Ever wondered what happens when your right to resell clashes with someone else's trademark? The secondary market is booming—from luxury perfumes to used hard drives and even virtual farm animals—but these second lives come with surprising legal complications.Secondary markets aren't just about thrift store finds anymore. They're complex ecosystems where intellectual property law determines what you can truly do with the things you've purchased. Through a global tour of fascinating court cases, we unpack the legal principles that govern reselling, refurbishing, and reimagining products across physical and digital realms. In Norway, a phone repair shop learned the hard way that erasing Apple logos from replacement screens doesn't erase their legal obligations. Meanwhile, in India, courts embraced refurbished Seagate hard drives as sustainability wins. The digital world presents even thornier questions—can you resell an e-book like a paperback? (Spoiler: European courts say no.) And what about those $133,000 "MetaBirkin" NFTs that landed an artist in hot water with Hermès?From Brazilian video game importers to Italian pharmaceutical repackagers, we explore how trademark exhaustion works differently across borders. You'll discover why Chanel fights so hard to control where its perfumes are sold, how Zynga protected its virtual cows from unauthorized trading, and what happens when Finnish axes travel from North America to the Czech Republic without permission.Whether you're flipping consoles, fixing phones, or minting NFTs of luxury handbags, understanding these landmark cases could save you from accidental infringement. Secondary markets provide real benefits—reducing waste and extending product lifecycles—but navigating them legally requires knowing when ownership ends and intellectual property begins.Subscribe to Intangiblia for more plain talk about complex IP issues that affect everyday transactions in our increasingly digital marketplace. Your secondhand purchases might come with more legal baggage than you realized!Send us a text

At a special event in Belfast last night, Joe Kennedy III, US Special Envoy to Northern Ireland for Economic Affairs, announced that applications are now open for Connect to Success (C2S) a programme powered and implemented by Ulster University. This initiative aims to empower women entrepreneurs, bolster the regional economy, and advance gender equality in Northern Ireland. C2S sets itself apart from other women's entrepreneurial programmes in Northern Ireland by offering selected WOBs unparalleled access to global corporations and their international networks, a comprehensive team-based mentoring approach, and a targeted focus on women-owned businesses (WOBs) in the scale-up phase. C2S pairs 10-15 WOBS with teams of executives from some of the world's top multinational corporations. These mentoring teams will provide expert guidance to help shape and implement the long-term business and leadership strategies of the participating WOBs. The year-long mentoring program is scheduled to commence in January 2025. C2S's mentoring champions include industry giants such as Aflac, AIG, Coca-Cola, Goldman Sachs, Google, Irish Life Group, Kainos, KPMG, PwC, Seagate, and Stripe, Inc. Additional supporters of the C2S initiative include AwakenAngels, Catalyst, Cliste Hospitality, Endeavor Ireland, Northern Ireland Chamber of Commerce, Ormeau Labs, and Ulster Bank. Joe Kennedy III, US Special Envoy to Northern Ireland for Economic Affairs, said: "Empowering women in business isn't just a local effort; it's a global game-changer. Whether it's in Belfast or in Boston, we need more women-led enterprises and more female investors. By championing women entrepreneurs, Connect To Success, Ulster University, and their partner companies are igniting economic growth, driving social progress, and paving the way for a more inclusive and prosperous Northern Ireland." Kim Sawyer, Executive Director of Connect to Success, said: "This initiative goes beyond business growth; it's about empowering women, fostering cross-community collaboration, and breaking down barriers that have traditionally limited women's access to capital, markets, and networking. By connecting women entrepreneurs with mentors from some of the world's most successful companies, we aim to equip them with the skills, connections, and confidence needed to elevate their businesses and pay forward the opportunities they've received. "Moreover, the program offers C2S mentors from global corporations a unique perspective on the entrepreneurial mindset of SMEs, enriching their understanding of agility, innovation, and risk-taking. This experience not only sharpens their leadership abilities but also sparks creative thinking and opens doors to new partnerships and ventures." Ulster University Vice Chancellor Professor Paul Bartholomew added: "Connect to Success will play a key role in supporting innovation and entrepreneurship, in a specific area critical to both economic growth and gender equality - supporting female entrepreneurs and women-owned businesses. At Ulster University, we are active and vocal champions of the development of female entrepreneurship and are deeply committed to helping women build and scale successful businesses. In partnership with Connect to Success, we can create a future where women-owned businesses are at the forefront of innovation, corporate success and regional economic prosperity. Highly rewarding and life changing experience New to Northern Ireland, C2SNI follows C2SPortugal, which supported over 1,100 women-owned businesses via 128 corporate mentoring teams from leading global companies, with mentoring from companies including L'Oréal, McDonalds, Microsoft and Nestlé. Ana Margarida Matos, Corporate Mentee, C2S Portugal, said: "For any woman who owns a business, Connect to Success combines the best of both worlds: flexibility and opportunity to run my own business with the resources and community usually found in large companies. Today, the hard disk drive industry and its big three companies - Seagate, Western Digital and Toshiba - are in decline. The Solid State Drive or SSD is on the rise. SSDs are faster, more reliable, and consume less power. Something that began 30 years ago with replacing audio tapes in telephone answering machines - remember those? - has grown to power a $60 billion market per the IEEE. HDD unit volume sales will never be as they were before. Consumers no longer buy HDDs for their iPods, laptops or even desktops. Sad. But the HDD's march towards oblivion has been arrested by a new market: Growing demand from enterprise companies storing data for "nearline" storage. Nearline, referring to data that the customer needs accessible but not so frequently nor immediately. This market is real. Companies in all sorts of fields are producing data at a far faster rate than they can afford to store it.

Whatever the cause, criminal sanctions enforcement will be an interesting area in 2024. The DOJ's planned aggressive push against companies and individuals for sanctions violations is about to be unleashed. There is no question that DOJ's enforcement initiative is coming—it is just a question of when.We have already seen several examples of what aggressive sanctions enforcement will look like -- as the new "FCPA," we can expect several standard elements:Large Penalties -- multi hundreds of millions, even reaching billions in more egregious cases.Reward for Voluntary DisclosuresCriminal Indictments, Deferred or Non-Prosecution AgreementsIndependent Compliance MonitorsParallel Regulatory Resolutions with OFAC, BIS, and or DDTCEnhanced Compliance Remediation RequirementsIndividual Criminal EnforcementIn this episode, Michael Volkov reviews the soon-to-arrive sanctions enforcement regime, and steps companies should take to protect against enforcement actions. Hear him discuss:The Department of Justice (DOJ) is signaling a shift towards aggressive corporate sanctions and export control enforcement, particularly focusing on national security issues like sanctions and export controls. Recent cases, such as the British-American Tobacco and SAP cases, serve as examples of how the DOJ's sanctions-focused enforcement strategy is likely to unfold, including potential penalties and consequences that companies may face.Companies are facing risks from various sources in the realm of sanctions and export control enforcement, including regulatory referrals from agencies like OFAC, BIS, and DDTC, as well as international intelligence relationships and whistleblowers.Seagate's blatant violation of Huawei export controls could be a significant indicator of the DOJ's enforcement initiative in the sanctions arena. This case demonstrates the potential consequences of willful violations and the importance of compliance with export control regulations.Common deficiencies in sanctions compliance programs, including corporate boards' lack of understanding, failure to address third-party risks, inadequate supply chain audits, weak internal controls, and insufficient training, highlight areas where companies need to improve to ensure compliance with sanctions regulations.ResourcesMichael Volkov on LinkedIn | TwitterThe Volkov Law Group

I am a survivor of PizzaGate. I was born 9-12-74. I met my real dad, Philip Baglio when I was 18. He informed me that the Sicilian side of my family had mafia connections. My grandparents on my mother's side of the family raised me. My grandfather was SC1 US Navy, WWII, on a mind sweeper ship. My grandfather was an unknowing and unwilling candidate in the Navy's human experimentation projects. The Projects that I am specifically exposing are the ones where Adolf Hitler was creating Supermen, the Ultimate War Fighting Weapon. There was gene splicing used in my creation. I was nicknamed, “Death” over the man who created me, The Angel of Death from WWII, Josef Mengele. He locked me and the other kids in cages, used trauma and torture based mind controlled techniques, surgically enhanced us, and electrocuted us to fracture our minds in efforts to train us for all sorts of missions. Some of us children were used for military reasons, or sent into Hollywood, music industry, medical industry, politics and journalism, etc, etc.All my life from birth until December 2011, I recall being trafficked and tracked by the military and government, as well as, serving as a Soldier on Black Operations.I woke up December 2014 to the fact that I was used as a Super Soldier, and have a Calling upon my life from YHWH. The most favorite part of my life is discussing how YHWH called me out of the darkness and got me free from the cages. When Max Spiers was assassinated July 2016, I felt urgency in my soul that I needed to come forward to the public. Since August 2016 I whistle blow about Child Trafficking, Satanic Ritual Abuse, Deep Underground Military Bases and what really happens in them. In this episode of Tech Talks Daily, I'm joined by Hugo Bergmann from Seagate, a global leader in data storage solutions, to tackle a significant problem facing today's businesses: the rising and often unsustainable costs of data storage. According to recent statistics, more than half of British businesses' IT leaders are grappling with the spiraling costs of data storage, which are becoming untenable. With some companies spending as much as £231k per year, many businesses are compelled to delete data that could potentially unlock revenue-generating innovation, a decision they can ill-afford in a world where data is king. What's worse, over half of IT leaders believe their senior leadership remains oblivious to the magnitude of the problem. During our discussion, Hugo and I delve into this pressing issue, exploring how the current global economic crisis has exacerbated the need to curb data costs without losing the valuable insights that data offers. We shed light on the necessity of better data management and discuss innovative strategies such as storage-as-a-service models, that can help predict costs more accurately. Hugo also highlights Seagate's commitment to fostering a circular economy in the data storage industry. We discuss the importance of refurbishing and reusing storage devices, thereby extending their lifespan, and the steps the data storage industry can take toward creating a sustainable data sphere. Whether you're an IT leader battling ballooning data storage costs or a tech enthusiast interested in the future of data management, this episode is a treasure trove of insights. Tune in as we navigate the challenges and possibilities in the realm of data storage with Hugo Bergmann.
