Ohio law sees backlash from business owners As THC and CBD-infused drinks grow in popularity, especially among people looking for alternatives to alcohol, Ohio's new law restricting hemp-derived products is changing how and where those beverages can be sold. After voters approved recreational cannabis use in 2023, a number of small businesses across the state began selling THC drinks, with some seeing demand rival traditional beer and wine. Wednesday on the "Sound of Ideas," we'll discuss Senate Bill 56, signed in December and enacted in March, which makes selling hemp products like these illegal. At first, the law included a provision allowing THC beverages to continue being sold by breweries and retailers for a limited time. But Governor Mike DeWine used a line-item veto to remove that carveout, saying it could create confusion around how the products are regulated. The change has prompted legal challenges and created uncertainty for businesses that invested in the drinks, with some pulling products, cutting staff, shifting operations out of state or closing completely. And with a similar federal law set to take effect in November, the future of hemp products—and the businesses built around them—remains uncertain. This week on the Hemp Podcast, we have a long conversation about hemp-derived intoxicating cannabinoids with Chris Fontes, president of the U.S. Hemp Authority and founder of Trojan Horse Cannabis and High Spirits Beverages. Trojan Horse Cannabis was the first company to bring so-called intoxicating hemp derivatives to market, changing the hemp space forever. For decades, hemp advocates said hemp was different from marijuana because hemp couldn't get you high. But the 2018 Farm Bill created the perfect conditions for the birth of a whole new chapter in the story of hemp. Fontes said when he read the hemp language in the 2018 Farm Bill, "My first thought was: We have uncontrolled THC. There is now a version of THC that is not controlled. Something could be done with this." THC is the chemical compound produced in the cannabis flower known for its psychoactive properties. Applying basic principles of math, Fontes realized that this legal THC "can be put into a product at a 10 milligram standard dose and could be shipped through the mail to anyone in the country at the time as there was no state by state blocking and interstate transport was explicitly protected," he said. Thus, the intoxicating hemp-derived cannabinoid market was born. And that's where this conversation gets interesting. This isn't your typical fiber and grain hemp discussion. But if you want to understand why lawmakers are reacting, why definitions are shifting, and why the word hemp feels contested right now — you have to understand where this market came from. High Rise Beverage co-founder Matt Skinner has built a coastal-themed brand in the Southeast but his ambitions extend across the nation. The Charleston, South Carolina-headquartered intoxicating hemp beverage brand is now available in 22 states, and Skinner sees an opportunity to go even bigger. "We're in the space of being a nationwide brand at this point," he says on the latest edition of the Brewbound Podcast, recorded in October at the National Beer Wholesalers Association's Annual Convention in Las Vegas. "Having those partnerships and getting in with the right distributors now is important. They're finding who they feel like their horses are in the category, and I think we are aligning across the country with that. But the Southeast is very important to us." Ohio Gov. Mike DeWine's executive order has been paused by a temporary restraining order.
Gov. Mike DeWine took executive action this week to temporarily ban the sale of "intoxicating hemp" products in the state. DeWine said the products represent a consumer product emergency. The order bans the sale of unregulated products that contain THC derived from hemp including candies and drinks. THC is the psychoactive compound found in the cannabis family of plants. DeWine's executive order is for 90 days. We will begin the “Sound of Ideas Reporters Roundtable” with the governor's executive action. The Ohio House this week passed -- with some support from Democrats -- two bills that proponents say will give property owners some tax relief. The two bills, which the Senate now takes up, make changes to how property taxes are determined and how schools and other local entities collect the money raised from levies. Eleven protesters have paid nearly $400,000 in restitution in a pretrial diversion program that, if all stipulations are met, will null charges they incurred while protesting the war in Gaza at Case Western Reserve University last year. The protesters, ages 20 to 25, splashed red paint on buildings and sidewalks. They were charged with breaking and entering, possessing criminal tools and vandalism. They spoke publicly last weekend, saying the university is making an example of them in order to quash pro-Palestinian protests. Early voting is underway for the November election. And in addition to levies and mayoral an council races, there is a robustly contested battle for four open seats on the Akron Board of Education. Eight candidates meet this week for a debate sponsored by the Akron Press Club in partnership with Ideastream Public Media, the Akron Beacon Journal and Signal Akron. Our Anna Huntsman was one of the journalists posing questions to the candidates. People are packing independent music venues. That's a good thing. But the venues aren't turning a profit. That's troubling. So says a new report from the National Independent Venue Association on the impact of small music clubs on the state's economy, which estimates the more than 300 clubs made $3 billion last year. Students, alumni and supporters of student-run WCSB college radio at Cleveland State University held a protest this week after the university announced an agreement with Ideastream Public Media to switch to an all-Jazz format programmed by Ideastream.

This week on the Hemp Show, we're continuing the conversation around the need to split the industry into two. There is much confusion in the minds of law makers and consumers when it comes to what hemp is. For years hemp advocates championed the fact that hemp doesn't get you high, but thanks to a loophole in the 2018 Farm Bill, somebody figured out how to get high from hemp, and so began the era of intoxicating hemp that we find ourselves in now. But if hemp is getting you high, it's not hemp — it's weed. Stop calling it hemp. And that's why there needs to be a legislative fix. Erica Stark from the National Hemp Association joins us to discuss the issue and share her ideas on what a potential fix might look like. Then we talk to Lancaster Country regenerative hemp farmer Steve Groff about the various hemp projects he's working on down at the farm, where he's got 60 acres of fiber hemp ready to harvest in about three weeks. He talks about the “green decortication” project he's working on and how he hopes to inspire people at the Global Fiber Hemp Summit in Raleigh next week. As always Groff sees potential, but he's not waiting for the next Farm Bill to act. “I'm not checked out,” he said. “I'm checked in.” Plus, news nuggets from around the hemp world: Kazakhstan is preparing to make passport paper from hemp, Arizona courts are tightening THC rules, and Morris Beegle calls again for clear bifurcation between cannabinoid and industrial markets. In popular memory the repeal of US Prohibition in 1933 signaled alcohol's decisive triumph in a decades-long culture war. But as Dr. Lisa Jacobson reveals in Intoxicating Pleasures: The Reinvention of Wine, Beer, and Whiskey after Prohibition (University of California Press, 2024), alcohol's respectability and mass market success were neither sudden nor assured. It took a world war and a battalion of public relations experts and tastemakers to transform wine, beer, and whiskey into emblems of the American good life. Alcohol producers and their allies—a group that included scientists, trade associations, restaurateurs, home economists, cookbook authors, and New Deal planners—powered a publicity machine that linked alcohol to wartime food crusades and new ideas about the place of pleasure in modern American life. In this deeply researched and engagingly written book, Dr. Jacobson shows how the yearnings of ordinary consumers and military personnel shaped alcohol's cultural reinvention and put intoxicating pleasures at the center of broader debates about the rights and obligations of citizens. This interview was conducted by Dr. Miranda Melcher whose new book focuses on post-conflict military integration, understanding treaty negotiation and implementation in civil war contexts, with qualitative analysis of the Angolan and Mozambican civil wars.
