In the monumental case, families, doctors, and the United States government are asking the Supreme Court to strike down Tennessee's ban on hormone therapy for transgender youth. Gender Justice legal and policy experts held a briefing to walk listeners through the key legal arguments made on December 4th, explaining how this case advanced to the nation's highest court, and discussing the potential outcomes that could impact transgender rights across the country. Host: Noah Parrish, Gender Justice Communications Director Guests: Erin Maye Quade, Gender Justice Special Projects Advisor, and Miraya Gran, Minnesota Building Families Coalition infertility advocate At Gender Justice, we advocate for gender equity under the law. We also subscribe to the philosophy of reproductive justice, a concept developed by Black women advocates in the 1990s defined as “the human right to maintain personal bodily autonomy, to have children, to not have children, and to parent the children we have in safe and sustainable communities.” Access to infertility treatment and services is a key component of this right. Though specifics on state laws vary widely, 22 states and the District of Columbia require insurance to cover some kind of fertility treatment — but Minnesota isn't one of them. In this episode we talk with Miraya Gran, a leader of the Minnesota Building Families Coalition, and Gender Justice Special Projects Advisor Erin Maye Quade, who in her role as a Minnesota legislator is lead Senate author of the Minnesota Building Families Act, which would align Minnesota law with the position of the medical community as well as the reproductive rights, health, and justice communities. Justice for Reyzl: Standing up to LGBTQ Workplace Discrimination Host: Noah Parrish, Gender Justice Communications Director Guest: Brittany Stewart, Gender Justice Senior Staff Attorney In August 2024, Gender Justice and co-counsel Wanta Thome PLC filed a discrimination lawsuit against the Academy of Holy Angels, a Catholic high school in Richfield, Minnesota, and the Archdiocese of St. Paul and Minneapolis after they effectively terminated Reyzl Grace, a staff librarian, when she came out as trans. Reyzl Grace's story highlights the importance of ensuring that no employer in Minnesota has carte blanche to discriminate against employees simply because of who they are. We believe the school violated the Minnesota Human Rights Act (MHRA) by refusing to allow Grace, who served as a secular librarian at the school, to reapply for her position on the basis of gender identity and sex. While the MHRA does permit limited exemptions on religious grounds, the Legislature never intended for these exemptions to apply to secular employees. In this episode of The Gender Justice Brief, Reyzl Grace's attorney, Brittany Stewart, outlines our case seeking justice for her: Background and context on Reyzl Grace's case Grace v. SCOTUS Chat: Recorded live with Jess Braverman, Gender Justice Legal Director and Erin Maye Quade, Gender Justice Special Projects Advisor On June 27, 2024, the U.S. Supreme Court issued its decision in Idaho v. United States and Moyle et al., or the “EMTALA” (Emergency Medical Treatment and Labor Act) case, which centers on whether state abortion bans supersede the federal EMTALA law mandating that hospital emergency departments receiving federal funding must stabilize a patient whose life or health is at risk. In its long-awaited decision, the Court sent the case back to the lower courts, where. It also reinstated a lower court's ruling permitting doctors to provide emergency abortion care even where such care conflicts with Idaho's abortion ban—but not before several patients had to be airlifted out of Idaho to receive emergency health care because of the Court's initial decision. By punting on what should be a straightforward ruling, the Supreme Court effectively condones the denial of emergency abortion care. In this SCOTUS Chat, Gender Justice Special Projects Advisor Erin Maye Quade and Legal Director Jess Braverman share their analysis of the Supreme Court ruling. The policy was included in the omnibus Commerce policy bill that passed this session. Our guests for this episode bring a wealth of knowledge and experience to the discussion, describing the urgent need for codification, the process of drafting and passing this law, and the impact that the policy will have on the many people for whom gender-affirming care is an essential aspect of their healthcare. Host: Noah Parrish, Gender Justice Communications Director Guest: Jess Braverman, Gender Justice Legal Director On June 13, 2024, the Supreme Court issued a decision in U.S. Food and Drug Administration v. Alliance for Hippocratic Medicine, its first abortion case since the Dobbs ruling reversing Roe v. Wade. In a unanimous ruling, the U.S. Supreme Court maintained the current FDA regulations on mifepristone, one of the two pills used in medication abortion. This medication, alongside misoprostol, constitutes the primary method for over 60% of U.S. abortions and plays a vital role in reproductive healthcare beyond abortion, including miscarriage management and treating reproductive health conditions. As reliance on medication abortion surges nationwide, with over three in five abortion patients opting for this method, the Supreme Court's decision maintains access to a fundamental aspect of reproductive healthcare. However, while this ruling maintains the status quo for mifepristone access, it contains troubling language suggesting that doctors with religious objections to any medical treatment could potentially opt out, even if it could result in death or severe harm to a patient. Even where there are no alternative providers to ensure care (in largely rural areas and healthcare deserts, for example) In the latest SCOTUS Chat, Gender Justice Communications Director Noah Parrish sits down with Legal Director Jess Braverman to discuss the ruling and its implications. Host: Noah Parrish, Gender Justice Communications DirectorGuests: Jess Braverman, Gender Justice Legal Director and Paige Suelzle, Litigation Counsel at The Lawyering Project In this episode of The Gender Justice Brief we talk with The Lawyering Project's Paige Suelzle about a recent victory for abortion funds—and for the First Amendment—in a case that is likely to have broad regional and national repercussions. When the Dobbs decision was announced on June 25, 2022, abortion became illegal in Alabama overnight. By the end of that summer, Alabama's Attorney General threatened to criminalize people who help Alabamians from leaving the state to access legal abortion—including abortion funds like The Yellowhammer Fund, based in Tuscaloosa, Alabama—which had a chilling effect on providers and funds. Represented by The Lawyering Project, the Yellowhammer Fund fought this threat in federal court, and in May 2024 received a preliminary ruling: their case can move forward, and the fund can resume assisting people while the case progresses. “The right to interstate travel is one of our most fundamental constitutional rights,” wrote U.S. District Judge Myron Thompson in his preliminary ruling. “Alabama can no more restrict people from going to, say, California to engage in what is lawful there than California can restrict people from coming to Alabama to do what is lawful here.” References from the podcast and additional resources: The Lawyering Project's timeline of the case The Yellowhammer Fund National Network of Abortion Funds Our Justice (Minnesota's abortion fund) SCOTUS Chat: Can States Ban Emergency Abortion Care? In honor of the 10th anniversary of the passage of the Women's Economic Security Act (WESA), which guarantees nursing rights for Minnesota workers, we are re-releasing our 2023 episode on Pregnancy and Pumping Rights. In 2014, Gender Justice helped catapult the life-changing package of legislation known as the Women's Economic Security Act over the finishing line. In the decade since, the policies have been further strengthened, solidifying protections for pregnant and nursing employees, creating supports for parents of young children, narrowing the gender pay gap, and more. In this episode, Senior Staff Attorney Sara Jane Baldwin and Humphrey School of Public Affairs policy student Allison Glass discuss the law and its implications. ""Our goal with every case we take is to improve the law and improve people's lives more than just one client. We can have all the great laws we want, but if they're not enforced, then there's no real change," says Senior Staff Attorney Sara Jane Baldwin. "So there's a lot of work to do, and we're ready to do it." Join us on Monday, May 13th to celebrate the 10th anniversary of WESA! • Time: 8 am – noon • Where: Minnesota Senate Building, Room 1200, at 95 University Ave. W. in St. Paul (a virtual option is available.) This episode of The Gender Justice Brief is a recording of the panel of advocates and researchers featured in the film Preconceived, moderated by Gender Justice Executive Director Megan Peterson at its premiere at the South By Southwest festival in Austin, Texas on March 9, 2024. Preconceived tells the stories of Maleeha and Maria, just two of the thousands of people who have been deceived by coercive anti-abortion propaganda mills known as crisis pregnancy centers (CPCs). As the film follows these protagonists, it sheds light on the deceptive practices deployed by CPCs, investigates the funding streams that fuel their spread, and raises urgent questions about how to combat disinformation in a post-Dobbs era. Crisis pregnancy centers, or “CPCs,” are anti-abortion organizations that target pregnant people with predatory, deceptive marketing. Their main function is to attract and intercept Black, brown, Indigenous, and low-income people before they access abortion care. Their goal is ideological, not medical: They want to prevent pregnant people from obtaining abortion services using any means necessary, including by using delay tactics, disinformation, and deception. With nearly a hundred CPCs in Minnesota, they outnumber abortion clinics by about 10:1. This week Special Projects Advisor Erin Maye Quade and Organizer Jay Belsito talk with our guests, Olivia Crull and Carolyn Handke from the grassroots Minnesota Abortion Action Committee, about the harm that CPCs pose to our community. This episode was recorded live, at the annual Gender Justice Brunch. --- Among our amazing guests, we welcomed Helene and MatthewWoods. Helene recounts the challenging journey of Matt, during his transition from elementary to middle school. After Matt came out as transgender, he faced significant difficulties at school, including discrimination and being denied access to appropriate restrooms. This led to frequent absences and a loss of interest in school. After the family patiently explored several solutions, their struggles led to a legal battle and with the support of the attorneys at Gender Justice, the Woods family won in a pivotal court decision that affirmed Matt's identity. This legal victory rekindled Matt's motivation, leading to an impressive academic comeback, high school graduation, and more. The team at Gender Justice is extremely proud to have had the opportunity to represent the Woods family. And we will continue to provide legal support and advocacy in overcoming discrimination and fostering positive change for all. This episode, hosted by Erin Maye-Quade features a discussion with Denise Specht from Education Minnesota, Beth Gendler from Jewish Community Action, Monica Meyer from Gender Justice, and Chris Williams from Education Minnesota. The conversation revolves around school board elections, which have notoriously low turnout. The panel discusses the role of school boards in hiring educators, setting policies, and approving curricula, and highlights the direct impact these decisions have on students and teachers. The discussion also touches upon the national movements aiming to restrict educational freedoms, particularly concerning honest historical education and the affirmation of diverse identities. Denise Specht sheds light on the need for students and staff to feel safe and authentic in schools, advocating for the freedom to learn and teach truthfully. Monica Meyer elaborates on the organized efforts to discriminate and restrict educational content, particularly targeting LGBTQ+ students and the teaching of America's history of racism and slavery. Beth Gendler addresses the underlying white Christian nationalist agenda driving these efforts, aiming to reshape the nation starting with grassroots influence on children's education. Beth urges parents to educate themselves about school board candidates, emphasizing the importance of voting in these elections. Chris Williams provides a historical context to the current situation, tracing it back to strategic campaigns by influential think tanks. He highlights the deliberate misinformation and manipulation tactics used to promote discriminatory agendas, stressing the need for community engagement and critical evaluation of candidates and their endorsements. -- For additional resources, please visit: https://www.edmnvotes.org/2023-voter-guide/ https://www.genderjustice.us/resource/trans-students/ ### Visit the "Gender Justice" Website here and "Unrestrict Minnesota" here. In this episode, Erin Maye Quade is joined by Christina Sambor and Brittany Stewart. The discussion centers on Gender Justice's expanded work into North Dakota and South Dakota, a region often used as testing grounds for right-wing movements. Gender Justice is challenging discriminatory laws, promoting LGBTQ rights, and reproductive rights, and bolstering legal capacity. Christina Sambor gives an in-depth overview of North Dakota's current gender justice landscape. Notably, the state's recent legislation targeting transgender rights has sparked significant concern. Bills, such as HB 1254, prohibit gender-affirming care for minors, restricting treatments such as puberty blockers and potentially subjecting medical professionals to legal consequences. Brittany Stewart underscores this legislative push against trans rights as a façade of child protection, rooted in deep-seated bias against the trans community. ### Visit the "Gender Justice" Website here and "Unrestrict Minnesota" here. In this episode of The Gender Justice Brief podcast, Erin Hart, Communications Director at Gender Justice, hosts a discussion with Jess Braverman, Legal Director at Gender Justice, and Minnesota State Senator Erin Maye Quade, Special Projects Advisor. This episode focuses on the complex topic of FDA medication abortion lawsuits and their potential impact on reproductive rights. Senator Maye Quade delved into the importance of Mifepristone, a key component in medication abortion alongside Misoprostol, emphasizing their combined efficacy, with Mifepristone boasting a remarkable 99.6% success rate for safe pregnancy termination. Jess Braverman navigated the intricate FDA timeline related to Mifepristone, dating back to its approval in 2000, which sparked legal battles over the years. Recent pivotal rulings in April 2023 emerged from Texas and Washington, stirring controversy regarding Mifepristone's accessibility. Notably, the Supreme Court temporarily intervened, pausing any regulatory changes during the ongoing legal saga. The conversation dissected the August ruling from the Fifth Circuit Court, which pertained to doctors' "standing" in the case and its potential impact on Mifepristone's availability. Ultimately, the legal battle carries far-reaching implications on reproductive rights, extending beyond Minnesota's borders. Erin also addressed the peculiar claim that doctors suffer an "aesthetic injury" when patients opt for abortions. ### Visit the "Gender Justice" Website here and "Unrestrict Minnesota" here. In this episode, Erin Hart welcomes Jess Braverman, the legal director at Gender Justice, and Erin Maye Quade, Gender Justice Special Projects Advisor (and rising TikTok star). The team discusses Anderson v. Thrifty White, a lawsuit filed on behalf of Andrea Anderson, who was denied service when she sought to fill a prescription for emergency contraception. The complaint, filed in Aitkin County District Court in Minnesota's Ninth Judicial District, argues that Anderson's experience constitutes illegal discrimination based on sex, and that denying her service based on her pregnancy-related health care needs violates the Minnesota Human Rights Act. After the Supreme Court overturned Roe v. Wade earlier this summer, there has been a rise in pharmacists refusing to dispense contraception and emergency contraception to patients. With more than half of states working to ban access to safe, legal abortion care, access to prescription medications, including contraception, is more important than ever. Gender Justice hopes that a future victory in this case shows that people like our client, and countless others across the country who rely on their local pharmacies for birth control, cannot be discriminated against. ### Visit the "Gender Justice" Website here and "Unrestrict Minnesota" here. The importance of reclaiming the narrative and valuing individual freedoms, especially in predominantly conservative states like North Dakota. HB 1254, which prohibits gender-affirming care and criminalizes doctors who perform such care, was signed into law with a broad "grandfather clause" that may not protect those currently receiving treatment ### Visit the "Gender Justice" Website here and "Unrestrict Minnesota" here. In this episode, Erin Hart, Megan Peterson, and Jess Braverman discuss: The FDA approved Mifepristone for as part of a two-drug regimen for medication abortion in 2000 with unnecessary restrictions, but during the pandemic, the FDA relaxed rules allowing telemedicine access to the medication. After the Supreme Court overturned Roe v. Wade, ending the federal right to abortion, an anti-abortion group went after medication abortion in a manufactured lawsuit Alliance for Hippocratic Medicine vs. FDA. Chaos and confusion, inhibiting access to medication abortion, is the current goal of the anti-abortion movement and lawmakers. This is impacting reproductive rights, but there are ongoing legal battles and campaigns to support reproductive freedom. Providers are working hard to keep abortion accessible in Minnesota, but removing old laws and passing new protective acts is necessary to provide additional protections for patients and providers. What can you do? Contact your legislators to pass the Reproductive Freedom Codification Act repealing Minnesota's abortion restrictions (unrestrictmn.org/ask) and the Reproductive Freedom Defense Act protecting patients and providers (unrestrictmn.org/rfda) …and donuts. ### Visit the "Gender Justice" Website here and "Unrestrict Minnesota" here. In this episode, Erin Hart, Megan Peterson, and Abena Abraham provide a legislative update, covering: Dr. Sarah Traxler, Chief Medical Officer for Planned Parenthood North Central States (PPNC), testified on the Reproductive Freedom Defense Act in the Senate Health Committee. Since the overturning of Roe v. Wade, PPNCS has seen a 13% increase in patients coming from out of the region for abortion and a 40% increase in second-trimester abortions. Efforts to pass SF 165, the Reproductive Freedom Defense Act, continue. This bill is to ensure that all Minnesotans have access to reproductive healthcare and that healthcare providers are protected in providing essential healthcare services. The Reproductive Freedom Defense Act passed the Minnesota House on Monday with 68 “yes” and 62 “no” votes. The movement cannot be stopped, and Minnesota will have the back of providers and patients who need to come here to get care. We also discuss the Trans Refuge Bill, which passed by the Minnesota House early Friday morning. The bill was led by Representative Finke, who spoke passionately about the importance of passing the bill. The bill has also been heard by the Senate Judiciary, and Public Safety Committee and hopefully is on a pathway to reach the governor's desk this year. ### Visit the "Gender Justice" Website here and "Unrestrict Minnesota" here. In this episode, Erin Hart, Megan Peterson, Jess Braverman, and Abena Abraham talk through the latest updates from the Minnesota legislature and abortion rights. First, we cover the Reproductive Freedom Defense Act, a Minnesota law that protects patients and providers from legal attacks from anti-abortion states. The bill is expected to be voted on in the House on Monday, March 20. Legal director Jess Braverman provides an overview of cases coming out of Texas and the legal landscape that patients and providers are facing. The Red River Women's Clinic in Minnesota won a case challenging the trigger ban in North Dakota, affirming constitutional protection for abortion in the state constitution. The Center for Reproductive Rights brought the case to court, resulting in a significant win. Megan and Abena touch on their recent trip to the Abortion Care Network Conference, where they discussed the cases coming out of Texas and the lawsuit against the FDA for its approval of Mifepristone. The conversation emphasized the need for medically accurate and supportive pregnancy care, particularly for vulnerable communities. The group also gives an update on the other bills moving at the Capitol, including the Positive Pregnancies Support Act and the Reproductive Freedom Codification Act. Jess wraps up the conversation with an update on the lawsuit Doe v. Minnesota and the latest motion to intervene from an anti-abortion group. ### Visit the "Gender Justice" Website here and "Unrestrict Minnesota" here. In this episode of The Gender Justice Brief, Erin Hart, Senator Erin Maye Quade, and legal director Jess Braverman return to discuss the groundbreaking case of Cooper versus USA Powerlifting, which has set a precedent for trans inclusion in sports. JayCee Cooper, Gender Justice's first client to join the podcast, shares her experience and why she brought the case against USA Powerlifting, highlighting the ongoing attacks against the trans community. The case sheds light on the importance of transgender inclusion in sports. The podcast delves into how it will help educate people and break down misinformation perpetuated in the media. With the help of co-counsel Nichols Kaster and Premo Frank, as well as national partners like Athlete Ally and Inclusion Playbook, Gender Justice was able to gain support for trans inclusion in sports and set an example for other states to follow. This victory emphasizes that trans inclusion is essential for the growth and success of women's sports. ### Visit the "Gender Justice" Website here and "Unrestrict Minnesota" here. In this episode, Erin Hart and Megan Peterson, and Abena Abraham discuss the current state of legislation. Cynthia Lin's keynote leads into the episode. Description: In this episode, Cynthia Lin from the National Network of Abortion Funds delivers a keynote address at Reproductive Freedom Lobby Day in Minnesota, emphasizing the importance of advocating for reproductive autonomy and abortion access. We also discuss the fractured landscape of abortion rights in the US, the impact of the recent Dobbs decision, and the situation in neighboring Wisconsin. We recap Gender Justice's lobby day, which focused on pushing for the leadership agenda and exploring Minnesota's efforts to expand abortion access, reproductive health rights, and justice. Finally, we discuss the impending decision from a Texas court on Mifepristone and the need to continue efforts to counter the anti-abortion movement's goal of banning all abortions. ### Visit the "Gender Justice" Website here and "Unrestrict Minnesota" here. In this episode, Erin Hart, MN Representative Leigh Finke, and Kat Rohn discuss the Trans Refuge Bill advancing at the Minnesota legislature. Anti-LGBTQ+ states like South Dakota are blocking necessary gender-affirming care for minors, denying them the support they need to thrive. The proposed Trans Refuge Bill in Minnesota is a crucial piece of legislation for the trans community, protecting their rights and making space for them to thrive. Trans and gender-expansive people are fighting for their rights in the political sphere, testifying in hearings and speaking out in support of the bill. Representative Finke, the bill's author, is building a testifiers bank to ensure that experts are present to clarify the bill's intentions and goals. Personal stories of trans and gender-expansive individuals are a powerful tool in gaining support for the bill, and community involvement is critical for its success. Non-right-wing media must highlight this important legislation, as only a few states have passed similar bills into law. Contacting legislators and community engagement are key to getting the Trans Refuge Bill passed and protecting the reproductive rights of transgender youth. ### Visit the "Gender Justice" Website here and "Unrestrict Minnesota" here. Header: In this episode, Erin Hart and Erica Soloman (Exec. Director at NCJW MN) discuss HF44, the Menstrual Equity Bill. NCJW Minnesota is pushing for the "menstrual equity bill" (HF 44 and SF 50) to fund menstrual products in public and charter schools. One in five students experiences "period poverty," and many miss class without access to menstrual products. NCJW Minnesota has distributed over 200,000 menstrual products since 2018 but seeks a systemic solution. The bill has bipartisan support but faced opposition and transphobic language. High school graduates, organizations, and Girl Scouts testified in support. NCJW Minnesota is also part of the Communities Combating Hate coalition working on legislation against hate crimes and bias incidents. In this episode, Legal Director Jess Braverman and Special Projects Advisor Erin Maye Quade discuss how religion is being used to expand and limit civil rights. The Supreme Court's Kennedy v. Bremerton School District case called into question the use of the Lemon Test for Establishment Clause violations and raised questions about religion in public spaces. Title IX's exemption for religious organizations raises concerns about discrimination protection for women in religious-affiliated institutions. A critique of the Supreme Court for not relying on facts or precedent in recent cases. The Minnesota Human Rights Act prohibits discrimination, but has discriminatory exemptions for LGBTQ people. The Affordable Care Act and emergency contraception are also discussed in relation to Supreme Court cases. The Minnesota Human Rights Act is one of the strongest in the country, but it also has exceptions and discriminatory language. ### Visit the "Gender Justice" Website here and "Unrestrict Minnesota" here. In this episode, Erin Hart, Jessica Nyman, and Abena Abraham discuss the intense start of the Minnesota legislative session: What is it like being at the Capitol again? A lot of movement around abortion-related legislation. The PRO Act, which would establish a statutory right to choose reproductive healthcare options, including abortion, was introduced quickly and is a top priority for legislators. The bill had its first hearing last week, with strong support from providers and patients and opposition from those who do not support abortion rights. The PRO Act, which enshrines the right to abortion and other reproductive healthcare, also includes provisions to prevent municipalities from restricting abortion rights and ensures that they provide the basic fundamental right to abortion. The bill is a top priority for legislators and could be enacted by the end of the month. HF 91/SF 70, repealing Minnesota's abortion restrictions, has been introduced and had its first hearing last week in the House. Many amendments have been proposed by opponents of the bill that are rooted in misinformation and inflammatory language. The testimony provided at the hearing was interesting but also a shock for the new legislators and staff who have not had the opportunity to listen to arguments against abortion rights. It's weird. You can email us your GJB bumper ad masterpiece to gjb.podcast@gmail.com. And we're back next week with a full episode brimming with our usual trivia and maybe poo facts.

'Dazed and Aroused' author GJB breaks into Sam's house and makes her read his book and then listen to him talk about it. The result is a (delightfully) disjointed account which includes the likes of His Novel (good or not so good?); places that aren't London; miscellaneous mishaps; twitter crimes; James Brown; second album anxiety; Jack Underwood's arse and the joy that is Literary Death Match. It's like opening a box on your birthday and finding something nicer than a dead kitten inside. Oh yes.
