In June 2022, Westminster member Melynda Dovel Wilcox wrote a report on behalf of our Therefore Project, chronicling Westminster’s history relative to race, which has since been turned into this book. Dr. Cliff Johnson grew up in Columbus, Georgia, steeped in the racism of the Jim Crow era. But as a young pastor of a new Presbyterian church just outside the nation's capital, he felt called by his faith in the 1950s and 1960s to overcome the legacy of his upbringing. He embarked on a personal journey toward greater racial understanding, and through his deeply personal and honest sermons, invited his congregation to join him. One member of Cliff's congregation, Connie Ring, would play a key role in fighting back against Virginia's "Massive Resistance" to the Supreme Court's landmark 1954 decision declaring that separate was inherently unequal. Together, Cliff and Connie showed that it was not only possible for individuals to acknowledge and conquer their own prejudices, but also imperative for achieving a society in which everyone has equal standing. Over 100,000 new COVID cases have been recorded in Israel for their 7-day rolling average, setting set a new world record high, where over 90% of the adult population has received 2 vaccine doses, 80% have received 3 doses, and over 500,000 Israelis have received 4 doses—which the government is now pushing for all adults. Duane Lake spent six years locked up in a jail cell in Clarksdale for a triple murder he didn't commit. “I lost it all — my family, my marriage, my job, my career,” said the 35-year-old welder. “Now I'm working, trying to get everything back. I've got to take it one day at a time.” He spent many of those days in the “dead zone” — what defense lawyers are calling the time behind bars without legal representation. He was arrested in 2015, but he wasn't indicted until two years later. Then he spent another four years in jail while awaiting trial. But he had no lawyer to fight for his release, so he wound up filing his own motions for a speedy trial. He never heard anything back. A court-appointed lawyer represented him at a hearing after his arrest. Another court-appointed lawyer represented him at a hearing after his indictment. In November — more than six years after he was jailed — a jury acquitted him of capital murder. Thousands of Mississippians are locked up in jails awaiting trial because they can't afford a lawyer. Cliff Johnson, director of the Roderick and Solange MacArthur Justice Center at the University of Mississippi School of Law, said about 85% of those charged with crimes in the state can't afford private lawyers and must rely on public defenders. The problem? “Many of those same poor people who can't make bail are forced to rely on a public defender system that appoints them a lawyer at the outset of their case who handles only preliminary matters and then disappears,” Johnson said. “No other lawyer is appointed until after an indictment is obtained by the district attorney, and in Mississippi that can takes months or even years because we don't have a time limit on how long a person can be jailed prior to action by a grand jury.” He referred to that lengthy stretch without representation as “the dead zone.” “It is a failure of Mississippi's criminal legal system that has devastating consequences for poor defendants,” Johnson said. Mississippi is one of five states with no statewide public defender system. Instead, the burden for legal representation falls on local governments, many of which struggle to fund such representation. Johnson said he's amazed “how cavalier some Mississippians are when it comes to allowing the government to take people's liberty. They say they don't trust the government, but they sure seem happy to let the government rob other folks of their freedom.” Because Lake's case appeared to have been weak, he said, if a public defender had been appointed and worked early on the matter, perhaps prosecutors would have considered a request to dismiss the charge. “The law and our criminal rules say that there is a presumption of release prior to trial and that requiring payment for one's freedom should be the exception rather than the rule,” he said. “But Mississippi judges demand that people pay for their liberty in 99 percent of felony cases, presumption of innocence be damned.”  Th​e problem ​caused by the combination of Mississippi's bail practices and spotty public defender system is growing because the jail population continues to grow, he said. The number of Mississippians incarcerated in county jails across the state have increased by more than 500 since the pandemic began, a report by his office shows. Of the more than 5,700 jailed, 2,700 have been there longer than 90 days. More than 1,000 have been incarcerated at least nine months, and 740 have been stuck in county jails over a year. An MCIR analysis of the database shows that 1 out of every 17 people in a Mississippi jail hasn't been indicted. Most have been jailed for more than two months — enough time for people to lose jobs and fall behind on financial commitments while they wait for legal help. Of those, 89 have been jailed more than six months, and 29 have gone more than a year. One man arrested for murder in Lauderdale County has been jailed for nearly four years. He still hasn't been indicted. That extra time behind bars costs Mississippi counties, which spend at least $90 million a year for pretrial incarceration alone. This is just your friendly reminder that prisons are wicked, unbiblical, and unjust. Christians must be at the forefront of demanding the dismantling of the prison system. And Christians of all people should know why. Because they get used to abuse the innocent, you know, like Christians, like Christians in China, like Christians in Canada. Sure, very short jail time for violent criminal awaiting their trial and punishment. But mass incarceration is heinous sin against God. It treats human being bad in His image as animals. It prevents true restorative justice from being carried out where restitution is possible, and it prevents the justice of the death penalty from taking away the blood guilt from the land.  Boston patient removed from heart transplant list for being unvaccinated A 31-year-old father has been removed from the heart transplant list at a Boston hospital because he is refusing to get the COVID-19 vaccine, his family said. DJ Ferguson's family say he was first on the list to receive the transplant at Brigham and Women's Hospital — but he is no longer eligible because of his vaccination status, CBS Boston reported. His father, David Ferguson, said his son — who is fighting for his life in the hospital and is in desperate need of the transplant — doesn't believe in the COVID-19 vaccine. It's a policy they are enforcing and so because he won't get the shot, they took him off the list of a heart transplant,” David told the outlet. Oh nevermind…  It's time for Christians to step up their game in the medical industries. Start your own practices, your own surgery centers, you own pharmacies, and hospitals. Because He is Lord of the family and the state, and He gives them their respective authorities, and they cannot go beyond what He has given them or abdicate the duties He has given. The problem? “Many of those same poor people who can't make bail are forced to rely on a public defender system that appoints them a lawyer at the outset of their case who handles only preliminary matters and then disappears,” Johnson said. “No other lawyer is appointed until after an indictment is obtained by the district attorney, and in Mississippi that can takes months or even years because we don't have a time limit on how long a person can be jailed prior to action by a grand jury.” He referred to that lengthy stretch without representation as “the dead zone.” “It is a failure of Mississippi's criminal legal system that has devastating consequences for poor defendants,” Johnson said. Mississippi is one of five states with no statewide public defender system. Instead, the burden for legal representation falls on local governments, many of which struggle to fund such representation. Johnson said he's amazed “how cavalier some Mississippians are when it comes to allowing the government to take people's liberty. They say they don't trust the government, but they sure seem happy to let the government rob other folks of their freedom.” Because Lake's case appeared to have been weak, he said, if a public defender had been appointed and worked early on the matter, perhaps prosecutors would have considered a request to dismiss the charge. “The law and our criminal rules say that there is a presumption of release prior to trial and that requiring payment for one's freedom should be the exception rather than the rule,” he said. “But Mississippi judges demand that people pay for their liberty in 99 percent of felony cases, presumption of innocence be damned.” Th​e problem ​caused by the combination of Mississippi's bail practices and spotty public defender system is growing because the jail population continues to grow, he said. The number of Mississippians incarcerated in county jails across the state have increased by more than 500 since the pandemic began, a report by his office shows. Of the more than 5,700 jailed, 2,700 have been there longer than 90 days. More than 1,000 have been incarcerated at least nine months, and 740 have been stuck in county jails over a year. An MCIR analysis of the database shows that 1 out of every 17 people in a Mississippi jail hasn't been indicted. Most have been jailed for more than two months — enough time for people to lose jobs and fall behind on financial commitments while they wait for legal help. Of those, 89 have been jailed more than six months, and 29 have gone more than a year. One man arrested for murder in Lauderdale County has been jailed for nearly four years. He still hasn't been indicted. That extra time behind bars costs Mississippi counties, which spend at least $90 million a year for pretrial incarceration alone. This is just your friendly reminder that prisons are wicked, unbiblical, and unjust. Christians must be at the forefront of demanding the dismantling of the prison system. And Christians of all people should know why. Because they get used to abuse the innocent, you know, like Christians, like Christians in China, like Christians in Canada. Sure, very short jail time for violent criminal awaiting their trial and punishment. But mass incarceration is heinous sin against God. It treats human being bad in His image as animals. It prevents true restorative justice from being carried out where restitution is possible, and it prevents the justice of the death penalty from taking away the blood guilt from the land. Boston patient removed from heart transplant list for being unvaccinated A 31-year-old father has been removed from the heart transplant list at a Boston hospital because he is refusing to get the COVID-19 vaccine, his family said. DJ Ferguson's family say he was first on the list to receive the transplant at Brigham and Women's Hospital — but he is no longer eligible because of his vaccination status, CBS Boston reported. His father, David Ferguson, said his son — who is fighting for his life in the hospital and is in desperate need of the transplant — doesn't believe in the COVID-19 vaccine. It's a policy they are enforcing and so because he won't get the shot, they took him off the list of a heart transplant,” David told the outlet. Now our biggest service moment of the day might be letting our spouse decide which TV show we'll be watching together. But thankfully because of technology, we can find lots of service opportunities online that we can do from the comfort of our own homes. One such opportunity comes through Zooniverse, an online science platform that conducts research on interesting scientific topics, all led by volunteer researchers. Joining us today is astronomer and science lead Cliff Johnson, here to talk with us about the mission of Zooniverse and how anyone can get involved in real scientific research.  The Need for Cuddlers (0:15:07)Lately, I've really been missing getting hugs from people! I didn't really consider myself to be a touchy person until we were advised not to touch anyone... and I miss it! Who knew how important physical contact is? We recently found out about is a position called a “cuddler;” a volunteer whose entire job is to provide this important physical contact for newborn babies in the hospital by holding and snuggling them! This seemed too good to be true, we so we invited Dr. James Kirk Bass , a neonatologist and pediatrician at the University of Tennessee Medical Center, to tell us more!  Self-Compassion (0:33:43)As parents, we want to be caring and loving to our kids. I don't think any of us want to be that parent that only cares about themselves... like Cinderella's stepmother or Luke Skywalker's evil father Darth Vader, just caring about our own vanity or ruling our own galaxy while our kids feel forgotten. The Governor moves inmates out of Parchman Unit 29.Then, in today's Book Club, the unsolved murder of a young girl in McComb 50 years ago.Plus, we talk to the filmmakers behind MPB's newest documentary, Meet Carl Jackson.Segment 1:Inmates located at Mississippi's Parchman prison are being moved to a nearby private facility. The prison has been rocked by recent violence, and is under federal investigation. Inmates of the infamous Unit 29 at are moving five miles away to Tallahatchie County Correctional Facility. 50 inmates have already been moved, and they began moving 500 more inmates Wednesday morning. Cliff Johnson is the Director of the MacArthur Justice Center at the University of Mississippi. He commends the Governor's quick action and tells MPB's Kobee Vance he believes this is a temporary solution while more permanent plans are negotiatedDemocrat Carl Mickens is Vice Chair of the House Corrections Committee. He acknowledges the transfer of inmates from the ill-equipped Unit 29 addresses the immediate concerns within the department of corrections. But, as he tells our Kobee Vance, the legislature must also look at the bigger picture. Segment 2:Fifty years ago, the body of a 12 year-old girl was found in an oil field outside of McComb, Mississippi. She had been shot in the head. The suspects were two police officers. Despite two trials one suspect was acquitted. The other had charges against him dropped. Today, the murder of Tina Andrews remains unsolved. Trent A. The State Auditor's office uncovers an embezzlement scheme.Then, the U.S. Department of Justice Civil Rights Division announces an investigation of the Department of Corrections.And, the Fifth Circuit Court hears the appeal in Mississippi's six-week abortion ban.Segment 1:The State Auditor's Office in cooperation with the Hinds County District Attorney's office is uncovering what Auditor Shad White calls the largest case on record. Arrests were made on Wednesday of former Department of Human Services Director John Davis and Dr. Nancy New, owner and Director of the Mississippi Community Education Center (MCEC) and New Learning, Inc, along with four other alleged co-conspirators. Auditor White addressed the indictments at the Hinds County Courthouse Thursday. We also received comment from the U.S. Attorney's office.Segment 2:The U.S. Department of Justice announced its investigating four Mississippi prisons. The Civil Rights Division will examine conditions at Parchman Penitentiary, Southern Mississippi Correctional Institute, the Central Mississippi and Wilkinson County Correctional Facilities. Mississippi 2nd District Congressman Bennie Thompson requested the investigation after recent violence and the deaths of at least 15 inmates most of them at Parchman. He tells MPB's Michael Guidry Mississippi has a problem and he hopes the DOJ's involvement will bring some solutions. Less than a month into the 2020 legislative session, there is unrest in the State house between the Speaker and a group of retired lawmakers.Then, the Mississippi Supreme Court upholds a 12 year sentence for contraband cell phone. Plus, the William Winter Institute's Day of Racial Healing.Segment 1:Four freshmen members of the Mississippi House might have to give up their legislative seats if they continue to serve and receive state retirement. A new regulation adopted by PERS--the Public Employees Retirement System allows retirees to collect their pensions while serving in the legislature. The regulation changed is based on an opinion written by then-Attorney General Jim Hood. But, House Speaker Phillip Gunn has advised the House Management Committee to disregard the new PERS regulation over questions of statute.Representative Billy Andrews of Lamar County is one of the four freshmen lawmakers. He tells MPB's Michael Guidry the AG opinion influenced his decision to run for office.Representative Jason White of Holmes County is the Speaker Pro Tempore. He tells MPB's Desare Frazier he believes the law is clear-- that elected officials can not serve in the legislature and draw state retirement.Segment 2:The Mississippi Supreme Court's confirmation of a 12-year prison sentence for an African American man who carried his mobile phone into a county jail cell is shining further light on the need for sentencing reform. Willie Nash was given the twelve year sentence by a trial judge in August of 2018. A 2012 Mississippi law sets a sentencing range of three to 15 years for inmates found with deadly weapons, cellphones or components of cellphones in state jails and prisons. Cliff Johnson, Director of the MacArthur Justice Center at the University of Mississippi tells our Michael Guidry the court's decision highlights the need to look at the prison crisis holistically.Segment 3:Today marks the fourth annual National Day of Racial Healing; a day to address the historic and contemporary effects of racism. In the 1970's the Cleveland Indians failed in their annual quest to reach the postseason, the ALCS and World Series. However, they played their hearts out and Cleveland Municipal Stadium was the place to be to enjoy the Tribe in person. The team made history in 1975 by hiring the first African American manager, Frank Robinson. At various times the Tribe contended and the fans dreamed of October baseball. Today we are covering August 19 – 25, we are going to be talking about – Jimmie Foxx pitching career, Gooden early excellence, Bill Veek grand stand moment, Yogi Berra and the harmonica, Juan Marichal and John Roseboro fight and the professional pinch hitter Matt Stairs.   If you love the history of the game, and relate all your stories in life to baseball, and you tend to get goose bumps, grim and even water your eyes a bit when Ray Kinsela asks his Dad to play catch. You are truly at the right place. This podcast is part of thisdayinbaseball.com, if you love baseball history, no matter who you search for you are going to find great nuggets of information.   TRIVIA: What owner once bought a jackass as a team mascot and named it after himself? He also had a nickname :The Wizard of ODD. On August 19, 1945 – In game two of a doubleheader against the Cincinnati Reds, 37-year-old slugger Jimmie Foxx makes his first major league start, pitching the first seven innings for the Philadelphia Phillies at Shide Park. He leaves with a 4 – 1 lead, and Andy Karl saves Foxx’s only decision, a 6 – 2 final.  Here is his stat line his ERA in 10 appearances is 1.52, ERA+ was 243, batters only hit .171 with a .479 OPS and of the 76 batters that faced Foxx not one of them was able to get an extra base hit. The only black mark was 14 Base on Balls vs 10 K’s. Foxx also known as “The Beast” had always wanted to pitch, he was a star hurler in High School. However it was the WAR and the end of his career that really gave him a chance. After the 1944 seasons he appeared in only 15 games, but the War gave him another chance as he signed with the Phillies for a final go round. The 3 Time MVP was not fairing any better so they last place Phillies gave him a shot on the mound, and Foxx the future Hall of Famer. Foxx made the most of it to finish his spectacular career.      On August 20, 1964 — During a bus ride after a Chicago White Sox sweep the Yankee’s 4 straight, Mickey Mantle misinformed his teammate Phil Linz who had been playing Mary Had a Little Lamb on his harmonica that their manager Yogi Berra had asked for the harmonica to be played louder, when in fact he asked him to stop, a confrontation occurs on the back of the team bus between the skipper, and the utility player. As told Mel Stottlemyre a rookie at the time - “Yogi told Phil he was going to shove the harmonica up his ass if he kept playing — plus a few other things. I don't know if it scared Phil but he tossed the harmonica toward Yogi, who slapped it out of the air and whacked it off Joe Pepitone's knee. Linz apologized the next day and he was fined $200, With a bus full of reports the event was well well-publicized Linz apologized the next day and he was fined $200. Some say that seeing that side of Berra fired up the third-place team, , to a successful pennant run, but may have reinforced the perception Berra had lost control of the team with so much dissension on the club, leading to his dismissal after Game 7 of the World Series. Yogi had many Yogisms, here is one I will think about allot, “If you don’t know where you’re going, you’ll wind up somewhere else”   On August 21, 2010 — Matt Stairs sets the career record for pinch-hit home runs when he goes deep off Ernesto Frieri in the eighth inning of a 6-5 loss in Milwaukee. The two-run shot over the Miller Park right field fence, his twenty-first round-tripper coming off the bench, moves the premier pinch-hitter ahead of Cliff Johnson.   Matt stairs is 1 of only 5 Canadian born players to hit 200 homeruns, and he has the record for a position player playing for 12 different teams and 13 franchises. He played for the Expos and Nationals. His pinch-hit home run in the eighth inning of Game 4 in the 2008 National League Championship Series off the Los Angeles Dodgers reliever Jonathan Broxton was called "one of the most memorable home runs in Phillies history" On April 12, 2009, Stairs' game-winning home run against the Colorado Rockies was the last home run called by legendary broadcaster Harry Kalas, who died unexpectedly less than 24 hours later. Matt Stairs is a great what if – he didn’t get regular at bats until age 29, if he had been in the right situation at age 22-23 both  Bill James and Joe Posnanski feel he could have been Hall of Fame material.   On August 22, 1965, After Juan Marichal had knocked down Maury Wills and Ron Fairly in the top of the third, John Roseboro signaled for Sandy Koufax to retaliate in the bottom of the inning. It didn’t work. “Koufax was constitutionally incapable of throwing at anyone’s head,” Roseboro wrote in his 1978 autobiography, “so I decided to take matters into my own hands.” Roseboro was throwing the ball too close to his head while returning throws to Koufax. Marichal complains to the umpire about the throws and then the two square off, that is when MArichal hits Roseboro over the head with a bat. Marichal was suspended for eight games and fined $1,750. Roseboro filed a lawsuit, asking for $110,000 in damages, but settled for about $7,000. He reportedly needed 14 stitches to close the wound on his head. It truly was one of the ugliest events in baseball history. For many the story ends there – In a SF Chronicle article Barbra Roseboro his widow said, In restaurants, over the phone with clients, at the hospital where he lay dying, John Roseboro couldn’t escape the questions. “People would come up to us at dinner and say, ‘Please tell us about the fight with Marichal,’” the catcher’s widow said recently from her office in Beverly Hills. “He would always accept his responsibility for that incident. He’d say: ‘I provoked it. I threw that ball too close to Juan’s ear.’” It was however Roseboro who helped Marichal transition into Dodger blue in 1975, they made peace at an old timers game in the 1970’s and Roseboro wife’s PR firm helped Marichal cross the line to get into Cooperstown when they felt the legacy of the fight was hurting him after missing for a second time. Roseboro’s widow speaks almost as fondly of Marichal. “After my husband passed away, Juan would call to check up on me and my daughter every six months or so,” she said. It is a great story how two people with differences and an ugly incident can come together to make peace.   On August 23, 1982, Gaylord Perry of the Seattle Mariners is caught putting a foreign substance on the ball. Long suspected of throwing a “spitball,” Perry is ejected from a game for the first and only time in his career. From Peter Gammons: Against the Red Sox. In the seventh inning, down 1-0 with the bases loaded and two out and facing Rick Miller, who was his nemesis, he threw a pitch that dropped measurably. Umpire Dave Phillips, one of the most respected umpires of the era, jumped out from behind home plate and ejected Gaylord. There was some argument from Perry and M’s manager Rene Lachemann, but it sure seemed obvious to all of us in the building that there was a very mysterious flight pattern to the pitch. But the reason Perry was ejected was a warning he got in the top of the fourth inning. And that was, well, divine intervention. Red Sox outfielder Reid Nichols asked Phillips to check the ball. Phillips did, found some substance, and issued the warning. Nichols said, “in the bottom of the third inning I was standing at my position in left field and a voice came to me reminding of the scripture that ‘no weapon formed against thee shall prosper.’ So when I got up to the plate in the next inning, I asked the umpire to check the ball.”   On August 24, 1951 — In another of Bill Veeck’s legendary public relations stunts, “Fans Managers’ Night,” the Browns defeat the Athletics, 5 – 3. The Browns’ coaches hold up placards for 1115 fans, who vote “yes” or “no” on the options given them. Manager Zack Taylor sits in a box behind the dugout with two fans who monitor the voting. Adding to the festivities is Max Patkin, the clown prince of baseball, who coaches at first base for several innings. Sherm Lollar voted in to start behind the plate instead of Matt Batts, has three hits including a homer, and Hank Arft, also voted in, knocks home two. Gus Zernial’s 28th home run accounts for all the A’s runs. When the stunt was announced on August 15, A’s GM Art Ehlers bitterly denounced it as “farcical.”   So, just how did the managers do? In his autobiography, Veeck -- As in Wreck, the Browns owner wrote of the Grandstand Managers' performance, "Never has a game been called better." And, though Veeck was certainly prone to hyperbole, he had a point: The managers correctly decided to leave Garver in the game, and they even voted to play back for a double play with runners on first and third with one out in the first inning -- while Athletics second baseman Pete Suter obliged by grounding into a double play. The Grandstand Managers only made one glaring mistake in the game. After tying the game with a single in the first inning, the group instructed Arft to steal second base with two outs. Unfortunately, the Athletics apparently saw the move coming, and Arft was thrown out easily to end the inning.   How many fans wish they had Veeck as the owner? In 2003 during the playoff game when the A’s were playing the Red Sox, I sat in front of a guy who yelled for Grady Little to put in Trot Nixon for 6 innings. When he finally did, Nixon hit a game winning 2 run homerun in the 11th.     My Dad used to say the sadest words ever spoken are oh what could have been stories - On August 25, 1985 — At the age of 20 years, 9 months, 9 days, Dwight Gooden becomes the youngest 20-game winner ever when the Mets beat San Diego at Shea Stadium, 9-3. Doc is 27 days younger than former Indian hurler Bob Feller, who accomplished the feat with Cleveland in 1939. He will win the NL Cy Young Award and the pitching Triple Crown, compiling a 24–4 record and a league-leading 1.53 ERA, 268 strikeouts, and 16 complete games in 1985. In 86 he will the Mets win the 1986 World Series. Sadly, Gooden remained an effective pitcher in subsequent years, but he will only once have an era under 3, and never win more than 13 games in a season after age 26. His career was ultimately derailed by cocaine and alcohol addiction. John Pazdan was a founding member of two of the greatest power pop bands of the 70s. He formed Pezband, but left before their first album came out (he would rejoin in the 80s). He and singer Cliff Johnson left to form Off Broadway, but he only stuck around for that band's debut album, which spawned the #51 US single "Stay in Time" in 1979. In the 90s he was a member of the cowpunk band Big Guitars From Memphis, who were relatively successful at the time, but has mostly been lost to history.  Since then John has made a living as a gun for hire and has composed and arranged loads of tunes for various multi-media projects, and still plays around the Chicago area when he's asked, including gigs playing for President Obama. He is a wonderfully outspoken and opinionated artist and we discuss his views on the treatment of musicians, how they're paid, and the state of the business today.
