Kirkland advised on more than $427 billion in global mergers and acquisitions over the year, surpassing rivals like Latham & Watkins, Skadden Arps Slate Meagher & Flom, and Freshfields. Under the Family Smoking Prevention and Tobacco Control Act, the FDA must approve new tobacco products. Wages and White Lion Investments (dba Trion Distribution) and Vapetasia manufacture and sell flavored nicotine-containing liquids for use in refillable e-cigarette systems. They applied for FDA approval in 2020; about ten months later the FDA announced new requirements for approval and, based on those requirements, denied the applications citing the deficiency. The manufacturers challenged the denial and the Fifth Circuit, sitting en banc, found the FDA's actions were arbitrary and capricious. SCOTUS granted the FDA's cert petition and the court heard oral argument on Monday, December 2. In Lindenberg v. Jackson National Life Ins. Co., 912 F.3d 348 (2018), the Sixth Circuit declared unconstitutional Tennessee’s law capping punitive damages based on the Tennessee constitution. But in the wake of Lindenberg, Tennessee state courts continue to reduce punitive damage awards in reliance on the statutory cap because the Tennessee Supreme Court has not directly addressed the law’s constitutionality. And in a case on a different statutory damages cap, the Tennessee Supreme Court indicated it likely would have disagreed with the Sixth Circuit. McClay v. Airport Mgmt Svcs, 596 S.W.3d 686, 693 n.6 (Tenn. 2020)Federal court certification of state law questions to state high courts is a thorny issue with competing concerns. All states but North Carolina permit certification, but the federal courts control which questions presented in the case it certifies for resolution. State courts are free to decline to answer the questions certified and to do so after a period of months, as happened in Lindenberg. Some experts point out that even when the state court chooses to answer the questions certified, the process can be time consuming and inefficient.Our panel will explore the issues of federalism, efficiency, and prudence presented when considering the question certification process between federal and state courts.Featuring:Hon. At the age of 96, Judge Pauline Newman is the nation's oldest federal judge. In 1984, Judge Newman became the first judge appointed directly to the US Court of Appeals for the Federal Circuit. In April of last year, reports surfaced that Federal Circuit Chief Judge Kimberly Moore had initiated a complaint against Judge Newman under the Judicial Conduct and Disability Act of 1980. Although the complaint was initially based on alleged “cognitive decline,” it later morphed to focus on her unwillingness to cooperate with Judge Moore's investigation. This program will provide an update on Judge Newman's case and discuss issues related to this most-unusual set of circumstances. This program coincides with panelist David Lat's recent interview with Judge Newman, available here, which allows viewers to hear Judge Newman in her own words. On November 13, 2023, the Supreme Court formally announced a Code of Conduct, a significant development encapsulated in a 14-page document outlining five canons of conduct. Addressing issues such as judicial recusal and permissible outside activities, the Code consolidates ethical rules guiding the Court's members. This webinar assembles a panel of Supreme Court and Legal Ethics experts to delve into the nuances of the Code, exploring surprises within its text and elucidating its implications for the Court's future. The release of a Code coincides with the Professional Responsibility & Legal Ethics Practice Group's sponsorship of a National Lawyers Convention breakout panel titled "Originalist Perspectives on Ethics and the Supreme Court." The discussion, held just days before the Code's unveiling, pondered the necessity of an Ethics Code for the Supreme Court and foreshadowed lingering questions for the Court. She was preceded in death by her father, John Warren Sedwick; mother, Catherine Adele Sutherland; and husband, Kenneth Jerome Rhodes, ‘Jerry'. She is survived by son, Brian Rhodes; daughter-in-law, Rebecca Rhodes (Glen Allen); daughter, Jennifer Perkins; son-in law, Jamie Perkins (Indianapolis); grandchildren, Brenden Perkins, Julia Rhodes, Sara Rhodes, John Rhodes; brother John Sedwick. One minute she's making candles from crayons the next she's collaging with a 70's Sears catalog.  The constant theme through those creative endeavors is her love of kitsch, color and all things vintage.  Whether she is crafting or decorating a Kitschmas tree, her distinct style shines through. Jennifer has had as many careers within the creative industry as she has had crafty passions.  She started her creative career as a jewelry designer but has worn many hats through the years including television host, brand ambassador and craft magazine editor. She has done ad campaigns for Michaels, been a guest on the Rachael Ray show multiple times and had her work featured in places like Country Living, Better Homes and Gardens and Houzz.  Most recently Jennifer is working on her 4th craft book which will be available in the fall of 2022. Jennifer has lived in Austin, TX for over 20 years.  She has two kiddlets, 1 husband, 2 dogs, 2 rabbits and 3 cats. If she's not crafting, she's at the thrift store. Jennifer Perkins, for those of you who don't watch TV, is an actual TV personality. She has hosted multiple programs on both HGTV and the DIY Network. On top of that, she's a crafting Queen and old hat when it comes to vintage and thrift. As in, she's been collecting bakelite since infancy. But don't worry, she's real low key about it. Really chill. The same kind of chill she is while casually mentioning the NINE full-sized Christmas trees she had up for this past holiday season. She doesn't really count the ones that are shorter than three feet. Oh, and she used to be a brand ambassador for Treetopia. Again, catching our breath, trying to remember that this is actually happening. Turns out, though, that she's just a giant weirdo like all of us. It's fantastic. Enjoy her descriptions of growing up in an old Victorian home with her mildly eccentric parents. Please also listen for the sign of quiet shame that rolls out of Sam when Jennifer mentions anthropomorphic tableware. Her son was diagnosed with Caudal Regression Syndrome from the first few days of life and she has been fighting for him ever since. She a nurse so she knows her way around the health care field but it does not make it any easier. She was told that her son, Noah, would never walk but he has been proving physicians wrong left and right. He's walking, jumping and playing on playgrounds, something she thought he would never do. Jennifer's perseverance and strength is incredible, she says all moms would do this for their kids, but Emily's not so sure. Caring for a child with a health condition is not easy but Jennifer makes it look, dare I say, easy? This week's guest is Jenny Hart, an amazing artist and founder/CEO of Sublime Stitching, a contemporary studio for hand embroidery, delivering designs and patterns that are far edgier than anything your grandmother every worked on. Jenny has authored many books on the subject, has been feature in numerous publications, she's exhibited her work in prestigious galleries and shows, and has rejuvenated a medium in danger of loosing relevance and slipping in obscurity. She was an original founder of the Craft Mafia in Austin Texas, only to be replicated in many other cities, and Jenny was in a select group of artists called 40 under 40 who were recognized by the Smithsonian on the 40th anniversary of the Smithsonian’s Renwick Gallery, where some of her art remains on display. She has sold work to some of Hollywood's elite, including Laura Dern, Tracy Ulman and two really big names that she will share a really funny story about in our episode. What do you do when you're emotionally depleted and you just need a break? Woof! We've all been there before. Heck, you might be feeling it right now...  The alarm clock goes off. You open your eyes and feel just as exhausted as when you went to sleep. Your brain starts to spin out of control, thinking about the slew of 80 billion things that lie ahead for you. People wanting you to do stuff. Emails waiting for answers. Laundry that needs folding. And a never ending supply of tasks that need to get done… yesterday.  The problem is, your inner love tank (as Dr. Chapman would say) is teetering on empty. The red light is blinking out of control, and you're emotionally spent. You've got nothing left to give and you feel like a Mack truck just ran you over. What do you do then? My conversation with Jennifer Perkins earlier this week, triggered this thought of the day. Change is hard, and it's also emotionally exhausting! Many state attorneys general have banded together to challenge alleged overreach in the environmental arena, including litigation against the EPA’s coal-fired power plant regulation plans.
