Cyberattacks have become big business, from the standpoint of both the attackers and attorneys pursuing liability compensation from corporate attack victims. Threat actors range well beyond hacker cults of old, now including sophisticated state actors, large businesses organized for the very purpose of cyber breach and theft, and complex threat networks that aggregate information formerly treated as innocuous.  Ransomware is changing the state of cyber insurance, and both National and State regulations across the globe are entering the field to govern the conduct of business victims in this climate, both in terms of ransom payments themselves, and subsequent obligations to persons whose information goes out the pipes.  Breaches, in short, are now a ubiquitous part of the multinational business landscape, and failing to test system vulnerability can present existential risk to any global business organization.   We’re joined by attorney and cybersecurity expert Kari Rollins to discuss what companies can, and in some cases must, do to prepare for a potential cyber attack. Yet after investing so much money and time bringing someone into their world, these same business owners turn around and give their leads the cold shoulder.   Customer acquisition is a critical part of growing your business, but inspiring people to stick around is even more critical. New customers are the most expensive to acquire and the least likely to buy. When all you’re doing is chasing new customers, while ignoring the people you’ve already paid to acquire, you’re costing yourself obscene amounts of time, money, and energy.   Tune into this episode to hear from Yara Golden, an email marketer working with some of the biggest names in the Internet marketing space (including Russell Brunson), as she joins James and Dean for her third appearance on Just The Tips to show you how to grow and monetize your email list in a way that you AND your followers feel good about.   When done correctly and consistently, emailing leads you’ve paid to acquire can add several zeros to your bottom line. It’s Not What You Have, It’s What You Do With It One of the most common excuses Yara hears from people who aren’t emailing their leads regularly is, “My list only has XYZ people on it.” But the size of your list matters a lot less than you think. A small list of quality leads will outperform a giant list of leads who are “meh” about you and your products. If you have any doubts that quality trumps quantity when it comes to your list size, tune in for Yara’s story of a client who closed over $9,000 from a list of 500 people. Start With This Six-Email Sequence After someone opts-in, what do you do with them (after fulfilling whatever lead magnet or product they opted in for, of course)? Start with Yara’s six-email sequence that answers six questions anyone who opts into your list will have about you and what you do. Use these emails to build the know-like-trust factor, share how they can work with you, and set expectations right up front. It’s important to be yourself in these emails, so the people who are a good fit for you stick around, and the people who aren’t realize they’re better off elsewhere. So there’s this fun nightlife vibe going on that bigger college towns have. We have really good weather here. The weather in Fort Collins is just fantastic all year round. Even now, it’s January, it’s in the fifties, sunny, and in the fifties. And so you can run, you can mountain bike, you can climb mostly year-round. If you’re into golf, you can golf year-round. There’s a lot of outdoor activities that you can do throughout the year that you can’t do in a lot of other mountain west locations. And then on top of that, it’s just really close to a lot of really great things. We’re about an hour north of Denver. So the Denver crowds tend to stay away from Northern Colorado. And so we kind of have our forests and our trails and our mountains to ourselves up here. And within an hour of town, you can be back-country skiing. You can be whitewater rafting, mountain biking, backpacking, rock climbing. I mean, There’s so much stuff to do right in town, but also within an hour that a lot of the crowds just kind of stay away from, which makes this place a real gem" "In Fort Collins, you can go out on a Saturday afternoon for a mountain bike ride on one of our local, popular trails and maybe pass ten to fifteen other people. Whereas in Denver, you might pass a thousand people on the local mountain bike trails. So, you know, although there are people out recreating, it is not the crowds like you see down south of here which is really, really special, I think for the people that live here" "I think there’s 220 miles of bike path and bike lane and Fort Collins. So, basically, every street has a bike lane that’s like three or four feet wide. But there’s also a lot of dedicated bike paths that go through the parks, go down along the railways, that are off the streets and totally bike-friendly… Everyone rides their bikes everywhere because it’s so easy" "So the big adventure that you got to do after you’ve played outside in Fort Collins is head back into town, clean up, and get on some bikes … and you head into town, and we’ve got, I think we’ve got 30 or 40 breweries in town … you can ride your bike from brewery to brewery, to distillery, to dispensary, if that’s your thing. So there’s all sorts of fun things to do on bikes. Fort Collins is very patio oriented in the summer. Everyone is sitting outside. Everyone is enjoying the sunshine. And enjoying a good beer after a long day on the mountains" "What’s cool about Fort Collins is there’s enough different breweries that you can find very different styles of beer. So if you like German-style beer versus Belgian-style, beer versus American-style, or whatever your poison is, you can find it here in Fort Collins" "Yeah, you know, the rain doesn’t really stop people here. If you want to get on your bike and riding the rain, it’s actually a really fun experience. So what if you get wet? It’s going to stop raining. That’s the good thing about Colorado. You know, if you get stuck in a rainstorm, it’s only gonna last a little while, and then you’ll dry out at the next brewery. My theory is, that’s the time to be out there. It’s fun to be out in the rain" "I mean, in any given day, basically winter or summer, you can trail run, you can mountain bike, you can hike, you can rock climb, you can golf, you can hunt, you can fish, you can raft, and you can kayak. I mean, there’s a lot of opportunity here if you’re a thrill-seeker or you love the outdoors. It’s got a little bit of everything. And we’re just far enough away from the big city that it’s not overrun yet. Also, the downtown area’s got great nightlife, and I think that that’s something that maybe falls away in some of the mountain towns. And we’re not in the mountains, but we’re tucked right up against them. And so, you know, there’s a lot to do here. Almost every business has the potential to create trade secrets. What is a trade secret and how can companies acquire and, more importantly, protect these intellectual property rights? Joining me for this conversation is Robert Friedman, who provides a roadmap for employers looking to properly care for, protect, and possibly defend their company trade secrets. Robert is a partner and Practice Group Leader of the Business Trial Practice Group and is based in the Sheppard Mullin New York office. He is also head of the firm’s South Asia team and a member of the White Collar and International Arbitration groups. The relationship between the U.S. and China has deteriorated over the last four years. Barely missing a beat from the coronavirus pandemic, China is the only major world economy to post positive growth during the pandemic period, at a rate of 10% at that.  China is now 1/6th larger than the U.S. economy measured by Purchasing Power Parity (PPP), and is projected to outpace the U.S. economy by 135% in just three years’ time, by 2024.  China, moreover, has almost completely displaced the U.S. as the lead trade partner for most nations around the world, toppling the U.S. from that perch with Germany just last year.  And China, as the new Asia Pacific Hegemon, recently formed the Regional Comprehensive Economic Partnership, with virtually all Asia Pacific nations, including historically Japan and Korea. Joining me for this conversation is Seoul, Korea based Paul Kim, to explore the potential turbulence between a once-hegemonic U.S. and the now-hegemonic China. Paul also shares updates from other Asian countries that might affect multinationals doing business in Asia. "The whole section of Palo Duro Canyon is completely different from the north, east, south, and west parts. The north parts, you have really pretty greenery with the rolling hills. And the east parts are just these big boulders that you get to climb up and some people that actually go out there and do rock climbing. The south part, you get some slots; you get the caves. And the west part, you still get the caves, but you get more of the tree vibe and valley feel. What’s the point of these cold, winter months? Why can’t we just run around outside all year long with sun-kissed shoulders and bask in the brightness? Well, as nice as that might sound, we need professional downtime. Our bodies need rest, and our minds need pause. Still, “downtime” is just a hard concept to digest. And it doesn't help that we’re conditioned to feel guilty about it. Despite the dreary mood of winter scenes, those naked branches and gray skies have purpose. When leaves fall from trees and shriveled brown buds drop to the ground, the body of that tree is giving itself permission to rest. It’s really important that as humans, we do the same. The cycle of the seasons holds purpose, and we zip through it at our own peril. While we might look outside and see a vast stillness, what we’re looking past and through is a whole lotta space. And that space is a lot more fertile than we give it credit for. It’s in that newly transparent space, the space that was once taken up by distractingly pretty blooms... the space of their absence is where we’ll find answers. In today’s episode, Karlee talks about the importance of making space for pause. Winter is a time to integrate & marinate. It’s a time for healing the burnout of the hustle season. Core values provide that compass that we all need to show us the direction to follow in order to achieve our goals, and to not be taken off course by the many distractions which life routinely presents. Believe it or not, 2020 will soon be drawing to a close, and with that comes all the usual stress and chaos that each December brings added onto to all the excessive anxiety that this past year has already provided. As a result, I’ve had to double down on my self-care practices, and I imagine the same may be true for you as well. That’s why today’s episode is a throwback one that is all about self-care, one of the most important tools in improving overall health and wellbeing so you can show up your best in your career and life. This episode is filled with information and advice that is as relevant and valuable today as it was when it first aired – maybe even more so. Self-care allows us to take some time out, recharge, and create the space we need to show up with more energy, focus and clarity. BUT, we don’t all have a great relationship with it. If we misuse self-care and end up relying on it as a way of shutting out our problems OR avoid it because we don’t feel deserving, it can keep us from improving our health and reaching new levels of success. When a child with pain does not get timely or appropriate treatment, it makes pain more refractory to treat and often makes the patients and their families feel hopeless, underserved, or mistrusted by the healthcare system.   Pediatricians as the first point of contact (and defense) for all healthcare, with trusted and longitudinal relationships with their patients and their families play a critical role in the success of treatment outcomes, and keeping them engaged and hopeful as they go through their treatment.    As a pediatric pain specialist, I often see patients after patients who have undergone an extensive workup; seen an impressive lineup of specialists, and have waited many months to years before they get to the appropriate care they need and deserve.    I’m bringing in someone who sees patients at an entry-level to share the challenges of pain care in a primary care setting and the strategies she employs to address them as a pediatrician, Dr. Dhanu Sant, MD!   Dr. Sant is the founder of WholeKids Pediatrics, an online service for providing virtual consultation and educational content to keep your family healthier through nutritional, herbal, and lifestyle remedies. Crisis Management 101 At first, we were facing more of a business and marketing crisis than a worldwide shutdown like we see today. That is the first step in crisis management—identifying you are actually IN a crisis. But in crisis management, the most immediate thing is to then determine what the situation is and get the facts. This enables tourism organizations to have more strategic discussions based in realism, not idealism. You can’t react to a crisis based on what you wish was happening or somebody’s artificial forecast. You have to react based on the facts, and sometimes you have to go below the surface to get away from the noise and piece together what is really happening. Stepping Stones Rick recently authored an op-ed that ran in the Vancouver Sun titled “Immediate Financial Assistance Needed to Save BC Tourism Sector.” In this piece, Rick talks about the importance of funding tourism now in order to regain lost business by the year 2023. This is not a quick rebound. Even if a vaccine is approved and distributed in major markets across the globe, it will take time for the wheels to start turning again. People have to individually want to travel again—not desire. But making travel a priority when they’re concerned with getting back to work and replenishing their savings is also going to take time. The pandemic has taken a toll on our industry, but we do have the power to rebuild it better than before. The United States Supreme Court infrequently hears antitrust cases but when it decides to hear a case, the Court has the power to shape the framework of American antitrust laws. In this episode, we’re examining the implications of the Supreme Court’s recent decision in the 2019 Apple Inc. v. Pepper case and the role of the Court in bringing antitrust laws in alignment with modern economic understanding.  Joining me for this conversation are two guests: Thomas Dillickrath and Bevin Newman.  Thomas Dillickrath is a partner in the Antitrust and Competition Practice Group in Sheppard Mullin’s Washington, D.C. office. Tom focuses on antitrust litigation and merger investigations. Prior to joining the firm, he served as Deputy Chief Trial Counsel at the Federal Trade Commission’s (FTC's) Bureau of Competition. Bevin Newman is a partner in the Antitrust and Competition Practice Group in Sheppard Mullin’s Washington, D.C. office. To fully understand the nuances of this area of law, we’re exploring the development of the Antitrust Criminal Penalty Enhancement and Reform Act (ACPERA) over the years and the growth of cartel litigation in the U.S. Joining me for this conversation are two guests, Dylan Ballard and Mike Scarborough. But when we get so excited about an idea that we don’t properly put it through its paces, we end up wasting exorbitant amounts of time and money trying to fulfill an idea that’s never going to happen. Then we blame our customers for not seeing the value, leap to the next “sure thing,” and repeat the process again. This exact cycle is one of the top reasons 90% of startups fail, and why even established businesses can waste hundreds of thousands of dollars on “sure thing” business ideas. Instead of letting idea excitement run the show, tune into this episode of Just The Tips with guest Dr. Adam J. Yes, entrepreneurs have to take risks in order to get anywhere. But there’s a big difference between taking a risk and allowing idea excitement to blind you. When your latest big idea strikes, document it, but give yourself space to get beyond that initial burst of excitement. That way you can evaluate your idea with a level head (and potentially save yourself years of wasted time and money). It’s not your customers’ fault. When you test the waters with your product and don’t get the response you’re hoping for, it’s all too easy to decide you don’t have the right customers. Or that they’re clueless for not seeing the value in what you offer. Educating people who don’t yet understand the value in your idea is possible, but it works a LOT less frequently than most people think. If your solution isn’t a solution in their minds, no amount of educating them will change that.   Keep it lean when you test the waters. Instead of cannonballing into the water with your new idea, dip your toe in, especially when you’re gauging customer interest. Just because someone says they want it, doesn’t always make it so. It depends on who you’re asking, and whether you’re actually solving their problem, or just solving a problem you think they have. You’re never going to feel fully qualified, and nothing will ever be “perfect.”   It’s not about you. There are people you can help NOW. By procrastinating, or even giving up on, your dreams, you’re depriving them of your help. Imagine if you called an ambulance because you were in excruciating pain, and when the EMTs arrived, they just stood outside and stared at you through your living room window. When you allow your own limiting beliefs to derail you, you’re doing to the people you could be helping what the EMTs did in this example scenario.
