven't had the proper chance to mourn their loved one, 26-year-old Botham Jean, throughout the years-long saga surrounding the fatal shooting. Guyger fatally shot Jean, who is Black, after she entered his home on Sept. 6, 2018. He was eating ice cream when Guyger came in. Guyger says she thought it was her place and he was an intruder, so she shot him. Guyger lived on the floor above Jean. She was arrested, fired from the department and indicted for murder. She was convicted and sentenced in 2019 and made an appeal last year. After the appeal was filed last year, Alissa Charles-Findley, Jean's sister, told me her family's mourning has been prolonged. 'It Feels Like We Were Sentenced Too': For Botham Jean Family, the Trauma Never Endshttps://www.dallasobserver.com/news/it-feels-like-we-were-sentenced-too-the-jean-familys-trauma-has-been-prolonged-13710612

Today on the podcast, Robin and Lester share their thoughts on the question asked at the end of every episode, “What is Justice?”. In addition, to close out the podcast, we share a few clips that exemplify the various types of justice as well as a short compilation of many of our former guest's definitions of Justice.   Robin Frazer Clark: Robin Frazer Clark is the owner and founder of the law firm of Robin Frazer Clark, P.C. Ms. Clark has practiced law for thirty years in Atlanta, Georgia, all as a trial lawyer in personal injury cases. Prior to this firm she was a partner in Clark Goldner, P.C. from 2004-2006 and a partner in Jewett and Clark, LLC from 1997-2004. Ms. Clark devotes one-hundred percent of her practice exclusively to representing everyday Americans who have been injured by the carelessness of others. This includes personal injury and employment matters, automobile wrecks, tractor-trailer wrecks, premises safety, elevator and escalator cases, products safety (including defective automobile manufacture), medical malpractice and sexual harassment cases. Ms. Clark was recently invited and inducted into the International Society of Barristers. She is a Past President of the Georgia Trial Lawyers Association (GTLA) and previously served as President-Elect, Vice-President, Secretary, Treasurer, Parliamentarian and Education Committee Co-Chair of GTLA. She served on the Editorial Board of The Verdict and was elected to membership in the American Board of Trial Advocates (ABOTA). Ms. Clark was also on the Board of Governors for the State Bar of Georgia for Atlanta Circuit Post No. 36. She is a Past President of the State Bar of Georgia and a member of the Atlanta Bar Association, in which she is a Past Chair of the Litigation Section. She is a Member of the General Practice and Trial Section of the State Bar of Georgia. She is also a member of the American Association for Justice (formerly, the Association of Trial Lawyers of America) and a member of the Executive Committee of The Lawyers Club of Atlanta. Ms. Clark is a Fellow of The Lawyers Foundation of Georgia. Read Full Bio   Lester Tate: Lester Tate is a trial lawyer who served as the 48th President of the State Bar of Georgia.  Since 1996, he has practiced as a member of Akin & Tate, Georgia's oldest continuing  law firm. He has spent his entire professional career as a courtroom lawyer, having tried  over one-hundred civil and criminal cases to verdict and appeared over thirty times in  state and federal appellate courts.  He currently serves as National Treasurer of the American Board of Trial Advocates and  a member of the Executive Committee. He is the past President of the Southeastern  Chapter of the American Board of Trial Advocates (SEABOTA) and is a member of the  American Bar Association's House of Delegates.   Lester is a Fellow in the International Society of Barristers, an invitation-only trial lawyer  honorary society, whose members are rigorously screened by trial lawyers and judges to  determine the member's ability, experience, accomplishments and ethical standards.   He is Senior Fellow of Litigation Counsel of America, a trial lawyer honorary society  comprised of less than 1% of American lawyers, and, because of his extensive courtroom  experience, he holds the rank of “Advocate” in the American Board of Trial Advocates  (ABOTA).  While devoting most of his time to wrongful death and serious personal injury cases,  where he has a number of million and multimillion-dollar verdicts and settlements,  Lester's practice includes many diverse matters. He has successfully defended  individuals charged with a broad array of state and federal crimes at trial, ranging from  murder to conspiracy. Plus we talk to Jack about congress has failed its responsibilities, the Fed has let the country down, and address the main issue of the flood of money put into the economy over the last few years, combined with unprecedent amounts of spending. In September 2018, Botham Jean, an unarmed black man, was killed inside his own apartment by Amber Guyger- an off-duty police officer who mistakenly entered his apartment thinking it was her own. After a frantic 911 call, an investigation into the incident ensues and this high profile case added fuel to the national conversation about police brutality against black people in America. How does an off-duty officer resort to her gun so quickly? Did Amber's pre-existing racial biases lead to this fateful decision? Why did some media outlets find it necessary to slander Botham Jean's name after his death? And how can one of Botham's family members find the strength within them to forgive the killer? All this and more are discussed as we take on a frustratingly outrageous and completely unforgettable homicide.UPDATE: ** Since the recording of this episode, Amber Guyger's second appeal has been denied and the court has upheld her conviction.**FIND US ON SOCIAL MEDIA:Instagram: @crimefamilypodcastTwitter: @crimefamilypod1Facebook: Crime Family PodcastEmail: crimefamilypodcast@gmail.comEPISODE RESOURCES:Timeline of Events:https://abcnews.go.com/US/death-innocent-man-timeline-wrong-apartment-murder-trial/story?id=65938727Guyger Found Guilty:https://www.cbsnews.com/news/amber-guyger-verdict-guilty-verdict-delivered-in-ex-dallas-police-officer-trial-today-live-updates-2019-10-01/Amber Guyger's Sentencing:https://www.cnn.com/2019/10/02/us/amber-guyger-trial-sentencing/index.html"Bo's Law":https://www.wfaa.com/article/news/local/three-year-anniversary-botham-jeans-death-legacy-bo-law-dallas-officer-shooting/287-f7089c96-9d96-4423-858f-4089c9abac61Botham's Family's Lawsuit:https://www.dallasobserver.com/news/botham-jean-family-moves-forward-with-lawsuit-against-dallas-11970691Texas Murder Laws:https://www.nealdavislaw.com/criminal-defense-guides/types-homicide-charges-texas.htmlDr. Todd Grande's Analysis of the Case:https://youtu.be/Lyy5EZt35XwAmber's Text Message Exchanges:https://www.google.com/amp/s/amp.cnn.com/cnn/2019/10/02/us/amber-guyger-trial-offensive-texts-trnd/index.htmlAmber's Appeal:https://www.dallasnews.com/news/courts/2021/11/18/dallas-appeals-court-again-upholds-amber-guygers-conviction-for-the-murder-of-botham-jean/
