A 1ª Turma do Supremo Tribunal Federal retoma hoje, às 14 horas, o julgamento da ação penal sobre a tentativa de golpe de Estado em 2022. O primeiro processo julgado envolve o chamado “núcleo crucial” da trama, que tem como réus o ex-presidente Jair Bolsonaro e mais sete colaboradores de seu governo, sendo cinco deles militares. O placar está em 2 a 1 pela condenação dos acusados e nesta quinta-feira devem ser conhecidos os votos da ministra Cármen Lúcia e do ministro Cristiano Zanin. Em explanação que começou pela manhã e terminou no fim da noite de ontem, o ministro Luiz Fux votou pela absolvição de Bolsonaro dos cinco crimes imputados pela Procuradoria-Geral da República, contrariando os votos de Alexandre de Moraes e Flávio Dino. O magistrado também absolveu outros cinco réus, mas condenou o tenente-coronel Mauro Cid e o general Walter Braga Netto apenas pelo crime de abolição violenta do Estado Democrático de Direito, por causa do plano de assassinato do ministro Alexandre de Moraes, do STF, formando maioria contra esses dois réus. Em entrevista à Rádio Eldorado, Ana Laura Barbosa, professora de Direito Constitucional da Escola Superior de Propaganda e Marketing (ESPM), apontou contradições no voto de Luiz Fux. “O ministro voltou atrás com relação a alguns posicionamentos, demonstrou aí algumas contradições em comparação com qual era o posicionamento dele no julgamento dos executores do 8 de janeiro, dos indivíduos que diretamente participaram das depredações”, ponderou. A especialista também contestou a tese de Fux de que os atos preparatórios dos réus não configuraram um golpe de Estado e levantou outra contradição na condenação de Braga Netto e Cid por abolição violenta do Estado Democrático de Direito. “A dúvida que fica é qual é a linha que divide a conspiração, que na visão dele não seria um crime, e o tentar. Porque me parece que na visão dele o tentar executar um golpe de Estado exigiria atos que na verdade seriam efetivamente a prática do golpe de Estado. Na minha visão, o conspirar para realizar um golpe de Estado já chega a ser tentar fazer um golpe de Estado. E aí de fato a conclusão foi a condenação apenas de Braga Netto e de Mauro Cid e a absolvição dos demais réus. Essa é a primeira sentença do magistrado em um caso da Lava Jato. Appio entendeu que o Ministério Público Federal teve acesso aos dados bancários de Schmidt de forma ilegal. Alvo de duas ações na operação, o empresário foi acusado pelo MP de pagar propinas de mais de US$ 200 milhões. Ele estava foragido desde julho de 2015. Segundo a Procuradoria-Geral da República, ele “é, provavelmente, o fugitivo com maior patrimônio desviado dos cofres públicos brasileiros”. Schmidt foi detido pela primeira vez em Lisboa, em março de 2016, e travou uma batalha jurídica para evitar a extradição.
