EO 14281 poses significant challenges for employers because it seeks to limit disparate impact liability but clashes with established state and local regulations and laws, such as New York City's law regarding the use of automated employment decision tools. This tension underscores the increasing complexity of managing artificial intelligence (AI)-driven decision-making in the workplace amid shifting legal standards. This week's key topics include: the scope of EO 14281; conflicts between EO 14281 and existing federal, state, and local laws; and best practices to mitigate risks in AI employment decisions. Epstein Becker Green attorneys Marc A. Mandelman and Nathaniel M. One-hundred days into the second Trump administration, Quality Matters host Andy Reynolds welcomes Eric Musser, Vice President of Federal Affairs at NCQA, for an insightful discussion about NCQA's recommendations to the Trump administration for improving health care quality.Eric shares ideas to shape a strong quality future for value-based care, digital health infrastructure and behavioral health. The conversation focuses on value-based care models that prioritize care integration to prevent or alleviate chronic illness. Eric identifies fragmentation's threats to care delivery and data management—problems NCQA's recommendations aim to address.Specific suggestions include:Expanding the commitment the first Trump administration made to getting all Medicare beneficiaries in value-based care arrangements by 2030. This ambitious goal requires big changes in policy and practice, but could lead to better outcomes and more efficient care delivery.Creating innovative care models that leverage technology and dynamic care plans. These models would use advanced technologies like AI to integrate patient data more quickly and effectively. Dynamic care plans would allow for real-time updates based on patient data from various sources, including remote monitoring.Prioritizing patient-generated data and patient-reported outcomes. This approach focuses on incorporating patients' experiences and goals into their care plans. The aim is to improve patient engagement and ensure care matches what matters to patients, particularly those with chronic conditions.Promoting standardized data exchange in Medicare Advantage programs. This recommendation addresses the need for better data sharing between plans, providers and patients. This would mean dismantling data silos and creating more comprehensive, real-time views of patient populations. There is tremendous potential for the Trump administration to improve health care quality. Listen to this episode to find out how.Key Quote:“ We know the Trump administration has a patients first agenda. They put the consumer first in the way they think about quality and payment. There is a desire in the measurement space to have more measures centered around patients' goals. That's a person-reported outcome or a patient-centered outcome, as we call it here at NCQA. You want to make sure that the patient gets that strong clinical care. But the experience to ensure that they want to come back for that clinical care is also extremely important. So person-reported outcomes are about enhancing the experience of patients as they work with their care team. This is important for folks with chronic conditions, behavioral health. Having those goals that are patient-centric–like walking down the stairs, getting to church–are all ways which improve health and then get that buy-in to the care plan that we're seeking to support.”-Eric MusserTime Stamps:(01:22) Opportunities in the First 100 Days of a New Administration(05:30) Deep Dive: Value-Based Care and Care Integration (07:12) Fixing Two Kinds of Fragmentation(10:49) Four Operational How-Tos Links:NCQA's Recommendations to the Trump AdministrationListen to Eric's Episode on Data SharingConnect with Eric

rePROs Fight Back released its 13th annual 50-State Report Card on Sexual and Reproductive Health and Rights. The United States, overall, received an ‘F' grade, while 5 states received an ‘A' and 25 states failed. Jennie Wetter, Director of the rePROs Fight Back initiative and host of the rePROs Fight Back podcast, sits down to discuss this staggering loss of rights and the continuous fight for our right to bodily autonomy with Tarah Demant, Interim National Director of Programs, Advocacy, and Government Affairs at Amnesty International USA. While 2024 had some bright spots, including abortion-related ballot measures passing in 7 of the 10 states where they were on the ballot, we are still experiencing the fallout of the 2022 Dobbs decision. The human rights crisis unleashed by that decision has led states to continue restricting abortion access and has emboldened anti-rights advocates to increase their attacks on gender-affirming care. Using 11 criteria, the 50-State Report Card ranks each of the 50 states and the District of Columbia on three broad indicators relating to reproductive health and rights: prevention, affordability, and access to services. You might be interested in the Public Health is Dead podcast: https://www.publichealthisdead.com/ 9o03Support the showFollow Us on Social: Twitter: @rePROsFightBack Instagram: @reprosfbFacebook: rePROs Fight Back Bluesky: @reprosfightback.bsky.social Email us: jennie@reprosfightback.comRate and Review on Apple PodcastThanks for listening & keep fighting back!

The origin story of the United States of America begins, in no small part, with maritime trade issues. Most of the declared and many of the undeclared, wars our nation has fought can be traced to the safety of our maritime commerce and unfettered access to the open seas.Look at any map, and you'll see we have oceans to the east and west of us, between our nation and its markets, allies, and competitors on the world stage.Today we're going to cast a wide net on that world view with returning guest, Ross Kennedy.Ross is a logistics and trade expert who has worked at the intersection of global trade, supply chains, and national security for two decades in support of United States national interests and private-sector clients.SummaryThis conversation delves into the intricate relationship between maritime trade, national security, and the evolving policies under the new administration. Ross Kennedy, a logistics and trade expert, discusses the historical context of maritime commerce in the U.S., the challenges of reindustrialization, and the need for a coordinated approach among various stakeholders in the maritime sector. The dialogue emphasizes the importance of investing in domestic shipbuilding capabilities, addressing supply chain issues, and recognizing strategic choke points in global trade. Kennedy advocates for innovative funding mechanisms and a holistic strategy to revitalize the maritime industry and ensure national security.TakeawaysThe U.S. maritime industry is crucial for national security.90% of global trade is conducted via maritime routes.A coordinated approach among stakeholders is essential.Reindustrialization requires long-term planning and investment.Funding mechanisms must support small businesses in the maritime sector.Disused shipyards can be revitalized for modern needs.Strategic choke points are vital for U.S. interests.Investing in domestic capabilities is a priority.Healthy debate is necessary for effective policy-making.The Arctic route poses significant geopolitical challenges.Chapters00:00: Introduction to Maritime Trade and National Security02:46: The Impact of the New Administration on Maritime Policies08:11: The Role of Stakeholders in Shipbuilding13:58: Challenges in Maritime Infrastructure and Supply Chains20:25: Innovative Approaches to Shipbuilding and Economic Zones25:26: The Future of Maritime Commerce and Procurement Reform27:16: Decoupling Funding from National Security29:18: Investing in Domestic Capabilities31:51: Reimagining Maritime Logistics35:05: Reviving Disused Shipyards38:30: Strategic Maritime Infrastructure43:44: Choke Points and Global Trade50:27: Closing Thoughts

A federal agency called the Consumer Financial Protection Bureau — CFPB for short — has taken big steps to help people with medical debt. In early February, the Trump administration moved to effectively shutter the agency. We talked with credit counselor Lara Ceccarelli about how the CFPB has helped clients at the nonprofit where she works, and how she’s navigating the sudden change. And consumer-rights advocate Chi Chi Wu — an attorney with the National Consumer Law Center — describes the court battle she and her colleagues are mounting to slow down the agency’s dismantling — and where things could go from here. In this interview, we're excited to have Ilona Cohen to help us understand what changes this new US administration might bring, in terms of cybersecurity regulation. Ilona's insights come partially from her own experiences working from within the White House. Before she was the Chief Legal Officer of HackerOne, she was a senior lawyer to President Obama and served as General Counsel of the White House Office of Management and Budget (OMB). In this hyper-partisan environment, it's easy to get hung up on particular events. Do many of us lack cross-administration historical perspective? Probably. Should we be outraged by the disillusion of the CSRB, or was this a fairly ordinary occurrence when a new administration comes in? These are the kinds of questions I'll be posing to Ilona in this conversation. How the Change Healthcare breach can prompt real cybersecurity change 'Shift Left' feels like a cliché at this point, but it's often difficult to track tech and security movements if you aren't interacting with practitioners on a regular basis. Some areas of tech have a longer tail when it comes to late adopters and laggards, and application security appears to be one of these areas. In the first month of the new Trump Administration, much of the attention outside our borders has focused on Europe and the Middle East—the two regions that always seem to divert our focus from America's greatest competitor, the People's Republic of China (PRC). We often think of the challenge in terms of the most obvious arena—the Pacific—but it extends from the Arctic to Africa and, increasingly, to space.Returning to Midrats this Sunday to discuss the PRC's challenge for the new administration is Dean Cheng.Dean Cheng, Senior Advisor, United States Institute of Peace; Non-resident Senior Fellow, Potomac Institute for Policy Studies; Non-resident Fellow, George Washington University Space Policy Institute. He recently retired after 13 years with the Heritage Foundation, where he was a senior research fellow on Chinese political and security affairs, and wrote on various aspects of Chinese foreign and defense policy.Prior to joining the Heritage Foundation, he was a senior analyst with the China Studies Division (previously, Project Asia) at CNA from 2001-2009. Season 5: Episode 203In this episode of North American Ag Spotlight, host Chrissy Wozniak is joined by Rusty Rumley, Senior Staff Attorney at the National Agricultural Law Center, to explore the shifting landscape of agricultural policy under the new administration. They discuss the recent election outcomes, highlighting the Republican control of both chambers of Congress and the White House, and speculate on what this might mean for agricultural legislation, particularly the Farm Bill. Rusty provides insights into the complexities of passing a Farm Bill with a narrow majority, the potential use of the Congressional Review Act to repeal recent regulations, and the significant changes brought by the end of the Chevron deference, which could require clearer directives from Congress on policy. The conversation also delves into how budget reconciliation could impact nutrition programs in the Farm Bill, emphasizing the critical balance between SNAP benefits and agricultural support. Additionally, they touch on the ongoing debates regarding foreign ownership of U.S. farmland, with specific attention to state-level actions and potential federal policy adjustments. Rusty looks to the future with cautious optimism, suggesting that while significant changes might be limited, there could be beneficial tweaks ensuring more stability in agricultural policy. The episode wraps up with Rusty explaining the role of the National Agricultural Law Center as a neutral source of legal information for the ag community, encouraging listeners to engage with their resources. This afternoon, Joe began a conversation about new reports indicating that the Cybertruck bomber has connections to Ukraine. This follows revelations that Trump's would-be assassin also had ties to Ukraine. Later, he noted that Ukraine appears to be cozying up to Canada, seemingly as a way to manipulate the American government. Additionally, Joe discussed how the southern border is a key factor in the rise of these terror attacks. However, hope is on the horizon with the introduction of Tom Homan. In closing, Joe shared some explosive insights about Islam, the intentional sowing of division, and much more before ending with a prayer!
