   Slam the Gavel welcomes back Connie Reguli to the podcast. Connie was last on Season 2; Episode 98 and Season 3; Episodes 63, 70, 77 and 89. Today we discussed the Family Rights and Responsibility Act that has passed through the Senate in Tennessee. If this bill passes it has the potential to sweep through this nation, stripping parents of their parental rights via teachers, CPS and/or Department of Health.     Connie has served as an attorney for three decades throughout Tennessee and helped parents fighting for their rights and defending parents against their own government. Connie was retaliated against severely and the whole system turned against her, concocting a fake crime for strongly defending a parent. When attorneys stand up, they get BRUTALIZED.      There were CPS bills that came up this year and Connie went in to speak against these bills, all got passed in the House and Senate. Within one of those bills was Reverse The Standard of Proof For Parents: that if a court found that child had been severely abused (terms used loosely), the child could not return to a parent unless the court excluded the parent by clear and convincing evidence  as a perpetrator, or any other person - grandmother or anybody. CONSTITUTIONAL VIOLATION.     Within the  bill was that if  the state can put on proof by an expert that the child and the expert can reasonably "predict" that the child is going to suffer from a severe psychological event such as anxiety or depression then that is severe abuse, and the parent can't see the child. You can't predict that they are going to have injury in the future. Termination of a parent's rights should NEVER occur over MONEY.      We discussed the bill (TN, 2024 SB2749) " Family Rights and Responsibilities Act."  It has already passed through the Senate Committee in TN. WHAT IS A PARENT?  Within  this Bill, is the way the state will define a parent. A parent is a biological, legal or adoptive parent OR an individual who has been granted decision-making authority over the child under state law. Here are parental rights: direct upbringing of the child, moral and religious training, make medical, gender and mental health decisions, to access medical records, educational records etc.. Even a non parent can make decisions for the child. They have defined decision making authority which is GRANTED BY THE STATE. We are damaging OUR rights, not ADDING to them. BAD NEWS. Also, ANY branch, agency or commission or instrumentality of the state government: so the literal reading of this is that a teacher can grant decision-making authority.......This is making our children a commodity. However, the clerk of court at the U.S. Supreme Court is refusing to docket. This is obstruction of justice and a crime. But only an illusion of freedom.     Tanawah explained how this will be handled. When people are silent, they give their consent. People must speak up and speak out. When government is silent that is an indication of guilt. Once the clerk steps aside, this will be handed to the justices, the tour will be started. There will be press conferences  and rallies in every state Capitol and the tour will circle the whole country. Many of those books are a part of the new literary curriculum in Montgomery County, Maryland. The stack included toddler board books like “Pride Puppy,” “Bye Bye, Binary,” and “The Gay B Cs.” There were other titles aimed at elementary and middle school students, like “Not My Idea: A Book About Whiteness,” and the soft-core porn graphic novel “Gender Queer.”“This is part of a culture of indoctrination,” said Nomani.Last month, Muslim parents, Ethiopian Christians, and Peruvian Catholics gathered to protest outside of a Montgomery County Public School Board meeting. They carried signs saying “Restore Opt-Out Now!” and “Family Rights.” Nomani stood with them.Nomani is from such a family herself. As a child, she immigrated to the United States from India with her parents. She was raised in a traditional Muslim household. Now, at 58, after navigating the hardships of single parenthood, working as a journalist at the Wall Street Journal, and writing her latest book, Woke Army: The Red-Green Alliance That is Destroying America's Freedom, she's fighting alongside observant Muslim families in Montgomery County for the right to opt their children out of a new LGBTQ+ literary curriculum. Nomani had me flip through several of the books she brought while recording the podcast.

We are joined today by Jill Sauber, managing attorney at Sauber Legal Services. They offer holistic legal representation and comprehensive estate and elder law services. The focus on making those life transitions easier and her ability to offer great council, provide support, and helpful resources led us to our conversation today. We discuss what to consider when moving a loved one into senior housing at this time, what should they consider when signing agreements, rental and care contracts. Understanding what all of those agreements are and who should sign them. We talk about questions for those families that already have a loved one in a facility what rights do they have to see or spend time with their loved one? Under what circumstances are these visits allowable? Jill Sauber answers very important questions and helps us navigate this process successfully. Jill Sauber helps clients navigate estate planning (as they focus on asset growth) to long-term care planning (where the focus shifts to asset preservation and care). After a death occurs, she helps resolve contested Will or Trust issues (litigation), counsels on Medical Assistance claims, and guides families through the probate process. Jill obtained her law degree from the University of St. Thomas School of Law and earned Bachelor of Science degrees from the University of Minnesota in Biology, Physiology, and Mortuary Science. Her background and experience as a licensed mortician provides her with a unique perspective in both estate planning and elder law. She enjoys a broad-based Estate and Elder Law practice, with emphasis on long-term care planning, asset protection, government benefits, estate planning, estate administration (probate), trusts, litigation, and mortuary law. The diversity of her practice – both planning and litigation – affords her insight to ensuring that her clients' wishes are carried out in their final estate planning documents.  Her litigation experience includes successfully litigating long-term care insurance disputes, probate and trust disputes, and prosecuting financial exploitation cases. Jill focuses on special needs planning, which is unique planning for disabled individuals receiving government benefits, designed to ensure continued eligibility for those benefits.  She works closely with many attorneys to properly set up and fund Special Needs Trusts and advises on proper distributions out of those trusts to ensure compliance.  It is typical that such Special Needs Trusts are established following a large personal injury award, worker's compensation award, other settlement or inheritance. You may find Jill volunteering with the Wills for Heroes Program, the Minnesota Assistance Council for Veterans (MAC-V), or other community groups.  She is also a participant in the Minnesota Elder Justice Center, a Dementia Champion through the ACT on Alzheimer's Initiative, and a member of the National Academy of Elder Law Attorneys (NAELA).  She is acting Treasurer of the Elder Law Governing Council of the Elder Law Section of the Minnesota State Bar Association, incoming President of the Minnesota NAELA Chapter, and an active member in American Bar Association Senior Lawyers Division committees. She is a frequent speaker and lecturer on topics related to elder law, financial exploitation, Medical Assistance (Minnesota Medicaid) benefits, capacity/cognitive issues, estate planning, and several other related topics. Brett Sutton is joined by two members of his team, Sandra Lepson and Evelin Bailey, to discuss the upcoming changes to CFRA and what employers need to know about the new SB-1383 expansion. The team also dives into FMLA and how this will be adjusted/used in combination with these new CFRA changes. There’s a lot to cover in this week’s podcast, so let’s jump right in. Highlights: What is the current CFRA law? A covered employer has to have 50 or more employees under the CFRA and Family and Medical Leave Act (FMLA). Who is an eligible employee under CFRA vs. FMLA? What are some qualifying reasons an employee can take leave? How does military leave apply under the FMLA? A family member can leave for up to 26 workweeks to care for an injured military member. This is unpaid, but it is job-protected leave. Evelin shares what leave is available under California law vs. Federal law. What are the upcoming CFRA changes and whom will they impact? Brett weighs in on what he’s seen when it comes to layoffs during the pandemic. The definition of family member is changing. Employees can take on the care of the elderly grandparent for up to 12 workweeks and they’d still be eligible for personal leave for up to 24 workweeks. This is where things get complicated. Parental leave laws and how they’re changing in 2021. What happens if the CEO or an executive member needs to take leave? Any employer with five or more employees has to comply with the pregnancy disability leave law. Your employee handbook needs to be updated! Make sure you designate the leave in writing! What is the max potential for taking leave? Your employee could technically be out on leave for 56 workweeks. What questions should you ask your employee before they take their leave? Things to think about when it comes to the health insurance benefits. Many parents are afraid to exercise biblical discipline or teach their kids the moral standards of Scripture for fear of having their children taken from their homes. Are these concerns legitimate? Do we have more parental rights than we think? And who can we call when we think our rights as parents are being violated? Our guest, Brad Dacus served as Legislative Assistant to U.S. Senator Phil Gramm, and went on to receive his Juris Doctor from the University of Texas, School of Law. In 1997, Mr. Dacus founded Pacific Justice Institute, where he serves as president and works to defend religious liberties and parental rights. Brad Dacus can be heard weekly on his radio show, The Dacus Report, and he has been a guest speaker on CBS Evening News, CNN, NBC News, and the O'Reilly Factor. Mr. Dacus has participated in respective debates against the presidents of the ACLU and Americans United for Separation of Church and State. Mr. Dacus has guest lectured at Stanford University School of Law and has testified numerous times before the California State Legislature. He was presented an honorary Doctorate of Religious Freedom and Family Rights degree from California Baptist University. Do You Know Your Parental Rights It's time to give parents back their license to parent. So many kids today are getting amped up and told to do their own thing by friends, social media, and just about everyone and everywhere else they turn to in our culture. Many kids believe their parents have no right to tell them what to do; they've bought the idea that their parents darn sure don't have the right to brainwash them with all that archaic Christianity stuff. Believe it or not, unfortunately, a lot of this stuff is coming from their public schools. I hope today we can help blow the lid off of some of the urban legends about the Department of Human Services (DHS) coming in to snatch kids away from parents just because they're Christians trying to raise their kids according to the mandates of the faith. But, by the same token, there are still some very legitimate concerns that need to be addressed. Today's guest ought to be an encouragement as we discuss parental rights by addressing the following topics: Who is Brad Dacus and why should I listen to him. What is the Ninth Circuit and why should parents be concerned. What is gender identity dysphoria. Is there empirical proof of gender dysphoria. Jim Black is the founder of and lead researcher at Angel Eyes over Texas (AEovrT). In 2015 he was elected Vice-President of the Grandparents' Rights Association of the United States (GRAUSA). Both organizations advocate for Family Rights on both state and Federal levels. Jim's professional background was in neither Law nor Social Work, but instead as a Manufacturing Engineer specializing in Automated Manufacturing Systems. In 32 years he worked specialty contracts for more than 52 enterprises covering such areas as Petrochemical, Oilfield Production, Offshore Drilling, Cardiac Surgical Instruments, Automotive, Aerospace and numerous other fields in between. His experience was not only varied but it provided him to a very diverse set of management skills. His exposure to CPS began with his own children in 1992. With various bouts with them in 1994 and 1997. In 2000 and 2001 he began dealing with them over his grandchildren. But it was not until 2009 and they were removed that his real battle began. Early in the case he began noticing inconsistencies in how the Texas system was designed and how it was managed. In 2010, AEovrT was created to research and break down the mechanics of how the system has failed. By taking an Engineering approach to the system he is able to separate emotion from facts and present truly logical remidies.
