In this episode, I break down two major federal laws passed in 2023 that expand workplace protections for women—especially those who are pregnant, postpartum, or breastfeeding. The Pregnant Workers Fairness Act (PWFA) gives employees the right to reasonable accommodations for pregnancy, childbirth, and related medical conditions, similar to the ADA standard, as long as the employer has 15 or more employees. We also cover the PUMP Act, which strengthens and broadens the right to break time and a private space to express breast milk at work. Together, these laws close long-standing gaps in federal protections and help ensure that women don't have to choose between their jobs and their health.

NLRB – The NLRB issued a complaint against SpaceX and in response, SpaceX filed its own lawsuit claiming that the entire structure of the NLRB is unconstitutional. This could get interesting. Johnson v. Federal Information Systems, Inc. – In this case, an employee was discharged after making a complaint of discrimination, which sounds like a classic retaliation claim except for one key fact. Ledesma v. Orland Park Wedding Center, Inc. – What should you do if an employee discloses mental health conditions and asks for a leave of absence? Galette v. The U.S. Department of Labor (DOL) recently issued Field Assistance Bulletin No. 2023-2 to provide guidance to its field staff regarding enforcement of the Providing Urgent Maternal Protections for Nursing Mothers Act (PUMP Act), passed in 2022. Now in effect in all states, the PUMP Act expands the Fair Labor Standards Act's (FLSA) workplace protections for all employees, not just nonexempt workers, who need to express breast milk.In this episode, Heather and Emily discuss the new guidance and how the DOL interprets and may enforce the PUMP Act, including available remedies for violation of any provision of the Act.

The PUMP Act, or the Providing Urgent Maternal Protections (PUMP) for Nursing Mothers Act, is a federal law in the United States that was enacted in 2018. The law requires employers to provide reasonable break time and a private, non-bathroom space for nursing mothers to express breast milk at work. The PUMP Act amends the Fair Labor Standards Act (FLSA), which sets minimum wage and overtime pay standards for employees in the US, to include these protections for nursing mothers. The law applies to all employers covered by the FLSA and applies to nursing mothers for up to one year after the birth of a child.
