The 2021 National Lawyers Convention took place November 11-13, 2021 at the Mayflower Hotel in Washington, DC. The topic of the conference was "Public and Private Power: Preserving Freedom or Preventing Harm?" The panel covered "IP Law and Culture."A perennial debate about intellectual property and culture is how intellectual property laws enhance or restrict the ability of people to contribute to and build a culture. The Supreme Court has described copyright as "the engine of free expression," but criticisms frequently arise when intellectual property law prevents people from using the work of others to express themselves. In the trademark context, recent Supreme Court decisions struck down the prohibition of federal trademark registration for immoral, scandalous, and disparaging marks as a violation of First Amendment speech rights. Some argue that the Court’s reasoning should further be applied to strike down most federal Trademark Dilution claims, which allow brand owners to sue those who use their trademarks in ways that blur or tarnish the trademark. Glasser, Ph.D., an Associate Professor at Tulane EDU, School of Science & Engineering, stops by to share his work with quantum optics and discusses what this work may hold for the future. A higher-quality image can be gained by quantizing light in a specific way, allowing a more extended range for optics to be used effectively. By quantum correlating the pairs of photons, accurate measurements, even beyond lasers, can be created. By eliminating "noise" in calculations using quantum optics, the data collected from the experiment can be much more dependable. After graduating from Norwich Free Academy, he went on to receive a degree in English at Eastern Connecticut State University and a Master's degree in teaching at Sacred Heart University. Influenced by the strength, wisdom and humor of his mom, love for hip hop and people, his practices with tutoring at ECSU, and his personal frustrations with his own educational experiences and education system as a whole (his 10th grade English teacher had a sign in her classroom which read, “Silence is Golden” –Ahhh! Freaky stuff!), Ryan developed a passion for teaching and promised himself he would break that golden silence and bring golden noise into education! For the last fourteen years, he has kept his promise teaching English in Manchester, CT public schools, coaching youth poets, and performing and presenting on hip hop poetics and the significance of empowering youth. In addition to teaching middle school students, Ryan also consults with educators running workshops and professional developments centered on The Open Mic Movement in Education and teaching educators strategies for establishing and maintaining effective classroom environments. Ryan has also presented at numerous educational conferences including LID, CONFRATUTE, NYCORE and COESBOC, NEAG, delivered a TEDx Talk titled 'Transforming Struggle into Strength', featured as a guest poet performer along with Pam Nomura in Hartford Connecticut's Riverwood Poetry Series, starred as the feature poet at Hartford's RealArtWay's' Inescapable Rhythms Poetry Series and is currently writing a Memoir and a guide to The Open Mic Movement in Education. On November 11, 2020, The Federalist Society's Intellectual Property Practice Group hosted a virtual panel for the 2020 National Lawyers Convention. The panel covered "Intellectual Property Rights and the Rule of Law."The world’s first democratized intellectual-property legal system, initiated by Art. I, Sec. 8, Cl. 8 of the U.S. Constitution, is intended, per Federalist #43, to: provide uniformity for the protection of IP rights; secure those rights for the individual rather than the state; and incentivize innovation and creative aspirations. Predictability, rooted in uniform application of the rule of law, is essential for property rights and economically sustainable growth. This is especially true in the context of intellectual property and the tremendous investments required for innovation and creative expression. These intended goals can be jeopardized in times of crisis if they are seen as being pitted against health, safety, security, and humanitarian needs that arise during actual or perceived crises such as the COVID-19 pandemic.How can private IP rights be achieved and maintained in a manner that genuinely promotes public good without capture issues? Does a crisis necessitate a suspension or weakening of intellectual and/or other property rights –– or is it in times of crisis that rule of law and its attendant stability/predictability are most crucially needed? What we can learn for IP from how the rule of law has been affected by national crises in the past? David Samson spent 18 seasons in Major League Baseball and 16 as President of the Miami Marlins. In 2017, he was the second-longest tenured team President in MLB and was one of only seven current Presidents to have presided over a World Series champion.        In 2017, Samson completed the negotiation to sell the Miami Marlins to a group led by Derek Jeter and Bruce Sherman for $1.2B. Samson acted as Chief Negotiator in the process. In 2019, Nothing Personal with David Samson made its debut.  Nothing Personal, a simulcast, gives its audience a unique look inside the world of sports, business and entertainment. Our conversation focused on the future of sports after this pandemic.
