June 28, 2024 will be remembered as a historic day in U.S. Supreme Court history. The Court reversed its forty year old precedent in Chevron v. Natural Resources Defense Council, a precedent that was the most important and most cited decision in all of administrative law. The Court's Chevron precedent established a forty year practice of broad judicial deference to federal agency's authority to interpret ambiguous statutes according to those agencies' own criteria. In its decision in a pair of cases concerning the regulation of activity on fishing boats falling under the purview of such a vague statute, Loper-Bright v. Raimondo and Relentless v. Department of Commerce, the Court established new grounds according to which courts, agencies, and Congress would act. To discuss this "sea-change" in the law, we're bringing you an exclusive, immediate mini-sode with one of the lawyers part of the team that prevailed, John Vecchione. Mr. Vecchione is a Senior Litigation Counsel for the non-profit New Civil Liberties Alliance representing clients against the Administrative State. On May 30, 2024, the Supreme Court issued its decision in National Rifle Association of America v. Vullo. In a 9-0 decision, the Court sided with the NRA, affirming the actions taken by New York Department of Financial Services Maria Vullo violated the First Amendment. The case, known as one of the two "jawboning" cases heard this term (along with Murthy v. The Context of White Supremacy welcomes Michael F. Vecchione. “Recently retired as chief of the Rackets Division of the Kings County District Attorney's Office,” Mr. Vecchione is a retired prosecuting attorney, non-fiction writer and Long Island City, New York resident. He co-authored Crooked Brooklyn: Taking Down Corrupt Judges, Dirty Politicians, Killers and Body Snatchers in Brooklyn. This details some of the more salacious cases of Vecchione's career - including Racist Suspect Michael Mastromarino. This White dentist was a Master Deceiver and mastermind of a body parts smuggling ring. In addition to helping to convict Mastromarino, Vecchione co-authored Behind the Murder Curtain: Special Agent Bruce Sackman Hunts Doctors and Nurses Who Kill Our Veterans. About half of this text is devoted to the infamous Michael Swango. This book focuses on Swango murdering and lying at the New York state veteran's hospital. Swango killed (or tried to kill) a number of patients there - including privileged black male veteran Andrew Wood, who survived the attack. Vecchione told us he thinks many of Swango's victims were classified as black. He also classified the conduct of numerous White health care executives and hospital officials as “lazy” for not properly vetting. Swango. We discuss women's sports and the idea that often there isn't much incentive for women to keep playing beyond a certain point because of dead ends they might find there. We talk about various exercises, such as those that have to do with your groin, quads, or hamstrings, that athletes should be doing to avoid injuries. The Supreme Court's most momentous decision was not the 5-to-4 vote to overturn Roe v. Wade. That simply sent the issue back to the states to decide. Rather it was the blockbuster decision to rein in the Environmental Protection Agency from claiming powers that Congress did not grant. When Congress passed the Clean Air Act it authorized the EPA to impose the “best system of emission reduction” for carbon-emitting activities. It did not authorize the EPA to shut down electricity generated from coal. It did not authorize a “generation shift” to so-called renewables like wind and solar. The EPA had claimed these powers to order changes of vast economic and political significance and the Supreme Court essentially said “no you can't do that, not unless there's legislation that clearly and explicitly authorizes it.” As John Vecchione, my guest on this episode, puts it succinctly: “Why do you write down laws? If you write down the laws, don't those words mean something or can they mean anything?” What the EPA has been saying is ‘We are going to set the CO2 levels such that the coal plants can no longer operate. We want to put the coal plants out of business completely.'  This was not its intended mandate. In this episode our hosts, Steve and Katie Keene, speak with Natalie Vecchione who is a FASD parent advocate, podcaster, author…..and most importantly a wife and homeschool mom of two. Natalie and her husband, John, built their family through domestic adoption. Their son, who is 19, lives with an FASD (Fetal Alcohol Spectrum Disorder). He has graduated from homeschool as an aspiring, carpentry apprentice. He lives “interdependently” in an apartment with two roommates and he works part time at a home improvement store.. Their daughter is almost 7 and Natalie & John have a much different adoption journey with her daughter, as they are very close with their daughter's birth mom. Their daughter just started her homeschool journey last year. Natalie turned her family's unique challenges and journey with FASD from career reinventing into a calling when she and her husband began FASD Hope in October 2020.Natalie has been an FASD podcaster for almost 2 years.
