Bad Men Must Serve the Time for Crimes from Insurance Fraud to Murder After a multiple-count indictment against dozens of members of the Gangster Disciples five of them, Alonzo Walton, Kevin Clayton, Donald Glass, Antarious Caldwell, and Vancito Gumbs, appealed their convictions and sentences following a joint trial. Each raised several grounds for reversal contending they were overcharged and over-sentenced. Some argued that the Racketeer Influenced and Corrupt Organizations Act violated the Sixth Amendment because the jury failed to find that the conspiracy involved murder. In United States Of America v. Antarious Caldwell, a.k.a. Fat, a.k.a. Phat, Kevin Clayton, Alonzo Walton, a.k.a. Spike, Vancito Gumbs, Donald Glass, a.k.a. Smurf, a.k.a. Dred, No. 19-15024, United States Court of Appeals, Eleventh Circuit (August 16, 2023) the Eleventh Circuit Affirmed all but one sentence and all convictions. BACKGROUND The Gangster Disciples began as a loosely affiliated network of street gangs in Chicago but later became a hierarchical national criminal organization. Its hierarchy consisted of a "Chairman" and "national board" for the country. The "Chief Enforcer" managed a team of "Enforcers" who exacted punishments for violations of the gang's rules, such as the prohibition against cooperating with the police. Relevant Crimes The indictment charged an array of criminal activities including carjacking and insurance fraud, attempted robbery of Eric Wilder, murder Pretrial and Trial Proceedings The principal charge against all the defendants was count one, which charged that the defendants conspired to conduct and participate directly and indirectly in the conduct of the Gangster Disciples through a pattern of racketeering activity in violation of the Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. § 1962(c). DISCUSSION The Eleventh Circuit concluded that the district court did not abuse its discretion in its pretrial and trial procedural decisions and that the district court also did not abuse its discretion when it declined to ask questions during voir dire about unconscious bias. The District Court Did Not Impermissibly Depart from Neutrality When It Questioned a Witness. The trial judge is more than a referee to an adversarial proceeding. Consistent with the common-law tradition, the judge may comment on the evidence and question witnesses and elicit facts not yet adduced or clarify those previously presented. This questioning is limited only by the principle that a judge must maintain neutrality between the parties. The district judge stayed well within these bounds. He asked a single question without commenting on the veracity or relevance of the witness's testimony. The district court did not err, let alone clearly err, when it asked a witness for that information. Caldwell's Conviction Under the Armed Career Criminal Act and His Sentence Must Be Vacated. The Supreme Court recently held that attempted Hobbs Act robbery is not a "crime of violence" under section 924(c). 142 S.Ct. at 2020. So, the Eleventh Circuit must vacate Caldwell's conviction and it remand for the district court to re-sentence Caldwell for his remaining counts of conviction. All the other convictions and sentences were affirmed. ZALMA OPINION Insurance fraud is a serious crime. It is not as serious as murder. But when a group of men work together to commit murder and insurance fraud they are acting beyond reason and deserve as serious a sentence as the court can provide in accordance with the law. The appeal was their right and the Eleventh Circuit had the obligation and right to disavow them of their arguments and only changed a sentence because of a change in the law. "Street gangs are gangs formed by youths in urban areas, and are known primarily for street fighting and gang warfare.[29] The term "street gang" is commonly used interchangeably with "youth gang", referring to neighborhood or street-based youth groups that meet "gang" criteria.[30] Miller (1992) defines a street gang as "a self-formed association of peers, united by mutual interests, with identifiable leadership and internal organization, who act collectively or as individuals to achieve specific purposes, including the conduct of illegal activity and control of a particular territory, facility, or enterprise."[31] Some of the well-known ones are the Black gangs like the Bloods and the Crips, also the Vice Lords and the Gangster Disciples. Other racial gangs also exist like the Trinitario, Sureños, Tiny Rascal Gang, Asian Boyz, Wa Ching, Zoe Pound, The Latin Kings, The Hammerskins, Nazi Lowriders and Blood & Honour." The DC gangs would play G-Funk and all music (the uncensored versions.) Link: https://en.m.wikipedia.org/wiki/G-funk. As a child, I was forced to be profane, mean, loud, aggressive, and violent by the DC gangs. A musician not having their life together after years in the business isn't exactly something new. That's why so many of them burn out and fade away, relegated to the status of one-hit wonders. The world of rap is no different. But few rappers have wasted more of their prime getting shot or serving time in and out of prison than Chicago artist, King Yella. Whether he's beefing with Offset over “smashing” Cardi-B, or claiming the cops are out to get him, this longtime member of the Gangster Disciples is as intense, gritty, and aggressive in real life as he is in his music. You know... when he actually gets around to making some. Which, honestly, is all that often anymore. Instead, he's turned himself into something of a YouTuber and is making a decent living by doing so.
Mr. Sprained Ankle's seventh studio LP lands at midnight Drake has announced his follow-up to last year's Certified Lover Boy. It's called Honestly, Nevermind, and it arrives tonight at midnight. The rapper announced the news in an Instagram post today (June 16). Find that below. Drake released his sixth studio album Certified Lover Boy in September of 2021. The LP shot to No. 1 on the Billboard 200 chart, overtaking Kanye West's Donda with what was at the time the biggest debut week of 2021. The LP includes the Right Said Fred-sampling, Young Thug and Future-featuring “I'm Too Sexy” and the 21 Savage and Project Pat-featuring “Knife Talk.” It also includes an R Kelly co-writing credit. Just days before the album's release, he shared an unreleased Kanye West and André 3000 track—featuring a Drake diss—on SiriusXM's Sound 42. West—now legally known as “Ye”—would later invite Drake to appear as his guest at a previously unannounced December 7 event intended to aid in the release of Gangster Disciples co-founder Larry Hoover. CLB is the full-length follow-up to 2018's Scorpion. In between those two LPs, Drake dropped Dark Lane Demo tapes, which landed last year, as well as his 2019 compilation Care Package. source: https://pitchfork.com/news/drake-releasing-new-album-honestly-nevermind-tonight/ --- Support this podcast: https://anchor.fm/masseffect/support

Dave Mays was once looked at as the Michael Jordan of hip-hop publications, and… he's back! As a 19-year-old sophomore at Harvard, he founded The Source magazine, which began as a monthly newsletter, eventually becoming one of the world's longest-running rap/hip-hop magazines.Mays had a vision to put hip-hop on the forefront of all genres and succeeded immensely turning his newsletter into a full-fledged publication. That ride ended in 2005, when he and Raymond “Benzino” Scott were forced out in a dispute with investors.Understanding today's needs, Mays returns with Breakbeat Podcasting network, which will host several culturally diverse podcasts with a variety of hosts. Mays also hosts his podcast, “The Dave Mays Show.”Breakbeat will also produce docuseries, starting with the “Unsigned Hype,” a popular series in The Source magazine that introduced several hip-hop and R&B acts. Larry Hoover has been incarcerated since 1973. At this rate, it's highly unlikely he'll ever see the outside world again. This former leader of Chicago's Gangster Disciples is currently serving multiple life sentences at the prison known as ADX Florence, which has a reputation for being one of the most psychologically punishing correctional facilities in the entire world. After being charged with serious criminal activities in the 1970s, Larry would later be convicted of running the Gangster Disciples from inside his prison cell. That was in 1997 and every single day since then, Larry has been forced to spend 23-hours in solitary confinement. His case is widely regarded as hopeless because in order to be released he would need to obtain pardons at both the state and federal levels. Well, in order to accomplish just that, hip-hop superstars Drake and Kanye West recently set aside their widely publicized differences to throw a benefit concert in Larry's name and raise awareness over his plight. So, how exactly did Larry Hoover's reputation grow even larger from behind bars? And just why have Kanye and Drake teamed up to see him released? Those answers and more in our latest episode of Before They Were Famous.
the sight of Ye (who recently changed his name from Kanye West) and Drake on stage together is not something fans would ever expect to see, because of their long-running feud. For the past few years we've seen the former friends locked in a war of words, lyrics and even emojis. But they've put that to one side for a concert to raise awareness for a man they both want to be freed from jail. Larry Hoover, 71, is in one of the most secure prisons in the US. He's been behind bars for more than five decades for his involvement in crimes such as gang-affiliated murder. Court documents from July say Hoover was one of the leaders of a Chicago gang called Gangster Disciples between 1970 and 1995. Under Hoover's direction, the gang sold "great quantities of cocaine, heroin, and other drugs in Chicago". In 1973 he was convicted for ordering the killing of a 19-year-old neighbourhood drug dealer and sentenced to 150-200 years. In 1997 he was given six life sentences after being found guilty of federal drug conspiracy, extortion and continuing to engage in a criminal enterprise. His supporters say while in prison Hoover has told followers of the Gangster Disciples group that he denounced violence, wanted all members to get an education in school and has shown rehabilitation. Larry Hoover has unsuccessfully appealed to be freed, or to be put in a lower security prison, under the First Step Act - which is a way to challenge extremely long sentences for federal drug offences. In the appeal case the court was told Hoover had been under "severe isolation" in jail, including being in solitary confinement for up to 24 hours a day. According to the Hoover Project - which campaigns for his release - keeping him longer than the time he's served "serves no practical purpose". Raised in Chicago, Ye has supported Larry Hoover for a while and has been trying to get him out of prison. He brought up the case when he met former President Donald Trump in 2018 and asked for Hoover to be pardoned (which didn't happen). Ye also has a song on his new album Donda called Free My Father, which features Larry's son, Larry Jr speaking. Speaking ahead of the concert in Los Angeles, Larry Hoover Jr said the event would help to take his dad's "plea for redemption worldwide and show that we are truly stronger together on behalf of any and everyone with a loved one wrongly or unjustly incarcerated". Hoover's lawyer Justin Moore told Newsbeat there will be future efforts to free him using the First Step Act. "We are cautiously optimistic that Larry, who is now in the twilight of his years, can show that he can re-enter society and adjust to life as a fully rehabilitated citizen." --- Support this podcast: https://anchor.fm/masseffect/support
Ronnie Bazel was 19 when he was sentenced to a decade in prison under mandatory minimum laws for crack sales. With just two years to go he was stabbed in the heart by an enforcer for the Gangster Disciples, allegedly for running up a prison drug debt. Bazel's family was looking for answers when they received a letter from a convicted cop killer that accused the federal government of covering their tracks.

From A Gang To God: In the gangsta lifestyle, you end up one of three ways: JAIL CELLS, WHEELCHAIRS, or GRAVEYARDS. Butterfly Evolution sits down with Author, Gang Consultant Ronald Baldridge Ronald is founder of P.I.A.N.O. Inc., Partners in Alliance Needing Others, a 501c3 non-profit organization, that mentors young boys from single parent homes (predominately single mothers) Ron was born in Greenville, Mississippi, Washington County, on August 12, 1967. His mother moved Ronald and his older brother to Memphis, Tennessee in 1974. She taught them both to judge people individually . However, there were two types of people Ron hated - white people and the police. Ron and his brother grew up in the inner city of North Memphis with the values of love, family, respect, and determination. Seeing his mom struggle to keep food on the table Ron made a decision to help by any means necessary. He strayed from the path in which he was taught and chose a journey of seeking wealth. This journey took him down an unexpected road of self-destruction. Ron started selling drugs and making $1000 every three hours was easy. Ron easily put aside the values his mother worked so hard to instill in him. He continued to make wrong choices that led him to not only becoming a member of a North Memphis gang called the Night Hawks , but Ron also became an enforcer for one of the most feared gangs in this country - the Gangster Disciples . It was on July 7, 1985, that Ron s life would change forever. That night in a gang shooting, he was left paralyzed from a bullet that shattered his spinal cord. That night a white police officer would enter his life. Don't miss this powerful show. Grab your sons and join Butterfly Evolution Monday April 18th at 8 PM CST.
