Odds & Ends Again is a resale storefront that helps seniors downsize and sell items they no longer need. The owner, Brett Foss says he didn't realize the zoning rules for his store would be different than other retail spaces.Arden Hills mayor David Grant told the Minnesota Star Tribune the city had given Foss all the information he needed about city zoning rules. Joining me for a wider conversation about city zoning and the impact it has on communities is Evan Roberts. He's an assistant professor with the University of Minnesota and is leading a project called the Minnesota Zoning Atlas.

“Homeownership is the American Dream.” This saying is so ingrained in our zeitgeist that most Americans don't even pause to question it. However, according to the Black Knights Home Price Index, the average US home price increased nearly 80% from April 2015 to April 2023. Census data reveals that the median household income only increased by 4% during this period. Homeownership has thus become increasingly out of reach, especially for young professionals. So, how did the American Dream become an American nightmare?In his brand new book, “Stuck: How the Privileged in the Propertied Broke the Engine of American Opportunity,” The Atlantic's Deputy Editor Yoni Appelbaum offers a contrarian view, arguing that the crisis in American homeownership isn't actually about cost—it's about mobility. There are many places in America where housing remains affordable and even dirt cheap. The problem is that those affordable options are in less desirable locations, with fewer opportunities for high-quality jobs, education, and health care. We'll take a look. And, the Evangelical Council for Financial Accountability announces a new leadership standard. But first, Adam Greenway is suing the Southern Baptist seminary he once led. Lawyers for Adam Greenway, who resigned as president of Southwestern Baptist Theological Seminary in September 2022, alleged in a complaint filed Wednesday (March 20) that the school and the chair of its trustee board defamed Greenway, violated the terms of a non-disparagement agreement and made him “unemployable.” Greenway's attorney had previously sent the school a demand letter for $5 million to settle the dispute. Profits are interests in land that allow the holder to extract resources from the property, such as minerals or timber. Covenants and Servitudes Covenants and servitudes are restrictions on the use of land that are created by agreement between landowners. Covenants are typically imposed by developers or homeowners' associations to maintain the uniformity and aesthetic appeal of a community. Servitudes are similar to easements, but they are created to benefit a specific piece of land rather than a person or entity. Zoning Laws and Regulations Zoning laws and regulations are enacted by local governments to control the use of land within their jurisdictions. These regulations typically divide a community into different zones, each with its own set of permitted uses. Zoning laws are designed to promote public health, safety, and welfare by ensuring that development is compatible with the surrounding area. Understanding Real Covenants and Equitable Servitudes. Real covenants and equitable servitudes are legal mechanisms that shape the use of land and create enforceable obligations for property owners. Real Covenants. A real covenant is a contractual agreement between property owners that imposes certain obligations or restrictions related to land use. These covenants are typically found in deeds or other written agreements. Enforceability. For a real covenant to be enforceable, it must meet certain criteria, including a writing requirement, intent to bind successors, and touch and concern the land. Courts carefully examine these elements to determine the covenant's validity. Equitable Servitudes. Equitable servitudes are similar to real covenants but are based on principles of fairness and equity. These servitudes arise when a property owner, through a written agreement or a pattern of conduct, creates an obligation that runs with the land. Enforcement. Equitable servitudes are enforced in equity, meaning that a court can issue an injunction to prevent a violation of the servitude. This legal mechanism allows for the protection of property interests and the preservation of neighborhood aesthetics. Case Study: The Miller Subdivision. In the Miller Subdivision case, homeowners in a residential subdivision had a real covenant prohibiting the construction of fences over a certain height. One homeowner, Mr. Thompson, erected a fence exceeding the agreed-upon limit. The court, in its decision, analyzed the enforceability of the real covenant and the impact on property values and neighborhood aesthetics. Land Use Planning and Zoning Laws. Real covenants and equitable servitudes intersect with land use planning and zoning laws. Durham, North Carolina, is experiencing a hot debate over changing its zoning code. The proposed “Simplifying Codes for Affordable Development” (or SCAD) presents tactical adjustments that focus on loosening the current rules so local people can make small-scale changes to their neighborhood. The changes would eliminate parking mandates, legalize smaller homes on smaller lots, and permit mixed-use development.
