Michelle explains what's going on with:Non-compete agreementsNon-solicitation agreementsIn Washington stateOn the federal levelExempt versus non-exempt employeesAnd much moreA very timely and fast changing topic relevant to all business owners and buyers.This was recorded prior to July 3, 2024 and on this date, a federal judge in Texas hearing the case against the FTC allowed an injunction for the plaintiffs only and plans to make a full ruling by August 30.   There remains a chance that the judge will rule on August 30 that the FTC overstepped its authority and halt the implementation of the law.  Because we cannot be sure, all companies, other than those participating in the lawsuit, should expect the law to go into effect on September 4 and be prepared to notify employees that their noncompetes are no longer valid.Legal Disclaimer: The contents of this presentation are solely informational and not legal advice. Michelle founded Equinox in 2005 to provide business leaders a more transparent, responsive, and business focused solution for their legal needs. Over the past 17 years, she's morphed the business model to offer a fixed fee General Counsel Services solution giving business leaders the confidence and freedom to include legal in their strategic and tactical planning -- they have a relationship with their lawyer and they know what they are paying, when they'll get a response, and that the solution is right for their business. It's a tough model to manage and she's learned a ton about how to make this work for her clients and for her own business. When Michelle started Equinox in 2005, she had a 1 year old at home and was pregnant with her second child. Michelle's kids have grown up with Equinox a part of their lives -- but also having their mom in their lives! While they've seen her work a lot over the years - and seen the ups and downs of being an entrepreneur and employer, she's always been there for them. Michelle committed early on to picking them up from school, taking them where they needed to go, and participating in what was important to them. These were priorities for Michelle and forced her to make decisions in her business and her life to make these work for her family. Michelle has an undergraduate degree in business from the University of Notre Dame and a JD/MBA from Northwestern University. “I am definitely a creator. I need to create, I need to be inventing things. And if I only have one company, a single company cannot consume the amount of creation that I need in my life. And so for me, having side businesses is a way of protecting my core business from being changed constantly because of my needs as an owner. “And honestly, when, when I'm coaching small business owners in the EO Accelerator program, one of the biggest challenges I see are owners forcing their business to take their total creative output even when that business doesn't need it. What that business really needs is to be stabilized, have a simple product and structure that can grow instead. “Business owners are constantly trying to shove all of themselves into a single entity.
