Intro.(1:12) - Start of interview(1:54) - Janine's "origin story."(2:25) - Her path from law school to plaintiff litigation work, representing and training employers, and the founding of Emtrain.(5:40) - Her thoughts on lawyers transitioning to entrepreneurship, and her personal story with Emtrain: "I had this day job that was pretty directionally consistent with what I wanted to do in a technology aided fashion." "It was a big deal when I quit my day job in 2006 and all of a sudden there were five of us employed by Emtrain."(7:02) -  "The real transitioning point was in 2016-2017, after watching the SF trial of Ellen Pao v. Kleiner Perkins (2015), that seemed to me a seminal point. The beginning of harassment law as we know it began with another huge SF trial, the Baker Mackenzie case (1994). I watched both trials so I thought this would become another inflection point."(7:40) - I predicted the #MeToo movement in an article that I published on Medium. "Women everywhere are going to be so upset. The law is not an adequate channel to address these issues in real time, and social media is going to become the avenue to bring more accountability."(8:20) - "This is when I decided to take some outside capital for Emtrain." Her vision of Emtrain, and their new technology approach with predictive analytics and benchmarks.(13:03) - How technology has impacted her business offerings. Scaling from a one-dimensional compliance training program to two-way communication and multi-stakeholder engagement.(15:03) - Impact and take-aways from Emtrain's 2021 Workplace Culture Report (based on 20 million employee responses on workplace).(18:44) - Her take on the impact of COVID-19 and WFH policies in the workplace: "We have to be more intentional in virtual settings." We will have to navigate the "in-group / out-group" challenges and dynamics.(21:16) - The role of the board on ethics, respect and inclusion. "Laws follow people, people don't follow laws." "Younger generations are social justice warriors." Reputation impacts the corporate brand.(24:33) - The impact of ESG in her industry. "We are a tool in the tool chest to support and manage the corporate brand and how they're perceived by stakeholders."(27:23) - Her thoughts on the BRT 2019 restatement of corporate purpose and the rise of employee activism.(31:02) - Her take on corporate boardroom diversity. "If Theranos would've had any woman on its board, maybe she would've called b*%&t on Elizabeth Holmes". "Different people see different things." "What about the Purdue case, the social consequences are huge." "Compiling diversity metrics is a start, but that's like crawling. Where we need to go is understanding the KPIs and dynamics to reach a better trajectory."(38:19) - How she came up with the framework used by Emtrain. It's all about organizational behavior. Her take on the difference between US and European corporate approach to social issues.(40:48) - Her take on the recent exodus of people and companies from SF/Bay Area/CA and why she thinks CA will be fine.(44:23) - Her favorite books:Atlas Shrugged, by Ayn Rand (1957)Sci-fi and fantasy books.(47:13) - Her mentors: "I unfortunately was late in the game on having mentors" Recently I've connected with some great advisors:Frits Habermann, ex CTO of Lynda.com (acquired by LinkedIn)Steve Roop, formerly with Glassdoor.(48:52) - Her favorite quote: "Our strengths are our weaknesses and our weaknesses are our strengths"(49:33) - Her "unusual habit": I twirl my hair when I'm thinking!  She loves reading ("that's what winds me down")(50:24) - The living person she most admires right now: Bill Gates.(52:45) - Her parting thoughts for directors on how to deal with social issues:  "Every board member should think about their ethics, respect and inclusion as part of their reputation. They need to start operationalizing these matters within the organization."Janine Yancey is the Founder & CEO of Emtrain, a California based online workplace culture platform that helps companies diagnose, benchmark and prevent bad workplace culture outcomes. Most conversations in B2B sales are about how you sell to the person you're speaking with. Ask them the right questions, learn their pains, needs, and goals, give them pricing, send them proposals, etc. There is A TON of content in this area. The oft-overlooked part is how to navigate a multi-stakeholder deal. Most enterprise, and many non-enterprise, sales include a main point-of-contact, influencers, the economic buyer, and the final decision-maker.In these cases, your main point-of-contact has to become your champion, and you have to coach your champion to gain buy-in at these different levels. Because there's not much content about how to do this, I'm especially excited to have had the opportunity to speak with Nikki Ivey, cofounder of SDRDefenders and sales rep at Emtrain, who sells a DEI product to a customer who often has to fight for budget internally. California Groundbreakers
Policy and a Pint: Sexual Harassment at the State Capitol

California Groundbreakers

Besides #MeToo, one of the best-known hashtags in California right now is #WeSaidEnough. That term was introduced in a bipartisan letter published last October in the Los Angeles Times, with signatures from more than 140 women working in California politics. It was the first statement nationwide by women calling for an end to the pervasive culture of harassment and assault within the halls of government. Their actions highlighted the fact that, even in a state as progressive as California, the Capitol community can still be an "old boys' network" that doesn't always treat women working within it with much respect. So what happens next? What will come from the Capitol's legal investigations and legislative hearings? Should we expect specific bills on this issue, and will they have teeth? And how will the sexual harassment scandals in state government translate into policy that affects workplaces around California? PANELISTS * Samantha Corbin, executive director of #WeSaidEnough, the op-ed letter that turned into an equity-focused organization * Assemblyperson Laura Friedman (D-Glendale), who held hearings on this topic in her role as chair of the Assembly Rules Subcommittee on Harassment, Discrimination, and Retaliation Prevention and Response * Jodi Hicks, partner at the women-led government relations firm DBHK and one of the signers of the #WeSaidEnough letter * Janine Yancey, an employment-law attorney and CEO of Emtrain, a HR and compliance training firm PODCAST TIMEFRAME * 2:05 minutes - "I get to have the privilege of speaking out without fear" -- Panelists introduce themselves * 6:15 min - "We got 22,000 hits on the website almost immediately" -- How #WeSaidEnough got its start, and where it's going now * 12:50 min - "I woke up in the middle of the night and thought, 'Wait, I just signed this letter . . . and I think there's a committee on sexual harassment . . . and I think I'm the chair'" -- From making Hollywood movies to holding goverment hearings on sexual harassment * 22 min - "The Senator said, 'We might start a policy not to have drinks with female lobbyists.'" -- The negative impact of speaking out * 28:30 min - "'I don't want anyone to see you with me" - because I'm the Sexual Harassment Fairy" -- Is it easier now or not to speak out and be a "Silence Breaker?" * 36:20 min - "These two venture capitalists say, 'I haven't read that article. How come I'm not getting invited to these sex parties?" - How California businesses are reacting * 42:45 min - "We're asking women to be the ones to put themselves out there, and not get to the top" -- Being guilty of not doing anything . . . and how to change that * 53:10 min - "We can be a lot more productive, a lot more objective, and have a lot more transparency" -- How can the state legislature build a structure that has a fair process for all parties involved? * 57:25 min - "It's one of the reasons to seize on this moment, because this may not be a hot topic in a year" -- What panelists think of the legislature's new bills that tackle sexual harassment * 1 hr, 6:20 min - "One person thought that was highly offensive, another person asked, 'Well, was his fly undone?'" -- Is there a backlash to this movement now? * 1 hr, 12 min - "The problem is, when you're an elected official, the accountability is hard to find" - - Why does the state legislature play by different rules on this than everybody else? * 1 hr, 16:50 min - "Victims are looking for resources, to feel solidarity, to be connected, and to reserve the right to make decisions on a go-forward basis" - - Two panelists' new technology to combat sexual harassment * 1 hr, 23 min - "I'm not going to act like Melanie Griffith, I'm going to act like Sigourney Weaver in 'Alien'" -- What's needed to make efforts of the past few months permanently stick

Twitter, LinkedIn, the Chronicle, other media - social and print - throughout Silicon Valley and beyond, abound with frustrations about diversity in the workplace these days. The conversation is important because we have a lot of work to do to get to workplaces that are truly equal, that are welcoming -- workplaces where one does not have to suffer through explicit or implicit questions about her ability or right to be there. These are conversations we try to enable on Unraveling Pink: non-judgmental, open conversations about what we think but may not typically express, about the gender-based assumptions that impact our productivity or satisfaction at work, and what we can do about them. Silicon Valley is currently in the "Red Zone." But there is hope. There is a "release valve" that offers help to employers and employees. Resources that enable employers to create the kind of diverse environment that Google is struggling to develop in the very public eye right now. Resources that employees can anonymously seek out to get help when they feel harassed or discriminated against -- or just need a sanity check when suffering through yet another micro-aggression in a workplace that doesn't reflect their identity. In this episode of Unraveling Pink, Janine Yancey, CEO and founder of Emtrain, shares how Emtrain serves as this very necessary release valve, and how we can move our organizations from the Red Zone, through Orange, and even Yellow, into the coveted Green Zone.
