I first saw Tim's work when he represented retired Navy Seal Eddie Gallagher. Gallagher was accused of 10 UCMJ offenses while serving in a war zone. During this period, I never saw a team so adeptly defend themselves against charges within the military justice system. Later, he represented Stuart Scheller. Scheller spoke out on the Afghanistan withdrawal and faced time in the brig for his offenses. Again, this same professionalism was on full display throughout this public ordeal. Timothy Parlatore is the founder and Managing Partner of Parlatore Law Group. He is a nationally recognized attorney who practices criminal defense and civil litigation. Throughout his career, Mr. Parlatore has avoided pigeonholing himself into representing only certain types of clients or cases in favor of maintaining an interesting and eclectic portfolio of cases.  He initially rose to prominence through his representations of the former Police Commissioner of New York City, the men who parachuted from the World Trade Center, and organized crime figures. In 2018, a decorated U.S. Navy SEAL was arrested and accused of some shocking crimes. Investigators said, while Eddie Gallagher was leading a platoon of these elite commandos in the battle to retake Mosul, Iraq from ISIS, he stabbed a defenseless prisoner to death. The accusations came from SEALs in Gallagher's own platoon, who also said he was known for taking shots at civilians from his sniper's nest, and killing at least two. We talk with 'New York Times' correspondent Dave Philipps, who covered Gallagher's trial and interviewed many of the Navy SEALs who leveled the accusations against Gallagher. He served as a Corpsman and a Sniper. During his final deployment in 2017 to Mosul, Iraq, Gallagher was the Platoon Chief. The objective during this deployment was to work side by side with the Iraqi military to retake the city of Mosul from ISIS. It was after this deployment where a few members of his platoon accused him of committing war crimes. We walked through this deployment and what led to some of the SEALs claiming he was a war criminal. After spending time in a military prison and being mistreated by the Navy, he was acquitted of murder charges. This entire ordeal became a political point of contention which led to President Donald Trump intervening on Gallagher's behalf. A crisis at the top of military leadership in the handling of a high-profile war crimes case has raised questions in the San Diego military community about the military justice system and what good order and discipline looks like. President Donald Trump's recent interventions in several military justice cases, including that of San Diego-based Navy SEAL Eddie Gallagher's, have military leaders debating whether the moves undermine the authority of military commanders to instill good order and discipline in the ranks. Some Navy leaders in San Diego said they are flummoxed by Trump's interventions and their recent fallout, including the firing of Navy Secretary Richard Spencer over the weekend. “He's hammering away at the foundation of the military — good order and discipline,” said a senior San Diego Navy official not authorized to comment. “The president essentially said he doesn't trust one of his admirals' judgment. Guys at my level are literally just throwing up their hands.”

I look at some of the reasons, so many Americans reflexively oppose the US strengthening ties with our nuclear rival. I take on some establishment lies that created the dangerous situation we are now in with Russia and explain Trump has been more aggressive against Russia than Obama.  Links Russia showed US inspectors its hypersonic nuclear missile system under the auspices of the NEW START Treaty. [Link] The Pope visits Nagasaki to call for an abolition of nuclear weapons. [Link] Turkey is refusing to sign off on a NATO defense plan until NATO starts to recognize the Syrian Kurdish militia the YPG as a terror group. [Link] Erdogan says Turkey will manufacture fighter jets in house. [Link] NATO countries are working on a plan to pay more of NATO’s budget in an attempt to appease Trump. France has said they will not sign on to the plan and already contribute enough to defense. [Link] Turkey says their newly purchased Russian-made S-400 air defense system will not be integrated into NATO’s air defense. Russia says Turkey is looking to purchase more S-400s. [Link]  War Crimes The Navy is pushing back against Trump’s decision to restore the pay and rank of war criminal Navy Seal Eddie Gallagher. [Link] The Secretary of the Navy Richard Spencer proposed a secret deal to the White House that would allow Gallager to retire a Navy Seal. Publicly, Spencer pushed to hold a hearing to determine if Gallager would be allowed to retire a Seal. Secretary of Defense Mark Esper asked for Spencer’s resignation in response to the secret proposal. [Link] Bolivia The coup government in Bolivia has passed a new law that annuls the recent election won by Evo Morales and bars him from the coming election. The government made an agreement with protesters to withdraw the military in exchange for the end of protests. [Link] Bolivia’s coup government is investigating the former president for sedition and terrorism. [Link]  UK The UK is refusing to hand control of the Chagos Islands to Mauritius. A UN court rules the UK had to return the islands. [Link] China The US accuses China of attempting to influence the Taiwanese election. [Link] The US sailed warships through waters claimed by China in the South China Sea. [Link] Pro-democracy parties win a majority of council seats in an election. [Link] Afghanistan Trump says the US is working on a deal with the Taliban. [Link] An American civilian was killed by a grenade attack on a UN convoy in Afghanistan. [Link] Iraq The State Department has cut or withdrawn almost all personnel in Iraq, overseeing the distribution of $1.16 billion in aid. [Link]  Iraq shuts down 12 tv and four radio stations for supporting the protest movement. [Link]  Libya US officials meet with Libyan strongman Haftar. Haftar controls the majority of the country and is fighting an offensive for Tripoli. The US pushed Haftar to end the offensive. [Link]

Why does the military have a justice system distinct from the civilian justice system? And what are the implications of having separate forms of accountability? Former Republican Congressman Tom Rooney joins TYFYS to give his take. Congressman Rooney represented Florida’s 16th and then 17th congressional districts from 2009 to 2019. During his time in government, he served on the Armed Services Committee, the Intelligence Committee, and the Committee on Agriculture. Before his political career, Rooney served in the US Army as a Judge Advocate, a military lawyer. He worked as a prosecutor at Fort Hood, Texas, and he later taught law at the United States Military Academy at West Point. In this episode Congressman Rooney discusses his time in the Army and in Congress. In light of his background with military justice and his political experience, Rep. Rooney also gives his perspective on the President’s decision to pardon convicted or alleged war criminals. This episode was recorded on the morning of November 20, 2019. The Secretary of the Navy was fired after going around the Secretary of Defense in order to cut a drug deal with the President regarding Navy SEAL Eddie Gallagher. Round 2: An Army Lt Col is taking charge of troops in a combat zone like nobody ever has before. When you hear this story, your head will be spinning. Round 3: The fucking Russians are back to their old tricks. Round 4: Marine Corps Sergeant Brendan VanDalinda, who has been diagnosed with cancer, went to the Patriots game on Sunday where he was honored with Super Bowl tickets and then dropped a pass from Tom Brady like a boot. We bring him on the show to discuss if he “followed it” or not. Round 5: It's our Thanksgiving episode. We are gonna gather at our internet Thanksgiving table and tell you some things that we are Thankful for. No one better touch the fucking deviled eggs before we finish giving thanks.

U.S. Defense Secretary Mark Esper demanded the resignation of Navy Secretary Richard Spencer, one week after President Trump overruled military leaders and cleared three U.S. servicemembers accused or convicted of war crimes. The men included Navy Seal Eddie Gallagher, who has been accused of multiple war crimes, including shooting two Iraqi civilians and fatally stabbing a captive teenager in the neck. Gallagher was convicted of posing with the teenage corpse but was acquitted of premeditated murder. Trump criticized the Navy on Thursday for moving toward holding a review hearing to decide if Gallagher should be ousted. The New York Times reported Navy Secretary Spencer then threatened to resign after Trump's backlash but there are also reports that Spencer attempted to reach a backroom deal with Trump that would have allowed Gallagher to keep his Trident Pin. In a statement on Sunday, Defense Secretary Mark Esper said he was “deeply troubled by this conduct.” We speak with Daniel Ellsberg, one of the world's most famous whistleblowers. In 1971, he was a high-level defense analyst when he leaked a top secret report on U.S. involvement in Vietnam to The New York Times and other publications that came to be known as the Pentagon Papers and played a key role in ending the Vietnam War. On today's episode of Loud & Clear, Brian Becker and John Kiriakou are joined by Ann Wright, a retired United States Army colonel and former U.S. State Department official in Afghanistan, who resigned in protest of the invasion of Iraq and became an anti-war activist.President Trump last week pardoned Navy SEAL Eddie Gallagher, who had been convicted of war crimes after murdering an ISIS suspect in cold blood. Gallagher had been turned in by his own men and prosecuted by his superiors. Navy Secretary Richard Spencer opposed the pardon and went public with his opposition to President Trump’s decision to also led Gallagher keep his Navy SEAL pin. Yesterday, Defense Secretary Mark Esper forced the Navy Secretary to resign. The Colombian government announced last week that it would close its borders in an attempt to contain mass strikes and protests that have swept the country in opposition to right-wing President Ivan Duque. The original goal of the protests was to oppose Duque’s austerity measures. But in the wake of mass protests across South America, they have taken on a life of their own and are threatening Duque’s hold on power. James Jordan, a member of the Alliance for Global Justice and has been deeply involved in supporting the Colombian peace process, joins the show. An agreement has been reached in Bolivia between the Movement for Socialism party of President Evo Morales and the coup government of Jeanine Añez to call new elections to normalize the situation in the country. Morales remains in exile in Mexico, and the Añez regime has vowed to prosecute him on a wide range of extremely heavy, trumped-up charges. Brian and John speak with Patricio Zamorano, an academic and international analyst and Co-Director of the Council on Hemispheric Affairs, COHA. Anti-establishment candidates won a sweeping victory in Hong Kong’s municipal elections over the weekend. A record number of voters--turnout was 70 percent--led to the opposition capturing 389 out of 452 elected seats on district councils, up from only 124. Pro-establishment candidates won only 58 seats, down from 300. KJ Noh, a peace activist and scholar on the geopolitics of Asia, and a frequent contributor to Counterpunch and Dissident Voice, joins the show. In gun control news, Washington state has raised its minimum age for purchasing a semi-automatic rifle to 21, along with other new rules governing gun ownership. The age restriction went into effect in January, with the other changes taking effect July 1. But some in state law enforcement have vowed not to enforce the measure, arguing that it violates the Second Amendment. In rules for rulers news, Congress is weighing up a bipartisan bill to crack down on the sharing of child porn on Defense Department computers after a watchdog group found the Pentagon's network ranked among the top US ISPs for sharing the vile content. In more rules for our rulers news, a jury found decorated Navy SEAL Eddie Gallagher not guilty of premeditated murder of an injured and captured ISIS fighter he was accused of stabbing. He was, however, found guilty of taking a selfie with the corpse. The case was centered on him killing an ISIS militant who lay helpless, already wounded and being treated by a medic. The case was spoiled when the medic who was already granted immunity from the Military claimed he killed the ISIS militant. Trump has been in the news this week, taking credit for the not guilty verdict. Mueller has agreed to testify before the House judiciary and intelligence committee, do really think he had anything important to say?Mueller agrees to testify under subpoena before House lawmakers It looks like critics who thought they had heard the last from former Special Counsel Robert Mueller in the ongoing President Trump-Russia collusion saga have been proven wrong. Mueller has agreed to testify before the House judiciary and intelligence committees on July 17 after they subpoenaed Mueller on Tuesday, according to the committees' chairmen, Reps. Jerry Nadler, D-N.Y., and Adam Schiff, D-Calif. House Democrats have fought toget access to Mueller and his unredacted report on Russian interference in the 2016 presidential election and whether President Trump obstructed justice. Weeks of negotiations between the Democrats and the Justice Department ultimately resulted in the subpoena.Fox News has learned Mueller would agree to appear only under a subpoena - and that the subpoena was "friendly." Perhaps a bigger question is, What do Democrats hope to achieve with Mueller's testimony? The news of his scheduled appearance has already overshadowed this week’s scheduled Democratic primary debates and could be addressed by all 20 presidential candidates over the two-night event in Miami. For the past several years, former Marine and editor here at Hurricane Media Nick Coffman has been writing in-depth about the true story behind the men known as MARSOC 7. Much of what he wrote was from information relayed to him from the commanding officer of these men, Marine Corps Major Fred Galvin. While Galvin was still in the fight to clear his name, we had him join us previously on Episodes 198 and 206. You can go back to these episodes as well as Nick Coffman’s many articles covering what went down through court documents and testimony to learn the full backstory. Galvin joins us on this episode to speak of the good news of MARSOC 7’s name being cleared with this recent vindication. He expands on the unfair perception of what went down that was painted by the media and many political leaders. Galvin hopes to continue his career with The Marine Corps from here, and we get into that as well. We also get his take on the more recent charges of war crimes against Navy SEAL Eddie Gallagher, as well as a discussion on China which we hope to expand upon for a future episode with Fred. We recorded this episode prior to learning of the death of Navy SEAL Ron Bellan. We learned about this through social media and do not have any further details at this time. Ron was a previous guest of this podcast on Episodes 126 & 139.
