Two wildfires that burned more than 1 million acres in the Panhandle were caused by downed power lines, according to the Texas A&M Forest Service. In this episode of S&C's Critical Insights, Juan Rodriguez, Co-Head of S&C's European Competition Group and the Firm's Antitrust Group, and associate Marielena Doeding discuss the European Court of Justice's ruling in the Fiat case and its implication for future state aid investigations. This landmark judgment—in which the Court of Justice annulled a General Court judgment and European Commission decision –clarified the parameters under which the Commission may investigate individual tax rulings under state aid rules. Although the judgment reaffirms that the Commission may investigate tax measures for compliance with state aid rules, in doing so, it cannot apply its own version of the arm's length principle to tax measures; in particular, it cannot apply the arm's length principle to tax measures in jurisdictions unless – and then only to the extent that – the law of the jurisdiction incorporates that principle. Instead, the Commission must carefully consider national tax rules to assess whether or not a measure confers a selective advantage for state aid purposes. In the United States, an administrative law judge recently denied the Federal Trade Commission's request to prohibit the transaction on competition grounds. In Europe, the European Commission opened a highly publicized suspensory investigation into the transaction, which is seen as a test case for the EC's recently revised policy on reviewing mergers that do not require mandatory reporting to the EC. The Great Product Owner: When lack of experience becomes an asset for a PO! This PO was new to the organization, and didn't have a lot of knowledge about the product. However, that was not an obstacle for this Product Owner. She took that as an opportunity to ask question, and learn as much as possible from the team. Because of that learning journey, she also learned to be present, and help the team answer some critical questions. Even if she did not know the answer to those questions, she was able to find out who else to involve, and helped the team at the same time as she discovered the product herself. In this segment, we refer to the book Fish! By Stephen Lundin, and how the PO exemplified the model described in the book: Play, Make the Day, Be There, Choose Your Attitude! The Bad Product Owner: PO actions the disengage, and demotivate Scrum teams This was a marketing team working with a sales tool. The Product Owner decided by themselves that the team was “not going fast enough”, and started asking some team members to “work on this project during your lunch break”. When that was found out by the rest of the team, the team felt betrayed, and started to disengage from the work! Juan was working with a marketing team. This team was divided between China and the USA, and on top of that, the team did not share a language. While the USA part of the team used English to communicate, the China based portion of the team would not feel comfortable with English in all situations, and preferred to use Chinese. This meant that the manager, who spoke Chinese, quickly became the bottleneck in communication, as she needed to translate all the conversations in the team. Juan had a problem to solve: how to help a team communicate regularly (in the daily meeting) without the manager having to be in the middle? In 1609 a free man of African and European ancestry, Juan Rodriguez, left the Dutch ship Jonge Tobias anchored off Manhattan Island with “eighty hatchets and some knives” to set himself up in trading with the local Indians. Ashore in coming years he fought off Dutch rivals, married an Indian woman, and started a family, all the while prospering by trading in bear and beaver pelts. His is one of the many stories presented by David Hackett Fischer in his new book African Founders: How Enslaved People Expanded American Ideals, which examines nine Afro-European regional cultures in North America. Following in the footsteps of his previous books Albion's Seed, Liberty and Freedom, and Champlain's Dream, in African Founders, Fischer seeks to determine in this case how individuals both free and enslaved within these cultures “acted with purpose and resolve to change the ways that free and open systems worked in what is now the United States.” David Hackett Fischer is University Professor and Warren Professor of History Emeritus at Brandeis University. Author of numerous books in addition to those already mentioned, his Washington's Crossing won the 2005 Pulitzer Prize in History.
