“Fortnite” has opened the door for a new wave of popular streamers and aficionados to go pro by turning their favorite past-time into a potential career. Outside of a few major streamers that most of us already know like Ninja and Tfue, there are even younger players who have newly arrived on the stage ready to leave their mark on the industry. Un mardi du mois d'avril, je salue parmi les personnes retenues au CRA un monsieur avec une abondante chevelure blanche, plutôt en retrait du groupe, qui ne parle pas français ; j'apprends qu'il est polonais et qu'il va être expulsé en Pologne au motif de constituer « une charge déraisonnable » pour l'Etat français. Je sais ce qu'est une charge déraisonnable dans mon budget ou même dans les comptes d'une entreprise ; le récit médiatique quotidien nous susurre combien « nous ne pouvons accueillir toute la misère du monde » ou même comment « des hordes d'étrangers viennent profiter du système français d'aide sociale ou de santé ». Mais comment des personnes peuvent-elles produire de tels déséquilibres dans les comptes de notre Etat ? Méandres des textes de loi Je cherche à comprendre à partir de l'exemple donné par ce Monsieur... Je cherche aussi à éviter de nous noyer- nous autres citoyens plus ou moins néophytes juridiques- dans les méandres des nombreux textes de loi. Ces derniers encadrent certes scrupuleusement et soigneusement ce motif d'expulsion pour « charge déraisonnable » ; mais finalement il persiste un flou bien déraisonnable en théorie et, en pratique, qui frise la folie ! Définition juridique des notions de la libre circulation des ressortissants européens et de la citoyenneté européenne : La libre circulation dans l'Union Européenne va de pair avec la notion de citoyenneté européenne définie dans l'article 20 du Traité européen (TFUE) : « Est citoyen de l'Union toute personne ayant la nationalité d'un Etat membre ». Elle « complète la citoyenneté nationale et ne la remplace pas ». L'article 21 du même traité « prévoit le droit pour tout citoyen de l'Union de circuler et de séjourner librement sur le territoire des Etats membres ». La liberté de circulation pour tout citoyen européen peut s'exercer pendant une période de trois mois. Au-delà, des conditions de ressources et d'assurance maladie sont nécessaires. Ce droit est étendu aux membres de la famille des citoyens européens sous certaines conditions (et aux citoyens d'Islande, du Lichtenstein, de la Norvège et de la Suisse), et des mesures transitoires d'intégration ont été prises pour la Croatie jusqu'au 30 Juin 2015. Séjour inférieur à trois mois d'un Européen dans un autre pays de l'Europe Le citoyen européen doit être en possession d'un document de voyage, il ne doit pas être une menace à l'ordre public ni une charge déraisonnable pour le système d'assistance sociale français, ni constituer un abus de droit. Trois textes de loi nous précisent cela ! (1) Hé oui, rien que pour définir ces trois conditions, il y a toute cette littérature juridique. Vous comprendrez aisément mon souci d'éviter les noyade ! Littératures inhospitalières Pensez à vous munir de suffisamment d'eau pour étancher votre soif et vouss tenir éveillés jusqu'à la fin de mon article, sinon signalez-vous pour organiser votre retour vers des littératures plus hospitalières et plus riantes ! Séjours supérieurs à trois mois : Ils sont autorisés selon l'âge des personnes, leurs activités, ou leurs attaches en France donc pas pour tout le monde. L'article 20 du TFUE prévoit que : « tout citoyen de l'Union a le droit de séjourner sur le territoire de l'Etat membre pour une durée de plus de trois mois... s'il dispose, pour lui et pour les membres de sa famille, de ressources suffisantes afin de ne pas devenir une charge pour le système d'assistance sociale de l'Etat d'accueil au cours de son séjour, et d'une assurance maladie complète dans l'Etat d'accueil ». Il faut donc soit travailler, soit justifier de ressources suffisantes et disposer d'une assurance maladie, soit être étudiant (donc obligatoirement avoir des ressources suffisantes et une assurance maladie). (2) Le caractère suffisant des ressources est apprécié en tenant compte de la situation personnelle de l'intéressé. En aucun cas, le montant exigé ne peut dépasser le mon- tant du RSA (soit 400 euros en moyenne) ou, (si l'intéressé remplit les conditions d'âge pour l'obtenir), au montant de l'allocation de solidarité aux personnes âgées. (Soit 514 euros). (3) Qu'est-ce qui peut venir contredire le principe fondamental de libre circulation des citoyens européens? Trois motifs d'éloignement uniquement peuvent être invoqués par les préfectures : la menace à l'ordre public, l'abus de droit et la charge déraisonnable. Analyse d'une charge déraisonnable Alors, qu'est-ce que cette charge déraisonnable en tant que motif d'expulsion ? La charge déraisonnable est avérée lorsque « le recours à l'assistance sociale revêt un caractère récurrent pendant des périodes de séjour de moins de trois mois » ou lorsqu'il est clairement établi « que l'objet unique des séjours est le bénéfice des aides ou prestations sociales françaises ». (4) Cela ressemble à la chasse « aux fainéants et autres profiteurs », décris par une certaine rhétorique politique ! La charge pour le système d'assistance sociale d'un ressortissant est évaluée en prenant en compte le montant des prestations sociales non contributives dont il a réellement bénéficié, la durée de ses difficultés et de son séjour. Elle n'est pas « déraisonnable » si elle concerne les prestations sociales contributives auxquelles tous les contribuables participent. L'aide sociale (une notion européenne) a pour objectifs de répondre aux besoins primordiaux des personnes lorsque celles ci ne peuvent y pourvoir ; elle ne peut intervenir que lorsque toutes les autres possibilités ont été épuisées ; elle concerne les domaines de la santé, des personnes âgées et handicapées, l'aide sociale à l'enfance et le développement social. L'analyse de la charge déraisonnable ne peut donc se faire qu'au cas par cas : Selon la circulaire du 10 Décembre 2010 : « C'est en fonction des différents éléments liés au parcours individuel de l'intéressé que vous pourrez déterminer si celui-ci peut (...) se prévaloir de la solidarité financière de l'Etat membre d'accueil, en vous assurant notamment du caractère accidentel ou temporaire de ses difficultés et de l'absence d'une organisation volontaire d'insolvabilité visant à bénéficier abusivement d'une prise en charge par l'assistance sociale ». (5) Cette note montre bien le caractère imprécis des critères à établir par les préfectures et la partialité possible de leur appréciation. Néanmoins, la circulaire va encore plus loin dans le même chapitre : « Le Conseil d'Etat dans un avis du 26 novembre 2008 (...) a déduit que même si l'intéressé n'est pas encore effectivement pris en charge par l'assistance sociale, l'insuffisance des ressources permet de constater l'absence de droit de séjour (...) » de plus de trois mois aux ressortissants européens. Par simple présomption, l'Etat français se débarrasse des citoyens « sans revenus » ? Donc pas de pauvres à nos portes, au cas où ils nous demanderaient quelque chose ? Malheureusement, je n'ai pas pu trouver le nombre de citoyens européens expulsés tous les ans au motif de charge déraisonnable. Le ministère de l'Intérieur précisait au 15/01/2015 que 3 332 européens avaient été éloignés du territoire français en 2014 mais sans préciser les motifs. Les concernés étaient tout d'abord Roumains et Bulgares pour l'essentiel, ensuite les Polonais et enfin quelques Espagnols, Belges, Allemands, Portugais, Italiens et Grecs. (6) De même, je n'ai pas pu obtenir le montant de l'aide sociale dépensé dans la prise en charge des citoyens européens résidents sur le sol français. D'autres questions subsistent ; par exemple, pourquoi avoir défini cet encadrement juridique difficile à mettre en œuvre dans la pratique, avec des incohérences internes et en contradiction avec le principe européen de la libre circulation ? Ce n'est certes pas le seul exemple qui nous montre combien la France peut s'affranchir des principes juridiques de l'Union européenne. Un écran de fumée comme parade aux critiques politiques sur le coût de l'immigration, repris et enrichi par les différents gouvernements successifs? Quoi d'autre encore ?Revenons à notre Monsieur Polonais au centre de rétention de Bordeaux. Son dossier juridique nous apprend qu'il a fait l'objet d'une OQTF sur ce motif de charge déraisonnable. Pourtant, il n'avait jamais sollicité l'aide sociale française. Il a été interpellé alors qu'il s'apprêtait à rentrer en Pologne. Il n'a pas compris pourquoi il était ainsi enfermé ; il n'a d'ailleurs pas contesté la mesure de placement en rétention puisqu'il souhaitait repartir au plus vite. Finalement, il a été expulsé après 13 jours d'enfermement. Rappelons que le coût moyen d'une expulsion depuis un centre de rétention, déterminée par la Cour des comptes en 2010, est de 20 970 euros. (7) Mais tout de même, quelles sont les charges les plus déraisonnables pour l'Etat français ? Over the past couple of years, Nathan has had incredible success with his content on both Twitch and YouTube. The infamous "Fjell with lubed Holy Pandas Typing Sounds" took the internet by storm and many people blame this video for the recent hole in their wallets. Taeha Truly broke the internet with "The Making of Tfue's $3500 Custom Luxury Mechanical Keyboard". A video that many people say opened up the doors to this community and ushered in a new wave of keyboard enthusiasts.
