On this edition of Parallax Views, legal scholar and Boston University Law professor Jonathan Feingold joins us to discuss a growing crisis in higher education: the escalating assault on academic freedom. At the center of this episode is the recent dismissal of Dr. Cemal Kafadar and Dr. Rosie Bsheer—faculty leaders of Harvard's Center for Middle Eastern Studies—following politically charged accusations related to programming on the Israel-Palestine conflict. Feingold, a member of Concerned Jewish Faculty & Staff-Boston Area, breaks down why these dismissals are not just isolated incidents but part of a broader pattern of repression targeting scholars and students advocating for Palestinian human rights. We dig into the weaponization of antisemitism discourse, the chilling effect on scholarship, and how elite institutions like Harvard are capitulating to pressure from right-wing forces and donor lobbies—including those aligned with Trump's authoritarian cultural agenda. This story isn't just about Israel-Palestine. Even for those uninterested in debates over Israel-Palestine, the implications of this case are far-reaching. It raises urgent questions about academic freedom, free speech, and free inquiry in American universities. What happens when controversial topics become grounds for dismissal? How do elite institutions navigate the tension between political pressure and intellectual autonomy? And what does this say about the health of democratic discourse in higher education? This episode is not just about one controversy at Harvard—it's about the future of the university itself.

This is a replay version of an episode originally published in July 2019. Please note that any law discussed in the episode may be out of date.SOSR is like a classic car. It can work well but only in the right conditions. An employer must have a fair reason to dismiss an employee. When other avenues are exhausted, employers can sort to SOSR - which stands for ‘some other substantial reason'. Rather unhelpfully, there is no definition or guidance about its meaning. It must be 'substantial', which can include anything that is not frivolous or insignificant. In this episode of Employment Law Matters, Daniel Barnett talks about the top five SOSR dismissals and why lawyers use that phrase, and looks at in which situations the use of SOSR can prove most useful.
Since Ghanaian President John Mahama took office, thousands of government employees — including nurses and teachers — have lost their jobs. The opposition demands reinstatement, calling the move politically motivated. Trade unions have warned of severe consequences.
Can an employer simply dismiss an employee once they have reached the normal or agreed age or retirement? What needs to happen should an employer decide to keep their employee on for a little bit longer? There were recently two related cases which came before the Constitutional Court, but there was no absolute consensus on the matter given that there were three separate judgements. Lester Kiewit speaks to Advocate Tertius Wessels, Managing Director at Strata G Labour Solutions, to discuss how legal pitfalls in the workplace can be avoided when it comes to dealing with retirement age matters.See omnystudio.com/listener for privacy information.
Today's Headlines: Today marks three years since Russia invaded Ukraine, and Trump is setting conditions for U.S. support in peace talks—namely, demanding $500 billion in rare earth minerals as "payback" for U.S. aid. Zelensky is not having it. Meanwhile, Russia just launched its biggest air attack yet. Over in Israel, the next round of hostage swaps is on hold as Israel demands less "humiliating" releases. Germany just voted, with conservatives winning and the far-right making gains. Back in the U.S., Trump fired the top military officer and replaced him with a loyalist lacking standard experience, while also purging Pentagon officials. Meanwhile, Elon Musk emailed 2.3 million government workers demanding proof of productivity—non-response = resignation. The Justice Department quietly deleted a misconduct database for federal police officers and Pope Francis remains in critical condition. Finally, the White House just limited DOGE's access to personal taxpayer data... after having it for two weeks. As the Special Counsel winds down the DC criminal case and the Florida appeal, veteran prosecutors Mary McCord and Andrew Weissmann analyze the strategy behind getting a dismissal without prejudice before Donald Trump takes office, while dispelling the notion that Jack Smith “folded” in any way. Then, they head to New York to break down the nuance of Judge Merchan's decision to postpone Trump's sentencing, as he accepts briefing on a motion to dismiss the case that both parties agreed to. And before wrapping up, Mary and Andrew review some of the presumptive nominees Trump has named for top Justice Department posts, and the contrast of working on behalf of a client versus working on behalf of the Constitution.A note to listeners: Since we recorded, the 11th U.S. Circuit Court of Appeals also granted Special Counsel Jack Smith's request to dismiss that appeal without prejudice.Want to listen to this show without ads? Summary Eric Rubenstein and Ron Chapman join The Compliance Guy to discuss the implications of a recent dismissal of a False Claims Act case based on the appointment clause. The guys explore the historical context of key tam cases, the role of relators, and the complexities surrounding the appointment clause. The conversation delves into the differences between dismissals with and without prejudice, the potential for Supreme Court involvement, and the impact of venue shopping on key tam cases. The episode concludes with a discussion on judicial appointments and their political implications. Takeaways Qui Tams are a significant part of healthcare fraud enforcement. The appointment clause raises questions about the authority of relators. Dismissals with prejudice are nearly final and limit future actions. The Supreme Court may be interested in conflicting rulings on key tam cases. Venue shopping can dilute the strength of a case. Judges may make decisions that align with their career interests. The appointment of special counsels has constitutional implications. Relators can receive a larger share if the government does not intervene. Resource limitations often lead to the government declining key tam cases. Judicial decisions can reflect broader political agendas. 00:00 Introduction to Key Tam Cases and the Appointment Clause 07:03 Exploring the Appointment Clause and Its Implications 14:03 Dismissal with Prejudice vs. Without Prejudice 16:19 The Future of Key Tam Cases in the Supreme Court 24:13 The Impact of Venue Shopping on Key Tam Cases 30:29 Judicial Appointments and Political Implications

In a shocking twist of irony, former Attorney General Bill Barr came out Wednesday in support of former President Donald Trump—specifically, in support of him in both his New York criminal trial, and also of him for president. If you've been following this developing saga between these two, this is quite a big deal, given the fact that after President Trump left office, Mr. Barr went on a campaign against him—appearing on many TV programs in order to rail against President Trump. However, despite having lobbied all of that criticism for the past three years, Mr. Barr made an appearance on Fox News Wednesday where he appeared to change his tune, and said that he will be voting for President Trump in 2024. And what's really interesting to note is that this change in attitude toward President Trump on the part of Mr. Barr appears to be echoed by the broader American electorate. In fact, according to polling, President Trump's numbers went up after his criminal indictments.
