In 2024, his Legal Innovation Through Design Thinking course was recognized by Bloomberg Law as one of the law school innovations of the year. He oversees and teaches global leadership and design thinking for legal leaders from firms, government, and the judiciary. He focuses his Executive Education teaching and writing on leadership, teams, talent development as strategy, design thinking and driving innovation and organizational alignment from a talent management and diversity and inclusion perspective.Before HLS, Professor Westfahl was the Director of Professional Development at the law firm Goodwin Procter LLP. In 2008, Professor Westfahl was chosen as one of Law Firm, Inc. magazine's five “Innovators of the Year” for his development of a cutting edge attorney assignment system and database called iStaff, which effectively ties attorney work assignments to their professional development needs. Professor Westfahl is the author of the book You Get What You Measure: Lawyer Development Frameworks and Effective Performance Evaluations (NALP, 2008).Prior to his work at Goodwin Procter, Professor Westfahl spent six years leading professional development for the Washington, D.C. office of McKinsey & Company. The decision overturns the growing body of case law precluding FCA liability when a defendant's interpretation of the applicable law was objectively reasonable regardless of the defendant's actual knowledge. Boyd also previously practiced law as a partner in the Boston office of Goodwin Procter LLP and the Washington, D.C., office of Alston & Bird. Guest Ken Lee had not really thought he would be a lawyer; he went to law school as a means for kicking life's decision-making down the road. After a summer job at the Attorney General's office in Boston and a course of study that pointed him to litigation, he had a couple of views of paths he could take. He started in litigation at a number of firms but found, over time, that he didn't find much joy in it. He figured that if a partner position came, he would continue the toil. The partner job did not materialize and, instead, he was let go. He took that as an opportunity to try out the public side and took a job back in the Attorney General's office, where he felt much more connected to the work.As he found his footing again professionally, his family of four got news that they would soon be five. Their surprise addition made Ken rethink how he wanted to be spending his time and what the optimal job-household divide was for their family. On Thursday, March 25, 2021, the Supreme Court issued its decision in Ford Motor Company v. Montana Eighth Judicial Dist. Court and the consolidated case of Ford Motor Company v. Bandemer. The case turned on specific personal jurisdiction, the type of contacts required by the Fourteenth Amendment to satisfy Due Process, and the Court’s precedent in International Shoe Co. v. Washington, which sets the standards required for an out-of-state defendant to be constitutionally called into a foreign state court. In this case, two plaintiffs sued Ford alleging product liability causes of action resulting from death and serious injury that occurred during accidents allegedly caused by product defects. Markkaya Gullett died and Adam Bandamer was seriously injured. The pair of wrongful death and serious bodily injury product liability claims were brought separately in the states where the death and the injury respectively took place: Montana and Minnesota.Ford Motor Co., as an out of state defendant incorporated in Delaware and headquartered in Michigan, argued in both cases that insufficient contacts connected Ford to the two forum states so neither the Montana nor the Michigan state court could constitutionally exercise specific personal jurisdiction over Ford. Both state court cases were heard by their state Supreme Courts and both times, the Supreme Courts ruled against Ford holding Ford was properly subject to personal jurisdiction in their state judicial system.Ford appealed both state Supreme Court decisions on the constitutional Due Process question. In an 8-0 decision, the Supreme Court ruled against Ford holding that Ford’s contacts with both forum states were sufficiently extensive and connected to the subject matter of each suit that an exercise of personal jurisdiction could satisfy Due Process and was reasonable and fair in line with International Shoe.Featuring: -- Karen Harned, Executive Director, National Federation of Independent Business Small Business Legal Center -- Jaime A. For law students who want to do good in the world, there are three conventional paths.  Some law students pursue jobs in the public interest and work for non-profit organizations.  Others find jobs in government agencies where there are many opportunities to serve the public good (in local, state or federal government). Still other aspiring attorneys elect to choose a traditional career in private practice and pursue pro bono work on the side.  But there is a fourth way to use your law degree that can satisfy a desire to do good while doing well, go to work for a mission driven practice. There are many examples of mission driven practices.  Some firms focus on representing non-profit institutions in corporate or litigation matters.  Other firms might do civil rights work or represent individual clients who are victims of domestic violence. There are firms that represent labor unions and firms that handle asylum cases.  There are firms that advocate on behalf of special needs children to obtain services that are being denied by school systems. And there are firms that represent profitable businesses that have a mission driven good or service that they provide. My guest in this episode, Jonathan Klavens, represents the last category of mission driven practice.   Jon is the owner of Klavens Law Group.  His practice focuses on meeting the diverse legal needs of companies, investors, public entities and nonprofits in the areas of clean energy/clean technology, sustainable agriculture/aquaculture and food ventures, social enterprise and impact investment. In his practice, he draws on his diverse background in general corporate, securities, project development and finance, fund formation, energy transactional, energy regulatory, environmental and nonprofit matters. Jon founded Klavens Law Group, P.C. in 2007 to help enable innovative ventures that have positive environmental or other social impact. Jon previously practiced law at BCK Law, P.C. and Goodwin Procter LLP, and clerked for the U.S. Court of Appeals for the First Circuit.  He holds a B.A. from Columbia College, a Masters in Public Policy from the Harvard Kennedy School and a J.D. from Northeastern University School of Law, a school which attracts a lot of students looking to make a difference in the world.

Many observers felt that commercial real estate was the next shoe to drop after the subprime housing crisis, but it has outperformed most investment options. Craig Williams and Bob Ambrogi welcome Attorney Fred Alvarez, chair of the ABA Commission on Opportunities for Racial and Ethnic Minorities in the Profession and award recipients Attorney Richard A.
