Jerry Perullo, former CISO of the NYSE, former chairman of the board off the FS-ISAC, founder, professor, and host of the Life After CISO podcast, comes down to the Cyber Ranch to discuss the many roles he's had throughout his career and the many highly unique opinions he has on the cyber industry. Together, Jerry and Allan break down what's overrated in cybersecurity, from patching to dark web to vulnerability departments, and every detail and concept in between. While Jerry acknowledges the importance of patching in certain contexts, he also explains that it's often overemphasized in its ability to provide cyber solutions. For patching to make an impact, the vulnerability has to be known and understood. In Jerry's experience, patching doesn't solve many of the problems in cybersecurity and can instead create a false sense of security, especially in the case of in-house coding errors. Although patching can create a long-term solution, you may only overcome that weakness for a moment and end up coming back to the same issue a few months later. “When I say it's overrated is, first of all, patching is to address a known vulnerability in a piece of software, right? That means that the vulnerability has to already be out there, has to be profiled, has to be understood, and the manufacturer has to have actually created some kind of fix for it.” What about encryption? Is that also overrated? The idea of encryption comes from the idea of keeping information and vulnerabilities out of your enemies' hands. However, too much focus on encryption blinds us to other issues and other tools that can be used against us. Although certain vulnerabilities around encryption are exploited, Jerry points out that you rarely, if ever, hear about the threats that we're warned about when we're sold on the concept and idea of encryption. With so many other ways to be hacked and exploited, Jerry says our focus on encryption keeps us in the dark about what the reality of online safety is. “In any event, we spend so much time worrying about encryption and encrypting things, and whether it's encryption at rest, or whether it's in transit, or anything else like that, that I think sometimes we blind ourselves, especially on internal tools.” Are short SLAs (service level agreements) for addressing critical risk overrated? In Jerry's mind, the timeframe of your SLA doesn't matter if you need a problem fixed immediately. Whether it's a 48 hour turnaround, a 29 day, or a 364 day window, critical threats need immediate fixes and your service team should understand that. If the response to a necessary and urgent request is for your team to inquire about the SLA, you have a much bigger problem than the time it will take. Instead you have a toxic culture problem, something that cannot be fixed with simple tweaks to your SLA. “I always would just preach that you don't want to ever undermine your credibility. You don't want to bring weak sauce. Gotta be able to reproduce everything, have a video, all of that, and if you don't, then yeah, you people are gonna abuse your SLAs and push it to the edge.” What's your thoughts on departments with “vulnerability” in their name? Although Jerry has had vulnerability departments and teams in previous companies he's worked with, adding vulnerability to a department name rarely has the impact beyond specifying that they run the vulnerability scanners. Beyond running the scanners, processing these results and reporting them is a completely different beast. Rarely is a vulnerability department able to process and report these results without making data ten times more complicated and time consuming for your board to understand. They're tool-focused, it's in their name, but it may not be what you really need when you're assessing risk. “I think it's really important that you just speak about them all collectively, in a tool agnostic fashion. Meanwhile, now that he is staying in Pawnee permanently, Ben decides to move out of the motel where he has been living. Andy Dwyer and April Ludgate offer him a spare room in their house, since their previous roommate moved out and left the house to them. Although the two have been living by themselves for only a week, the house is a complete mess with no everyday items like plates or utensils available. Ben decides to teach a reluctant Andy and April how to properly live like adults. Meanwhile, the parks employees attend an art show exhibiting paintings that will later be hung in government buildings. Jerry displays his painting of the fictional topless centaur Greek goddess Diaphena, which looks exactly like Leslie. Jerry explains he subconsciously painted Leslie while thinking about powerful women. Instead of being embarrassed, Leslie feels empowered by the painting. Tom, however, is humiliated because a pot-bellied cherub in the painting shares his likeness. The next day, local conservative activist Marcia Langman (Darlene Hunt) compares the painting to bestiality, deems it unsuitable for a government setting and demands it be destroyed. Leslie goes on the news program Ya Heard? With Perd! to rouse public support for the painting by portraying it as a depiction of a powerful woman. However, she is undermined when reporter Perd Hapley also has on adult film actress Brandi Maxxxx, who defends the painting by comparing it to pornography. Chris convenes a meeting of the Pawnee Public Arts Commission to rule on whether the painting is acceptable. Despite Leslie's eloquent defense, the commission fears the nudity is offensive and decides to destroy it instead of risking public backlash. Leslie retaliates by stealing the painting. After cleaning up around the house, Ben gives Andy and April money to buy common household items. Although they almost waste their money on frivolous items, Andy insists they need to take Ben's advice. April admits she is afraid of growing up because she does not want them to lose their unique personalities, but Andy assures her they will not change. Chris angrily demands Leslie bring the painting to city hall the next day to be destroyed. When Leslie reluctantly agrees to do so, Jerry expresses disappointment that she would give up so easily. Feeling empowered again, Leslie asks Jerry to quickly paint another, similar painting, only this time with Tom as the centaur. Leslie tells Marcia the new painting is the original one but painted over. With no more nudity in the painting, a frustrated Marcia gives up her quest to have the painting destroyed. Ben later confides to Andy he likes Leslie but is unable to ask her out because of Chris, but Andy tells him if they truly care about each other, then it will eventually happen.

My now annual conversation with Jerry Schlichter, plaintiffs attorney with Schlichter Bogard & Denton has been one of the more popular episodes on the 401(k) Fridays podcast. He burst onto the scene with a flurry of litigation in 2006 and to date he has secured settlements of over $300 million and what he would call significant improvements in their plans. He has been repeatedly elected by his peers for inclusion in "Best Lawyers in America” and “Lawyer of the Year” and is listed in the 2019 edition. Jerry has been featured in numerous national publications, including the New York Times, Reuters, Bloomberg, USA Today, and the Wall Street Journal, for his and the firm’s success in pioneering claims of excessive fees in 401(K) plans and obtaining precedent-setting results involving claims of excessive fees against large employers, and for the reduction in fees his cases have caused throughout the 401(k) industry. He and the firm have obtained settlements in these 401(k) excessive fee cases of more than $300 million for employees and retirees, in addition to significant improvements in their 401(k) plans; in total, this relief has been valued at more than $1.5 billion. He also was lead attorney for the firm in the first and only full trial of an excessive fee case in the country, resulting in a verdict of $36 million. In recent rankings of the most influential people in the 401(k) industry by 401kWire.com, Jerry has repeatedly ranked in the top 5. According to a recent article published in Reuters, the CEO of Brightscope, an independent company which evaluates 401(k) plans, stated, speaking of Mr. Schlichter’s national impact on 401(k) plan fees, that “[h]is impact has been humongous." The New York Times has referred to Jerry as “a Lone Ranger of the 401(k)’s,” and he has been referred to by Investment News as “public enemy no. 1 for 401(k) profiteers” and by Chief Investment Officer as “the industry’s most feared attorney.” In describing the effect of his work on behalf of employees in 401(k) plans, the Wall Street Journal referred to it as being “Schlicterized”. In 2014 and 2015, Mr. Schlichter’s firm obtained the two largest 401(k) excessive fee settlements in history. The first was a settlement for $62 million against Lockheed Martin on behalf of Lockheed Martin employees, which included significant changes to the Lockheed Martin 401(k) plan. The second was a settlement for $57 million from Boeing, which likewise included significant non-monetary relief. Also in 2015, Mr. Schlichter won a unanimous 9-0 decision in the U.S. Supreme Court in Tibble v. Edison, the first U.S. Supreme Court case to consider fees in 401(k) plans. In an order in the case of Nolte v. Cigna Corporation in 2013, the U.S. District Court judge stated: “As the preeminent firm in 401(k) fee litigation, Schlichter, Bogard & Denton has achieved unparalleled results on behalf of its clients. Jerome Schlichter and Schlichter, Bogard & Denton’s work throughout this litigation stands as yet another example of the firm’s acting as a private attorney general, risking breathtaking amounts of time and money while overcoming many obstacles for the benefit of employees and retirees. . . . Mr. Schlichter and the Schlichter, Bogard & Denton firm’s actions have led to dramatic changes in the 401(k) industry, which have benefited employees and retirees throughout the country by bringing sweeping changes to fiduciary practices.” The U.S. District Court in Tussey v. ABB similarly found of “special importance . . . the significant, national contribution” made by the team led by Mr. Schlichter, which has “educated plan administrators, the Department of Labor, the courts and retirement plan participants” about the fiduciary obligations of 401(k) plan administrators. Jerry has received numerous awards, such as the Levee Stone Award and "What's Right with the Region Award" for his contributions to revitalization of the city of St. Louis and the state of Missouri. In December 2013, Jerry was honored with the prestigious St. Louis Award, given to the person who has accomplished the most in the prior years for the development of St. Louis. Jerry spearheaded the founding and development of another St. Louis not for profit, Arch Grants, which is a global competition for startup businesses in which winning entrepreneurs come to St. Louis, receive $50,000.00 and a broad package of support services including business mentoring, discounts on office space, and free legal, accounting, and marketing services. Arch Grants has provided grants of $50,000.00 to 114 startups since its founding in 2012, and has been the subject of numerous national articles describing its building of entrepreneurial businesses in St. Louis. David Kohan, along with his friend Max, created the long-running hit comedy series Will & Grace. But the Emmy Award winner is also one of the biggest Clippers fans we know, and boy was he excited to preview the upcoming season in Clipperland, one which he believes will be “the year.” Boasting the likes of Kawhi Leonard, Paul George and a deep supporting cast, the Clippers are primed for a breakthrough season. Coincidentally, Will & Grace just made a big announcement of its own: the show will be ending after one final season. Following the Clippers discussion, David touches upon that as well as his sister’s stellar TV series, Orange Is the New Black. Some special clips (Clips?) have been excerpted below: 4:15-4:26: “I thought for a second when Chris Paul was joining the team, ‘Well, this is about as good as it’s gonna get as a Clipper fan.’ But I was wrong. This is about as good as it gets.” 7:36-7:43: “Suddenly, it felt like we were frontrunners, and I’ve never felt that way as a Clipper fan before.” 11:40-12:07: “More than anything, If Jerry West is there, I feel like he’s a magician. It was such a satisfying season to me. … You really got the sense, unlike years before, they all played for each other, that they genuinely cared about each other, that they enjoyed playing together, and that they were locked in defensively most of the time. … They really did seem to be giving their best effort, not caring who carried the scoring load, everybody had their roles which were clearly defined. There was energy and passion and intensity. … The Lob City teams, there always seemed to be more talent than cohesiveness.” 26:14-28:14: “People talk about the Clippers’ health and the health of their two superstars with Kawhi’s quad and Paul George’s shoulder, but the Lakers, I think, are in a much more perilous situation. … That team doesn’t quite make sense to me as currently composed. They don’t seem balanced.” 30:46-31:46: “Looking back [on Will & Grace’s run], I guess more than anything, [what stands out is] how special it is to work with those four actors, because I actually think they’re the best at what they do. … There’s a whole confluence of things that has to come together in order for something to work. But one of the things that I really appreciated during that gap between the first run and the second run was just how good I had it working with those four actors. In today’s day and age, being digital is a big buzzword. It’s true, there is an importance to being digital, but there is also a technology fallacy. The people behind the tech are really the ones that can make and break the technology. So, how can you create a happy blend of technology, people, and scaling up? Gerald (Jerry) C. Kane, Ph.D., is a Professor of Information Systems at the Carroll School of Management at Boston College. He is also the author of The Technology Fallacy: How People are the Real Key to Digital Transformation, where he surveyed over 20,000 executives worldwide and interviewed over 100 executives and thought leaders to determine the key factors associated with digitally mature companies. There is a mistaken belief that a lot of the problems companies are coming across in this modern age are due to a fast-paced technology environment. Often, companies fight this problem with more technological solutions, but the reality is, quality people are the real solution behind this. In the five years of researching The Technology Fallacy, Jerry spoke to countless of leaders in cutting-edge companies like Facebook and Google, some at traditional companies like Walmart and John Hancock, and some at small startups, to get a good range of data. When interviewing the Chief Human Relations Officer at Walmart, she shared that leadership realized they probably would be out of business in 10 years if they didn’t adapt to new changes. When a giant like Walmart realizes they need to adapt or sink in this environment, every company should pay attention. In Jerry’s survey, 90% of employees came back to him saying that they felt they had to update their skill set at least yearly to keep up with the demands of their job, but yet less than half of them said their organization was able to provide these resources. Employees were also 15X more likely to leave their organization within a year if they weren’t getting additional resources to improve their skill sets. This causes a big problem for companies looking to expand and adapt to the marketplace. Keeping and educating talented team members that could grow into new environments was the key to success for companies; not the implementation of new technology. He who will drink from my mouth will become like me, I shall become like he, and the things that are hidden, should be revealed to him.” He interprets the passage as a reference to drinking a psychoactive mushroom substance Jerry goes on to explain that Jesus realized his feeling of eternal life through the use of psychoactive entheogens He says that this is not a means of dismissing Christianity, but instead to reintroduce Christianity with its original roots Tom Hatsis on Psychedelics in Christianity Tom says that Jerry makes a lot of assertions, but does not present any evidence. He talks about art, but not anything in scripture Tom is curious why the only artwork that Jerry brings his assertions about mushrooms are from a time where we can’t ask them about it Tom brings up Julie and Jerry’s book and that the first chapter has nothing to do with Christian History at all Tom uses an example of stone mushrooms. Someone doing a cross cultural analysis, might agree that they are mushrooms based on the other findings of cannabis and opioids But, as a historian, Tom looks for evidence and in this case, there are eye witness accounts of its use He brings up the example, the infamous plaincourault fresco of Adam and Eve at the tree of good and evil with the forbidden fruit Using this one example, he wants to prove how critical historical methodology is used to prove unsubstantiated claims on Christian art as wrong Tom urges listeners to view the unaltered versions of the plaincourault fresco at Georgio Samorini’s Flikr page The paradise tree is a mix of the tree of knowledge of good and evil and a symbol of Christ's victory over Adam’s transgression. In the play, it was tradition to place small Eucharist wafers on the tree branches so that’s what the white dots are on the tree branches The tree's shape is not a mushroom cap, it is a parasol of victory Jerry’s Rebuttle Jerry says that the absence of evidence, is not equal, or proof of evidence of absence (just because it’s not written in text, doesn't mean that its not there in the art) Jerry’s issue with the fresco is that “The Fall” is a New Testament creation, not all the way back in Genesis He says that on their website, they do not ‘alter’ the image, they ‘enhance’ it He says that Tom claims the fruit doesn't matter, but the fruit does matter (it could be a psychedelic mushroom) He touches on the skeletal appearance of Eve and the meaning of renewal of life Jerry thinks this image is the beginning of the religious experience and symbolism that the soul is immortal and will continue to exist after death He says the serpent is not a depiction of evil entering Eden, but instead a source of knowledge and a spiritual guide to the feminine to help bring man into higher awareness Tom’s Rebuttle Tom says he didn't hear any evidence from Jerry, he heard arguments to authority He says that Jerry uses anthropology to uncover history, and opinions of art historians, but medieval historians agree that the mushroom is not present in Christian art He also says he did agree with Jerry about the mushroom in art, but that was last year and he has proven himself wrong and that the mushroom caps are parasols of victory Jerry says that Amanita Muscaria was in the Soma, but Tom says cannabis was, and mushrooms were not Chris Bennett's book on Soma There is zero evidence for mushroom art during medieval times In Jerry’s book, he writes about the Basilica di Aquilea, saying that they are Amanita Muscaria, but Tom says they are not that type of mushroom Tom also says that in the play depicted in the plaincourault, that the script literally says the wafers are hung on the tree, and that the little white dots are not the dots from an Amanita Muscaria Jerry’s Closing Remarks He says that this isn't just cultural analysis, this is about fieldwork and looking at how native people view this artwork The problem he has with Tom and Church historians is that it is not taking evidence from Ethnobotanists Jerry says he believes that there is a long tradition of entheogenic mushrooms in Christian art and would like this debate to continue Tom’s Closing Remarks Tom says he still isn't hearing evidence, he is only hearing assertions and argument to authority and eminent scholars Tom says that Genesis doesn't matter in the plaincourault, because we know that it's about the play He has multiple articles debunking these images on his website Carl Sagan’s Bologna Detection Kit - which shows how to spot fake conspiracies Tom says the holy mushroom hypothesis fails against all the claims Jerry has made Links Tom's Website Jerry's Website Check out our online course, "Introduction to Psychedelics" About Jerry Jerry B.
