Physicians leave clinical medicine for a variety of reasons. Many leave due to burnout or job dissatisfaction. However, a small and growing number have been forced out of practicing medicine by a process called sham peer review. Peer review is a legitimate process to protect patients in which fellow physicians on a hospital medical staff objectively review a physician's work. But the process can also be used to falsely accuse physicians of poor performance to silence them and have them removed from the medical staff. The process almost always results in a National Practitioner Databank report, which makes it difficult to maintaining malpractice insurance coverage, and eventual rejection from payor physician panels. The Association of American Physicians and Surgeons (AAPS) and Dr. Lawrence R. Huntoon have spent the past twenty years fighting this unfair abuse of the peer review process. Dr. Huntoon is the Past President of the AAPS and has served as Editor-in-Chief of the Journal of American Physicians and Surgeons since 2003. He has also been the Chairman of the AAPS Committee to Combat Sham Peer Review since 2004 and is an internationally recognized and court-qualified expert in sham peer review. MARILYN M. SINGLETON MD, JD The US recently hit 3 million documented Covid-19 cases. That sentence on its own can seem jarring, but it’s important for Americans to ingest COVID-19 statistics more holistically. “If you focus exclusively on headlines, you’re not seeing the full picture. News of daily spikes are causing some businesses to have second thoughts on reopening but we’ve all seen the detrimental impacts of a lockdown. We need to be vigilant in our fight against the virus, but it’s not a binary choice between reopening and public health; we can have the best of both worlds,” says Dr. Singleton. Hospitalization: Despite the rise in cases, COVID-19 patients fill only 8 percent of the available hospital beds. Death Rate: Revised CDC estimates place the COVID-19 mortality rate at 0.4 percent—considerably less than the 3.4 percent death rate that was initially reported by the World Health Organization. Mental Health Toll: A Kaiser Family Foundation survey in late May found that 39 percent of adults “feel that worry and stress related to” COVID-19 has had a negative impact on their mental health and about half have deferred seeking medical care. Health Care Disruptions: Some 80,000 diagnoses of five common cancers may be missed or delayed because of disruptions to health care caused by the COVID-19 pandemic. The CDC also attributes to COVID-19 up to 39 percent excess deaths from delayed treatment for renal failure, diabetes, heart disease, Alzheimer disease and dementia.

But now, because of coronavirus, lots of places have suspended those bans. Some have even banned reusable bags. Why? Because, as we knew even before they banned them, single-use plastic bags are more hygienic. 97% of people never wash their reusable bags. But, environmentalist groups call virus fears from reusable bags “misinformation". Alex Truelove of the Public Interest Research Group says, “there are no studies … that reusable bags are transmitting viruses.” He’s right about the lack of human COVID-19 studies. But, in 2013, when millions of piglets died of a novel swine coronavirus, the Agriculture Department concluded that reusable feed bags were the likely cause. After the virus fears diminish, politicians will put their plastic bag bans back in place. Why? “8 million metric tons of plastic enters the ocean every year,” explains Truelove. Again, that’s true, and plastic pollution is a serious problem. But economics professor Ross McKitrck of the University of Guelph pushes back, saying, “Get some facts on the table about where that plastic comes from.” Almost all of it comes from Asia and Africa. The North American fraction is less than 1%. She graduated from Stanford and earned her MD at UCSF Medical School. Dr. Singleton completed 2 years of Surgery residency at UCSF, then her Anesthesia residency at Harvard’s Beth Israel Hospital. While still working in the operating room, she attended UC Berkeley Law School, focusing on constitutional law and administrative law. She interned at the National Health Law Project and practiced insurance and health law. She teaches classes in the recognition of elder abuse and constitutional law for non-lawyers. She lives in Oakland, Ca.
In most states, physicians are able to dispense medications in their offices to patients. Although it isn't the most common practice, it allows doctors to have a better handle on how well their patients are following medication instructions, adds convenience for patients, and oftentimes leads to lower prices. However, there are six states that do not allow physicians the privilege of dispensing the medications despite the fact that they are examining, diagnosing, determining a treatment plan, and prescribing medications. My guest today is Dr. Kris Held, the new president of the Association of American Physicians and Surgeons and an ophthalmologist in private practice. She wants to dispense medicines to her patients in the office which would help in their compliance and save them lots of money - often upwards of 70% or more on what they would pay at the pharmacy. After trying to get laws passed to change the rules in Texas, she has teamed up with the Institute for Justice to sue the state. Their legal case is built upon the justification that the State of Texas is violating the state constitution with irrational and protectionist laws affecting her legal right to earn a living. The argument that pharmacies should only dispense medications because of safety concerns seems to be debunked by the fact that 44 states have had this privilege with no obvious problems. Also, there is a significant cost savings that could be gained through this practice. Currently, Texas spends over $3 billion on medication prescriptions each year in their MedicAid program. That translates into approximately $75 per prescription. One practice in Kansas, which is allowed to dispense in house writes 22,000 prescriptions a year and spends an average of $6 per prescription. This means even if Texas could only move a quarter of their dispensation to doctor's offices they might save $1 billion. That's a lot of money and could be spent elsewhere in the budget or maybe returned to taxpayers. Kris Held, MD is an ophthalmologist in private practice at Stone Oak Ophthalmology in San Antonio, TX. She completed an internal medicine residency at Parkland Memorial Hospital and University of Arizona Affiliated Hospitals and then became an Instructor at the University of Arizona College of Medicine and a staff physician at the Tucson Veterans Administration Hospital. She has been in solo private practice since 1981 and has served as Executive Director of the Association of American Physicians and Surgeons (AAPS) since 1989. She is currently president of Doctors for Disaster Preparedness. Since 1988, she has been chairman of the Public Health Committee of the Pima County (Arizona) Medical Society. She is the author of YOUR Doctor Is Not In: Healthy Skepticism about National Healthcare, and the second through fourth editions of Sapira's Art and Science of Bedside Diagnosis published by Lippincott, Williams & Wilkins. She authored books for schoolchildren, Professor Klugimkopfâ??s Old-Fashioned English Grammar and Professor Klugimkopfâ??s Spelling Method, published by Robinson Books, and coauthored two novels published as Kindle books, Neomorts and Moonshine.
