Full and fair access to immigration legal services is vital to ensure justice for asylum seekers and other migrants seeking protection in the immigration courts or immigration status before U.S. Citizenship and Immigration Services (USCIS). Legal representation is also essential to the effective functioning of the immigration court system, improving outcomes and appearances at all levels—an essential element for a body that is facing more than 2 million pending cases. Resolution of affirmative applications before USCIS and immigration court cases takes years, and the waiting times continue to grow. For poor and low-income immigrants, there is an average of only one legal representative for 1,413 unauthorized persons in the United States and this number varies greatly by state. Panelists discuss the current state of immigration legal services and the growing need for representation. They address the importance of investment in universal representation and the use of innovation and technology to ensure access to justice for those seeking status and protection in the United States. Special Guest Julie A. Werner-SimonMs. Julie A. Werner-Simon is often referred to by her colleagues by the acronym “JAWS”– her initials.  In response to the historic overturn of Roe v. Wade, Ms. Werner-Simon leads the Overground Reproductive Law Project (ORLP), aka the “Harriet Project”, with Los Angeles Women Lawyers (WLALA) and the Southwestern Law School Women Law Student group. Their focus is to assist lawyers from Reproductive Access Yes (R.A.Y.) states who wish to provide reproductive assistance to women in “No-choice” states. Ms. Werner-Simon served a federal prosecutor for almost 30 years in Los Angeles and Alaska. She has also served as an Assistant United States Attorney (AUSA) and held positions as:  Deputy Chief of the Organized Crime Strike Force and Senior Litigation Counsel of White Collar Crimes. Before her federal career, she was an Assistant District Attorney (state prosecutor) in Alaska primarily prosecuting sex crime cases. Werner-Simon has been recognized as a crime-victim advocate and lectures here and abroad on the American legal system, constitutional history, and the importance of civic literacy and engagement in democracies.On these shores, Werner-Simon advises, and at times, mentors lawyers and others on messaging, strategy and persuasion. She is also a pro bono lawyer for the national organization Kids in Need of Defense (KIND) representing minors from Central America facing deportation proceedings in the U.S.  And through May 2020, Werner-Simon is a Post-JD (juris-doctorate) Research Fellow in Constitutional Studies at Southwestern Law School.

This episode of CMSOnAir is the second in a series featuring academics, policymakers, and advocates who have written for the Center for Migration Studies’ (CMS) Journal on Migration and Human Security (JMHS). In this interview, Jennifer Podkul, the Vice President of Policy and Advocacy at Kids in Need of Defense (KIND), describes the United States’ recent history with respect to the humanitarian protection of children and offers an overview of the current situation at the US-Mexico border for child migrants. An international human rights lawyer and expert on child migration to the United States, Podkul recently testified before the House Committee on Homeland Security on the best practices for the care and protection of child migrants. Podkul’s 2016 JMHS paper, “The Impact of Externalization of the Migration Controls on the Rights of Asylum Seekers and Other Migrants,” examined how the United States, Australia, and the European Union sought to prevent migrants and refugees from arriving at their borders to seek protection. One example presented in the paper is the Obama administration’s response to the increase in unaccompanied children in 2014. Podkul describes what has changed since the Obama administration with respect to the deterrence of child migrants and offers policy recommendations for the care and reception of child migrants. From a frozen asylum system, huge camps on the Mexico border and family separation policies, to the worsening lack of healthcare and the aftereffects of COVID-19, Latinx communities are at a disadvantage both inside and outside U.S. borders. In this episode, we focus on events over the last few years greatly impacting Latinx communities: socially, economically and politically—as Trump administration immigration policies have resulted in child separation,huge camps on the Southern border, stalled immigration and much more. Meanwhile, those held in detention centers face an added layer of challenges—ranging from lost children, to an increased risk of COVID infections. Are detainees seeking self-deportation to avoid contracting COVID? And what about sexual abuse? Despite numerous lawsuits and thousands of complaints filed against detention facilities staff, this staggering pattern of sexual abuse seems to continue in immigration detention centers. Today, a conversation about US immigration policy and its human and economic impacts. President Donald Trump’s consistently anti-immigrant rhetoric and his efforts to fund and build a massive wall on the southern US border have raised the temperature in the national debate over immigration. The president has imposed steep reductions in the numbers of immigrants admitted to apply for citizenship, and sharply curtailed US approval of refugee asylum requests — even as the number of people seeking entry to the US has risen. Families have been forced to wait for months, sometimes years, for their cases to be heard in immigration court, and since last year, many have been sent to wait for their hearings in dangerous Mexican border towns. Tens of thousands of refugees fleeing war, violence and poverty have been turned away. The agencies charged with carrying out immigration policy — Customs and Border Protection, Immigration and Customs Enforcement (ICE) and the Department of Homeland Security, report stepped-up border apprehensions, undocumented immigrant arrests and deportations. To help us understand the impact of these changes in US immigration policy, Tom talks today with four people who’ve been on the front lines of America’s immigration conflict... Ruben Chandrasekar is the director of the Baltimore office of the International Rescue Committee, which provides support and relief for refugees. Gabriela Roque (ROH-keh) is the lead Baltimore organizer for the migrant-rights advocacy group, CASA of Maryland. They join me here in Studio A… And Sonia Nazario is the Pulitzer Prize-winning author of Enrique’s Journey, a contributing opiniojn writer to the New York Times, and a board member of Kids in Need of Defense (KIND). They also provide representation for children who would otherwise be showing up before judges alone. [13:49] KIND also advocates for changing the laws that impact children coming into the U.S. and being separated from their parents. [14:18] David was a stay-at-home dad while his wife pursued a career. David became a foster parent, as well, to do something positive for others. Over several years, they fostered four children at different times. David learned how traumatic it is for children to be separated from their parents, even when it is necessary to protect them. [16:14] David wants to help, in whatever way he can, to mitigate some of the damage and contribute to helping the people working to lessen the negative impacts of some of the policies and practices in place, separating children from families. [16:43] There are different ways to communicate with children. Sometimes it can be through books and discussions more than just trying to explicitly teach somebody a lesson. [17:10] Nikki is living in Bangkok, Thailand with her husband and son. They have been there for about a year. [17:27] Nikki started illustrating the book about 10 years ago. She stopped after three pages, having lost interest in illustrating “other people’s books.” She put it away until very recently. Nikki painted in acrylics. She finished all the pictures, redoing some of them. Then she scanned them all to a computer and did the layout electronically. [18:05] Publishing books is very affordable in Bangkok. Production costs in the U.S. are much higher. For the next run, production costs, with shipping, will be less than $1.00 per book. At a selling price of $10.00, they will donate almost $9.00 per book sold. The first production run came to about $3.00 per book. [19:00] David wrote a lot of books. There will be quite a few more to come. Nikki drew the pictures for another one, many years ago, that she is considering redoing, and there is another she may start illustrating soon. Nikki’s goal is to have a second book done in the next six months. [20:00] David is 65. This experience is a reinvention for David and a time of discovery. Both David and his wife retired at the end of 2018, so they are exploring how to use the time available to them, including working with his writings of the past. [20:59] It was a joy for David to see the book become real that had always been in his head.There is a real sense of satisfaction that Nikki, the child David was trying to teach and inspire, is now a part of the process of completing the book, for others and her own child. [22:11] Nikki tells how she could tell her usually unexcitable father was excited on first seeing the book. [23:16] Nikki had the story in an email sent from David. Nikki had to break it into pages and come up with the images based on the words on the page. Besides the interior illustrations, she designed the cover, using illustrations from the book. [24:57] Nikki tells how it came to pass that she illustrated the book. She had gone through a vocational art program. Once or twice David had hinted that it would be nice if Nikki or someone she knew drew the pictures for the story. [25:31] It’s nearly impossible to get a children’s book publisher to pick up an unknown author. There are so many children’s books, already. To pay someone to do high-quality illustrations is extremely expensive, so it’s hard to recoup those costs. Nikki always considered that she had the capability to do it and she really loved David’s books. [26:02] It almost felt to Nikki like an obligation to do the illustrations for the books she had loved from her childhood, so that’s how she came around to it. [26:14] Marc has a good friend through Leadership Austin who aged out of the foster care system. Marc also knows people in organizations at the border and he lives in Mexico, so he feels connected to the Yeager’s story in several ways. [26:52] Nikki talks about the distribution of the book. They also created lesson plans that go along with the book and they plan to do read-alouds in schools, with activities for teachers and classes. [27:31] Nikki and David are working very hard to get more reviews and word-of-mouth. Nikki invites listeners of the Repurpose Your Career podcast to spread the message. More than 1 million people in the United States receive temporary forms of humanitarian relief. Additionally, each year, tens of thousands are granted asylum or admitted as refugees. The Trump administration has sought to reduce these protections, by temporarily halting refugee admissions and reducing the number of refugee admissions to less than half of the prior level. Other forms of humanitarian relief, including Deferred Action for Childhood Arrivals (DACA) and Temporary Protected Status (TPS), are under threat from the administration, the courts, and Congress. In this panel, the Presidents of Kids in Need of Defense (KIND) and HIAS, joined by the head of Hispanic and Migration Affairs at the Mexican Embassy, discuss the current state of humanitarian relief and the implications of the administration's policy decisions for the most vulnerable immigrants, including refugees, TPS recipients, and children.

Since 2009, the number of unaccompanied minors apprehended crossing the U.S. border has sharply increased. The journey for these children is long, expensive, and dangerous. What is the cause of this sudden influx of young immigrants? On this episode of Lawyer 2 Lawyer, hosts Bob Ambrogi and J. Craig Williams interview Alex Nowrasteh from the Cato Institute and Elizabeth Dallam from Kids in Need of Defense (otherwise known as KIND). Together they discuss the immigration numbers, reasons for seeking asylum, and suggested policy changes. Tune in to learn how immigration is affected by Central American gangs and the War on Drugs. Alex Nowrasteh is the immigration policy analyst at the Cato Institute's Center for Global Liberty and Prosperity. Previously he was the immigration policy analyst at the Competitive Enterprise Institute. Among many publications, his work has appeared in The Wall Street Journal, Houston Chronicle, and Boston Globe. He has appeared on Fox News and numerous television and radio stations across the United States. He received his B.A. in Economics from George Mason University and Masters in Economic History from the London School of Economics. Elizabeth Dallam is the National Legal Services Director at Kids in Need of Defense (KIND) which is a program providing pro bono legal services to children who arrive "unaccompanied" or alone to the United States. Previously, she served as the Senior Protection Officer at the United Nations High Commissioner for Refugees in Washington, DC. During her tenure at that organization, she acted as the agency's focal point on unaccompanied children and advocated for systemic reforms in law and policy to better protect children. Prior to that, Elizabeth was the Executive Director of the Florence Immigrant and Refugee Rights Project in Arizona, where she started a children's representation project.
