Thank you for tuning in to episode 360 of The Everyday Life Balance Show. Today, we're diving deep into something that touches all of us: rest, relaxation, and - yes - stress. We live in a world where constant busyness becomes the norm, but what happens when that busyness turns into imbalance? Even though there are external stressors, stress is also about what's happening inside us. We'll explore how everyday imbalances - like poor sleep, bad diet, or even emotional burnout - can trigger stress. I'll give you practical tools for nurturing rest to bring your body, mind, and spirit back into balance. Let's talk about how to reclaim your peace. The Holistic Benefits of Rest and Relaxation Before we dive into what throws us out of balance, let's start with what balance looks like. It's a life that allows for the 3Rs, rest, renewal, and relaxation. Because with proper rest, everything shifts: our mental clarity and emotions. Let alone our energy levels and physical health. Rest is like a reset button for your entire system.  When was the last time you had a proper rest? Unfortunately, with the advent of technology, our mind is constantly active. We check our phones every second for emails, messages, interesting videos we can share, etc.  The fact is, your brain loves to rest. Science tells us that when we're well-rested, we think more clearly, we're more creative, and we make better decisions. Rest gives us a cognitive boost. Our brains sort through memories, consolidate learning, and clear out waste during periods of deep rest and sleep. Physical Health: However, rest isn't just for your brain. Your body needs rest to heal. Research shows that good sleep supports a healthy immune system, repairs tissues, and even reduces the risk of chronic illness. Think of it this way: every time you allow yourself to rest, you strengthen your body's ability to heal and thrive.  Emotional Wellness: How many of us have felt completely overwhelmed after a bad night's sleep or a stressful week? That's because rest regulates your emotions. When we rest, we reduce cortisol, our stress hormone, and help the nervous system shift into "rest and digest" mode. It calms the body down and releases feel-good hormones like serotonin. It's beautiful how interconnected everything is. Our mental, emotional, and physical health all feed off each other, and rest is at the core of keeping everything in balance. Let's determine What Causes Imbalances That Activate Stress Now, I want to dig deeper into why stress seems to creep into our lives so easily, especially when things feel out of balance. There are many external stressors in life, work, family, finances, relationships. What often goes overlooked are the internal imbalances that can activate stress. Let's talk about some of these common imbalances and how they can trigger stress: 1.   Sleep Deprivation: One of the biggest culprits behind stress is a lack of sleep. Sleep is your body's primary way of recharging mentally and physically. Without enough sleep, cortisol levels rise, which keeps you in a constant state of alertness. That's why, when you suffer from sleep deprivation, even small things, like a long email or a traffic jam, can feel overwhelming. Studies show that chronic sleep deprivation increases stress levels and anxiety. It can even lead to mood disorders like depression. 2.   Nutritional Imbalances: What we eat directly impacts how we feel, and certain nutritional imbalances can cause our stress response to kick into high gear. Diets high in sugar, processed foods, or caffeine can spike your energy temporarily but then crash it, putting unnecessary strain on your nervous system. Meanwhile, deficiencies in essential nutrients - like magnesium, vitamin D, or B vitamins - increase stress and anxiety levels. Your body is like a finely tuned machine. And it needs the right fuel to function calmly and efficiently. I recommend you speak to a professional dietician or nutritionist to ensure you get these nutrients in your diet or supplementation if necessary. The highest source of vitamin D is the sun. 3.   Emotional Burnout: We often think of stress as something that comes from external sources. However, emotional stress like worry, unresolved feelings, overextending yourself for others, or simply not processing emotions, can leave us feeling emotionally depleted. When you don't allow yourself to rest or recharge emotionally, you end up caught in a burnout cycle. This can lead to feelings of overwhelm, irritability, and even physical symptoms like headaches or fatigue. Talking things through with a professional therapist or your best friend is comforting and a great therapy. 4.   Lack of Physical Movement: Movement is crucial for releasing stress. Prolonged periods of inactivity - such as sitting at a desk all day or being indoors - can cause our bodies to retain stress. Exercise releases endorphins, those natural mood boosters, and helps flush cortisol out of your system. So when we don't move enough, stress gets "stuck" in the body, contributing to tension and anxiety. 5.   Social Disconnection: Here is a common imbalance we don't always consider: disconnection from others can activate stress. Humans are wired for connection. When we don't get enough positive social interaction, whether through friendships, family, or community, we can start to feel isolated, and that isolation can manifest as stress or anxiety. For this reason, spending time with loved ones or engaging in meaningful conversations can calm you down. 6.   Unresolved Mental or Emotional Patterns: Sometimes, the imbalances are deep-rooted in our thinking. If you find yourself constantly in a state of 'fight or flight,' it could be due to unprocessed trauma, chronic worry, or an underlying sense of insecurity. These thought patterns trap us in a cycle of stress, even when the outside world seems calm.  Practical Tools for Restoring Balance and Reducing Stress So now that we know what can throw us off balance, let's talk about how to rebalance. Here are some heart-centred, practical tools to help you activate rest, calm your nervous system, and restore inner peace. 1.   Create a Consistent Sleep Routine: Your body thrives on consistency. Try to maintain a consistent sleep schedule, even on weekends. Create a calming nighttime ritual that signals to your body it's time to unwind, whether it's turning off electronic gadgets, drinking herbal tea, or practising a little meditation. Prioritizing quality sleep is one of the most effective ways to reduce stress and restore balance. 2.   Nourish Your Body with Balanced Nutrition: Pay attention to how food affects your energy and mood. Opt for whole, nutrient-dense foods like leafy greens, nuts, seeds, and lean proteins that provide your body with essential vitamins and minerals. Additionally, be mindful of stimulants like caffeine or sugar, which can trigger spikes in anxiety. Small, nourishing meals throughout the day help keep your blood sugar stable, which directly affects how stressed or calm you feel. Keep your gut healthy. In stressful times, we often feel discomfort in that area. 3.   Set Healthy Boundaries for Emotional Balance: Emotional rest is just as important as physical rest. Practise saying "no" when your emotional energy feels stretched. Start small, whether it's declining an invite or asking for more time to complete a task. Protecting your energy helps you avoid emotional burnout and allows time to rest and recharge. Look at a holistic tool like Emotional Freedom Technique (E.F.T). 4.   Incorporate Gentle Movement Daily: It doesn't have to be intense. Gentle stretching, yoga, or even a slow walk in nature can do wonders for releasing tension and clearing mental fog. The key is to listen to your body and give it the movement it needs to reset. 5.   Prioritize Social Connections: Make time for meaningful connections. Whether it's scheduling regular dates with a friend, calling a family member, or joining a community group, surrounding yourself with positive social support can reduce stress and give you a sense of belonging and calm. 6.   Practise Mindful Breathing Techniques: When stress hits, focus on your breath. Deep breathing activates your parasympathetic nervous system, which calms your body. Try this simple breathing exercise: Inhale for four counts, hold for a count of four and exhale for six counts. Repeat for a few minutes and notice how quickly it brings you back into balance. 7.   Set healthy boundaries regarding your activities: Find balance in the way you manage your energy. Are there days when you are full of energy and pack everything in? Because you burnt too much energy in one day, you find yourself exhausted the following day. Learn to manage your activities well every week. Closing Thoughts: Remember, beautiful listeners, rest and balance are not a luxury. They are a necessity to thrive with ease. The next time stress tries to throw you off balance, know you have the tools to bring yourself back to a place of peace. Listen to your body, nurture it with rest, and don't be afraid to honour your limits. Your well-being depends on it. Thank you so much for tuning in today. If you found this episode helpful, please share it with someone who might need a little reminder to rest. I am sending you love and peace, and most of all I'm giving you permission to rest, renew and relax. Until next time, take care of yourself. You deserve it.

In this episode the Leading Better and Growing Faster podcast for school leaders, Joe and T.J. tackle strategies for building an environment where teachers want to work and want to stay. As our good friend, Principal EL, always says, “trying to find, hire, and retain teachers is like the hunger games.” There is definitely a shortage of qualified teachers, so it is imperative that we hang onto the ones we have. To do so, every school leader must actively work to create an environment where teachers thrive. We recommend a multifaceted approach: First and foremost, celebrating and praising the dedication and hard work of educators is paramount. Recognize their achievements, both big and small, not only to boost morale but also to reaffirm their value in the school community. Secondly, finding more time for teachers to engage in professional development, collaboration, and self-care is crucial. We know it's difficult, but school leaders must uncover ways to reduce the unnecessary administrative burden placed on staff, prioritizing time for their growth and renewal. Lastly, creating leadership opportunities within the school empowers teachers to take ownership of their roles, fostering a sense of purpose and investment in their work. This three-pronged approach is grounded in celebration, time management, and leadership cultivation. In the episode, T.J. digs into one the communication feedback models that we work with school districts on, including Specific Praise. The challenge is that managers believe they do this, but most workers disagree. Joe doubles down on the need for the 3Rs: Recuperate, Rejuvenate, and Regroup. Leaders often mistake downtime as wasted time, a major mistake. We suggest finding time for staff to achieve the 3Rs at work and beyond. The key is to communicate the goal and intended usage of the time provided for them. Lastly, don't forget to lift your influential teachers. They can galvanize school culture, but they should be developed as well. Do not leave their growth to chance. Find ways to give them leadership experiences and avenues to grow as a leader. Achieve the aforementioned strategies and you will be well on your way to developing the school culture where teachers thrive. A jury convicted Danny Masterson of two counts of forcible rape in California state court, and the judge just sentenced him to thirty years.  It was a daunting task for his lawyers, because Masterson maintained his innocence to the bitter end.  If the lawyers could have successfully threaded that needle, then Masterson would have potentially received fifteen years instead of thirty. Unfortunately, the sentencing presentation hit all the wrong notes.  Moreover, there was massive blowback over the sentencing letters submitted on his behalf, particularly the ones from his famous friends, including Ashton Kutcher and Mila Kunis. The letters did more harm than good, not only for Mr. Masterson, but for those who, with all good intentions, were offering their support. Therefore, join us for a whole lotta teachable moments as we dissect every aspect of Masterson's Sentencing with our good friend and colleague, Mark Allenbaugh.   IN THIS EPISODE:   Quality over quantity when it comes to sentencing letters; How to tell a mitigation story for a client who maintains their innocence at sentencing; How lawyers must lead and actively manage the mitigation narrative, particularly when it comes to sentencing letters; How tone deafness can result in the deafening sound of your bell being rung on the big day; The dangerous territory of using your kids/family as a sympathy ploy at sentencing; What we can learn from how the victims' statements far outweighed the supporters statements in terms of their emotional power and persuasion.   LINKS & FREE RESOURCES: www.sentencingstats.com www.zeropointoffender.com We talked a lot about a great article by a former federal Judge, Mark Bennett about his five rules for sentencing allocution.  To download the article, visit the shownotes for this episode at www.setforsentencing.com/podcast/masterson/ Lastly, we talked about the "3Rs" of sentencing mitigation.  If this is new to you, and you want to download the article Doug Passon wrote on this subject, same deal... visit the shownotes for this episode!   www.setforsentencing.com/podcast/masterson/

Interview Insights Top 3 Takeaways The pandemic ushered in an era in which 'respect' is the currency that makes people stay in their job. Leaders who make an extra effort to keep their top performers usually do. No matter how high the pay, if employees feel that they are undervalued, disregarded, and disrespected, they move on. At least those with the most potential and ambition move on. Know your employees. Take a quick survey of what they like and dislike, or ask any questions that will give you a better understanding of who they are. This way, you'll know how to give them respect in a way that matters most. Each person defines respect differently. Show Notes from this Episode Merrylue shared about her friend Joanna who, during one of the darkest moments, reminded her that our quest is not to be perfect but only to be our best. [01:44] The pandemic accelerated changes that were already been building up tensions. Merrylue explains why today's work environment is no longer "your grandfather's workplace." [07:26] Why is it important to avoid overloading top performers? [11:16] What is one of the dangers of top performers quitting? It tends to be a domino effect. After all, these are people their peers look up to. [13:40] What are stay interviews? What are some of the advantages stay interviews have over exit interviews? [17:20] Respect is defined differently by different people. Sally and Leroy's answer to the question, "What is it that would be most respectful to you," could not be further from each other. [20:15] What are the 3Rs that can be used to retain talent? Requirements, Rewards, and Respect. [24:16] CASE: Sandy works in the film industry in LA. She feels like she doesn't get enough respect at work, so despite the excellent pay, she dreads her working hours. [27:52] CASE: Jim works for a start-up company. Unlike Sandy, Jim isn't paid that much, but Jim loves his work. He is always looking forward to going to work, and that is because he feels like he is being treated like gold. What can you do when your client with two prior felony drug convictions gets arrested and charged for a new and very serious drug trafficking offense?  Most lawyers, looking at this history, the substantial weight of drugs involved, a pile of money, and a gun, would resign themselves to epic defeat.  This man was facing a sentence that could easily have landed this client in prison for the rest of his life.    But, attorney Joel Meyers was going to do everything in his power to achieve a different result.  He knew that his client had a story to tell.  More importantly, he knew that if he did his homework, developed that story with credible witnesses, experts, and evidence, there was hope.    I was fortunate to play a role in this result, as Joel, an "old friend" from our law school days, reached out to me to do a sentencing mitigation video in the case. He knew that the story was everything, and in this case, there was likely no better way to persuade the judge of the truth of our mitigation narrative.  The end result was nothing short of astounding.   IN THIS EPISODE: Cooperation as a way to demonstrate extreme remorse; Why former prosecutors don't always make great defense lawyers; Why psychological evaluations can be critical to help put the crime in proper context; The decision process for making a sentencing mitigation video; How the video inspired the attorney making it, the client who saw it, and the judge who insisted on having the whole courtroom watch it; The astoundingly good outcome achieved in the case, which included not only a low term of custody, but release at sentencing so that he could self-surrender to serve the rest of his sentence; The power of past, present and future redemption stories; The importance of building the right team of experts at sentencing.   Hopefully you never need the services of Joel Meyers.  But if you do: https://www.linkedin.com/in/joel-meyers-973b254/   We talked about Prison Consultants, including Maureen Baird (former BOP warden) and Walt Pavlo, President of Prisonology.  Here are two recent podcast episdoes featuring both of them: https://dougpassonlaw.com/podcast/prison-consultants-and-the-myth-of-the-fixer-how-to-separate-substance-from-snake-oil/ https://dougpassonlaw.com/podcast/telling-the-story-of-prison-at-sentencing/   Also, at the beginning of this episode, I lament my lost radio career.  Here's the man who crushed my dreams... but I'm not bitter! https://youarecurrent.com/2019/09/09/carmel-clay-historical-society-exhibit-features-whje/   FREE RESOURCES: NACDL ARTICLE ON SENTENCING MITIGATION VIDEOS - visit shownotes at www.setforsentencing.com/JoelMeyers NACDL ARTICLE on THE "3Rs" of SENTENCING NARRATIVE.  - visit shownotes at www.setforsentencing/JoelMeyers

If you've been paying attention, you've heard me talk, ad nauseum, about the use of sentencing statistics in Federal cases.   But did you know that sentencing statistics are also relevant in your STATE CASES?    But, state sentencing data is often harder to access, and may require a tenacious investigator to fight arduous public records request battles.   Therefore, helping us get Set for Sentencing, an extraordinary investigator, Rich Robertson of R3 Investigations, tells us how he conducts "sentencing studies" in state cases and uses them to great effect on the big day.    He speaks of the first case he saw a sentencing study deployed by a judge to justify a probationary sentence (Bishop Thomas O'Brien's infamous hit and run), and two recent Arizona voter fraud/ballot harvesting cases.  If you are a state-level criminal defense investigator, this is YOUR golden opportunity to carve out a niche in your jurisdiction, doing “sentencing studies”.    IN THIS EPISODE:     How the Bishop was saved by a sentencing study; Unwarranted obstruction by the powers that be when it comes to legal obligations to make public information available to the defense;  Using data to predict outcomes and manage client expectations about the ultimate result; Narrative-based sentencing outcome analyses; Challenging death penalty aggravators in the well-known Hidalgo capital case; Rich's sentencing studies on two recent Arizona voter fraud cases; Using sentencing data to give judges the cover they need to do justice (i.e. give a low or no sentence).   LINKS & RESOURCES: This is where you'll find Rich if you need him:  R3 Investigations That said, Rich has been all over, having worked on some incredibly high profile cases in AZ and around the country.  He's been on Dateline, 48 Hours, and many major news programs.  Google him!  But here's a taste: (2) Private investigator in Lori Vallow case details ‘bizarre' circumstances | CUOMO - YouTube You've heard me talk about the "3Rs" of sentencing storytelling.  This whole episode is really about the 2nd "R", RELATIVITY stories.  It can be an effective part of sentencing to compare the case at hand, with other similar cases for the judge to have a broader perspective on what other (hopefully lower) sentences judges have imposed.  If you haven't gotten a free copy of my 3Rs Article from NACDL's "The Champion", go to the shownotes on my website, and download a copy --- www.setforsentencing.com/sentencingstudy   JUAN MARTINEZ - A DISBARRED, DISGRACED, FORMER PROSECUTOR:   In this episode, we invoked this infamous ex-prosecutor's name a couple of times, but it occurs to me the average listener may not get the reference.  If you're curious, google him.  He was a deeply unethical and offensive death penalty prosecutor, perhaps best known for prosecuting the Jodi Arias case.  He was disbarred when 20+ years of shenanigans finally caught up with him, including multiple allegations of sexual harrasment.  It's important we tell his story, because he represents everything wrong with the criminal justice system, and judges and supervisors enabled his conduct for years.  Unfortunately, this happens more than you might think.  Our system is only as good as the people who toil in it, and this guy was garbage of the highest order.  Good riddance.  https://www.abc15.com/news/region-phoenix-metro/central-phoenix/juan-martinez-disbarred-no-longer-able-to-practice-law-in-arizona https://www.phoenixnewtimes.com/news/arias-prosecutor-juan-martinez-reassigned-after-misconduct-complaint-11363444

Focus on the 3Rs at first (reading; 'riting; and 'rithmetic). Short lessons (15 min. each w/breaks in between), less than 2 hours a day on academics (to grow & maintain a child's love of learning). Other subjects (history, science, health, etc.) can be occasional and less formal. Look for learning in everyday living & non-traditional resources (children's literature, movies, games, outings, etc.). The first step to understanding something new is often the most challenging part.  Our guest on Episode 239 of Class Dismissed explains why we must rethink how we teach students.  He suggests we reconsider the three Rs – Reading, Writing, and Arithmetic and possibly replace those with some new Rs. Such as Relationships, Resilience, and Reflection. Jose Antonio Bowen is the author of the hit book “Teaching Naked.” Bowen led innovation and change for over 35 years at Stanford, Georgetown, and the University of Southampton (UK), and he's just released a new book. “Teaching Change: How to develop independent thinkers using Relationships Resilience, and Reflection.” Drawing on new research, Bowen explores ways to prepare students better while also focusing less heavily on teachers themselves, instead placing greater emphasis on their process interactions within a learning environment. In “Teaching Change,” Bowen examines student psychology, history, assumptions, anxiety, and bias and advocates for education to focus on the new 3Rs—Relationships, Resilience, and Reflection. In our interview with Bowen, he said critical thinking has become more crucial than ever. “We have to teach them [students] process,” says Bowen. These three Rs are more about the process. The old three Rs were about content — Reading, Writing, Arithmetic — stuff you need to know.” “Relationships, Resilience, and Reflection are more about what you need to know about yourself so that you can manage your own future change. Because my goal as a teacher is to make myself obsolete, so you don't need me; you can think for yourself.”  To learn how more about the new 3Rs, listen to Episode 239 of the Class Dismissed Podcast on your favorite podcast app or iTunes. Let's call this part-two of our long days journey into the night of several recent high profile federal setnencings.  Continuing our conversation from last week (Sunny Bulwani), we dig in to the sentencing of the very public and tragic fall of attorney Michael Avenatti.  We did most of the stats in last week's episode, but this week (see links below).  In today's episode, we first focus on some statistical missed opportunities, particularly when it come to life expectancy.Tnen, we really dig in on the narrative shortcomings of Avenatti's sentencing presentation. Avenatti did himself no favors when, acting as his own attorney, he plead guilty without any agreements in the last of his three federal cases. Although statistically he came out all right, in practical terms, this man is likely to spend the rest of his life in a prison cell.  Today we make the case that Avenatti's failure to put forth any coherent and credible narrative to help the judge understand why he did what he did, what he is going to do to make it right, and why it will never happen again, sealed his own fate at sentencing.    IN THIS EPISODE: What it means to do an “open plea”; How making an unreasonable sentencing request risks removing you from the conversation; Comparing Avenatti's fraud sentences to those sentenced for murder and kidnapping, and recidivist child porn offenses; Judges can and do request sentencing statistics from the US sentencing commission, but you might not know it; Examining and critiquing the sentencing memos for narrative, style, and strategy; The mishap with Avenatti's Residential Drug & Alcohol Program (RDAP) request; Another bummer example of what happens when we ignore the all-important life-expectancy statistics; Putting pictures in pleadings; they go in the body of your memo, not in the back as exhibits; Avenatti's giant, missed opportunity to create context and connection with well-told, credible revelation and redemption stories.  LINKS: Last episode:  We began this conversation in EP. #32 (Sunny Balwani Sentencing Post Mortem) by doing a thorough, comparative statistical analysis of Avenatti's sentencing with Holmes, Bulwani and the Chrisleys (reality star fraudsters).  If you haven't heard the first 20 or so minutes of that episode, it's most certainly pertinent to today's discussion on Avenatti.   Check it out, along with Mark's awesome graphs and charts at: www.setforsentencing.com/balwani  or on YOUTUBE:  https://youtu.be/qVFps0dz8-k A couple months back, we gave Elizabeth Holmes the same treatment.  You can listen or watch that episode (Sentencing Post-Mortem Podcast) here: https://dougpassonlaw.com/podcast/elizabeth-holmes-sentencing-post-mortem/  or on YOUTUBE:  https://youtu.be/8QmadJLe3NQ ABT Book!  When analyzing the defense memo, we see the ABT at work, clearly defining the problem the judge needs to address ("the But").  The book is 7 bucks on amazon if you want to learn more.  If you're not up for buying the book, here's a short blog post on it: https://dougpassonlaw.com/blog/the-three-most-important-words-in-persuasive-communication/ Patterson study: Avenatti missed it. Holmes & Balwani missed it.  So did the Chrisley's.  Life expectancy could make a huge impact at sentencing.  And remember the Patterson study to make sure you're getting accurate numbers!  https://ajph.aphapublications.org/doi/full/10.2105/AJPH.2012.301148?role=tab MARK's CHARTS:  visit www.setforsentencing.com/avenatti to see some more of Mark Allenbaugh's visual aids concerning relevant statistical issues in the case. 3 RS:  Here we again analyze the defense mitigation presentation through the lens of the “3Rs” of Sentencing Narrative.  Avenatti missed the boat on all of them, but especialy REVELATION and REDEMPTION.  If you'd like to learn more about the 3Rs, head over to the shownotes at www.setforsentencing.com/avenatti, for a free download of the article I wrote on the subject for The Champion (NACDL).

Continuing my goal of showcasing my own work in December, this week's episode is all about my passion, my love, my baby; what we call DEFENSE DOCUMENTARIES.  Some call them mitigation videos or sentencing videos.  These are short, true, films produced for criminal cases (for plea negotion, sentencing, and post-conviction relief) and used to humanize our clients and advocate for them in a far more credible and powerful way.  I always say if the judge could spend the time with our clients and their families that we do, they'd have a whole new perspective on the case.  But our system isn't built that way.  In fact, in some cases, the first time a judge ever lays eyes on a client is on the day of sentencing.  Therefore, a well-made, ethically sound, defense doc is the closest we can come to bringing the judge off the bench and into our world.  I have found these stories, told with pictures, to be far more powerful than the words and all the other paper we lawyers are taught to present to find justice at sentencing.  I'm not just a lawyer, I'm an award winning filmmaker.  I've had non-legal documentaries play at film festivals across the country and beyond.  In 2005 I began combining my two passions of law and film, making my first defense defense documentary.  My client received probation, and I never looked back.  I've been leading the charge in this powerful form of legal advocacy ever since.  A few years back, I was invited by Park Howell to be a guest on his incredible podcast, "The Business of Story".  Park is also the co-author of the business version of the Narrative Gym book series.  Special thanks to him for allowing this re-broadcast.  Enjoy! IN THIS EPISODE: Doug's "origin story" - how he became a lawyer and a filmmaker; The story of the first defense doc Doug produced; Making empathy your guiding light at sentencing and using defense docs to do it; The important distinction between sympathy and empathy at sentencing; The 3 primary elements necessary for an effective defense doc; The "3Rs" of sentencing narrative. LINKS:  The podcast opens with a STORY of a client I called “Daniel”.  At the time, I was using a pseudonym to respect his privacy.  Since then, he's come out with his story and he was gracious enough to come on Set For Sentencing to tell it himself!  This was EPISODE 11, "It's a Real Life: A Former Client's Redemption story." Park Howell found me through what turned out to be a very controversial NYT Piece profiling my work, Called “No Jail Time, The Movie”. It was an NYT opinion piece or “op doc” that came out around 2017.  We're going to do a whole other podcast about No Jail Time the Movie, the focus of which will be the ETHICAL implications of DOCUMENTARY FILMMAKING, as the filmmaker, Lance Oppenheim did just about everything an ETHICAL documentarian should not do to get his movie made and into the hands of the Times.  The beauty of life, my practice, and my story journey has been constant learning and growth.  But, it occurs to me as I relistened to this great discussion that it occurred before Park Howell and I fully discovered and embraced the narrative structure of "AND, BUT, THEREFORE" (ABT), pioneered by story expert Dr. Randy Olson.  Therefore, we didn't yet have the full vocabulary to express the truth of narrative structure and the evolution of our process in helping others craft their brand stories and their legal stories.  Now we do- and it's ABT all the way, baby.  So, if I haven't included enough shameless plugs for the ABT, here's the Amazon link to buy my book, The Narrative Gym For Law: Intruducting the ABT framework For Persuasive Advocacy. Along the same lines, we discussed my "3Rs" of Sentencing Narrative - but at the time, those ideas were also not fully formed.  Now they are!  And you can have a copy of my article from NACDL's The Champion, for free.  Just visit the shownotes on my website (www.setforsentencing.com/defensedoc), scroll down, and click the download button.  Last, but certainly not least, if you are interested in learning more about The Business of Story and the incredible marketing and eductational opportunities Park Howell has to offer, visit: https://businessofstory.com

On Friday, 11/18/22, a federal judge sentenced Elizabeth Holmes to over eleven years in prison.  Ms. Holmes was convicted after trial of a "fake it 'till you make it" fraud involving her company Theranos, and the revolutionary blood testing technology dream machine that was not to be.  There are many lessons we can learn from what went down last week, so, helping us get Set For Sentencing, our old friend and guidelines expert, Mark Allenbaugh.  Mark and I break down what it was, what it could have been, and what comes next.    We also veer a way off the path, with admittedly wild speculation about whether Elizabeth Holmes may be on the Autism Spectrum, and if so, how that would have put her entire mitigation narrative in a different light. So, surf's up.  Let's ride the wave of this consequential current sentencing event, and take away some practical tips for your own case in the process.  In this episode:  How Ms. Holmes won the day when it came to the guidelines calculation; How much time she may actually serve given "good time"credit, First Step Act credits, compassionate release, and 1/2 way house options; Comparing the government's narrative with the defense narrative - which narrative was more compelling and why; Breaking down the opening paragraphs of the government and defense sentencing memoranda; “Shirley's Law” and the need to take control of the narrative; Whether 130 character letters is too much of a good thing; A wacky theory about Autism. LINKS: www.sentencingstats.com We talked oh-so briefly about two other current events, the special counsel appointment for Trump and the fact that the Oath Keeper/Stewart Rhodes Jury is now deliberating. Mark and I have previously done podcast episodes on both topics, so here are links to those shows: MAR-A-LA-GOING TO PRISON? SEDITION EDITION: POTENTIAL OUTCOMES IN STEWART RHODES SEDITION TRIAL Autism:  I mistakenly said 1/8 people have an autism diagnosis.  Way off.  It's more like 1/44.  BUT, that's still alot.  It means we've had clients with Autism Spectrum Disorder and We probably missed it.  If you want to learn more, here's a prior episode on that too:  UNDERTANDING AUTISM AT SENTENCING "Shirley's Law": If you don't control the narrative, someone else will and you will NOT like it!  This comes from Dr. Randy Olson, and it's in the book we co-authored on legal storytelling, The Narrative Gym for Law, available on AMAZON. And, last but not least, I talked a fair amount (again) about my "3Rs of Sentencing Storytelling".  These are the three major categories of stories any defendant can (and must tell) on their big day.  If you'd like to download a FREE copy of the article I wrote on the subject, from NACDL's The Champion magazine, visit the shownotes on my website for this episode: https://dougpassonlaw.com/podcast/elizabeth-holmes-sentencing-post-mortem/
