Dr Phil spoke at Madison Square Garden saying Trump wasnt a bully. Ha! Professor Yamada is an internationally recognized authority on workplace bullying. He is a professor of law and the director of the New Workplace Institute at Suffolk University Law School in Boston. It is the primary drafter of model workplace anti-bullying legislation known as the Healthy Workplace Bill, which is serving as a template for law reform efforts in the U.S. He also is the founding board chairperson of the International Society for Therapeutic Jurisprudence, which promotes the application and design of laws, legal procedures, and legal institutions that support psychological health and well-being. Professor Yamada identifies former President Donald Trump as being a classic workplace bully, constantly resorting to ridicule, name-calling, and cruel putdowns in his public and private behavior. These actions are consistent with some of the worst types of workplace bullying. Drawing from the DSM-V, Trump's behaviors are often called “cluster B” traits or behaviors. Cluster B includes narcissism, sociopathy, emotional dysregulation, impulsivity, and attention-seeking. It is no wonder that 40 out of 44 former insiders from the Trump White House have now come out in favor of Kamala Harris. The idea of well-being is central to Professor Yamada's work and the backbone of our discussion in this episode. In this week's episode, we're speaking with a legal tech entrepreneur who operates at the intersection of generative AI and access to justice. Today's guest, Kara Peterson, is co-founder of descrybe.ai, a free legal research tool leveraging AI to make complex legal information more accessible to professionals and laypeople alike. For several years, Kara worked in marketing and communications at various organizations, including Suffolk University Law School. She continued this work in the public health space for a decade, serving as Executive Director of Communications at Boston University School of Public Health and Chief Communications Officer at Harvard T.H. Chan School of Public Health. In these roles, she became further interested in access to justice. She would go on to create descrybe.ai with tech software engineer Richard DiBona, as a way to help people overcome the cost barriers to legal information they may need. This year, descrybe.ai is a finalist at the American Legal Tech Awards for both the AI category and the Startup category. In our conversation, Kara talks about what makes descrybe.ai unique and the problems it aims to address, how her hometown influenced her access to justice work, and her advice for legal professionals considering using generative AI.

So, this week, we wanted to look back on a wonderful discussion we had with Andrew Perlman, Dean at Suffolk University Law School. In this episode, Dean Perlman spoke about his various roles as a leader in the legal industry, and we discussed the impact of recent technological advancements on legal training as well as the bar exam. Andrew Perlman is Dean at Suffolk University Law School, and has been a faculty member there since 2001. Before entering academia, Dean Perlman was a litigator with a lifelong fascination with innovation and technology. He has served several important functions in the American Bar Association, and was recently appointed to serve on the Advisory Council of the ABA Task Force on the Law and Artificial Intelligence. Dean Perlman has also been involved in various national and local reform efforts—from police practices and access to justice, to developing alternate paths to law school and bar admission. He has served as a member of the Content Scope Committee of the National Conference of Bar Examiners, which helped to identify content for the next generation of the bar exam. Additionally, he has written numerous articles on professional responsibility and legal innovation, and he has served as a presenter or panelist at more than 100 academic, judicial, and other professional programs. Today, Dean Perlman talks about how his passion for innovation started with a Commodore 64, the history and culture of Suffolk, helping law students embrace generative AI, and updating the bar exam.

Our guest this week is a leading voice on the future of legal education and law practice. Andrew Perlman is Dean at Suffolk University Law School, and has been a professor there since 2007. Before entering academia, Dean Perlman was a litigator with a lifelong fascination with innovation and technology. He has served several important functions in the American Bar Association, and was recently appointed to serve on the Advisory Council of the ABA Task Force on the Law and Artificial Intelligence. Dean Perlman has also been involved in various national and local reform efforts—from police practices and access to justice, to developing alternate paths to law school and bar admission. He has served as a member of the Content Scope Committee of the National Conference of Bar Examiners, which helped to identify content for the next generation of the bar exam. Additionally, he has written numerous articles on professional responsibility and legal innovation, and he has served as a presenter or panelist at more than 100 academic, judicial, and other professional programs. Today, Dean Perlman talks about how his passion for innovation started with a Commodore 64, the history and culture of Suffolk, helping law students embrace generative AI, and updating the bar exam.

City lawmakers in Brazil have enacted what appears to be the nation's first legislation written entirely by artificial intelligence — even if they didn't know it at the time. The experimental ordinance was passed in October in the southern city of Porto Alegre and city councilman Ramiro Rosário revealed that it was written by a chatbot, sparking objections and raising questions about the role of artificial intelligence in public policy. Rosário told The Associated Press that he asked OpenAI's chatbot ChatGPT to craft a proposal to prevent the city from charging taxpayers to replace water consumption meters if they are stolen. He then presented it to his 35 peers on the council without making a single change or even letting them know about its unprecedented origin. "If I had revealed it before, the proposal certainly wouldn't even have been taken to a vote," Rosário told the AP by phone. The 36-member council approved it unanimously and the ordinance went into effect on Nov. 23. "It would be unfair to the population to run the risk of the project not being approved simply because it was written by artificial intelligence," he added. Porto Alegre, with a population of 1.3 million, is the second-largest city in Brazil's south. The city's council president, Hamilton Sossmeier, found out that Rosário had enlisted ChatGPT to write the proposal when the councilman bragged about the achievement on social media. Sossmeier initially told local media he thought it was a "dangerous precedent." The AI large language models that power chatbots like ChatGPT work by repeatedly trying to guess the next word in a sentence and are prone to making up false information, a phenomenon sometimes called hallucination. In an article published on the website of Harvard Law School's Center of Legal Profession earlier last year, Andrew Perlman, dean at Suffolk University Law School, wrote that ChatGPT "may portend an even more momentous shift than the advent of the internet," but also warned of its potential shortcomings. However, as the deadline approaches, many of these companies, particularly smaller ones, remain unaware or unprepared for the new regulations. The American Bus Association and other business groups have expressed concern over the lack of awareness and readiness among their members.The Financial Crimes Enforcement Network (FinCEN) is tasked with collecting this information and has been actively trying to raise awareness among businesses. The new rules, part of the 2021 Corporate Transparency Act, mandate companies to disclose owners' names, addresses, birth dates, and identification numbers. The data will be stored securely and made available to law enforcement and foreign governments under certain conditions.While existing companies have until the end of 2024 to comply, new companies formed in 2024 will have 90 days, and those established in 2025 or later will only have 30 days. FinCEN plans to continue its outreach efforts into 2024 and believes awareness will grow over time.Companies Scramble to Get Ready As New Owner-Info Rules Draw NearIn 2023, U.S. courts faced challenges with the rising use of generative artificial intelligence (AI) tools like OpenAI's ChatGPT, particularly after incidents where lawyers submitted legal briefs containing fictitious AI-generated case citations. Experts predict an even greater impact from generative AI on the legal industry in 2024 and beyond. Several U.S. judges have begun to address the use of AI in courtrooms, with some issuing orders to regulate its application in legal proceedings.Two New York lawyers faced sanctions for filing a brief with fake AI-generated citations, and a Colorado lawyer was suspended for a similar issue. Judges have been clear that misunderstanding the technology is not a valid excuse for its misuse. Orders regarding AI use in courtrooms vary, ranging from educational to outright prohibitions, with most requiring disclosure or verification of AI-generated information.The U.S. District Court for the Eastern District of Texas implemented a rule for lawyers to review and verify computer-generated content. The 5th U.S. Circuit Court of Appeals is also considering a certification requirement for the use of AI. In this episode, I interview Jack Ryan - a retired Captain from the Providence, RI Police Department. In the 90's, Jack received his Juris Doctorate, Cum Laude, from Suffolk University Law School. Jack is a former adjunct faculty member at Salve Regina University and lectures frequently throughout the United States. He is the Co-Director of the :Legal and Liability Risk Management Institute and has conducted agency audits for that entity, several involving issues of administrative investigations. Jack regularly conducts training seminars for LLRMI in a variety of subjects including Use of Force, Internal Affairs and Legal Issues. Jack has written two books for use by Rhode Island Law Enforcement Officers, Rhode Island Law Enforcement Officers Guide to Criminal Procedure and Rhode Island Law Enforcement Officers' Bill of Rights, a Practical Guide to the Law of Investigations and Hearings. Jack has written extensively on the legal issues surrounding the Internal Affairs process. Jack Ryan also writes a field guide for law enforcement officers nationally titled: Case Law for Critical Tasks in Law Enforcement, A Legal Guide for Officers and Supervisors, which is updated annually at the end of each United States Supreme Court Term. On this day in legal history, September 29, 1983, the War Powers Act was invoked for the first time – by President Ronald Reagan in order to keep a U.S. Marine presence in Lebanon.On September 29, 1983, the U.S. House of Representatives voted 270 to 161 to invoke the War Powers Act concerning the deployment of American Marines in Lebanon for an additional 18 months. The resolution had bipartisan support, including from President Reagan. This marked the first time the House invoked the War Powers Act, a law designed to limit the President's war-making powers, which was enacted a decade earlier. The Senate would go on to approve the resolution.President Reagan thanked the House for its bipartisan vote, emphasizing the importance of cooperation between the legislative and executive branches. However, the vote also revealed concerns among lawmakers about the U.S.'s role in the Middle East and the potential for the Marines to be drawn into a larger conflict. Some representatives warned that the resolution was tantamount to a declaration of war and could result in American casualties.The debate in the House was marked by a sense of urgency but also caution. Lawmakers were torn between the risks of pulling out and staying in Lebanon, with some describing it as a "very unhappy choice." Despite reservations, the prevailing sentiment was that Congress had to back the resolution to support the President during a crisis.The War Powers Act mandates that the President must notify Congress when American troops face combat and withdraw them within 60 to 90 days unless Congress authorizes their continued deployment. Interestingly, President Reagan had not made such a notification, but the compromise resolution asserted the Act's applicability, making Reagan the first President to acknowledge its validity. This failure to abide by the initial notification requirement, coupled with the later request for an extension, in full light of history, was a major step forward in placing the power to declare war in the office of the presidency.At the time, the Senate was also debating an amendment requiring more detailed reporting from the President on the Marines' mission in Lebanon. The House had rejected a similar amendment, which would have postponed a decision on the Marines' future for 60 more days. The debate touched on the balance of power between Congress and the President, the definition of success in Lebanon, and the long-term implications of U.S. involvement in the Middle East. In the ensuing 40 years, every president has either explicitly or tacitly leaned on the War Powers Act to substantiate action abroad. By way of brief background, the War Powers Resolution mandates that the U.S. President can only deploy armed forces abroad through a formal declaration of war by Congress, "statutory authorization," or in the event of a national emergency caused by an attack on the U.S. or its armed forces. The President must notify Congress within 48 hours of committing troops to military action and cannot keep them deployed for more than 60 days without an additional 30-day withdrawal period, unless Congress authorizes the use of military force or declares war. The resolution was enacted by a two-thirds majority in both the House and Senate, overriding President Richard Nixon's veto. Despite its provisions, allegations have been made that the resolution has been violated in the past, such as George W. Bush's invasion of Iraq in 2003 and Bill Clinton's involvement in the NATO bombing of Yugoslavia in 1999. While Congress has disapproved of these incidents, no successful legal actions have been taken against any President for such alleged violations.Suffolk University Law School in Boston has a significant impact on the Massachusetts legal landscape despite its lower ranking in national lists. As of 2021, the school is the leading source of judges in the state, contributing 118 out of 440 judges on the Massachusetts bench. Additionally, three of the seven justices on the state's highest court and Judge Gustavo Gelpí of the US Court of Appeals for the First Circuit are Suffolk alumni. High-profile roles in the state, such as the Secretary of State and Chief Public Defender, are also filled by Suffolk graduates.However, Suffolk Law ranks fifth in the Boston area and falls in the bottom third nationwide, according to U.S. News & World Report. Despite this, the school has a high retention rate for local graduates, which is crucial for Boston's legal market that faces competition from larger cities like New York and Washington, D.C. In 2022, 73% of Suffolk Law graduates took their first-year job in Massachusetts, a higher percentage than graduates from Boston University, Northeastern, and Boston College law schools.The school's strong presence in the state judiciary and public service sectors has created a cycle that attracts students interested in these fields. For example, state Sen. John Cronin chose Suffolk for its reputation in producing practice-oriented lawyers with distinguished careers in public service. The school's curriculum focuses on experiential programs, allowing students to gain real-world experience.Suffolk Law School also addresses a growing need in Boston's legal market by training scientists to become lawyers for biotech clients. The school offers a nighttime program in intellectual property law, attracting individuals with doctorates in science. Firms like Foley Hoag LLP and Foley & Lardner LLP have hired these specialists and sponsored their education at Suffolk's evening program.In summary, Suffolk University Law School plays a pivotal role in Massachusetts' legal ecosystem, particularly in the judiciary and public service sectors, despite its lower national ranking. Its strategic programs and high local graduate retention rate make it a cornerstone in the state's legal community. It stands as a clear example of the shortcomings and difficulties in trying to reduce a school's educational worth to a hierarchical ranking scale. Underdog Boston School Churns Out Judges, Big Law Partners (1)The IRS has released a plan outlining its operations in the event of a government shutdown, which appears increasingly likely if Congress fails to reach a funding agreement by October 1. The plan involves furloughing approximately 60,000 IRS employees, a change from last year's contingency plan. About one-third of the workforce will continue to work, funded by the Inflation Reduction Act, special compliance funding, and user fees. Essential functions like mail processing, criminal law enforcement, disaster relief transcript processing, and income verification for mortgage lenders will continue.However, the IRS will halt all audit functions, return examinations, non-automated collections, and will not answer taxpayer phone calls. Doreen Greenwald, President of the National Treasury Employees Union, expressed concern over the stress and financial insecurity that furloughed IRS workers would face. She also warned that a shutdown could exacerbate the agency's existing backlog by preventing new hires.Initial discussions had suggested that the IRS would remain fully operational by using funds from the Democrats' Inflation Reduction Act, which are not subject to annual appropriations and are available until September 2031. During the last government shutdown in 2018-2019, many IRS operations were halted, but tax refund checks would have been issued if the shutdown extended into tax-filing season. Eileen Sherr of the American Institute of CPAs advised taxpayers to use e-filing for error-free and direct-deposit refunds, as these will be the only ones processed during a shutdown.IRS to Partially Close, Furlough Staff in Federal Shutdown (2)A National Labor Relations Board (NLRB) judge has ruled that Starbucks violated federal labor law by increasing wages and benefits only for employees in non-unionized stores across the U.S. This marks the first nationwide ruling against Starbucks, which has been resisting a wave of unionization for the past two years. The judge, Mara-Louise Anzalone, stated that Starbucks engaged in a "corporate-wide effort to manipulate its employees' free choice" by tying their pay and benefits to their willingness to avoid organizing. The ruling orders Starbucks to compensate thousands of unionized workers who were unlawfully denied increased wages and benefits.This decision is significant as it is the first to find Starbucks in violation of labor laws on a nationwide scale, as opposed to previous rulings that were limited to individual stores. The unionization campaign against Starbucks has led to nearly 350 organized cafes in 37 states, and the NLRB has filed almost 100 complaints against the company. Of these, at least 75 are still pending.Starbucks has publicly denied any legal wrongdoing and argued that increasing pay for unionized workers would itself be illegal, as federal law prohibits unilateral changes to union workers' conditions. However, Judge Anzalone dismissed this argument, stating it wasn't made in good faith. She also ruled that Starbucks' actions illegally discouraged other workers from joining the union. While the judge did not order additional training for Starbucks managers on labor laws, she did mandate that the CEO read a notice of employee rights to U.S. workers and post it in every store.Starbucks Illegally Kept Wages, Benefits From Union Workers (1)The U.S. Patent and Trademark Office (PTO) has enough funds to continue operations for about three months in the event of a government shutdown. The agency plans to use its $1.04 billion operating reserves to cover patent and trademark expenses. The PTO is primarily self-funded through patent and trademark filing fees but still requires annual appropriations from Congress. In the past, the PTO has remained open during government shutdowns, including the 35-day shutdown from December 2018 to January 2019.However, some patent attorneys have expressed concerns about the PTO's long-term ability to function if appropriations are not made. The agency's financial stability during short-term shutdowns is a change from the past when Congress would divert part of the PTO's revenue to fund other government activities. Although a provision to prevent such diversion was removed from the America Invents Act of 2011, Congress has since committed not to divert PTO fees.Legal practitioners seem largely unconcerned about a potential shutdown affecting the PTO, as the agency has successfully weathered past shutdowns. The Patent Public Advisory Committee and PTO officials have planned for such contingencies by increasing the reserve fund. If a shutdown were to last beyond the reserve's capacity, most PTO employees would be furloughed, and the agency's regional offices would close.A prolonged shutdown could also affect the rulemaking process, including proposed changes to the Patent Trial and Appeal Board and requests for comment on artificial intelligence issues. Other agencies involved in the rulemaking process, like the Office of Information and Regulatory Affairs, could be impacted by furloughs. Finally, while the PTO would continue to collect fees, it would not be able to use those funds without congressional authority.Patent Office Has Funds to Stay Open Three Months Amid ShutdownThe U.S. Supreme Court is set to hear a case involving Zackey Rahimi, who argues that his Second Amendment rights were violated by a law preventing individuals under a domestic violence restraining order from owning firearms. This case could have broader implications for where guns can be carried, including in malls and parks. The court's decision will be its first opportunity to clarify its 2022 ruling in New York State Rifle & Pistol Ass'n v. Bruen, which has led to varying interpretations in lower courts.In Bruen, the Supreme Court established that the government must prove a law restricting gun access aligns with the nation's historical tradition of firearm regulation. However, this has led to inconsistent rulings, as judges lack clear guidance on how closely a modern law must resemble historical laws to pass constitutional muster. The ambiguity has particularly affected laws prohibiting gun possession in "sensitive places" like parks and libraries.Judges have been divided on what counts as a "sensitive place," leading to contrasting rulings. For example, a New Jersey judge ordered the state to stop enforcing provisions that prohibit gun possession in parks and libraries, while a similar challenge in New York received the opposite treatment. Legal experts anticipate that the Rahimi case could provide much-needed clarity on how to apply the Bruen test.If the court sides with Rahimi, it could have far-reaching implications for existing gun legislation, including laws about carrying firearms in "sensitive places." Renee Landers is a Professor of Law at Suffolk University Law School in Boston. She teaches Constitutional Law, Administrative Law, Health Law, and Privacy Law, among other academic pursuits. She also has served in a number of other impressive positions, including a term as President of the Boston Bar Association and another as Chair of the American Bar Association's Section of Administrative Law and Regulatory Practice. Among her many volunteer activities, Professor Landers has played and continues to play a significant role in the area of judicial ethics in her home state of Massachusetts. And, perhaps most important, she happens to be a great role model for aspiring lawyers. I've known Professor Landers for a number of years and could think of no one I'd rather talk with about some of the most significant decisions issued by the United States Supreme Court in the final weeks before its summer recess, and about the current controversy over whether the Justices should be bound by Congressionally-imposed rules of judicial conduct, as are all other federal judges. I learned a lot from the conversation and I hope you'll enjoy it as much as I did.

Remember to rate and review GTP in iTunes: Click Here To Rate and Review   Episode Details: Multi-Million Dollar Advocates Forum member Marc Diller of Diller Law, P.C. explains how he secured justice for tenant Cathrine Erickson when her landlord failed to prepare her Watertown, Massachusetts rental property for winter, creating a dangerous situation that resulted in permanent injury to Cathrine's right leg. After being informed by Cathrine and other tenants that the drain at the end of the sloped driveway was not working properly, landlord Rosalie Cunio chose to withhold important property information and ignore the contractor's proposed solution in favor of a cheap fix. The repair was ineffective, as water continued to pool, taking days to drain. The drainage problem was compounded when winter came and Rosalie did not "winterize" the rental property, including shutting off the exterior water. In February 2013, Cathrine returned home from her job as head coach of Northeastern University's track and field team and slipped on black ice caused by water spraying from a hose. As a result, Cathrine sustained a serious injury requiring a titanium rod as well as seven screws to stabilize her right leg. Today, this accomplished coach struggles with mobility and suffers from chronic pain. In March 2019, trial lawyer Marc Diller detailed the landlord's negligence and violations of common sense safety practices to a Middlesex County, Massachusetts jury. The jury returned a verdict in favor of Cathrine, awarding $2,324,815.62 in damages. Brookline's local paper, The Brookline Citizen, profiled Marc Diller as its Brookline Student of The Week. The article was titled, “Diller, an attorney in training”. Even back then, Marc's passion for service and the law was evident. Nearly 30 years later, Marc uses that passion to deliver safety and justice to his clients. Marc helps people and their families during their most vulnerable times. It's his ethos to hold corporations and insurance companies accountable for wrongdoings. Marc fights corporate and individual wrongdoers when it results in wrongful death or catastrophic injury. Marc doesn't back down from the fight. Throughout his 20+ year career, Marc has held property owners, who maintain dangerous conditions, accountable for their wrongdoings. He has made companies take responsibility for the death or losses that result from making, designing or selling dangerous products. Marc also makes employers on construction sites answer for unsafe work conditions. When motorcyclists, pedestrians, bicyclists and those in cars are killed or injured by dangerous drivers and the companies that employ them, Marc seeks justice. He goes after the drunk, distracted and drowsy drivers, the companies that employ them and the restaurants, bars, and clubs that ignore safe service practices and let drivers drive dangerously. “Our client's trust us to do right by them,” says Diller “and I insist that all Diller Law, PC's lawyers care about safety and accountability in our community.” Marc grew up in Brookline, MA, the son of a lawyer and an educator. At the University of Michigan, Ann Arbor he wrote for the Michigan Daily newspaper, majoring in English and communications. From there, he went to Suffolk University Law School, his father William's alma mater. Marc worked with his dad at the Law Offices of William Diller starting in 1997. William mentored Marc until 2013. Marc learned a lot from William's 40+ years experience in law. William was the editor-in-chief of the Suffolk Law Review ('69), clerked for Justice Reardon at the Massachusetts Supreme Judicial Court ('70), was an associate at one of Boston's premier law firms, and during William's 40 years in private practice, he handled many complex and significant personal injury cases.
