In today's episode, we talk with two Youth Fellows from the Texas-based organization, Jane's Due Process, founded to help Texas teens navigate judicial bypass. Because Texas now has a complete abortion ban, young people must travel out of state for an abortion. However, judicial bypass is still required in some other states. In this episode, we discuss the implications of the recent Supreme Court ruling in Dobbs v. Jackson, taking away the constitutional right to abortion by overturning Roe v. Wade and granting states the authority to impose restrictions on abortion care. We speak with Amy Perez, a nurse and abortion care provider living in Texas, about what the decision means for reproductive health and Amy Perez is a queer activist from Madison, Wisconsin. She graduated with a Bachelor of Science in Nursing and a minor in Chican@ & Latinx studies from the University of Wisconsin-Madison. As an undergrad, the Obama administration awarded her the President's service medal in recognition for 200+ hours of volunteer service for Planned Parenthood Federation of America. Upon graduation, Amy moved to Austin, TX to complete a Residency in Pediatric Intensive Care. After SB8 took effect, a bounty law that allows private citizens to sue whoever helps people obtaining abortions beyond 6 weeks of gestation, Amy decided to switch specialties to serve those affected by this law. Amy currently works as an Abortion Services Nurse for Planned Parenthood of greater TX at the South Austin Surgical Services Center. Amy intends to become a Sexual Assault Nurse Examiner to help victims of sexual violence when she becomes eligible to certify. Amy's goal is to become a Midwife and a Women's Health Nurse Practitioner and open her own sexual and reproductive health center. Eventually, she will also get a DNP in psychiatry & mental health. Amy has devoted her life to serving and empowering underserved and marginalized communities. On May 2nd, 2022, a Politico article was released that contained a leaked copy of the Supreme Court's draft decision of the Dobbs v. Jackson Women's Health Organization case that would most likely have been released formally in June or July of this year. The leaked decision, penned by Justice Samuel Alito, overturns Roe v. Wade, the 1973 Supreme Court case that guaranteed the constitutionality of abortion in the U.S. Caroline Reilly, Reporting Fellow with Rewire News Group, sits down to talk with us about the recent leaked draft and what this decision means for the future of abortion in America. The leaked draft ultimately upholds Mississippi's 15-week ban at the heart of the Dobbs v. Jackson Women's Health Organization case, overturns Roe v. Wade, and overturns Planned Parenthood vs. Casey, which ruled that patients cannot face “undue burden” when attempting to access an abortion. Technically and currently, abortion is still legal in all 50 states. This draft is not a ruling, but a window into what the Supreme Court is possibly planning to decide regarding the Dobbs v. Jackson Women's Health Organization case. If the Supreme Court indeed rules in line with the leaked draft, it will mean abortion will be illegal in half of the country. 26 states are likely to ban abortion if Roe is overturned. Those states and others will also likely take the opportunity to pass additional legislation that severely restrict or ban abortion care. This will lead to broad swaths of the country where abortion is inaccessible, and smatterings of states where abortion is accessible— leading to overwhelmed reproductive healthcare infrastructure in the states that do offer abortion care. As the U.S. faces these unprecedented attacks, we must remember that abortion is healthcare, abortion is freedom, and abortion is autonomy, and that the majority of Americans support upholding Roe. The fight to ensure access to basic, timely, and critical reproductive healthcare will continue. Serving as a TCFV Public Policy Coordinator and Public Policy Manager respectively, Jen and Mohini have many years of demonstrated experience in the gender-based violence and reproductive justice movements between them. Young people face all the same barriers that adults face in accessing abortion care, but in states like Texas, youth also face a parental consent law. Rosann Mariappuram, Executive Director of Jane's Due Process, sits down to talk with us about this extra barrier to care, and what it looks like after the passage of the six-week abortion ban, SB8. While also having to navigate the labyrinth of general, state-based abortion restrictions (such as mandatory ultrasounds, 24-hour waiting periods, a lack of abortion clinics in the state, and taking time off work and school), those under 18 in Texas must also receive parental or guardian consent when accessing abortion care. For many young people this can be an especially difficult challenge. If consent cannot be obtained, young people must go through a judicial bypass, or speaking with a judge to obtain a court order to receive an abortion. Judicial bypass processes often involve extremely invasive questions meant to gauge young people's “intelligence or emotional stability.” Judges ask questions about the pregnancy, family life, grades, and other personal concerns. Texas's passage of the six-week abortion ban, SB8, has complicated the judicial bypass process. The process, which already required two to three weeks of careful legal counseling, is forcing Jane's Due Process staff to work under a tighter schedule. Still, this legislation has left many teens unattended in their need for abortion care; in fact, during the first month of SB8's passage, abortion care in the state dropped by 50%, and 70-90% for young people. Sex education is not required in the state of Texas, but if sex education is taught, the current curriculum does not necessitate the sharing of information on contraception and abortion, nor does the curriculum require LGBTQ+ inclusivity. Texas also has some of the worst maternal mortality rates in the U.S., especially for Black women. New research has shown that, while Black women make up only 11% of Texas births, they make up 30% of maternal deaths. With no inclusive and supportive sex education and an extremely troubling maternal mortality status, Texas does not prove a hospitable state for exercising one's reproductive health. Abortion is incredibly difficult to access, especially after the passage of the six-week ban. Many patients are being forced to travel outside of the state and spend considerable amounts of money on transportation methods and overnight accommodations, while abortion funds and clinics are continuing to face increasing barriers to providing care, emotional and mental stress, and legal repercussions. Frances “Poppy” Northcutt gained national fame as the first and only woman in NASA's mission control room working on the Apollo Program. Poppy and her team designed the Return-to-Earth trajectory that took the Apollo 8 crew around the Moon and back to Earth. She worked on missions 10-13 and helped retrieve the Apollo 13 astronauts after their mid-flight disaster. After cuts in the space program, Poppy continued her advocacy for women's rights as a felony prosecutor in a domestic violence unit. Now in semi-retirement, Poppy's advocacy is focused on reproductive justice, as the attorney for Jane's Due Process, providing legal services to pregnant teen-age girls. Sam hosts James W. Russell, public policy affiliate scholar at Portland State University, to discuss his recent book The Labor Guide to Retirement Plans: For Union Organizers and Employees, on the importance of fighting for good end-of-life security and how employers and banks have capitalized off of the switch from pensions to 401ks. Russell and Sam begin by working to define and differentiate these two retirement plans, tracing the surge in 401ks back to the 1981 decision from the Reagan Treasury Department to make 401ks a valid substitute for a defined-benefits pension plan, rather than an additional tactic, and exploring why neoliberalism sought the switch, giving flexibility to the employer while shifting all of the risk onto the shoulders of the employee. Next, they dive into the role of labor organizing in the fight for better retirements, exploring instances of solidarity against two-tiered plans for legacy and incoming workers, and how unions can fight against what has arguably been the largest expropriation of workers' income over the last three decades. They return to the topic of neoliberalism, diving into George W. Bush's failed attempts to privatize social security, and the failure of the successful attempts to privatize these institutions in Chile under a Milton-Friedman-Influenced Pinochet regime. They wrap up with the role of conservative think tanks in driving privatization of retirement plans, before looking at what we can do as individuals, and organized groups, in fighting for better and more available pension plans for American workers. Sam and Emma host Elizabeth Samet, professor of English at West Point, to discuss her recent book Looking for the Good War: American Amnesia and the Violent Pursuit of Happiness, on the mythology behind the Americanized narrative of WWII, how it came to prevalence, and the role Tom Brokaw and Stephen Spielberg have to play. Professor Samet walks through the six myths she identifies throughout U.S. history, with the first – that the U.S. could not wait any longer to liberate the world from the growing threat of fascism and tyranny – starting to be manufactured as soon as the U.S. got its foot into the war, as she, Emma, and Sam dive into the isolationist nature of the US in the first few decades of the 20th Century, and the existing documents and pamphlets for soldiers attempting to revise this history to bolster their faith in the effort. Next, they look at the creation of a narrative of complete unity around this war effort in the wake of wars in the second half of the century, like Vietnam, which created division between the public and the military, which, along with a narrative exaggerating the sacrifices on our home front, worked to paint a picture of the Greatest Generation and their war as a collective American effort. They also cover the birth of the narratives of the U.S. as a liberator whose military will be greeted with open arms, which we would see repeated countless more times, most notably in the Iraq war, and the idea that this, like all U.S. wars, had a happy ending. This, at last, brings them to how these narratives were ultimately woven together, to create the final myth, which is that all of these narratives have been accepted and true since the beginning of the war. They explore how the baby boomer generation, through the works of Stephen Ambrose, Tom Brokaw, and Stephen Spielberg, among many others, revised and unified the narrative of their parents' generation to help a country whose confidence has been shaken to regain an earlier luster. They wrap up the interview by looking at the film noir cliché around WWII and its veterans, as well as looking at the current state of public opinion on our veterans, and how it maintains a bit of a contradiction on how we want to think about them. Sam and Emma also discuss the devastation of the tornado in Kentucky, its role as one more “once in a generation event” that's occurred this year, and the hypocrisy of libertarian ideology. And in the Fun Half: Emma and Sam dive into the announcement by the Biden admin that they would resume student debt collection, and the absurdity of a country that attempts to make a profit off of an educated populace, while Chris from Austin calls in to talk health policy, both federal and personal. They also look at Stuart Varney's coverage of the destruction of Seattle by a single city council member – Kshama Sawant – who helped bring about a $15 minimum wage, before moving onto the U.K. Court's decision regarding Julian Assange's extradition to the U.S., and contrast how it has been reported, from Joe Scarborough to Mehdi Hasan, before looking at Crowder capitalizing on the incredible masculinity he perceives emanating from Kyle Rittenhouse, and hearing Dan the Objectivist return to discuss how threats to well being aren't coercion, plus, your calls and IMs! He is former board member, volunteer attorney and current legal director of Jane's Due Process a statewide non-profit that helps young people in Texas navigate parental consent laws and confidentially access abortion and birth control. He is the immediate past president of the board of Every Body Texas the Title X grantee in Texas. He is a member of the Health Law, and Legislative and Campaign Law sections of the state bar. After this episode was recorded, The House of Representatives passed the Women's Health Protection Act (WHPA). WHPA protects the right to access abortion without restrictions and unnecessary bans. If passed, it would block state's mandatory waiting periods, mandatory ultrasounds, biased and false counseling, and two-trip requirements. Dr. Moayedi talks about what it has been like being a provider in Texas since SB8 became law, the tireless work leading up to the enactment of this law, and what comes next. A few weeks ago, a Texas Law went into effect that severely limits a woman's right to abortion and we here at the Sugar Free Podcast could not let such an important moment in the history of women's rights pass without having a REAL discussion about it. The Texas Law, prohibits women from having access to abortion once the unborn child has a detectable fetal heartbeat. This point for most women comes at the sixth week of pregnancy when most women don't even know they're pregnant. This, for most women will amount to either a complete loss of the right to an abortion or the loss of a reasonable amount of time to consider having an abortion. THIS AINT RIGHT AND WE NEED TO TALK ABOUT IT. Having the right to choose what you do with your body and when is one of the most fundamental rights a human can have. The recent passage and reaffirming of very restrictive abortion laws in Texas threatens to all but remove a crucial component of this fundamental right for women – their right to choose whether or not to have an abortion. Syd is going to 'lower the veil' on abortions and make them a real, tangible, thing for those who may not be familiar with the laws surrounding abortion or the story of a woman who has had one. The season finale of BFR includes guest speaker Irma Garcia who is a sex educator based in Texas. Irma is a certified sex educator in Texas and client services manager at Jane's Due Process, where she helps Texas minors exercise their reproductive rights to an abortion. Prior to joining the JDP team, she was a sexual health and abortion counselor at a local Austin clinic, as well as a birth doula. Now as the sexpert on staff and for the community, her focus is to connect the harm of sex-negative anti-abortion rhetoric into a wider sex-positive reproductive justice framework where marginalized people are not shamed and robbed of their autonomy. She believes that when Black, Indigenous, and other people of color experience pleasure on their own terms, it's an act of protest, but most importantly--self-care.
