Trans healthcare is an evolving discussion, and the implications greatly affect those in the LGBTQ+ community. At its heart, this is a conversation about the science meant to inform transition-related healthcare care, and what happens when politics deliberately distorts it. On March 31, 2026, The Supreme Court handed down an 8-to-1 ruling that conversion therapy, a practice every major medical and mental health organization has condemned as harmful and without scientific basis, now qualifies as “protected speech” under the First Amendment. The case, Chiles v. Salazar, centered on a Christian counselor in Colorado who argued that a state ban on the practice violated her right to speak freely with her clients. Justice Neil Gorsuch, writing for the majority, declared that the First Amendment “stands as a shield against any effort to enforce orthodoxy in thought or speech in this country.” Only Justice Jackson dissented, warning that the ruling “misreads our precedents, is unprincipled and unworkable.” This decision puts laws in 23 states and the District of Columbia at serious risk. It tells LGBTQ+ young people that any licensed therapist with a personal ideological or religious agenda now has the constitutional right to try to change who they are. It arrived on a day meant to celebrate trans lives. This ruling lands in the same moment that Professor Kinnon Ross MacKinnon, a trans researcher whose work I deeply respect, published in the New York Times that the Trump administration has been weaponizing detransition research to justify bans on gender-affirming care. At the same time, his guest essay outlines the complexities of gender fluidity that can occur after accessing medical treatments for gender dysphoria. Early studies from the 1970s through the 2000s found detransition rates of roughly 1 to 6 percent, primarily among adult transgender women who had full surgical transitions. New research focusing on younger populations, though, identifies that between 2-17% [GU1] of young LGBTQ+ people may experience a detransition process. The field of pediatric gender-affirming healthcare, when it was rapidly scaled up in the United States and Canada over the last 10-15 years, was not prepared for the question of detransition and how to care for these experiences. In the recent case Chiles v. Salazar, the Supreme Court was asked if Colorado's "Conversion Therapy" law violated the Ms. Chiles right to free speech. As is so often the case, the court agreed that the law violated Ms. Chiles free speech rights, just for the wrong reasons.
The recent U.S. Supreme Court decision in Chiles v. Salazar doesn't really close the case – but it also doesn't really leave it open. The 8-1 decision, in which the nation's highest court ruled that a Colorado ban on so-called “conversion therapy” for juveniles was unconstitutional, is subtle, complex, and unnerving; the American Psychological Association issued a statement noting that it was “deeply concerned” over it. The case relates to conversion therapy as talk therapy, specifically related to gender identity and First Amendment rights. But the decision only remands the matter for further review by the Tenth Circuit, thus leaving the issue essentially undecided. Is this just more judicial “Calvinball” – the game highlighted in the classic comic strip Calvin and Hobbes, in which the rules are made up on the fly – or is the Court simply assuring another bite at this apple? Jane Bambauer and Eugene Volokh analyze the US Supreme Court's new Chiles v. Salazar decision, which struck down (by an 8-1 vote) a law banning sexual orientation/gender identity conversion therapy, including therapy that consists entirely of speech. The Court held that the First Amendment protects professional-client speech, including counselors' use of conversion therapy with minor patients when that therapy consists solely of speech. In the process, the 8-justice majority rejected the state's argument that such speech can be regulated as “speech integrally related to unlawful conduct” – and in the process, cited Volokh's discussion of the speech integral to unlawful conduct exception in a friend-of-the-court brief that he filed. The Lasting Harm of Conversion Therapy: An Interview with Samuel Nieves This interview was recorded in November 2025 in anticipation of the Supreme Court ruling in Chiles v. Salazar and released afterward. Rather than focusing on the legal details of the decision, Curt and Katie talk with Samuel Nieves about the harms of conversion therapy, how change efforts can be disguised as therapy, and what clinicians need to understand when working with survivors. Sam shares from his lived experience as a survivor and explains why the deepest harms often involve identity damage, loss of self-trust, and disconnection from one's own lived experience. About our guest:Sam Nieves has a Bachelor's in Psychology. In 2019, he entered grad school to become a Licensed Marriage and Family Therapist, but left the field after 6 months of clinical experience. Since 2020, Sam has used his personal, clinical, and educational background to support survivors of conversion therapy. He is now a board member of the non-profit organization Conversion Therapy Survivor Network. Sam uses the online name “CantPrayMeAway” to share his own experiences as a client of conversion therapy and advocates for the end of all conversion practices worldwide. There was a settlement agreed to by the city of Louisville, Kentucky, regarding a Christian photographer who was threatened with legal sanction if she did not serve (so-called) same-sex weddings. The photographer was also prohibited by the city from expressing her views on marriage on her own studio website. Earlier this month, Mat argued before the U.S. Fourth Circuit Court of Appeals in the case of Zinski v. Liberty University. It's a case involving Jonathan Zinski, who Mat believes, "... intentionally set up Liberty University to try to take them down." This case could determine the scope of religious liberty protections for faith-based organizations. Oral arguments will be given before the Supreme Court tomorrow to settle the issue of birthright citizenship (Trump v. Barbara). Also discussed was the "creep" of Islamic Sharia and why Mat believes it's not compatible with American law. Highlighted was discussion of the "Preserving a Sharia-Free America Act" (H.R.5722/S. 3009) introduced by Representative Chip Roy and Senator Tommy Tuberville.
